Wasp, Town Engineer Marc Romero, Assistant to the Town Administrator Christine Canavan, Assistant to the Town Administrator 5:00 PM THE TOWN BOARD WORK SESSION CALL TO ORDER The Work Session of the Town Board was called to order by Town Supervisor Jaine Elkind Eney. Moved by Councilmember King, seconded by Councilmember Nambiar, the Town Board unanimously opened the Work Session at 5:04 p.m. Carried WORK SESSION ITEMS 1. Discussion - REALM Monument John Pritts explained that due to expense and the unavailability of patio pavers, the bench originally proposed as part of the REALM monument design has been removed. (See Attachment A.) The surface area will be concrete rather than pavers. The plaque will fill the entire right-side wall and is expected by the end of December. (See Attachment B.) The monument is anticipated to be completed within approximately one month. Mr. Pritts stated that three-dimensional sculpted images by artist Sara Kolbel will be included on the side. The back of the monument will reflect the harbor, and the front will list names related to enslaved people. He noted the monument is intended to serve as a teaching tool and that a bench could potentially be added later. Discussion included possible removal or reduction of forsythia to improve sight lines. Lighting has not yet been determined. Mr. Pritts also referenced an idea suggested by historian Ned Benton regarding a Civil War Memorial at the base of the stairs to tie into the REALM monument. Town Board November 19, 2025 2. Discussion - Award of Bid - TA-25-12A - Parks Building & Sign Shop Facility Reconstruction The Board discussed the third bid received for the Parks Building and Sign Shop reconstruction project. A Project Labor Agreement (PLA) is being utilized for the first time. The project was bonded in 2024, with $2.8 million previously allocated. Discussion referenced value engineering efforts and cost reductions from earlier bids. Councilmember Nambiar voiced concern and disagreement with the project. Councilmember King stated that the existing structure is problematic and that consolidating operations under one roof will save working hours and improve efficiency. 3. Discussion - Award of Bid - TA-25-11 Traffic Signal Replacement— Richbell Road & Palmer Avenue Town Administrator Robson explained this is a technology upgrade that will improve efficiency and safety; this was the only bid received. Councilmember King requested follow up on a previous fatal accident on Weaver Street and whether a plaque had been installed. 4. Discussion - Ambulance District Agreements Administrator Robson stated that the agreements have not materially changed. It was suggested they be approved for one year retroactive to 2025 due to lack of time to update them. LVAC preferred a one-year agreement, while MEMS were open to a longer term. The goal is to ensure continuity of service. 5. Discussion - Renewal of Mutual Aid & Rapid Response Plan 2025-2030 Administrator Robson explained that this is the Town's standard mutual aid agreement for the Police Department, providing reciprocal assistance among municipalities. 6. Discussion - Proposed Local Law - "Temporary Suspension of Chapter 99 of the Code of the Town of Mamaroneck" Councilmember Fiddelman stated she was comfortable setting a public hearing but expressed concern that neighbors could be disturbed over a prolonged period. Administrator Robson noted that most affected residents attended the neighborhood discussion meetings and that letters were sent with minutes summarizing the discussions. 7. Discussion - 2025 November Fee Schedule Update - Town Clerk The Town Clerk presented the proposed updates. 8. Updates • Zoning Board project had been reduced to 34 units and one story lower; proposal is now for six stories. It also includes affordable workforce units (4 of the 34 units). 9. Request for Executive Session Moved by Councilmember King, seconded by Councilmember Nambiar, the Town Board agreed to enter into Executive Session to discuss current litigation on the Tree Law and with Larchmont, the employment history of a particular person or persons, and collective negotiations pursuant to article fourteen of the Civil Service Law. Carried Town Board November 19, 2025 Moved by Councilmember Nambiar, seconded by Councilmember King, the Town Board unanimously agreed to resume the Regular Meeting. Carried 10. Discussion - Budget Comptroller Yogman reported that the tax rate remains at the cap of 2.83 percent. Fund balance has increased based on end-of-year projections. Administrator Robson noted the importance of consistent capital planning so that multiple large capital projects do not accumulate in 2027 and 2028. Discussion included the concept of a master recreation implementation plan for Town- owned land, senior housing, and housing needs generally, which were described as critical. The Larchmont Library requested a 3.8 percent increase. 11. Changes to Regular Meeting Agenda 8:26 PM TOWN BOARD REGULAR MEETING The Town Board meeting convened in the Courtroom Located on the second floor at the Town Center. The Public was to view the meeting on cable access television (Optimum 76/ Fios 35) or on LMCMedia.org SUPERVISOR'S REPORT Welcome to the November 19, 2025, meeting of the Town Board of the Town of Mamaroneck. The Town Board met today for a Work Session in Conference Room A starting at 5:00pm, which was open to the Public. With the election of Councilman Anant Nambiar to Westchester County Legislator, there is a vacancy on the Town Council, effective January 1, 2026. The Town Board has the authority to appoint a replacement who would be required to run for election in November 2026 in order to maintain their council seat. Con Ed Settlement: The Westchester Municipal Consortium (WMC)- an unprecedented coalition of 40 local municipalities that joined forces to become a party to Con Edison's 20256 electric and gas rate case filings before the NYS Public Service Commission (PSC) announced that a three-year settlement agreement (known as a Joint Proposal) has been formally reached between Con Edison, the PSC Staff, and other parties. Con Ed's original proposed electric rate increase of 13.4% has been reduced to 2.8% on the total customer bill under the settlement. On the gas side, the original proposed 19% increase has been reduced to 2% on the total customer bill. The agreement spans January 1, 2026, through December 31, 2028, with similar annual increases of approximately 2.8% (electric) and 2.0% (gas) in the second and third years. I want to congratulate our MHS sports teams who had an amazing record this year! The Varsity Football team won the school's first ever sectional championship! They go on to the regional final this Saturday November 22 at Arlington HS The women's field hockey team won sectionals, regionals and the state semi-final. They lost in the State finals. Boston Post Road, Mamaroneck, New York. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: October 2, 2025 Town Administrator Robson explained that questions raised previously had been addressed with counsel. As this Public Hearing had not been closed, it did not need reopening. Supervisor asked if anyone had any comments. The only comment was from Councilmember Nichinsky who mentioned having discussed this several times. Moved by Councilmember King, seconded by Councilmember Nichinsky, the Public Hearing was unanimously closed. Carried Moved by Councilmember Fiddelman, seconded by Councilmember Nambiar, it was resolved that WHEREAS, the Local Franchising Authority or "LFA" wishes to grant Franchisee a renewal of its nonexclusive franchise to construct, install, maintain, extend and operate a cable system in the Franchise Area as designated in this Franchise; WHEREAS, the LFA is a "franchising authority"in accordance with Title VI of the Communications Act, (see 47 U.S.C. §522(10)) and is authorized to grant one or more nonexclusive cable franchises pursuant to Article 11 of the New York Public Service Law, as amended, and Title 16, Chapter VIII, Parts 890.60 through 899, of the Official Compilation of Codes, Rules and Regulations of the State of New York, as amended; WHEREAS, Franchise's existing Cable System transmits both Cable and Non- Cable Services, which Non-Cable Services are not subject to the Cable Law or Title VI of the Communications Act; WHEREAS, the Cable System occupies the Public Rights-of-Way within the Franchise Area, and Franchisee desires to use portions of the Cable System to provide Cable Services (as hereinafter defined) in the Franchise Area; WHEREAS, the LFA and the Franchisee are entering into this Agreement for the purpose of setting forth the terms and conditions on which Franchisee shall be entitled to provide Cable Services in the Franchise Area with the express understanding and agreement that nothing in this Agreement shall add to or detract from the LFA's police powers, or rights or privileges in respect of the Public Rights of Way in accordance with Federal, State, and local laws. or(ii) Town Board November 19, 2025 the Franchisee's rights or privileges in respect of the Cable System in accordance with Federal, State, and local laws, as each relates to the provision of Non-Cable Services in the Franchise Area, it being the intent of the parties that this Agreement shall govern only the provision of Cable Services; WHEREAS, the LFA has identified the past performance of the Franchisee and the future cable-related needs and interests of the LFA and its community, has considered and approved the Franchisee's technical ability, financial condition and character as defined by Title 16, Chapter VIII, Part 894.6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, as amended, and has determined that Franchisee is in compliance with its existing franchise and applicable law and that its Cable System is adequate and feasible in a full public proceeding affording due process to all parties; WHEREAS, the LFA has found that Franchisee is and has been in substantial compliance with all terms and provisions in its existing franchise and applicable law. 2 Town of Mamaroneck September 11, 2025 WHEREAS, based on the representations of the Franchisee in the Franchisee's cable franchise applications, the LFA has found Franchisee to continue to be financially, technically and legally qualified to operate the Cable System in the Franchise Area; WHEREAS, the LFA has determined that in accordance with the provisions of the Cable Law, this Franchise complies with NYSPSC's franchise standards and the grant of a nonexclusive franchise to Franchisee is consistent with the public interest; and WHEREAS, the LFA and Franchisee have reached agreement on the terms and conditions set forth herein and the parties have agreed to be bound by those terms and conditions. NOW, THEREFORE, in consideration of each of the LFA's grant of a renewal franchise to Franchisee, Franchisee's promise to provide Cable Service to residents of the Franchise/Service Area of the LFA pursuant to and consistent with the Cable Law (as hereinafter defined), pursuant to the terms and conditions set forth herein, the promises and undertakings herein, and other good and valuable consideration, the receipt and the adequacy of which are hereby acknowledged, THE Town of Mamaroneck BOARD DOES HEREBY AGREE TO THE AGREEMENT AS PRESENTED. Public Hearing - Proposed Local Law - "Amendment to Certain Dimensional Requirements in the R-A Zoning District" The Notice of Public Hearing is entered into the record as follows: PUBLIC HEARING NOTICE LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, a Public Hearing will be held on Wednesday, November 19, 2025, at 8:00 PM or as soon thereafter as is possible, to consider the "Amendment to Certain Dimensional Requirements in the R-A Zoning District" Law, at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York. Purpose: The Larchmont Veterans' Building Corporation developed Elkan Park with a series of attached buildings, each containing a number of dwelling units. It was built to address Town Board November 19, 2025 the post-World War II housing shortage. When built, each individual building satisfied the side yard setback requirements of the zoning ordinance. In 1947, the Corporation began transferring title to the individual dwelling units within each building. Each dwelling unit became its own individual building lot. Units attached to other units on each side no longer had any side yards and became nonconforming. Under the zoning ordinance, nonconforming structures cannot be enlarged or expanded without obtaining a variance. Even if a proposed extension to the front or rear of any completely attached unit meets the dimensional requirements for front or rear yards, the owner still must obtain a variance because of the unit's nonconforming status. Because of the unique situation posed by Elkan Park, the Board of Appeals, barring some other problem, has granted such variances. Thus, the agenda of the Board of Appeals can be cluttered with applications for variances for construction that but for the nonconforming nature of the unit would be permitted as-of-right. This law would eliminate the need for properties in Elkan Park, whose side walls are attached to adjoining units on each side, from having to obtain a variance for expansions that otherwise satisfy the zoning ordinance. The proposed law also increases the maximum lot coverage from 25% to 35%. Carried Moved by Councilmember Fiddelman, seconded by Councilmember Nambiar, it was resolved, that the Mamaroneck Town Board finds that the adoption of the proposed local law, is hereby declared to be a Type II Action, with no impact under the New York State Environmental Quality Review Act(SEQRA) and requiring no further action. Carried Moved by Councilmember Nichinsky, seconded by Councilmember Fiddelman, the Local Law known as "Amendment to Certain Dimensional Requirements in the R-A Zoning District" was approved: Local Law No. 9 - 2025 This local law shall be known as the "Amendment to Certain Dimensional Requirements in the R-A Zoning District" Law. Section 2 —Amendment of a current section of the Mamaroneck Code: Section 240-4 of the Code of the Town of Mamaroneck hereby is amended by adding a new definition to be placed within that section in its proper alphabetical position: LOT LINE, INTERIOR A lot line or lines on a parcel in the R-A: Attached Residence District that is improved with a party wall that separates the lot from an abutting lot. Section 3 —Amendment of a current section of the Mamaroneck Code: Section 240-42 of the Code of the Town of Mamaroneck hereby is amended by deleting paragraph A. (3) and substituting the following in its place: (3) Maximum coverage of lot: 35%. Section 4 —Amendment of a current section of the Mamaroneck Code: Section 240-42 of the Code of the Town of Mamaroneck hereby is amended by deleting paragraph B. (2) and substituting the following in its place: (2) Minimum side yards. (a) For a lot with only one interior lot line: One at least: 25 feet. (b) For a lot with only one interior lot line: Total of two at least: 25 feet. (c) For a lot with two interior lot lines: 0 feet (d) An unattached accessory building not over one story or 15 feet in height and located on the rear one-third (1/3) of the lot may be placed at a minimum distance of five feet from the property line. On a corner lot, such accessory building shall not be located nearer to the street line than the required minimum front yard setback for the zoning district. Town Board November 19, 2025 Section 5 — Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 6 — Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Carried 3. Carried Public comments were received in support of the proposed local law from Bart Sages, Richard Zoffness, and Dara Gordon, all Town residents who spoke regarding safety concerns, limited visibility, delivery vehicles parking in no-parking areas, enforcement, and potential installation of bollards at this location. Moved by Councilmember King, seconded by Councilmember Nichinsky, the Public Hearing was unanimously closed. Town Board November 19, 2025 Carried Moved by Councilmember Nichinsky, seconded by Councilmember Fiddelman, the following Local Law known as "Prohibition on Parking within Forty Feet of the Driveway on North Chatsworth Avenue that serves the Property at 16 North Chatsworth Avenue" was approved: Local Law No. 10 - 2025 This local law shall be known as the "Prohibition on Parking within Forty Feet of the Driveway on North Chatsworth Avenue that serves the Property at 16 North Chatsworth Avenue" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 — Purpose: The purpose of this law is to improve visibility for drivers exiting the driveway that serves the property at 16 North Chatsworth Avenue. Section 2 — Prohibition of Parking on Maple Hill Drive within Thirty Feet of Murray Avenue: Section 219-18 of the Code of the Town of Mamaroneck hereby is amended to add thereto the following: Name of Public Highway Direction Location Of Travel North Chatsworth Avenue North East side from where the southerly boundary of the driveway that serves the property at 16 North Chatsworth Avenue (formerly known as Old Jefferson Street) meets North Chatsworth Avenue for a distance of 40 feet toward the intersection of North Chatsworth Avenue and Myrtle Boulevard Section 3 — Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of North Chatsworth Avenue indicating where parking is prohibited by this law. Section 4 — Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 — Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Carried Town Board November 19, 2025 RESIDENT COMMENTS Supervisor Elkind Eney asked if anyone in the audience wished to address the Town Board. Robert Stark of 704 Palmer Court suggested consideration of a left-turn signal at Palmer and Richbell Road. Mitch Green of 6 Meadow Place spoke about the Trees for Our Town program, including expansion of tree planting along Palmer Avenue, resident investment models, watering programs, and the possibility of private collaboration regarding Hommocks Fields improvements. Gail Heiman invited the Board to the 100th anniversary celebration at 16 North Chatsworth Avenue on December 18. BOARD OF FIRE COMMISSIONERS 1. Call to Order Commissioner Elkind Eney called the Meeting to order, then on motion of Commissioner Fiddelman, and seconded by Commissioner Nambiar, the Board of Fire Commissioners was unanimously declared open. Fire Claims Moved by Commissioner King, seconded by Commissioner Fiddelman, it was RESOLVED that the Board of Fire Commissioners hereby approves the attached list of fire claims. Carried 3. Certificate of Results of the Fire District Special Election Moved by Commissioner Fiddelman, seconded by Commissioner Nichinsky, WHEREAS, on November 18, 2025, the Town of Mamaroneck Fire District held a Special Election for the purchase of a pumper fire fighting vehicle, including apparatus and equipment, for Fire District No. 1 in the Town of Mamaroneck, at a maximum estimated cost of$1,734,000, including incidental expenses, hereto attached, and that said Certificate of Results of the Referendum, hereto attached, have been Certified by the Chairwoman of Elections and the Inspector of Elections, and it shows 88 percent were in favor, and WHEREAS, as required, the Certificate of Results of Canvas of the Special Election, were filed in the Office of the Town Clerk and Office of the Fire District Clerk, earlier today, November 19, 2025. See Attachment C. Carried Town Board November 19, 2025 4. Other Fire Department Business There being no further business to come before the Fire Commission, on motion of Commissioner Nambiar, Seconded by Commissioner King, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN OF MAMARONECK 1. Consideration to Award Bid - TA-25-12A - Parks Building & Sign Shop Facility Reconstruction Moved by Councilmember King, seconded by Councilmember Fiddelman, it was RESOLVED that the Town Board hereby awards base bid TA-25-12A - Parks Building & Sign Shop Facility Reconstruction with add Alternate #2 to Peter A. Camilli & Sons Construction LTD. for an amount not to exceed$2,500,048.00 and hereby authorizes the Town Administrator to execute the agreement and any related document necessary to carry out its implementation. Carried 3. Consideration of - Ambulance District Agreements Administrator Robson noted that this contract would be retroactive to February 2025. Moved by Councilmember Nambiar, seconded by Councilmember Fiddelman, it was RESOLVED that the Town Board hereby approves the extension of the Ambulance District Contracts with MEMS and LVAC for two years and hereby authorizes the Town Administrator to execute the agreements and any related documents necessary to carry out their implementation. Carried 4. Consideration to Set a Public Hearing - Proposed Local Law - "Temporary Suspension of Chapter 99 of the Code of the Town of Mamaroneck" Town Attorney William Maker explained that Chapter 99 of the Town Code governs filming within the Town. A production company has proposed a filming project that would not be able to comply with the current restrictions related to timing and number of permitted filming days. The proposed local law would temporarily suspend certain provisions of Chapter 99 to allow the project to proceed. Attorney Maker added that the company would be required to pay applicable filming fees, compensate residents, Town Board November 19, 2025 and likely compensate neighbors impacted by the production. Equipment trailers would be staged at Bonnie Briar Country Club, and filming would occur periodically rather than daily through the end of May 2026. Councilmember Nambiar noted that the Board would be welcoming public comment on this proposal at the December 3, 2025, Public Hearing and encouraged residents with concerns to attend and share their input. Consideration of - Renewal of Mutual Aid & Rapid Response Plan 2025-2030 Administrator Robson explained that this is a renewal of the countywide mutual aid plan as applies to the Police Department. The agreement provides for assistance from other municipalities in situations where resources beyond the Town's normal response levels are needed to address and mitigate an emergency. The plan is reciprocal, meaning the Town may call upon outside municipalities for assistance and, in return, agrees to aid when requested. The Administrator noted that this is a routinely renewed standard agreement. Moved by Councilmember Nichinsky, seconded by Councilmember Fiddelman, it was RESOLVED, that the Town Board hereby approves the renewal of the Mutual Aid and Rapid Response Plan Intermunicipal Agreement with Westchester County for July 31, 2025, through July 30, 2030, and hereby authorizes the Town Administrator to execute the agreement and any related documents necessary to carry out its implementation. Consideration to Set Public Hearing - Property Tax Levy in Excess of the Limit Established in General Municipal Law Town Attorney Maker explained that under New York State law, municipalities are limited in the amount by which they may increase the property tax levy each year. However, the law also permits a municipality to adopt a local law authorizing a tax levy in excess of the statutory cap, if necessary. Attorney Maker stated that it is often prudent to have such a local law in place as a safeguard if unforeseen circumstances, such as last-minute budget changes or cost increases, could otherwise push the Town above the allowable limit and potentially result in a shortfall or deficit. Councilmember Fiddelman noted that the Town has adopted this override local law annually for many years. Supervisor Elkind Eney emphasized that the Town does not intend to exceed the tax cap but that the measure serves as a safety net should unexpected expenses arise, such as increases in health insurance rates. Councilmember Nichinsky commented that, unlike school district budgets which are voted on by the community, the Town Board adopts the Town budget.
