MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK HELD ON APRIL 6, 2016, BEGINNING AT S:OOPM IN CONFERENCE

CALL TO ORDER-WORK SESSION
On motion of Councilwoman Katz,seconded by Councilman Odierna,the Work Session was unanimously opened
at S:OOPM.
Update—Electronic Agenda Project-Computer Hardware
Additionally Present: Roz Cimino, IT Director
There is a need to purchase laptop computers to resolve security issues for the Town Attorney and the Court Clerk
and for the Town Board to better access their documents. Ms. Cimino presented a demo of the new Town web
site.The Town Board Members will receive a URL so they can view it additionally.The site is due to go live in May.
Ms.Cimino also announced the new public WiFi.
Residential Site Plan Law
Mr. Maker distributed an additional memo for Town Board review referencing discussions at the Special Town
Board Meeting on March 28,2016.Specifically, Mr. Maker's memo contains additional exceptions to the draft
law, by adding to paragraph C.a number(7),"Construction undertaken pursuant to a building permit issued
before the date on which this law becomes effective".Additionally,a paragraph D.was added which states: D.
"This law shall not apply to a parcel for which an application for a building permit complete in all respects,was
filed with the building department before the day on which this law becomes effective".
Mr. Maker recapped the changes to the current draft.Mr. Maker is recommending the Town Board close the
current Public Hearing,and reset a hearing when the new draft is complete.
The Town Board will hear from the Building Inspector at the next Town Board worksession regarding recent tear
downs and how they fit into the Floor Area Ratio(FAR) law.
Supervisor Seligson noted that the Town will have two interns this summer working on the FAR law,sewer
laterals and Climate Smart Communities certification.
Update—Sewer System Evaluation Study
The Town Board reviewed an update memo from Mr.Altieri,dated April 1, 2016.The memo discusses the
formation of a Consortium between the Village of Larchmont,City of New Rochelle and Village of Pelham Manor,
in order to conduct the Sewer System Evaluation Study(SSES). Forming a Consortium requires an Intermunicipal
Agreement(IMA).The approval of this IMA is on the Regular Agenda for this evening.

The Town Board reviewed the recent mailing to the public.There was no additional discussion.
New Business
Supervisor Seligson stated that she was contacted by a fellow Supervisor asking for the Town's support of a
resolution regarding modifications being proposed for the Westchester County Airport. The Board reviewed the
resolution and felt it did not correctly state the Town Board's position.The Town Board wrote their own resolution.
This item was added to this evening's Agenda.
The Town Board reviewed a request to approve a proclamation in support of Healthy Brain Day.The Town Board
determined that this was not an appropriate proclamation for the Board to make.
EXECUTIVE SESSION
On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the Board unanimously agreed to
enter into an Executive Session to discuss employment history of particular employees and litigation.

On motion of Councilman Murphy,seconded by Councilwoman Elkind Eney,the Board unanimously agreed to
resume the Regular Meeting.
CALL TO ORDER- REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o'clock this evening,
adding this is an open meeting that all residents'are welcomed to attend.
PROCLAMATIONS—Mamaroneck High School Girls'Track and Field Team
Mamaroneck High School Varsity Ice Hockey Team
Supervisor Seligson welcomed the teams and their coaches.Supervisor Seligson spoke about how proud the Town
was in the outstanding accomplishments of all of these fine young student athletes.Supervisor Seligson then read
the Proclamation for the Girls Track and Field.
PROCLAMATION
Mamaroneck High School Girls Indoor Track Team
WHEREAS: The Mamaroneck High School Girls Indoor Track Team,coached by Bob Morrissey,won
gold medals in both the distance medley relay at the Yale Invitational and at the Armory
Invitational where they set the#1 US time of nine minutes and one second in the 4 x 800
Relay; and
WHEREAS: The team went on to win the New York State Title in the 4 x 800 Relay and qualified for
the National Championship with Senior Katie DeVore setting a new facilities record in the
1000 meter at the Rockland Invitational; and
WHEREAS: The 4 x 800 Relay team then won the 2016 National Championship with an all-time#7
U.S. record of 8:58.86 that was also a school,county,sectional and state record; and
WHEREAS: The Team members,Seniors Shari Rauls, Lauren Chapey, Katie DeVore,and Sophomore
Lauren Shpiz won the first National Championship by a MHS girls track team despite Katie

running with a sprained knee and ankle and Shari fighting the flu,the girls won the gold in
what the event announcer called a "titanic victory."
NOW,THEREFORE, BE IT RESOLVED,that I, Nancy Seligson,Supervisor of the Town of Mamaroneck,and the Town
Board members hereby congratulate the 2016 Mamaroneck High School Girls Indoor Track team,along with
Coach Bob Morrissey,for a season of truly impressive wins,including a State Title and National Championship in
the 4 x 800 Relay.

Supervisor Seligson read the Proclamation for the Boys Varsity Ice Hockey Team.
PROCLAMATION
Mamaroneck High School Ice Hockey Team
WHEREAS: The Mamaroneck High School Ice Hockey Team,coached by Mike Chiapparelli,won the
Tigers'first ever Division State Championship this year;the team is also Westchester
County's first ever New York State Division 1 State Title winner; and
WHEREAS: The Mamaroneck Boys defeated 3 time-state champion West Genesee 1-0 for the State
Championship,though they were outshot 27-10. This hard fought battle was won by
Mamaroneck due to outstanding goalie play and excellent team effort; and
WHEREAS: The team's success is attributed to the Captains who led the boys both on and off the ice,
Will Arbo,Jason Bienstock,Alex Ewald and Will Kirk.The 2015-2016 Tigers not only
excelled on the ice,in addition they were honored with the New York State Academic
Award for Excellence in the Classroom; and
WHEREAS: The team also won the Section 1 Howard Kosel Award for the Section's most
sportsmanlike team. Alex Ewald was Con Ed Athlete of the Week and Jake Levine won the
coveted NYS Hobey Baker Award for Team Leadership,Academic Excellence and
Sportsmanship; and
NOW,THEREFORE, BE IT RESOLVED,that I, Nancy Seligson,Supervisor of the Town of Mamaroneck,and the Town
Board members hereby congratulate the 2015-2016 Mamaroneck High School Ice Hockey team,along with Coach
Mike Chiapparelli,for an incredible year of on-ice and off-ice accomplishments including the State Championship.

SUPERVISOR'S SUMMARY REPORT
First 1 would like to congratulate and welcome Lorraine Walsh who was sworn in as mayor of the
Village of Larchmont Monday night, and congratulations to eubba Fanelli and Carol Miller who were
sworn in as trustees. We look forward to continuing our close working relationship with them and the
Village of Larchmont.
Community Choice Aggregation, now known as Westchester Power, letters went out this week and
many of you should have received them by now.As 1 have been reporting for months about the
program, this is program of Sustainable Westchester that pools the electricity demand of roughly
twenty participating municipalities to enhance the bargaining power of consumers and deliver cleaner,
cheaper energy.
Sustainable Westchester issued an RFP for energy service companies(ESCOs)and,following a period of
review of options and then negotiation concluded an agreement with Con Ed Solutions. (Somewhat

confusingly, although Con Edison Solutions is a wholly-owned subsidiary of Con Edison, it operates
independently and has a distinct mission under New York State utility regulations.)
When Westchester Smart Power is implemented in May, Con Edison Solutions will become the default
energy supplier for all consumers in participating municipalities, except those who have prior
agreements with other ESCOs. This will affect 3,793 residential customers and 296 commercial
customers in the Town.
However, every customer will retain the right to opt out of this default at any time and choose a
different energy provider. Similarly, those currently served by a different ESCO will have an
opportunity to opt in at any time.
Sustainable Westchester has created an interactive website for information and hired staff to respond
to phone calls about the program. The website, which contains much more information, is:
www.westchestersmartpower.org. The phone number is(855)492-7693.
Sustainable Westchester's agreement with Con Ed Solutions gives each municipality two distinct
default options: (1)a standard or"brown"rate that relies on traditional sources of energy, including
fossil fuels;and(2)a clean or"green"rate that delivers 100%renewable energy.
Just as individual consumers can opt in to a different ESCO,so, too, can they opt in to their preferred
rate. However, the Town had to choose one or the other as a default.
Fortunately, both the brown and the green rate are lower than current rates. In other words,
consumers will save money in either scenario. (As you see below, the savings are significant for
residential consumers, but negligible for commercial customers.)

(Note that this applies to electricity supply. Electricity delivery would continue to be Con Ed's
responsibility, and delivery rates will not be affected one way or another.)
These rates will be fixed for at least 24 months. Sustainable Westchester may choose to negotiate an
extension of the fixed term at the end of this year.
The Town chose the "green"rate as our local default because the benefits of the green rate far exceed
the relatively small price differential between the two.
Here are a few reasons:
Consumers will still enjoy a meaningful savings over the status quo with the green rate. We can save
money and be green simultaneously.
Consumer can still opt in to the brown rate, if that is what they prefer.
Transitioning to clean, renewable energy is one of the Town-s core sustainability objectives. We will
never have an easier, better,simpler, or more impactful way of accomplishing that objective.
For homes that are simply not suitable for solar power, because of their structure, orientation, etc.—
which could be a healthy percentage of our housing stock,—this may be one of the few realistic means
of tapping in to a renewable energy source.
Longer-term, opting for the green rate will help drive down costs further. Here is why:ramping up
demand for renewable energy helps stimulate growth in renewable energy capacity and infrastructure.
That, in turn, helps reduce prices. Bringing in big chunks of customers through community choice
aggregation contributes to that goal more effectively than scattered individual sign-ups.
1 will mention a few special meetings and events.Steve Altieri and 1 attended the Council of
Governments meeting last week in the County where the County Board of Legislators meets with Chief
Elected and appointed officials to discuss issues. 1 mention this because the issue of repairing sanitary
sewer lines was introduced and discussed.Subsequently the Town met with County representatives to
further pursue the issue. 1 had the pleasure of being one of the three judges at the Larchmont Friends of
the Library Spelling Bee this past Sunday. The LAC Choir team won. We continue to meet with our

communications consultant who is helping us craft a communications protocol that will include a twice
a year mailed newsletter and improved social media communications. Finally, a reminder that organic
waste collection began last week.

below because these streets are in proximity to the Fenimore Road exit from Interstate Route 95 and the
industrial district of the Village of Mamaroneck, resulting in major truck traffic on these streets as truck
drivers either seek major thoroughfares such as Weaver Street, or to return to the entrance to Interstate
Route 95. The Town Board neglected inadvertently to include Rocky Road as one of the streets from which
large trucks should be banned. In also assumed but did not include in the local law an exemption for heavy
motor vehicles owned or operated by governmental or public utilities. This amendment corrects those
oversights.

It is noted for the record,that Patricia Dutton,of 164 Rocky Road,emailed the Town Supervisor on April 4, 2016
in favor of the Amendment to include Rocky Road.
Supervisor Seligson explained the reason for this Amendment,then asked if anyone wished to comment on the
proposed Local Law.
George Tait,of 267 Hickory Grove Drive,addressed the Town Board in favor of this Amendment. Mr.Tait also
asked if the letters had gone out to the local businesses. Mr.Altieri responded, not as yet. Mr.Tait noted that
the Village of Mamaroneck has advised him that there will be a sign at the exit off 195 alerting trucks to make a
right turn for 195.
On motion of Councilwoman Elkind Eney,seconded by Councilman Murphy,the Public Hearing was
unanimously closed.
On motion of Councilman Murphy,seconded by Councilwoman Elkind Eney,the following Local law was
approved:

This local law shall be known as the "Amendment to the Restriction of Truck Traffic from Hickory Grove
Drive East, Rockland Avenue and a section of Myrtle Boulevard Law by Adding Rocky Road thereto" Law.

BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1—Purpose:
On March 2,2016,the Town Board,acting pursuant to the authority given to it by section 1660(a) (17) of
the New York Vehicle and Traffic Law, passed Local Law No. 2-2016 which banned heavy trucks from
traveling on Hickory Grove Drive East, Rockland Avenue and the section of Myrtle Boulevard described
below because these streets are in proximity to the Fenimore Road exit from Interstate Route 95 and the
industrial district of the Village of Mamaroneck, resulting in major truck traffic on these streets as truck
drivers either seek major thoroughfares such as Weaver Street, or to return to the entrance to Interstate

large trucks should be banned. In also assumed but did not include in the local law an exemption for heavy
motor vehicles owned or operated by governmental or public utilities. This amendment corrects those

Section 2—Creation of a Ban on Truck Traffic on Certain Streets:
(a) No trucks, commercial vehicles, tractors, tractor-trailer combinations, tractor-semitrailer
combinations, or tractor-trailer-semitrailer combinations weighing in excess of eleven (11) tons shall be
permitted to drive upon Hickory Grove Drive East,Rockland Avenue,Rocky Road and the section of Myrtle
Boulevard lying between its intersections with Weaver Street and Lakeside Drive. This prohibition shall
not be construed as preventing the delivery or pickup of merchandise or other property from parcels that
abut the streets or section thereof from which such vehicles or combination of vehicles is otherwise
excluded pursuant to this law.
(b) This local law shall not apply to motor vehicles meeting the description contained in paragraph (a)of
this section that are owned or operated by(i) the United States of America, or the State of New York, or
any City, County, Town, Village or School District located in the State of New York, or(ii) by any agency,
authority, board,department,division or service of any of the entities described in paragraph(b)(i)of this
section,or(iii)by public utility companies or(iv)by independent contractors engaged by any of the entities
described in paragraph (b)(i), (ii) or(iii) of this section.
Section 3-Violation:
A violation of this local law shall be punishable by a fine of$250.
Section 4—Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent
jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of
this Local Law,which may be implemented without the invalid or unconstitutional provisions.
Section 5—Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

This local law shall be known as the"Amendment to the Restriction on Parking on Hillside Road and on a
Section of Echo Lane" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1—Purpose:
On March 2, 2016, the Town Board, passed Local Law No.3-2016 which restricted parking on sections of
Hillside Road and Echo Lane.The Town Board intended the time restrictions to be consistent with parking
restrictions on neighboring streets but LL No.3-2016 was not consistent. The Town Board also wants to
clarify the location of the parking restriction on Echo Lane.This amendment does both things.
Section 2—Regulation of Parking on Hillside Road:
No motor vehicle shall be parked on the north side of Hillside Road between the hours of 10:00 AM and
11:00 AM (prevailing time) on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of each week.
This law shall not apply on holidays.

No motor vehicle shall be parked on the south side of Hillside Road between the hours of 2:00 PM and
3:00 PM(prevailing time)on Mondays,Tuesdays,Wednesdays,Thursdays and Fridays of each week. This
law shall not apply on holidays.
Section 3—Regulation of Parking on a section of Echo Lane:
No motor vehicle shall be parked on that section of the east side of Echo Lane which lies between Echo
Lane's intersections with Murray Avenue and Lookout Circle between the hours of 10:00 AM and 11:00
AM(prevailing time)on Mondays,Tuesdays,Wednesdays,Thursdays and Fridays of each week. This law
shall not apply on holidays.
No motor vehicle shall be parked on that section of the west side of Echo Lane which lies between Echo
Lane's intersections with Murray Avenue and Lookout Circle between the hours of 2:00 PM and 3:00 PM
(prevailing time) on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of each week. This law
shall not apply on holidays.
Section 4—Sign(s)to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the
surfaces of Hillside Road and Echo Lane indicating where and when parking is prohibited by this law.
Section 5—Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent
jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of
this Local Law,which may be implemented without the invalid or unconstitutional provisions.

WHEREAS,the Town solicited proposals to provide consulting services related to the acquisition of real
property along Weaver Street to allow for the construction of the proposed concrete sidewalk connecting
Murray Avenue to Bonnie Way.
NOW THEREFORE, BE IT
RESOLVED,that the Mamaroneck Town Board does hereby approve of the consulting agreement with
Universal Field Services at the cost of$21,200.00,for the right of way acquisition services for the Weaver
Street Sidewalk Extension Project—PIN 8761.32.

4. Authorization—IMA Sewer System Evaluation Study
Mr.Altieri explained that the Village of Larchmont,City of New Rochelle and Village of Pelham Manor, have
formed a Consortium to conduct the Sewer System Evaluation Study(SSES). Before the Town Board is approval of
an Intermunicipal Agreement(IMA) between these communities.
On motion of Councilwoman Katz,seconded by,Councilman Murphy,it was
RESOLVED,that the Mamaroneck Town Board does hereby approve the Inter Municipal Agreement
between the Town of Mamaroneck,City of New Rochelle,Village of Pelham Manor and Village of
Larchmont for the apportionment of the cost of the Sewer System Evaluation Study,and
BE IT, FURTHER
RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the
Town.

8. Resolution—Westchester County Airport
On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the following was unanimously
approved,
Whereas,the Town of Mamaroneck supports a modern and functional Westchester County Airport
that exists in harmony both with the natural environment and the communities that surround the
airport to the maximum extent practicable.
NOW,THERFORE, BE IT
RESOLVED,that the Town respectfully requests the Westchester County Board of
Legislators complete a thorough environmental review of the proposed modification to the per half
hour commercial passengers limits now contained in the County Terminal Use Regulation and in
connection with that detailed review solicit and consider citizen input to the planned expansion of
passengers permitted to leave or arrive at the airport per half hour.

REPORT OF COUNCIL
Councilman Murphy attended the LMC-TV Board of Control Meeting at which they approved allowing LMC-TV to
begin negotiating a lease agreement with the Village of Mamaroneck regarding a home for LMC-TV in the Fire
House on Mamaroneck Avenue.Councilman Murphy attended the Zoning Board of Appeals meeting, noting what
a very well run meeting they hold.Councilman Murphy is happy to be the liaison to the Zoning Board.
Councilman Odierna has nothing further to report,adding he has been busy with family as his wife is recuperating
from knee surgery.

Councilwoman Katz attended the traffic committee meeting, noting the Committee received its first thank you
note from a resident. The Traffic Committee had no new items on their agenda.
Councilwoman Elkind Eney attended the Senior Center Saint Patrick's Day Luncheon,adding a thank you to Maria
Gallagher for another wonderful event.She and Supervisor Seligson have had a number of Communications
Meeting with the Town's Consultant.As she has reported previously,the Town is working to improve its
communications via Facebook and newsletters. Councilwoman Elkind Eney noted that she and Christina Battalia
attended the Women's Club Philanthropic Luncheon.Councilwoman Elkind Eney,Supervisor Seligson and Steve
Altieri attended the Old Timers'Athletic Association's St. Patrick's Day and St.Joseph's Day Dinner.The well
deserving honoree was Village of Mamaroneck Justice, Dan Gallagher.Councilwoman Elkind Eney participated in
the Library Spelling Bee as a Wellesley College Alumni, unfortunately team Wellesley did not do very well.
Councilwoman Elkind Eney attended the Swearing in of the Village of Larchmont Mayor and Trustees.She wishes
Lorraine Walsh, Bubba Fanelli and Carol Miller good luck,and looks forward to working with them. Previously
Councilwoman Elkind Eney reported on Fire Council.Additionally,she attended the Recreation Commission
Meeting, noting that the new score boards are in,and camp registration is currently taking place.
