Robson,Town Administrator Allison May,Town Clerk Richard Polcari,Building Inspector From: William Maker,Jr., Attorney for the Town Subject: Energy Code Date: February 13,2026 New York State has upgraded the standards for energy efficient construction. To keep pace, the Town must amend its Code to incorporate the changes made by the State. In collaboration with the Building Inspector,I prepared the attached proposed local law. If the Town Board considers this proposed law worthy of public discussion, it may set a public hearing and after the hearing is closed, decide whether to enact it. (11 p!., Page 7 of 82 Local Law No. -2026 This local law shall be known as the "Adoption of the Updated NYStretch Energy Code" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 -Purpose: To protect and promote the public health, safety, and welfare of its residents by requiring compliance with energy efficient building standards, in 2021, the Town Board adopted the NYStretch Energy Code 2020, published by the New York State Energy Research and Development Authority. On December 31 2025, the State of New York adopted the 2025 Energy Conservation Code of New York State (2025 ECCCNYS). The Town Board recognizes that parts of the NYStretch Energy Code 2020 are more restrictive than parts of the 2025 ECCCNYS but other parts are not. The Town Board wishes to make the more stringent requirements for energy efficient construction in both the NYStretch Energy Code 2020 and the 2025 ECCCNYS applicable to construction in the unincorporated area of the Town of Mamaroneck. Acting pursuant to New York Energy Law§11-109(1), the Town Board updates the Town Code by incorporating into it the most energy efficient building standards of both the NYStretch Energy Code 2020 and the 2025 ECCCNYS. Section 2-Amendment of a current section of the Mamaroneck Code: Section 106-40.1 of the Code of the Town of Mamaroneck is repealed and the following is substituted in its place: §106-40.1 Adoption of NY Stretch Energy Code 2020 A. The NYStretch Energy Code 2020 shall apply to all new construction, substantial renovations, alterations and additions in the unincorporated area of the Town of Mamaroneck with respect to properties for which a building permit was issued prior to December 31, 2025. B. All new construction, substantial renovations, alterations and additions in the unincorporated area of the Town of Mamaroneck with respect to properties for which a building permit was applied on or after December 31, 2025 shall comply with both the NYStretch Energy Code 2020 and the 2025 ECCCNYS. In those areas where the NYStretch Energy Code 2020 imposes more stringent requirements for energy efficient construction than the 2025 ECCCNYS does, the NYStretch Energy Code 2020 shall apply. In those areas where the 2025 ECCCNYS imposes more stringent requirements for energy efficient construction than the NYStretch Energy Code 2020 does, the 2025 ECCCNYS shall apply. Page 8 of 82 C. Notwithstanding the foregoing, the more stringent requirements for energy efficient construction imposed by 2025 ECCCNYS shall not apply to persons who either have or will have obtained building permits or have or will have submitted complete applications for building permits prior to the effective date of this law. Section 3—Severabili[ : Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4—Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Robson, Town Administrator Re: Firearms Training Agreement Date: February 25, 2026 Attached is a proposed agreement between the Town of Mamaroneck and Westchester County to receive access to their firing range facility for firearms training. Although there are costs associated with the Range stipulated in the agreement, since we send our own training officer for our training sessions and we also assist the County in covering other trainings if necessary, there is ultimately no cost to the Town. Action Requested: Resolved that the Town Board hereby approves the agreement with Westchester County for access to their firing range facility for firearms training and hereby authorizes the Town Administrator to execute the agreement and any related documents necessary to carry out its implementation. Attachment/s: Police Firing Range Agreement 2026 Page 10 of 82 THIS AGREEMENT ("Agreement"),made _ ,by and between: THE COUNTY OF WESTCHESTER, a municipal corporation of the State of New York, having an office and place of business in the Michaelian Office Building, 148 Martine Avenue, White Plains, New York 10601 (hereinafter referred to as the "County") and THE TOWN OF MAMARONECK, a municipal corporation of the State of New York, having an office and place of business at 740 West Boston Post Road, Mamaroneck,New York 10543 (hereinafter referred to as the "Municipality") WITNESSETH: WHEREAS, the County, acting by and through the Westchester County Department of Public Safety Services (hereinafter referred to as the "Department"), has a firing range facility ("Firing Range") located at the County's Police Academy in Valhalla,New York, also known as the Grasslands Reservation, in the Town of Mount Pleasant, New York ("Police Academy"). This eighteen (18) point state-of-the-art Firing Range has an advanced targeting system and can accommodate duty side arms and most patrol rifles carried by law enforcement personnel in this County; and WHEREAS, Municipality desires to send its public safety employees to the Firing Range for firearms training purposes,upon the terms and conditions set forth below. NOW,THEREFORE, in consideration of the terms and conditions herein contained, the parties agree as follows: Section 1. The County and the Municipality agree that the Municipality may utilize the Firing Range by sending public safety employees to the Firing Range for firearms training, subject to availability. The Municipality may utilize the Firing Range during the hours of 8:00 am to 4:00 pm, or 4:00 pm to 12:00 am. Advance reservations will be required in order to use the Firing Range. The Municipality must contact the Department by telephone to determine availability and make a reservation at least forty-eight (48) hours prior to the desired firearms training session. Promptly thereafter, at least twenty-four (24) hours prior to the reservation Page 11 of 82 date, the Municipality shall send via facsimile or email a written confirmation letter to the Department specifying the dates and times reserved. The Department's Firing Range telephone number is (914) 231-4381 and the facsimile number is (914) 231-4389. It is hereby understood by the Municipality that an email will be provided by the Department's Firing Range personnel upon a telephonic request for the same from the Municipality. Section 2. In exchange for the use of the Firing Range, which will be staffed by a Department safety officer, the Municipality shall pay a flat fee of Six Hundred and Thirty ($630.00) Dollars per eight (8) hour tour, for a maximum number of thirty-six (36) officers in attendance. The Firing Range shall be operated under the direction of the safety officer. The Municipality shall adhere to all instructions issued by the Department's safety officer. A Municipality shall have the option of requesting the Department to provide a firearms instructor to assist with the training process of its employees. If the Municipality requests a firearms instructor, the Municipality shall pay an additional fee equal to $80.79 per hour or $646.32 per eight (8) hour tour. Anyone attending the Firing Range shall be responsible to bring his/her own weapons and ammunition. In the event that police officers from the Municipality provide instruction at the Police Academy under a separate agreement between the County and the Municipality, the Department's Commissioner or his duly authorized designee may provide such Municipality with a credit equal to one (1) eight (8) hour tour at the Firing Range for each seven (7) hours of instruction at the Police Academy. The County shall send an invoice to the Municipality not later than the 15th day of the month following the month in which the services were provided by the County. The Municipality shall pay any such invoice within thirty(30)days of receipt thereof. Section 3. The Municipality agrees to procure and maintain insurance naming the County as additional insured, as provided and described in Schedule "A," entitled "Standard Insurance Provisions", which is attached hereto and made a part hereof In addition to, and not in limitation of the insurance provisions contained in Schedule "A,"the Municipality agrees: 2 Page 12 of 82 (a) that except for the amount, if any, of damage contributed to, caused by, or resulting from the sole negligence of the County, the Municipality shall indemnify and hold harmless the County, its officers, employees, agents, and elected officials from and against any and all liability, damage, claims, demands, costs,judgments, fees, attorney's fees or loss arising directly or indirectly out of the performance or failure to perform hereunder by the Municipality or third parties under the direction or control of the Municipality; and (b) to provide defense for and defend, at its sole expense, any and all claims, demands or causes of action directly or indirectly arising out of this Agreement and to bear all other costs and expenses related thereto; and (c) In the event the Municipality does not provide the above defense and indemnification to the County, and such refusal or denial to provide the above defense and indemnification is found to be in breach of this provision, then the Municipality shall reimburse the County's reasonable attorney's fees incurred in connection with the defense of any action, and in connection with enforcing this provision of the Agreement. Section 4. In no event shall the County have any obligation to the Municipality or its employees for any claim raised or benefits provided pursuant to New York General Municipal Law Section 207-c. Section 5. The term of this Agreement shall commence upon execution and continue in full force and effect until July 31, 2030,unless terminated earlier pursuant to the terms herein. Section 6. This Agreement may be terminated by either party by giving written notice of such termination to the other party not less than thirty (30) days prior to the effective date of such termination. Section 7. All notices of any nature referred to in this Agreement shall be in writing and either sent by registered or certified mail postage pre-paid, or sent by hand or overnight courier, or sent by facsimile (with acknowledgment received and a copy of the notice sent by overnight courier), to the respective addresses set forth below or to such other addresses as the 3 Page 13 of 82 respective parties hereto may designate in writing. Notice shall be effective on the date of receipt. The failure of either party to insist upon strict performance of any term, condition or covenant herein shall not be deemed a waiver of any rights or remedies that the party may have, and shall not be deemed a waiver of any subsequent breach or default in the terms, conditions or covenants herein. Section 9. This Agreement and its attachments constitute the entire Agreement between the parties with respect to the subject matter hereof and shall supersede all previous negotiations, commitments and writings. It shall not be released, discharged, changed or modified except by an instrument in writing signed by a duly authorized representative of each of the parties. In the event of any conflict between the terms of this Agreement and the terms of any schedule or attachment hereto, it is understood that the terms of this Agreement shall be controlling with respect to any interpretation of the meaning and intent of the parties. Section 10. The Municipality and the County agree that the Municipality and its officers, employees, agents, Municipalities, subconsultants and/or consultants are independent contractors and not employees of the County or any department, agency or unit thereof In accordance with their status as independent contractors, the Municipality covenants and agrees that neither the Municipality nor any of its officers, employees, agents, contractors, subconsultants and/or consultants will hold themselves out as, or claim to be, officers or employees of the County or any department, agency or unit thereof 4 Page 14 of 82 Section 11. Municipality shall comply, at its own expense, with the provisions of all applicable local, state and federal laws,rules and regulations relating to this Agreement. Section 12. Nothing herein is intended or shall be construed to confer upon or give to any third party or its successors and assigns any rights, remedies or basis for reliance upon, under or by reason of this Agreement, except in the event that specific third party rights are expressly granted herein. Section 13. This Agreement may be executed simultaneously in several counterparts, each of which shall be an original and all of which shall constitute but one and the same instrument. This Agreement shall be construed and enforced in accordance with the laws of the State of New York. In addition, the parties hereby agree that for any cause of action arising out of this Agreement shall be brought in the County of Westchester. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid or void or unenforceable, the remainder of the terms and provisions of this Agreement shall in no way be affected, impaired, or invalidated, and to the extent permitted by applicable law, any such term, or provision shall be restricted in applicability or reformed to the minimum extent required for such to be enforceable. This provision shall be interpreted and enforced to give effect to the original written intent of the parties prior to the determination of such invalidity or unenforceability. Section 14. This Agreement shall not be enforceable until signed by both parties and approved by the Office of the County Attorney. Notary Public County Page 18 of 82 SCHEDULE "A" STANDARD INSURANCE PROVISIONS (MUNICIPALITY-Firing Range Agreement) 1. Prior to commencing work, and throughout the term of the Agreement, the Municipality shall obtain at its own cost and expense the required insurance as delineated below from insurance companies licensed in the State of New York, carrying a Best's financial rating of A or better. The Municipality shall provide evidence of such insurance to the County of Westchester ("County"), either by providing a copy of policies and/or certificates as may be required and approved by the Director of Risk Management of the County("Director"). The policies or certificates thereof shall provide that ten(10) days prior to cancellation or material change in the policy, notices of same shall be given to the Director either by overnight mail or personal delivery for all of the following stated insurance policies. All notices shall name the Municipality and identify the Agreement. If at any time any of the policies required herein shall be or become unsatisfactory to the Director, as to form or substance, or if a company issuing any such policy shall be or become unsatisfactory to the Director, the Municipality shall upon notice to that effect from the County, promptly obtain a new policy, and submit the policy or the certificate as requested by the Director to the Office of Risk Management of the County for approval by the Director. Upon failure of the Municipality to furnish, deliver and maintain such insurance, the Agreement, at the election of the County, may be declared suspended, discontinued or terminated. Failure of the Municipality to take out, maintain, or the taking out or maintenance of any required insurance, shall not relieve the Municipality from any liability under the Agreement, nor shall the insurance requirements be construed to conflict with or otherwise limit the contractual obligations of the Municipality concerning indemnification. All property losses shall be made payable to the "County of Westchester" and adjusted with the appropriate County personnel. In the event that claims, for which the County may be liable, in excess of the insured amounts provided herein are filed by reason of the Municipality's negligent acts or omissions under the Agreement or by virtue of the provisions of the labor law or other statute or any other reason, the amount of excess of such claims or any portion thereof, may be withheld from payment due or to become due the Municipality until such time as the Municipality shall furnish such additional security covering such claims in form satisfactory to the Director. In the event of any loss, if the Municipality maintains broader coverage and/or higher limits than the minimums identified herein, the County shall be entitled to the broader coverage and/or higher limits maintained by the Municipality. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the County. Page 19 of 82 2 The Municipality shall provide proof of the following coverage (if additional coverage is required for a specific agreement, those requirements will be described in the Agreement): a) Workers' Compensation and Employer's Liability. Certificate form C-105.2 or State Fund Insurance Company form U-26.3 is required for proof of compliance with the New York State Workers' Compensation Law. State Workers' Compensation Board form DB- 120.1 is required for proof of compliance with the New York State Disability Benefits Law. Location of operation shall be "All locations in Westchester County,New York." Where an applicant claims to not be required to carry either a Workers' Compensation Policy or Disability Benefits Policy, or both, the employer must complete NYS form CE- 200, available to download at: http://www.wcb.ny.gov. If the employer is self-insured for Workers' Compensation, he/she should present a certificate from the New York State Worker's Compensation Board evidencing that fact (Either SI-12, Certificate of Workers' Compensation Self-Insurance, or GSI-105.2, Certificate of Participation in Workers' Compensation Group Self-Insurance). b) Employer's Liability with minimum limit of$100,000.00. c) Commercial General Liability Insurance with a combined single limit of $1,000,000 (c.s.1)per occurrence and a $2,000,000 aggregate limit naming the "County of Westchester" as an additional insured on a primary and non-contributory basis. Dichter RE: Proposal for Monitoring Con Edison DATE: February 11,2026 Introduction While our participation in the Con Edison rate case was successful, it is also at an end. However, the end of the rate case does not mean that there isn't on-going work to do to protect your residents over the course of the next three years. Thus, during our recent video conference, I was asked to prepare a proposal for monitoring Con Ed during the three-year rate plan. The PSC decision does set out a level of increases over that span (for a typical Westchester residential customer, the estimated total bill impacts are 3.6%, 3.3% and 3.2% over the three years, down from Con Ed's initial proposal of about a 14% increase on residential electric rates. On the gas side, the estimated total residential bill increases are 2.4%, 7.8% and 5.6% down from 19% in Con Ed's initial proposal). However, the same PSC decision provides for a plethora of reports, reconciliations, adjustments clauses and proposals to be filed by Con Ed that can greatly impact the customer bill and quality of service. To give you an idea of the magnitude of the filings, in the three-year rate plan for Con Ed just completed, there were 588 filings in the rate case by all the parties prior to the PSC Order deciding the rate case. In the three years thereafter, there were 534 submissions. Almost all by Con Edison that will go unchecked, from Westchester's perspective, without monitoring the submissions and responding thereto when necessary. These filings can find their way into substantial additional surcharges added to the customer bill over the three years and a deferral of costs for recovery by Con Ed in the next rate case. A partial list of the types of submissions to be reviewed is below. Page 28 of 82 Westchester Municipal Consortium Page 2 February 11, 2026 Monitoring: The breath and scope of the reporting touches on almost all aspects of Con Edison's operations. The reporting includes: • Quarterly reports on capital spending projects. • Earnings reports to see if exceeds allowed rate of return. • Quarterly affordability reports based upon such measures as uncollectible, delinquencies and assistance programs. • Revenue Adjustment Mechanism, which can result in surcharges to customers if sales targets are not met or costs rise more than anticipated. • Non-wire solutions and alternatives. • Reconciliations of property taxes. • Earning Adjustments for meeting incentives. • IT spending. • 5-year forecast. • Annual Reporting. • Clean Energy reporting, such as gas emissions. • Reliability, safety and customer service performance metrics. • Rate Years 2 and 3 analyses for compliance. Generic Proceedings: In addition to the submissions in the rate case docket,there are other on-going generic proceedings before the Commission that impact all customers. For example,the PSC commenced a proceeding on the"Grid of the Future"to study meeting future demands for electricity. Correspondingly,there are proceedings on Electric Transmission Planning and Electric Vehicle requirements. New proceedings, such as the impact of AI data centers, are on the horizon. Appearances in these proceedings, even with limited submissions,lets the Commission know that Westchester is a voice to be heard, not just in rate cases, but in the development of policies affecting the manner, rates and quality of service. WMC Provisions in Joint Proposal: The Commission order provides for an annual meeting on capital projects between Con Ed and WMC. Con Ed is required to identify the projects scheduled for Westchester as compared to the investment in New York City. This will not only permit us to have input on the selected projects Page 29 of 82 Westchester Municipal Consortium Page 3 February 11, 2026 but determine if Westchester is receiving its fair share of investment dollars. We are looking at the week after Spring Break or sometime in April for the first meeting. The PSC Order also approves the analysis of network(underground)verses non-network(overhead) costs of service. In fact, the PSC Order goes so far as to call it a study. The Commission's decision rejects opposition to the analysis stating: "Finally,citing pre-filed testimony,such opponents appear to oppose a JP provision requiring the Company to prepare an informational analysis intended to distinguish the embedded costs of service between network and non-network facilities. They complain that such a study provides speculative benefits at best.The group does not indicate any specific reason for their opposition to the informational analysis. Given that the cost behind the study has not been demonstrated to be a substantive element of the Rate Plans, we see no reason to disturb the signatory parties'agreement requiring the Company to conduct such study." Per the settlement, a meeting will be convened between Con Ed and WMC representatives to go over the parameters for the study to determine if Westchester(and Staten Island)residents served by primarily by overheard wires are subsidizing NYC residents served by a more reliable and expensive underground grid system. There will also be a working group on property tax disclosures on the customer bill. Proposal: To monitor submissions, respond thereto, when necessary, participate in the WMC specific meetings, and provide periodic updates to our Consortium, we would propose an annual fixed fee for each of the rate years —We have had this arrangement with Rye, Rye Brook and Port Chester to monitor Veolia Water rate plans—The fee would be shared between my law firm and our expert in the rate case, Dr. Ben Johnson. We propose a flat fee of$60,000 per annum ($1,500 per year for each WMC member, if all 40 participate). If we do not include the generic proceedings, the annual fee would be reduced to $50,000, or $1,250 per member per year. It has been a privilege to represent all of your municipalities. Charging Rate Cost Comparison & Adjustment The Town of Mamaroneck's current fee rate of$0.30 per kWh was set through the original adoption of Local Law No. 3-2020 and has not been adjusted to account for current electrical supply and station maintenance costs. Please refer to the attached summary table of regional rates as obtained through the ChargePoint Station Network portal. The Engineering Depai tiiient recommends increasing the Town's fee rate to $0.40 per kWh that remains below the surveyed regional average of$0.44 per kWh and helps the Town to cover station operating costs for data subscriptions and maintenance. It should be noted that the survey table excludes public EV chargers in the Village of Mamaroneck Hunter Lot and Westchester County Center that do not charge for electrical power. Visitors to these charging stations remain responsible for other conventional parking fees charged by the respective government owner. Madison Ave Traffic Signal (H3361) Developer fees of$250,000 for the Madison Avenue green infrastructure/traffic signal project has a remaining balance in the traffic signal project. A budget amendment is recommended below to transfer the remaining funds to the Green Infrastructure Project. 2. Trails End Water Main (H1404) The water main at trails end was replaced under budget. A budget amendment to close this project and transfer remaining funds to the Water Fund is recommended below. 3. Rye Lake Filtration Plant(H1364) The project budget was increased by $1.4 million and the Town's share is 16.7% or an additional $233,800. The Town is participating in the EFC subsidized loan that will save taxpayers over$6m in interest expense over 30 years. A budget amendment is recommended below to reflect the additional expenses and the updated funding. 4.Water Infrastructure Paving (H1368) The Westchester Joint Water Works (WJWW) is focusing on the Rye Lake Filtration Project. We typically provide funding annually for paving restoration for water projects that arise during the year. As such, we have $510k currently available that is not anticipated to be needed in 2026. A budget recommendation to return $260,000 of this funding to the Water Fund is recommended below. Page 39 of 82 5. Town Center-Backup Boilers (H1614) The capital budget has funding for the replacement of the Town Center backup boilers. They are still functioning and the vendor has recommended that they be replaced when needed. A budget amendment to return these funds to the General Fund is recommended below. 6. Town Center Furniture-Engineering (H2496) Remaining funds for the replacement of furniture for the Engineer's office as part of the Town Center renovation is available to be returned to the General Fund. A budget amendment to return these funds to the General Fund is recommended below. 7. Drone (H3120) Insurance funding was received to replace the police department drone that malfunctioned. A small balance remains. A budget amendment is recommended below to transfer that balance to the Part Town Fund and close the project. 8. Police Department Evidence Container (H3186) An outside storage container was purchased to store large evidence items. A small balance is needed to complete the funding of the purchase. A budget amendment is recommended below to transfer funds from the Part Town Fund and close the project. 9. Fire Dept- Concrete/Shed (H3429) The concrete pad and shed at the Fire Department was completed and funds remain. A budget amendment is recommende3d below to transfer these funds back to the Fire department and close the project. 10. Parks Building (H5191) The Town was awarded NYSERDA funding of$200k for the Parks building heat pump upgrade. The current project budget includes $175k in funding. To keep pace, the Town must amend its Code to incorporate the changes made by the State. In collaboration with the Building Inspector,I prepared the attached proposed local law. If the Town Board considers this proposed law worthy of public discussion, it may set a public hearing and after the hearing is closed, decide whether to enact it. (11 p!., Page 47 of 82 Local Law No. -2026 This local law shall be known as the "Adoption of the Updated NYStretch Energy Code" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 -Purpose: To protect and promote the public health, safety, and welfare of its residents by requiring compliance with energy efficient building standards, in 2021, the Town Board adopted the NYStretch Energy Code 2020, published by the New York State Energy Research and Development Authority. On December 31 2025, the State of New York adopted the 2025 Energy Conservation Code of New York State (2025 ECCCNYS). The Town Board recognizes that parts of the NYStretch Energy Code 2020 are more restrictive than parts of the 2025 ECCCNYS but other parts are not. The Town Board wishes to make the more stringent requirements for energy efficient construction in both the NYStretch Energy Code 2020 and the 2025 ECCCNYS applicable to construction in the unincorporated area of the Town of Mamaroneck. Acting pursuant to New York Energy Law§11-109(1), the Town Board updates the Town Code by incorporating into it the most energy efficient building standards of both the NYStretch Energy Code 2020 and the 2025 ECCCNYS. Section 2-Amendment of a current section of the Mamaroneck Code: Section 106-40.1 of the Code of the Town of Mamaroneck is repealed and the following is substituted in its place: §106-40.1 Adoption of NY Stretch Energy Code 2020 A. The NYStretch Energy Code 2020 shall apply to all new construction, substantial renovations, alterations and additions in the unincorporated area of the Town of Mamaroneck with respect to properties for which a building permit was issued prior to December 31, 2025. B. All new construction, substantial renovations, alterations and additions in the unincorporated area of the Town of Mamaroneck with respect to properties for which a building permit was applied on or after December 31, 2025 shall comply with both the NYStretch Energy Code 2020 and the 2025 ECCCNYS. In those areas where the NYStretch Energy Code 2020 imposes more stringent requirements for energy efficient construction than the 2025 ECCCNYS does, the NYStretch Energy Code 2020 shall apply. In those areas where the 2025 ECCCNYS imposes more stringent requirements for energy efficient construction than the NYStretch Energy Code 2020 does, the 2025 ECCCNYS shall apply. Page 48 of 82 C. Notwithstanding the foregoing, the more stringent requirements for energy efficient construction imposed by 2025 ECCCNYS shall not apply to persons who either have or will have obtained building permits or have or will have submitted complete applications for building permits prior to the effective date of this law. Section 3—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Attachment/s: Police Firing Range Agreement 2026 Page 50 of 82 THIS AGREEMENT ("Agreement"),made _ ,by and between: THE COUNTY OF WESTCHESTER, a municipal corporation of the State of New York, having an office and place of business in the Michaelian Office Building, 148 Martine Avenue, White Plains, New York 10601 (hereinafter referred to as the "County") and THE TOWN OF MAMARONECK, a municipal corporation of the State of New York, having an office and place of business at 740 West Boston Post Road, Mamaroneck,New York 10543 (hereinafter referred to as the "Municipality") WITNESSETH: WHEREAS, the County, acting by and through the Westchester County Department of Public Safety Services (hereinafter referred to as the "Department"), has a firing range facility ("Firing Range") located at the County's Police Academy in Valhalla,New York, also known as the Grasslands Reservation, in the Town of Mount Pleasant, New York ("Police Academy"). This eighteen (18) point state-of-the-art Firing Range has an advanced targeting system and can accommodate duty side arms and most patrol rifles carried by law enforcement personnel in this County; and WHEREAS, Municipality desires to send its public safety employees to the Firing Range for firearms training purposes,upon the terms and conditions set forth below. NOW,THEREFORE, in consideration of the terms and conditions herein contained, the parties agree as follows: Section 1. The County and the Municipality agree that the Municipality may utilize the Firing Range by sending public safety employees to the Firing Range for firearms training, subject to availability. The Municipality may utilize the Firing Range during the hours of 8:00 am to 4:00 pm, or 4:00 pm to 12:00 am. Advance reservations will be required in order to use the Firing Range. The Municipality must contact the Department by telephone to determine availability and make a reservation at least forty-eight (48) hours prior to the desired firearms training session. Promptly thereafter, at least twenty-four (24) hours prior to the reservation Page 51 of 82 date, the Municipality shall send via facsimile or email a written confirmation letter to the Department specifying the dates and times reserved. The Department's Firing Range telephone number is (914) 231-4381 and the facsimile number is (914) 231-4389. It is hereby understood by the Municipality that an email will be provided by the Department's Firing Range personnel upon a telephonic request for the same from the Municipality. Section 2. In exchange for the use of the Firing Range, which will be staffed by a Department safety officer, the Municipality shall pay a flat fee of Six Hundred and Thirty ($630.00) Dollars per eight (8) hour tour, for a maximum number of thirty-six (36) officers in attendance. The Firing Range shall be operated under the direction of the safety officer. The Municipality shall adhere to all instructions issued by the Department's safety officer. A Municipality shall have the option of requesting the Department to provide a firearms instructor to assist with the training process of its employees. If the Municipality requests a firearms instructor, the Municipality shall pay an additional fee equal to $80.79 per hour or $646.32 per eight (8) hour tour. Anyone attending the Firing Range shall be responsible to bring his/her own weapons and ammunition. In the event that police officers from the Municipality provide instruction at the Police Academy under a separate agreement between the County and the Municipality, the Department's Commissioner or his duly authorized designee may provide such Municipality with a credit equal to one (1) eight (8) hour tour at the Firing Range for each seven (7) hours of instruction at the Police Academy. The County shall send an invoice to the Municipality not later than the 15th day of the month following the month in which the services were provided by the County. The Municipality shall pay any such invoice within thirty(30)days of receipt thereof. Section 3. The Municipality agrees to procure and maintain insurance naming the County as additional insured, as provided and described in Schedule "A," entitled "Standard Insurance Provisions", which is attached hereto and made a part hereof In addition to, and not in limitation of the insurance provisions contained in Schedule "A,"the Municipality agrees: 2 Page 52 of 82 (a) that except for the amount, if any, of damage contributed to, caused by, or resulting from the sole negligence of the County, the Municipality shall indemnify and hold harmless the County, its officers, employees, agents, and elected officials from and against any and all liability, damage, claims, demands, costs,judgments, fees, attorney's fees or loss arising directly or indirectly out of the performance or failure to perform hereunder by the Municipality or third parties under the direction or control of the Municipality; and (b) to provide defense for and defend, at its sole expense, any and all claims, demands or causes of action directly or indirectly arising out of this Agreement and to bear all other costs and expenses related thereto; and (c) In the event the Municipality does not provide the above defense and indemnification to the County, and such refusal or denial to provide the above defense and indemnification is found to be in breach of this provision, then the Municipality shall reimburse the County's reasonable attorney's fees incurred in connection with the defense of any action, and in connection with enforcing this provision of the Agreement. Section 4. In no event shall the County have any obligation to the Municipality or its employees for any claim raised or benefits provided pursuant to New York General Municipal Law Section 207-c. Section 5. The term of this Agreement shall commence upon execution and continue in full force and effect until July 31, 2030,unless terminated earlier pursuant to the terms herein. Section 6. This Agreement may be terminated by either party by giving written notice of such termination to the other party not less than thirty (30) days prior to the effective date of such termination. Section 7. All notices of any nature referred to in this Agreement shall be in writing and either sent by registered or certified mail postage pre-paid, or sent by hand or overnight courier, or sent by facsimile (with acknowledgment received and a copy of the notice sent by overnight courier), to the respective addresses set forth below or to such other addresses as the 3 Page 53 of 82 respective parties hereto may designate in writing. Notice shall be effective on the date of receipt. This Agreement and its attachments constitute the entire Agreement between the parties with respect to the subject matter hereof and shall supersede all previous negotiations, commitments and writings. It shall not be released, discharged, changed or modified except by an instrument in writing signed by a duly authorized representative of each of the parties. In the event of any conflict between the terms of this Agreement and the terms of any schedule or attachment hereto, it is understood that the terms of this Agreement shall be controlling with respect to any interpretation of the meaning and intent of the parties. Section 10. The Municipality and the County agree that the Municipality and its officers, employees, agents, Municipalities, subconsultants and/or consultants are independent contractors and not employees of the County or any department, agency or unit thereof In accordance with their status as independent contractors, the Municipality covenants and agrees that neither the Municipality nor any of its officers, employees, agents, contractors, subconsultants and/or consultants will hold themselves out as, or claim to be, officers or employees of the County or any department, agency or unit thereof 4 Page 54 of 82 Section 11. Municipality shall comply, at its own expense, with the provisions of all applicable local, state and federal laws,rules and regulations relating to this Agreement. Section 12. Nothing herein is intended or shall be construed to confer upon or give to any third party or its successors and assigns any rights, remedies or basis for reliance upon, under or by reason of this Agreement, except in the event that specific third party rights are expressly granted herein. Section 13. This Agreement may be executed simultaneously in several counterparts, each of which shall be an original and all of which shall constitute but one and the same instrument. This Agreement shall be construed and enforced in accordance with the laws of the State of New York. In addition, the parties hereby agree that for any cause of action arising out of this Agreement shall be brought in the County of Westchester. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid or void or unenforceable, the remainder of the terms and provisions of this Agreement shall in no way be affected, impaired, or invalidated, and to the extent permitted by applicable law, any such term, or provision shall be restricted in applicability or reformed to the minimum extent required for such to be enforceable. This provision shall be interpreted and enforced to give effect to the original written intent of the parties prior to the determination of such invalidity or unenforceability. Section 14. This Agreement shall not be enforceable until signed by both parties and approved by the Office of the County Attorney. Prior to commencing work, and throughout the term of the Agreement, the Municipality shall obtain at its own cost and expense the required insurance as delineated below from insurance companies licensed in the State of New York, carrying a Best's financial rating of A or better. The Municipality shall provide evidence of such insurance to the County of Westchester ("County"), either by providing a copy of policies and/or certificates as may be required and approved by the Director of Risk Management of the County("Director"). The policies or certificates thereof shall provide that ten(10) days prior to cancellation or material change in the policy, notices of same shall be given to the Director either by overnight mail or personal delivery for all of the following stated insurance policies. All notices shall name the Municipality and identify the Agreement. If at any time any of the policies required herein shall be or become unsatisfactory to the Director, as to form or substance, or if a company issuing any such policy shall be or become unsatisfactory to the Director, the Municipality shall upon notice to that effect from the County, promptly obtain a new policy, and submit the policy or the certificate as requested by the Director to the Office of Risk Management of the County for approval by the Director. Upon failure of the Municipality to furnish, deliver and maintain such insurance, the Agreement, at the election of the County, may be declared suspended, discontinued or terminated. Failure of the Municipality to take out, maintain, or the taking out or maintenance of any required insurance, shall not relieve the Municipality from any liability under the Agreement, nor shall the insurance requirements be construed to conflict with or otherwise limit the contractual obligations of the Municipality concerning indemnification. All property losses shall be made payable to the "County of Westchester" and adjusted with the appropriate County personnel. Dichter RE: Proposal for Monitoring Con Edison DATE: February 11,2026 Introduction While our participation in the Con Edison rate case was successful, it is also at an end. However, the end of the rate case does not mean that there isn't on-going work to do to protect your residents over the course of the next three years. Thus, during our recent video conference, I was asked to prepare a proposal for monitoring Con Ed during the three-year rate plan. The PSC decision does set out a level of increases over that span (for a typical Westchester residential customer, the estimated total bill impacts are 3.6%, 3.3% and 3.2% over the three years, down from Con Ed's initial proposal of about a 14% increase on residential electric rates. On the gas side, the estimated total residential bill increases are 2.4%, 7.8% and 5.6% down from 19% in Con Ed's initial proposal). However, the same PSC decision provides for a plethora of reports, reconciliations, adjustments clauses and proposals to be filed by Con Ed that can greatly impact the customer bill and quality of service. To give you an idea of the magnitude of the filings, in the three-year rate plan for Con Ed just completed, there were 588 filings in the rate case by all the parties prior to the PSC Order deciding the rate case. In the three years thereafter, there were 534 submissions. Almost all by Con Edison that will go unchecked, from Westchester's perspective, without monitoring the submissions and responding thereto when necessary. These filings can find their way into substantial additional surcharges added to the customer bill over the three years and a deferral of costs for recovery by Con Ed in the next rate case. A partial list of the types of submissions to be reviewed is below. Page 68 of 82 Westchester Municipal Consortium Page 2 February 11, 2026 Monitoring: The breath and scope of the reporting touches on almost all aspects of Con Edison's operations. The reporting includes: • Quarterly reports on capital spending projects. • Earnings reports to see if exceeds allowed rate of return. • Quarterly affordability reports based upon such measures as uncollectible, delinquencies and assistance programs. • Revenue Adjustment Mechanism, which can result in surcharges to customers if sales targets are not met or costs rise more than anticipated. • Non-wire solutions and alternatives. • Reconciliations of property taxes. • Earning Adjustments for meeting incentives. • IT spending. • 5-year forecast. • Annual Reporting. • Clean Energy reporting, such as gas emissions. • Reliability, safety and customer service performance metrics. • Rate Years 2 and 3 analyses for compliance. Generic Proceedings: In addition to the submissions in the rate case docket,there are other on-going generic proceedings before the Commission that impact all customers. For example,the PSC commenced a proceeding on the"Grid of the Future"to study meeting future demands for electricity. Correspondingly,there are proceedings on Electric Transmission Planning and Electric Vehicle requirements. New proceedings, such as the impact of AI data centers, are on the horizon. Appearances in these proceedings, even with limited submissions,lets the Commission know that Westchester is a voice to be heard, not just in rate cases, but in the development of policies affecting the manner, rates and quality of service. WMC Provisions in Joint Proposal: The Commission order provides for an annual meeting on capital projects between Con Ed and WMC. Con Ed is required to identify the projects scheduled for Westchester as compared to the investment in New York City. This will not only permit us to have input on the selected projects Page 69 of 82 Westchester Municipal Consortium Page 3 February 11, 2026 but determine if Westchester is receiving its fair share of investment dollars. We are looking at the week after Spring Break or sometime in April for the first meeting. The PSC Order also approves the analysis of network(underground)verses non-network(overhead) costs of service. In fact, the PSC Order goes so far as to call it a study. The Commission's decision rejects opposition to the analysis stating: "Finally,citing pre-filed testimony,such opponents appear to oppose a JP provision requiring the Company to prepare an informational analysis intended to distinguish the embedded costs of service between network and non-network facilities. They complain that such a study provides speculative benefits at best.The group does not indicate any specific reason for their opposition to the informational analysis. Given that the cost behind the study has not been demonstrated to be a substantive element of the Rate Plans, we see no reason to disturb the signatory parties'agreement requiring the Company to conduct such study." Per the settlement, a meeting will be convened between Con Ed and WMC representatives to go over the parameters for the study to determine if Westchester(and Staten Island)residents served by primarily by overheard wires are subsidizing NYC residents served by a more reliable and expensive underground grid system. There will also be a working group on property tax disclosures on the customer bill. Proposal: To monitor submissions, respond thereto, when necessary, participate in the WMC specific meetings, and provide periodic updates to our Consortium, we would propose an annual fixed fee for each of the rate years —We have had this arrangement with Rye, Rye Brook and Port Chester to monitor Veolia Water rate plans—The fee would be shared between my law firm and our expert in the rate case, Dr. Ben Johnson. We propose a flat fee of$60,000 per annum ($1,500 per year for each WMC member, if all 40 participate). If we do not include the generic proceedings, the annual fee would be reduced to $50,000, or $1,250 per member per year. It has been a privilege to represent all of your municipalities. Charging Rate Cost Comparison & Adjustment The Town of Mamaroneck's current fee rate of$0.30 per kWh was set through the original adoption of Local Law No. 3-2020 and has not been adjusted to account for current electrical supply and station maintenance costs. Please refer to the attached summary table of regional rates as obtained through the ChargePoint Station Network portal. The Engineering Depai tiiient recommends increasing the Town's fee rate to $0.40 per kWh that remains below the surveyed regional average of$0.44 per kWh and helps the Town to cover station operating costs for data subscriptions and maintenance. It should be noted that the survey table excludes public EV chargers in the Village of Mamaroneck Hunter Lot and Westchester County Center that do not charge for electrical power. Visitors to these charging stations remain responsible for other conventional parking fees charged by the respective government owner. Idle Fee Implementation Idle fees are assessed to EV charging customers whose vehicles that remain connected after the charging session is completed. State Grant-Document Scanning (B80102-3089) The revenue budget for the state grant requires an adjustment as funding was received in 2024. A budget recommendation is recommended below to reduce the revenue account to reflect 2025 revenues. Adult Recreation Programs (A7620) Additional Adult recreation instructors were needed based on enrollment and classes in 2025. A budget amendment is recommended to increase the budget line and the associated fee revenue. Police Department(B3120) A budget transfer from contingency for contract settlement expenses. A budget amendment is recommended below to transfer funds. Legal Retainers Additional legal services were needed for the Zoning and Planning boards, A budget amendment is recommended below to fund the additional cost from savings. Madison Ave Traffic Signal (H3361) Developer fees of$250,000 for the Madison Avenue green infrastructure/traffic signal project has a remaining balance in the traffic signal project. A budget amendment is recommended below to transfer the remaining funds to the Green Infrastructure Project. 2. Trails End Water Main (H1404) The water main at trails end was replaced under budget. A budget amendment to close this project and transfer remaining funds to the Water Fund is recommended below. 3. Rye Lake Filtration Plant(H1364) The project budget was increased by $1.4 million and the Town's share is 16.7% or an additional $233,800. The Town is participating in the EFC subsidized loan that will save taxpayers over$6m in interest expense over 30 years. A budget amendment is recommended below to reflect the additional expenses and the updated funding. 4.Water Infrastructure Paving (H1368) The Westchester Joint Water Works (WJWW) is focusing on the Rye Lake Filtration Project. We typically provide funding annually for paving restoration for water projects that arise during the year. As such, we have $510k currently available that is not anticipated to be needed in 2026. A budget recommendation to return $260,000 of this funding to the Water Fund is recommended below. Page 79 of 82 5. Town Center-Backup Boilers (H1614) The capital budget has funding for the replacement of the Town Center backup boilers. They are still functioning and the vendor has recommended that they be replaced when needed. A budget amendment to return these funds to the General Fund is recommended below. 6. Town Center Furniture-Engineering (H2496) Remaining funds for the replacement of furniture for the Engineer's office as part of the Town Center renovation is available to be returned to the General Fund. A budget amendment to return these funds to the General Fund is recommended below. 7. Drone (H3120) Insurance funding was received to replace the police department drone that malfunctioned. A small balance remains. A budget amendment is recommended below to transfer that balance to the Part Town Fund and close the project. 8. Police Department Evidence Container (H3186) An outside storage container was purchased to store large evidence items. A small balance is needed to complete the funding of the purchase. A budget amendment is recommended below to transfer funds from the Part Town Fund and close the project. 9. Fire Dept- Concrete/Shed (H3429) The concrete pad and shed at the Fire Department was completed and funds remain. A budget amendment is recommende3d below to transfer these funds back to the Fire department and close the project. 10. Parks Building (H5191) The Town was awarded NYSERDA funding of$200k for the Parks building heat pump upgrade. The current project budget includes $175k in funding.
