MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JULY 18, 2016, BEGINNING AT 5:00PM IN
CONFERENCE ROOM D AND CONTINUING AT 8:00 PM IN CONFERENCE ROOM C OF

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was
unanimously opened at 5:00PM.
Discussion – Computer Use Policy
The Town Board reviewed a draft Computer Use Policy prepared by IT Director, Roz Cimino. Once adopted
this policy would become part of the Town’s Administrative Manual. The Board asked for clarification on a
few items and will readdress the policy at the next worksession.
Update – Sheldrake Loft Project (Village of Mamaroneck)/Waverly Avenue Bridge
The Town Board reviewed plans for the Sheldrake Loft Project, with respect to the Waverly Avenue Bridge,
of which the Town owns. The Bridge leads to the entrance to the proposed development, and is due for
maintenance. The Town Board also addressed a very small strip of land which it owns and is proposed for
purchase by the developer. The Town Board agreed on a purchase price of $125,000. This authorization is on
the regular Agenda for this evening.
Update 2015 Budget Performance/Year End Financial Review – Larchmont Mamaroneck Joint Garbage
Disposal Commission (LMJGDC)
The Town Board reviewed the detailed memo regarding the LMJGDC 2015 Financials/Budget Performance
from Mr. Altieri dated June 20, 2016. Additionally the Board reviewed the General Fund Revenue for Fiscal
Year 2015, the General Fund Expenses for Fiscal Year 2015 and the Financial Statements for Year Ending
December 31, 2015. The Town Board had a number of specific questions which Mr. Altieri addressed,
specifically some with respect to commercial collection.
ADDED ITEM
Coop Camp
Councilman Murphy addressed with the Town Board a request by the Mamaroneck School Board for the
Town to make a larger contribution to Coop Camp. Specifically, the Town is being asked to match the
contribution of $20,000, currently being made by the Village of Mamaroneck. The Board noted that many of
the non-Town programs it supports have been cut back over the years. Councilman Murphy believes the
school will be making a more formal request.

Discussion – Proposed Amendments- Rock Removal Law
The Board reviewed Mr. Makers’ draft legislation. The Board discussed ‘true’ rock versus man made rock i.e.
driveway material, specifically whether the man made material should be removed from the legislation. The
Board discussed whether it is their intention to have a homeowner receive a rock removal permit to redo a
driveway. Mr. Maker will redraft the law without the manmade material. The Board will be updated if the
removal of manmade materials becomes an issue.
Update – Cambium Condominium Project
With respect to the Town’s continued discussion of a possible traffic circle at New Jefferson and Madison
Avenue, the Board would like to receive the expected $200,000 from the developer for a traffic light and set
it aside while it pursues with greater emphasis the concept of a traffic circle.
Update – Mamaroneck Housing Authority Activities
Councilwoman Elkind Eney, as liaison to the Housing Authority, gave an update on the Authority’s activities.
Councilwoman Elkind Eney noted the Housing Authority is finishing a renovation project for new siding and
a roofing. Additionally, she reported that their finances are very good. The Authority would like to begin
‘celebrating’ there accomplishments as well as their effectiveness in the community.
Update – Redwood Nursery Property
Additionally Present: Jessica and Tony Zavaglia, adjacent property owners to Redwood Nursery
Mr. Altieri and Mr. Maker gave the Town Board an update on the sale of the property. Mr. Altieri noted that
Town Building Inspector, John Landi found an oil leak on the property that has been reported to the NYS DEC
and Westchester County Health Dept., has since received a spill number, and Mr. Landi has requested for
testing where the tank was removed. Mr. Maker stated that there is a contract of sale being negotiated, but
there are legal issues as to what is allowable on the site based on a 1958 court decision. Neighbors believe
the site was expanded illegally, specifically the addition of impervious services. Mr. Maker stated that if the
purchaser wants to continue as a nursery, there would be an approval process by the Planning Board for site
plan. The Town Board strongly stated that they would like to be kept informed.
Proposed Water Rate Increase – Westchester Joint Water Works (WJWW)
Additionally Present: Tony Conetta, Director of the WJWW, and David Birdsall, Business Manager
The Town Board reviewed a memo from Mr. Altieri dated July 16, 2016. Specifically, Mr. Conetta
explained that although New York City proposed a 1.25% increase for their July water adjustment, the New
York City Water Board, pursuant to a court order, announced that the water rate schedule adopted in July
2015 shall remain in effect. The question is now whether the Town should take any action at this time on
water rates. The Board discussed this issue and a rate increase of 2.5% was determined. This approval is on
the regular Agenda for this evening.
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Board unanimously agreed
to enter into an Executive Session to discuss an employment settlement and litigation.

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Board unanimously agreed
to resume the Regular Meeting.
New Business
Hommocks Ice Rink
Councilwoman Elkind Eney spoke about the fundraising with respect to the showers and locker rooms at
the Ice Rink. The fundraisers have proposed putting the showers in the location where the old Zamboni was
kept. Currently this area is being used for storage, but the proposal is to build a new storage area. Mr.
Altieri has proposed that Calgi Construction do a schematic of what is feasible to flush out the two
proposals.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
SUPERVISOR’S SUMMARY REPORT
We have a presentation this evening from Tony Conetta, the director of the WJWW and David
Birdsall, the business director of WJWW to discuss the proposed water rate changes. The Town has
been doing street work and will begin resurfacing streets in the Howell Park neighborhood
Tuesday. All of the repaving in the Town should be completed by next week. The Town’s camp
programs are going full speed ahead for the summer. We have over 550 children in camp. It is a
large program to manage and everything is going very well so far. The Hommocks Pool is open to
residents on a daily basis. The Town’s summer concert series at Memorial Park started last
Monday. Tonight’s concert was cancelled due to bad weather, but has been rescheduled for
th
Monday August 8. There are concerts the next two Mondays in July. The Town’s new website is
up and running and looks great. The address is www.townofmamaroneckny.org. Please visit the
site to sign up to receive agendas and minutes from boards and committees in which you are
interested, monthly email newsletters and sign up for the new emergency notification system,
Swift 911. You should have received a newsletter in the US mail from the Town and me. I will be
sending a newsletter by mail twice a year. I will be sending a monthly newsletter by email. We
have also launched a Town government Facebook page. There are departmental Facebook pages
for Sustainability, Recreation and the Fire Dept. The government Facebook page is an opportunity
to check in with the Town on a daily basis to see what the latest news and events are. Please visit
the new website and Facebook page.

Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not.
PUBLIC DISCUSSION - Proposed 2016 Water Rate Increase
Tony Conetta, Director the Westchester Joint Water Works and David Birdsall, the Business Manager, gave
a presentation of the Water Works and the proposed rate increase.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve of a 2.5% water rate increase
for the Town of Mamaroneck, effective July 1, 2016.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Mamaroneck, Westchester
County, New York, will meet at the Town Hall, 740 West Boston Post Road, in Mamaroneck, New York,

a public hearing upon a certain map, plan and report including a revised estimate of cost prepared in
relation to the proposed increase and improvement of the facilities of the Town of Mamaroneck Water
District No. 1 in the Town of Mamaroneck, Westchester County, New York, consisting of the Town’s
share of the improvement of facilities of the Westchester Joint Water Works of the Town/Village of

York to Macy Road in Harrison, New York, including original furnishings, equipment, machinery,

of Mamaroneck Water District No. 1 (the “WJWW”) in the Town is $958,700, consisting of an increase
of $480,000 over that previously authorized.
Said capital project has been determined to be a Type II Action pursuant to the regulations of
the New York State Department of Environmental Conservation promulgated pursuant to the State
Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed will not result
in any significant adverse environmental impact and the documentation related to SEQRA is available in
the office of the WJWW for inspection during normal office hours.
At said public hearing said Town Board will hear all persons interested in the subject matter
thereof.

Supervisor Seligson explained the need for the additional funding, and then asked Mr. Conetta to further
elaborate.

WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has duly
caused to be prepared a map, plan and report including an estimate of cost, pursuant to Section 202 b of the
Town Law, relating to the increase and improvement of the facilities of the Water District No. 1 in the Town
of Mamaroneck, Westchester County, New York (the “Water District”), consisting of the Town’s share of the
improvement of facilities of the Westchester Joint Water Works of the Town/Village of Harrison, the Village
of Mamaroneck and the Town of Mamaroneck (together, “WJWW”), consisting of the construction of a 16-
inch water transmission main from North Barry Avenue in Mamaroneck, New York to Macy Road in Harrison,
New York, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental
improvements and expenses in connection therewith; and
WHEREAS, in order to undertake the improvements to the aforesaid facilities as described therein, it
will be necessary to expend the sum of $958,700, an increase of $480,000 over that previously authorized;
and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations
of the New York State Department of Environmental Conservation promulgated pursuant to the State
Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed will not result in
any significant adverse environmental impact and the documentation related to SEQRA is available in the
office of the WJWW for inspection during normal office hours; and
WHEREAS, at a meeting of said Town Board duly called and held on June 15, 2016, an order was duly
adopted by it and entered in the minutes specifying the said Town Board would meet to consider the increase
and improvement of the facilities of the Water District No. 1 in said Town at the revised maximum estimated
cost of $958,700, being an increase of $480,000 over that previously authorized, and to hear all persons
interested in the subject thereof concerning the same at the Town Hall, 740 West Boston Post Road, in
Mamaroneck, New York, in said Town, on July 18, 2016, at 8:00 o'clock P.M., Prevailing Time; and
ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as
follows:
Section 1. Upon the evidence given at the aforesaid public hearings, it is hereby found and
determined that it is in the public interest to make the improvement, to increase and improve the facilities
of Water District No. 1 in the Town of Mamaroneck, Westchester County, New York, consisting of the
construction of the Town’s share of the improvement of facilities of the Westchester Joint Water Works of
the Town/Village of Harrison, the Village of Mamaroneck and the Town of Mamaroneck, consisting of the
construction of a 16-inch water transmission main from North Barry Avenue in Mamaroneck, New York to
Macy Road in Harrison, New York, including original furnishings, equipment, machinery, apparatus,
appurtenances and incidental improvements and expenses in connection therewith, at a revised maximum
estimated cost of $958,700.

Section 2. This Order shall take effect immediately.
The question of the adoption of the foregoing order was duly put to a vote on roll, which resulted as

BOND RESOLUTION DATED JULY 18, 2016.
A RESOLUTION AUTHORIZING THE ISSUANCE OF AN ADDITIONAL $480,000 SERIAL BONDS OF
THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY A PORTION OF
THE COST OF THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER DISTRICT NO.
1, IN THE TOWN OF MAMARONECK, SULLIVAN COUNTY, NEW YORK.
WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations
of the New York State Department of Environmental Conservation promulgated pursuant to the State
Environmental Quality Review Act (“SEQRA”), the implementation of which as proposed will not result in
any significant adverse environmental impact and the documentation related to SEQRA is available in the
office of the WJWW for inspection during normal office hours; and
WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the
provisions of Section 202 b of the Town Law, and more particularly an Order dated of even date herewith,
said Town Board has determined it to be in the public interest to improve the facilities of the Water District
No. 1, in the Town of Mamaroneck, Westchester County, New York, at a revised maximum estimated cost of
$958,700; and
WHEREAS, it is now desired to provide additional funding for such capital project over the $478,700
previously authorized; NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as
follows:
Section 1. For the specific object or purpose of paying the cost of the increase and improvement
of Water District No. 1 in the Town of Mamaroneck, Westchester County, New York, consisting of the
construction of a 16-inch water transmission main from North Barry Avenue in Mamaroneck, New York to
Macy Road in Harrison, New York, including original furnishings, equipment, machinery, apparatus,
appurtenances and incidental improvements and expenses in connection therewith, at a revised maximum

estimated cost of $958,700, there are hereby authorized to be issued an additional $480,000 serial bonds of
said Town pursuant to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the plan for the financing of such specific object or
purpose is as follows:
1) By the issuance of $478,700 serial bonds previously authorized pursuant to a bond resolution
dated February 17, 2016; and
2) By the issuance of $480,000 serial bonds authorized to be issued therefor pursuant to this
bond resolution.
Section 3. It is hereby determined that the period of probable usefulness of the aforesaid
specific object or purpose is forty years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local
Finance Law, calculated from the date of the first bond anticipation note issued therefor. It is hereby further
determined that the maximum maturity of the serial bonds herein authorized will exceed five years.
Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York,
are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the
same respectively become due and payable. An annual appropriation shall be made in each year sufficient
to pay the principal of and interest on such obligations becoming due and payable in such year. To the extent
not paid from other sources, there shall be annually assessed upon all the taxable real property within said
Water District No. 1 in the manner provided by law an amount sufficient to pay the principal and interest on
said bonds as the same become due, but if not paid from such source, all the taxable real property in said
Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to
pay the principal of and interest on said bonds as the same shall become due.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the
issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be
prescribed by said Supervisor, consistent with the provisions of the Local Finance Law.
Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and
awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct
the sale, and award the bonds in such manner as she shall deem best for the interests of said Town, including,
but not limited to, the power to sell said bonds to the New York State Environmental Facilities Corporation;
provided, however, that in the exercise of these delegated powers, she shall comply fully with the provisions
of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal
bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not
be obliged to see to the application of the purchase money.

Section 7. All other matters except as provided herein relating to the serial bonds herein
authorized including the date, denominations, maturities and interest payment dates, within the limitations
prescribed herein and the manner of execution of the same, including the consolidation with other issues,
and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be
determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially
the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in
such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law,
as the Supervisor shall determine consistent with the provisions of the Local Finance Law.
Section 8. The Supervisor is hereby further authorized, at her sole discretion, to execute a
project financing and loan agreement, and any other agreements with the New York State Environmental
Facilities Corporation, including amendments thereto, and including any instruments (or amendments
thereto) in the effectuation thereof, in order to effect the financing or refinancing of the class of objects or
purposes described in Section 1 hereof, or a portion thereof, by a bond or note issue of said Town in the
event of the sale of same to the New York State Environmental Facilities Corporation.
Section 9. The power to issue and sell notes to the New York State Environmental Facilities
Corporation pursuant to Section 169.00 of the Local Finance Law is hereby delegated to the Supervisor. Such
notes shall be or such terms, form and contents as may be prescribed by said Supervisor consistent with the
provisions of the Local Finance Law.
Section 10. The validity of such bonds and bond anticipation notes may be contested only if:
1) Such obligations are authorized for an object or purpose for which said Town is not
authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of this
resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of
such publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 11. This resolution shall constitute a statement of official intent for purposes of Treasury
Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably
expected to be, reserved, allocated on a long term basis, or otherwise set aside with respect to the
permanent funding of the object or purpose described herein.
Section 12. This resolution, which takes effect immediately, shall be published in summary form
in the official newspaper of the Town, together with a notice of the Town Clerk in substantially the form
provided in Section 81.00 of the Local Finance Law.

2.Authorization – Sale of Surplus Land- Sheldrake Lofts Project
On motion of Councilwoman Elkind Eney, seconded by Councilman Odierna, the following was approved,
WHEREAS, in the course of conducting title searches for the Sheldrake Lofts Project in the
Village of Mamaroneck, it was discovered that a small parcel of land (200-300 square feet)
located within the development parcel is owned by the Town, and
WHEREAS, the Town has negotiated a sale price for this parcel of $125,000, of which the Town
will apply to the repairing of the Waverly Avenue Bridge.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve the sale designated as Block
and Lot 829-1000 for the amount of $125,000., and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said purchase on
behalf of the Town.

3.Authorization – Engineering Contracts – GHD Engineering and Rotfeld Engineering
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was approved,
WHEREAS, the four communities (Town of Mamaroneck, Village of Larchmont, Village of
Pelham Manor and the City of New Rochelle) are prepared to move forward with the
implementation of the Sewer System Evaluation Study (SSES) as required in the Town’s
agreement with Westchester County, and
WHEREAS, a formal request for proposal was issued and three firms responded, with the lowest
fee submitted by GHD Engineering.
NOW THERFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve and accept the proposal
submitted by GHD Engineering to complete the SSES, for a total cost of $1,013,487, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby approve that the firm of Dolf Rotfeld
will manage the project for a cost of $17,800.00.

4.Authorization IMAs – Town of Rye- Assessment Grievances
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the Intermunicipal
Agreement between the Town of Mamaroneck and the Town of Rye, whereby (A) the Town of
Rye’s Board of Assessment Review will adjudicate a grievance challenging the assessed
valuation of a property in the Town of Mamaroneck and (B) The Assessor of the Town of Rye
will represent the Town of Mamaroneck in that proceeding.

5.Consideration of Resolution – Sale of Hunting and Fishing Licenses
On motion of Councilwoman Katz, seconded by Councilman Murphy, the following was approved,
WHEREAS, due to a decrease in staff available to sell licenses for New York State Hunting &
Fishing, coupled with the limited revenue generated from these at times lengthy transactions,

WHEREAS, in this time of budgetary restraint, and the difficulty local governments’ face
working under the New York State Tax Levy Cap, it is no longer a service the Town of
Mamaroneck can sustain, and
WHEREAS, there are alternatives to purchase these licenses at local establishments’ such as
Extreme Archery in Mamaroneck and Dick’s Sporting Goods, from Governments Offices such
as the Town of Harrison and the County Clerk, as well as the ability to purchase licenses
on–line.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby end the sales of New York State
Hunting and Fishing Licenses from the Town Clerk’s Office in the Town of Mamaroneck
effective July 25, 2016.

6.Authorization IMA – Westchester County- Purchase of Surplus County Vehicle
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve an agreement with
Westchester County, subject to the approval of the form of the agreement by the Town
Attorney, for the purchase of one 2009 Ford E350 Para Transit Bus at a cost of $1.00, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on
behalf of the Town.

REPORT OF COUNCIL

Councilwoman Elkind Eney attended the Housing Authority Meeting on June 20, reporting that the siding
and roofing project will be completed on time and everyone is pleased. Councilwoman Elkind Eney
attended the Howell Park Steak Dinner, always a nice event. Councilwoman Elkind Eney attended a
Hommocks Ice Rink locker room/showers fundraising meeting. There is continued discussion of where the
th
location of these will be. On July 4, she attended the Flint Park Games events, and the old American
tradition of the Blessing of the Fleet at Harbor Island. Councilwoman Elkind Eney attended, along with
Supervisor Seligson, the SHORE/I CARE Annual Fundraiser, at which they honored Saint Augustine’s Church
in Larchmont. She attended the Planning Board Meeting, at which they continue their work on
implementing the Residential Site Plan Law. Councilwoman Elkind Eney and other Members attended the
Village of Mamaroneck Thursday evening ‘Block Party”. She congratulated the Mamaroneck Swim Club on
winning the third annual invitational swim meet. Councilwoman Elkind Eney made a number of
announcements on behalf of the Recreation Department.
Councilwoman Katz attended her first Board of Assessment Review Meeting, as a new Liaison to that
Board. Councilwoman Katz was unable to attend the Traffic Meeting due to High School Graduation for her
daughter, but reported that they discussed traffic calming measures in the Town. The Coastal Zone
Management Commission did not meet, as they had no referrals. Councilwoman Katz attended the
th
wonderful Village of Mamaroneck July 4 Parade, and very much enjoyed their fireworks. Councilwoman
Katz enjoyed the Street Fair in the Village of Mamaroneck, and then reminded residents to enjoy the BBQ
before the Monday Night Memorial Concerts.
Councilman Odierna noted that he also enjoyed the fireworks, noting the large numbers that attend. He
th
too enjoyed the Blessing of the Fleet. The Town Board held a Special Meeting on July 15 to authorize a
hiring in the Recreation Department. On behalf of Supervisor Seligson, Councilman Odierna attended the
th
Westchester Joint Water Works Meeting. On July 13 Councilman Odierna attended the Healthy
Mamaroneck Meeting, at which they discussed the annual fair, additionally Councilman Odierna attended
the Library Board Meeting, and the Fire Council Meeting.
Councilman Murphy attended the Cable Board of Control Meeting, noting the continued discussion of the
relocation of LMC-TV. Councilman Murphy noted that there are still issue to address, specifically the issue
with prevailing wages. The Cable Board of Control will be working with an attorney to determine this.
Additionally, LMC-TV has received a proposed lease from the Village of Mamaroneck, adding that the lease
needs more work.
