HomeMy WebLinkAbout2016_04_20 Town Board Minutes April 20, 2016 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON APRIL 20, 2016, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilman Murphy, the Work Session was unanimously opened at 5:00PM. OUT OF ORDER Update – Town Website Redesign Additionally Present, Roz Cimino, IT Director Roz Cimino and Steve Altieri presented the mockup of the new web site. The Town Board will be issued the URL so they can go on the test site, review and make their comments. Mr. Altieri noted that the next thth deadline is May 15 for changes to be made by the developer. After May 27, changes will have to be made in house. Review – Building Department Fees Additionally Present: John Landi, Building Inspector The Town Board reviewed the schedule of fees for the Building Department, and gave their feedback. Mr. Landi explained the reasoning behind some of the proposed increases. The Town Board received and reviewed the Building Fees for the Village of Larchmont. Review – Floor Area Ratio (FAR) Regulations Mr. Landi was also present for this discussion. The Town Board reviewed a schedule of nine homes in the community that were either complete teardowns, or had significant work done, but all within the zoning code and not needing variances. The schedule stated the lot size, the allowable structure square footage, and what the square footage of the as built new construction. It was noted that the home on Colonial Avenue should have been included on the list. The Town Board will prepare to take a ride to view the properties with the Building Inspector in preparation for continued discussion of the FAR Regulations. Additionally, the Town Board asked for the schedule to include FAR percentages and a Zoning Code column. ADDED ITEM Mr. Maker reported that he asked Mr. Siligato to prepare a report of the 2009 outstanding taxes prior to th the initiation of the in rem proceedings. In 2009 the outstanding taxes were $3.9 million, as of February 5, 1 April 20, 2016 that number is $1.3 million. Mr. Maker stated that hopefully the Judge will render a decision on these properties soon and then the Town Board can begin discussion on how to handle their sale. Discussion – Residential Site Plan Review Law The Town Board had before them the most recent version of the law. The Board discussed the pros and cons of the Planning Board having the ability to require site plan review for a structure already zoning compliant. It was noted that this is already the process for sub divisions, so essentially, this would be a residential application of what is already happening for sub divisions. The Town Board asked the Town Attorney to discuss the Town’s concerns with the Attorney for Planning and Zoning. Review of Baldwin Avenue Parking Regulations The Town Board reviewed the current draft legislation, and the resolution establishing the resident permit for Lot #1. The Town Board will move forward with setting the public hearing this evening. Discussion – Private Roads Deferred Update – LMC-TV Space Councilman Murphy lead the discussion by stating that at the last LMC-TV Board of Control Meeting there was discussion of prevailing wages, in regard to the proposed renovation of the former Hook & Ladder Firehouse in the Village of Mamaroneck, but not with an attorney present. Councilman Murphy added that he informed the Board of Control that he would not be voting on any decision with respect to the Fire House location until a legal decision is rendered on the issue of prevailing wages. Mr. Maker added that he recorded all the documents provided by Mr. Altieri and Mr. Siligato for the formation of the LMC-TV proposed relocation and he cannot see any argument that says this is not public monies and therefore the WICKS Law and prevailing wages would apply. Mr. Maker would like to put his understanding of the facts on paper for the Town Board to start a conversation and a recommendation for any other legal opinions with other municipalities. Mr. Altieri suggests sending the Lease and Contract to the Department of Labor for a ‘three prong test’ and for their opinion. Request for Executive Session – Acquisition of Real Property On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Board unanimously agreed to enter into an Executive Session to discuss Acquisition of Real Property. EXECUTIVE SESSION Acquisition of Real Property On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. 2 April 20, 2016 PROCLAMATION – Arbor Day Supervisor Seligson noted the Arbor Day resolution SUPERVISOR’S SUMMARY REPORT Earth Day is April 22 and we have several events with which to celebrate it in the Town. The first event was Grow It Green, held on April 10 at Larchmont Temple. It focused on environmentally sound gardening and landscaping practices. It was a large event with multiple vendors and speakers co-sponsored by the three municipalities. The Town’s Sustainability Collaborative worked closely with the Village of Larchmont organizers. The Town had two tables at the event with examples of green roof and permeable pavement technology. We also sold rain barrels. We sold 37 rain barrels that day and another 7 the following Saturday. Rain barrels will continue to be sold at the Town Yard as long as supplies last along with recycling bins on Saturdays from 8:00 to 11:30 am. You must pay by check. th Another April 10 event was the second Annual Bunny Hop Race. The Recreation Department held the race in conjunction with the Volunteer Ambulance Corps and Police and Highway Depts. There was a short race for children and a 5K for more serious runners. It was a beautiful, but cold day. We gave awards to the top runners and the kids loved seeing the Bunny and getting candy from her. Thank you to Girl Scout Troop 1826 who worked with the Town to hold a special E-Waste collection at the Carlton House 35 North Chatsworth Ave. this past weekend. In advance of the event, the Girl Scouts distributed fliers throughout the building encouraging residents to bring their E-waste (which is anything with a wire) to the basement of the building to help the Town’s recycling efforts. They collected over 136 items and filled a dump truck. Larchmont Girl Scout th Troop 2559 will help plant tree seedlings at the Hommocks Conservation Area on April 29. The Town is holding one of its two annual cleanups on Saturday April 30 from 10:00 am to noon on the Leatherstocking and Sheldrake Trails. We’re meeting at the Winged Foot Drive entrance to the trails. I would like to mention a few special events I attended as well. The LWV held their annual luncheon at Orienta Beach Club and County Legislator Catherine Parker was the speaker. The County LWV held its annual Running and Winning program. This is a program to bring together top female high school students in the County who are interested in government, politics and policy to meet with female chief elected officials, County legislators and State Assembly and Senate members. It is always an inspiration to hear from my fellow female elected officials and to meet the very special young women in our County. We had a TVS meeting (Town, Village, School) last week. Monday night there was a lovely reception honoring Former Larchmont Mayor Anne McAndrew’s and Trustee Marlene Kolbert for their long service to the community. I was pleased to be able to thank them and see so many people at the event. Finally, congratulations to Town resident Doug Bloom for being honored by the NY Audubon Council with the Norm Stotz Award for Extraordinary Volunteer Service on Behalf of the Audubon Society and the Environmental Cause. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1.Set Public Hearing – Baldwin Avenue Parking On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Restricted and Metered Parking on Baldwin Avenue” Law, for May 4, 2016 at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, 4 April 20, 2016 RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 2.Report of Bids – TA-16-02 – Resurfacing of Various Roads in the Town of Mamaroneck The Report of Bids is entered into the record as: ATTACHMENT A On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved, WHEREAS, on March 10, 2016 the Town publically opened and read six (6) bids for Contract TA-16- Road Resurfacing. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby AWARD Contract TA-1602 – Road Resurfacing, to the lowest responsible bidder meeting all of the Town’s requirements, to ELQ Industries to provide road resurfacing services at a total cost of $561,979.00, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. NOW, THERFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Shared Services Agreement between the Town of Mamaroneck and the New York State Department of Transportation, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Councilman Murphy also enjoyed the Grow It Green Event. th Councilman Odierna also enjoyed the Grow It Green Event. On April 13, he attended the Library Board meeting, noting they are making progress on the Transformation Project. Councilman Odierna noted that he is finding the Library Board to be very detailed in their financial reporting – very impressive. Councilman th Odierna stated that at the February 17 Town Board Meeting the Town Board was asked by the Town’s Poet Laureate to write a poem. Councilman Odierna delayed reading his until this evening. SPRING By Ernie Odierna, Feb. 21, 2016 How many “Springs” have you enjoyed? What do you hope this Spring will bring? Is there a favorite baseball team whose early successes will keep them around in the fall? Are there things this year you won’t be able to enjoy, like back when you were a boy? Are they more in your head, and a result of things you may have been told or read? A walk thru The Hommocks, The Sheldrake or along the waters’ edge in Harbor Island or Flint Park can be slow and flat with plenty of spots to rest and enjoy the habitat. The sense of renewal and rebirth that the Spring season brings never fails to kindle in me the feeling that I’ve been re-fueled, and with no harmful impact on the environment at that. Councilwoman Katz had no formal meetings since the last Town Board Meeting. Councilwoman Katz did attend the League of Women Voters Luncheon, at which Catherine Parker was the presenter. Councilwoman Katz was able to attend the end of the Grow It Green Event, as she was attending two volley ball tournaments with her family. th Councilwoman Elkind Eney attended the Larchmont Chamber of Commerce Fundraiser on April 7. She too enjoyed the League of Women Voters Luncheon. Councilwoman Elkind Eney thanked the Recreation Department and the Fire Department for all their hard work on the Bunny Hop. Councilwoman Elkind Eney th enjoyed the Grow It Green Event as well. The Planning Board met on April 13 and discussed the new residential site plan law, noting that their comments are being integrated into the current draft by our Town Attorney. Councilwoman Elkind Eney attended the Westchester Municipal Officials Association Dinner, at which Bob Freeman of the Committee on Open Government spoke about the FOIL Law. Councilwoman Elkind Eney attended a wonderful event in honor of the retirement of Village of Larchmont Mayor, Anne McAndrews and Trustee Marlene Kolbert. Yesterday, Councilwoman Elkind Eney attended the Summit, at which they discussed alternatives to 4 year colleges. Councilwoman Elkind Eney made some announcements of the Recreation Commission, of note is the installation of the new score board at the Ice Rink!
