BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was unanimously opened at 5:00PM. Presentation Green Codes Grant: Additionally Present: Professor John Nolon, of Pace University Land Use Law Center The Town participated in a NYS Cleaner Greener Grant sponsored by Pace University Land Use Law Center. Pace worked with the Town to identify Green Infrastructure as the sustainability element on which it would focus. Mr. Nolon presented the findings of the Capstone Report analyzing the Town’s code and recommended specific ways to implement Green Infrastructure in the Town. Mr. Nolon suggested referencing the NYS standards guides in the updated LWRP and Chapter 95 of the Town Code. Below as noted from the Report: Supervisor Seligson stated that the Town staff is reviewing the Report and the Town Board will work with staff and the Town Attorney to implement the recommendations. OUT OF ORDER Discussion- Residential Site Plan Law Additionally Present: Ira Block, Member of the Town’s Planning Board 2 March 16, 2016 The Town Board discussed the draft Residential Site Plan Law and hear remarks from Mr. Block. Mr. Block addressed the Town Board on behalf of the Planning Board. The Planning Board’s concerns about the current Residential Site Plan law include, the exemptions placed in the law, specifically for the Durham Road subdivision, adding that the exemptions should be very narrow, for very specific situations. Additionally, the Planning Board’s concerns about the 70% disturbance and would like to see that percentage lowered as a trigger for site plan review. The penalties are also too low, there should be daily fines. Mr. Block stated that he will address the Board again during the Public Hearing. Capital Project Review Additionally present: Anthony Siligato, Town Comptroller The Town Board reviewed a memo from Mr. Altieri dated March 10, 2016 discussing the Closeout of the Capital Projects. The Town Board reviewed the specific Capital Project Schedule, the Schedule of Interfund Transfers for the Capital Projects Close Out and a Schedule of the Honeywell ESCO Project’s Final Cost Breakdown by ECM by Location. The Town Board reviewed the Capital projects, with particular time spent reviewing the ESCO Project Breakdown. This item is on the Regular Agenda for this evening. Community Choice Aggregation The Town Board noted that the memo from Supervisor Seligson was very well explained, and there was little need for discussion. This approval is on the Regular Agenda for this evening. ADDED ITEM LMC-TV The Town Board discussed a contingent approval for the Fire House location. Specifically, that the questions of prevailing wage and WICKS law compliance be answered. Mr. Maker advised that the Town Board ask and receive a pro forma report of what the project would cost should prevailing wages be required. The Town Board would then have a worst case scenario to consider. Baldwin Avenue Parking The Town Board reviewed a memo from Mr. Altieri dated March 11, 2016 outlining the plan as previously discussed, for implementing a parking plan for Baldwin Avenue. The Town Board reviewed a draft resolution requesting an amendment to the Home Rule Legislation for the Town of Mamaroneck Residential Parking System. Additionally, the Town Board reviewed the plan to regulate short term parking for park patrons and long and short term parking for commuters and or occasional train parkers. ADDED ITEM Housing Authority Councilman Odierna stated that the Housing Authority was seeking clarification on whether the Section 8 applicants took precedent over work force housing, the response was yes. Supervisor Seligson elaborated, that this was negotiated with the County as part of the discussion in obtaining additional affordable housing units in the Cambium Project. Parking Fees The Town Board received a schedule from the Town Clerk on current pricing for the various Town Parking Lots. The Town Board discussed raising fees, minimally, as it has done each year to be consistent with other th municipalities. The approval of these fees will be on the April 6 Town Board Agenda. 3 March 16, 2016 CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT I presented an update on Town programs and activities at the Women’s Club last week. There has been lots of activity with Sustainable Westchester in regard to the Community Choice Aggregation program that we will talk about later this evening. We had an Employee Recognition Event in the Town yesterday where we recognized those employees who have worked for the Town from 10 to 40 years. The Chief of Police, Richard Rivera, has been with the Town for 40 years. It was a great opportunity to thank our wonderful employees and show our appreciation for the staff. We continue to refine our greenhouse gas inventory. We continued to work on our communications plan for the Town. We met with our consultant and have a proposal to start working on a tiered st communications plan. On April 1 the renovation of the TMPD will commence. The front desk will th be relocated during the renovation. There are two big events on April 10: one is the Town’s Bunny Hop race that begins at Memorial Park and the other is the tri-municipal Grow It Green event at Larchmont Temple. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board on anything other than the topic for this evening’s Public Hearing, and there was not. PUBLIC HEARING (S) – “Site Plan Approval for Residential Development Law of the Town of Mamaroneck” Law. The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on March 2, 2016 a Public Hearing will be held on Wednesday, March 16, 2016 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Site Plan Approval for Residential Development Law of the Town of Mamaroneck” Law. Section 1 – Purpose. This chapter is enacted to ensure that proposed development and use of land will preserve and protect environmental features, have a harmonious relationship with existing or permitted uses of contiguous land and of adjacent neighborhoods, enhance the appearance of the community and make sure that the health, safety, comfort, convenience and general welfare of the public is fully considered. The full text of this Amendment is stated below and can also be examined and copies obtained at the Town Clerk's office during regular hours, Mon-Fri, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, NY PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. 4 March 16, 2016 BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: March 5, 2016 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was unanimously opened. Supervisor Seligson recapped the work the Town Board has done drafting this legislation, then asked if anyone wished to comment on the proposed Local Law. Meg Deshpande, 6 Acorn Lane, asked for clarification, specifically the requirement of obtaining a topographical map. Doug Bloom, 22 Myrtle Boulevard, would like to see the Tree Law incorporated into the site plan review more fully. Elon Midor, 4 Murdock Lane, objects to restriction on trees as it takes away homeowner rights. He thinks the Planning Board does an excellent job and doesn’t need an added layer of work. He thinks the Town needs a Board of Architectural Review. George Roniger read a letter from Ruth Campanelli, 7 Barnum Road, in which she addresses the concerns of her neighbor who lived next door to the recent home tear down on Little Farms Road. Specifically complaints about developers. Ira Block, speaking on behalf of the Town Planning Board, spoke of the Planning Board’s concerns in the difference in the site plan and sub division approval process, specifically as it applies to the exemptions in the draft law, adding the Planning Board has discretion built in to the draft law, and feels the planning Board can address the ‘one offs’. Additionally, the 70% disturbance should be reduced. Finally, the fines are financially too low, especially for after notice of violation. Charlie Gottlieb, of Cuddy and Feder, representing Andrew and Emily Saines, the owners of the approved subdivision at 1 Durham Road. Mr. Gottlieb stated that written comments dated March 10, 2016 have been previously submitted. Mr. Gottlieb made additional comments to the written submission with respect to the comments made by the Planning Board, adding that there was considerable consideration made by the Planning Board for the sub division approval. Mitch Green, 6 Meadow Place read from his written comments submitted to the Town Board. In general, Mr. Green believes the law is not sufficient in its definitions and conditions for triggering site plan review. Additional Comments were received and noted for the record by: Lori Kupferberg, of Rockingstone Avenue, in an email dated March 16, 2016, wrote addressing grading issues, especially ones that cause drainage hardship to their neighbors. Maura Carlin, in an email dated March 14, 2016, noting some comments and concerns in the proposed law, specifically whether this law would have addressed the issues faced by the project at 305 Rockingstone/75 Vine. Burton Corwin, Commander, VFW Post 1156, submitted written comments, dated March 15, 2016, strongly favoring the law, and elaborating on three areas of concern within the law as written. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Public Hearing was unanimously adjourned until April 6, 2016. 5 March 16, 2016 PUBLIC HEARING – Town of Mamaroneck Consolidated Sewer District The following Notice of Public Hearing is entered into the record as follows: In the Matter of ORDER The Systemwide Planning Evaluation for an CALLING increase and improvement of the facilities of the PUBLIC Town of Mamaroneck Consolidated Sewer District, HEARING in the Town of Mamaroneck, Westchester County, New York WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has caused to be prepared a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to a systemwide planning evaluation for an increase and improvement of the facilities of the Town of Mamaroneck Consolidated Sewer District, in the Town of Mamaroneck, Westchester County, New York, at a maximum estimated cost of $414,000; and WHEREAS, said capital project has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, said regulations provide will not result in a significant environmental impact; and WHEREAS, it is now desired to call a public hearing on the question of the systemwide planning evaluation for an increase and improvement of the facilities of the Town of Mamaroneck Consolidated Sewer District, in the matter described above, and to hear all persons interested in the subject thereof, concerning the same, in accordance with the provisions of Section 202-b of the Town Law; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. Section 3. The notice of public hearing shall be in substantially the form attached hereto as Exhibit A and hereby made a part hereof. Section 4. This Order shall take effect immediately. Mr. Altieri explained that this bonding is for the sewer evaluation study, and because all the bids have not been received for this project, it is the recommendation that the hearing be closed and no action be taken. At such time when the bids have been opened the Town will re notice a public hearing. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously closed. 6 March 16, 2016 BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Murphy, seconded by Commissioner Councilwoman Elkind Eney, the Board of Fire Commissioners was unanimously declared open. Authorization to Appoint a Fire Fighter On motion of Commissioner Katz, seconded by Commissioner Elkind, it was RESOLVED, that the Town of Mamaroneck Fire Commissioners does hereby promote Michael Cassidy to the position of Fire Lieutenant effective March 17, 2016 at an annual salary of $104,188.00. Commissioner Elkind Eney thanked Chief Noah Goldberg and Ambulance District Administrator Mike Liverzani for organizing this Town wide event. Commissioner Elkind Eney reported that the group of Firefighters who are responsible for the new Fire Trucks went to Pennsylvania to meet with the manufacturers for a pre-construction meeting. Commissioner Elkind Eney also reminded residents that at daylight savings we remind everyone to change the batteries on their smoke and carbon monoxide detectors. There being no further business to come before the Commission, on motion of Commissioner Odierna, seconded by Commissioner Katz, the Commission unanimously adjourned and the Town Board reconvened. 8 March 16, 2016 AFFAIRS OF THE TOWN 1.Tree Appeal – 4 Murdock Road Additionally Present: Elon Midor, developer of 4 Murdock Road, along with Dan Sherman his Landscape Architect and Greg Mercurio, his Arborist. Mr. Sherman stated, there was an original plan in September 2015 for the removal of 26 trees. After working with Elizabeth Paul, the Town’s Environmental Planner, six trees have been taken off the removal list to leave the removal of trees to 20. It was also noted that the developer is planting 44 new trees. The Town Board reviewed the Tree Preservation Commission Statement of Findings dated March 3, 2016 and letters in objection from Lisa and Randy Siegel, of 4 Split Tree Road, Janet Azaguny, of 3 Split Tree Road, and Sharon and Eric Draghi, of 8 Split Tree Road. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby deny the Tree Appeal and grants permission for the Revised Tree Removal Application for 4 Murdock Road. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Nay Seligson Aye 2.Authorization to Closeout Various Capital Projects On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Closeout of the Capital Projects and the Closeout Interfund Transfers as detailed by the Town Comptroller in the following schedules: Attachment A and B The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 3.Approval – Community Choice Aggregation Supervisor Seligson explained the project that the Town has been working on with Sustainable Westchester. This program “now branded locally under the name Westchester Smart Power, pools the electricity demand of roughly twenty participating municipalities to enhance the bargaining power of consumers and deliver cleaner, cheaper energy”. The Town has already approved participation in the 9 March 16, 2016 program and now must authorize the default option (1) a standard or “brown’ rate that relies on traditional sources of energy, and (2) a clean or “green” rate that delivers 100% renewable energy. On motion of Supervisor Seligson, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the default rate as being the Green Option for residential customers at .0809/kwh and for commercial customers .0965/kwh. Set Public Hearing – Amendment to Truck Ban – Hickory Grove East, Rockland Avenue, and a Portion of Myrtle Blvd. It was noted that this amendment consists of two matters, one the inclusion of Rocky Road to the streets where heavy truck traffic is banned. Second, it exempts government units, utilities and contractors hired by government units or public utilities. WRITTEN COMMUNICATIONS None additional to what is recorded above during the Public Hearing REPORT OF COUNCIL Councilwoman Elkind Eney attended the Mamaroneck Chamber of Commerce Meeting at which they thst discussed plans for their March 18 Dinner Dance and plans for the Wine Trail on May 1. Councilwoman Elkind Eney, Supervisor Seligson and Steve Altieri, attended another Communications Meeting to continue discussions with the Town Consultant, adding the aim is to more effectively communicate with Town residents on key issues of importance. Councilwoman Elkind Eney attended the Rangers Road Tour event at the Hommocks Ice Rink, adding it was a very nice event. Councilwoman Elkind Eney attended the Housing Authority Meeting at which they discussed renovations at the Hommocks Apartments, adding that 11 March 16, 2016 those are progressing according to plans. Councilwoman Elkind Eney attended the Recreation Commission Meeting at which they discussed the plans for the upcoming season for the Hommocks Fields and rates for the Ice Rink. Councilwoman Elkind Eney attended the Planning Board Meeting at which they discussed two special permits and an application to raise a house. The Planning Board also discussed the Residential Site Plan law, noting that Ira Block was present this evening to present the Planning Board’s views. Councilwoman Elkind Eney and other Town Board Members attended the Westchester Municipal Officials Association Dinner, at which David Pope of the Pope Foundation discussed Public Private Partnerships. Councilwoman Elkind Eney and other Town Board Members attended the Summit meeting, at which Superintendent’s from the Mamaroneck and Rye Neck Schools discussed the ‘State of Schools’, specifically the difficulties they face with the Tax Cap. Councilwoman Elkind Eney announced the upcoming Spelling rd Bee, noting this is a Library event being held at the Larchmont Temple on April 3 at 3:30pm. Councilwoman Katz noted that Councilwoman Elkind Eney previously noted the many events she attended. th Councilman Odierna, along with Councilwoman Elkind Eney, attended on March 7, the Fire Council th Meeting, then on March 10 he attended the Library Board of Trustees Meeting. Councilman Odierna also thth attended, on March 11, the Healthier Sound Shore Coalition Meeting and then on March 15 the Healthier Mamaroneck Meeting. Councilman Murphy thanked the employees attending the recent Service Awards Luncheon at the Town Center. Councilman Murphy noted the wonderful comradery among the Town Staff, adding that this is indicative of how well this Town has been run for decades.
