The Town currently operates (8) public EV charging ports over its network of(4) charging stations. The Town's current fee rate of$0.30 per kWh is below the average of public available EV charging stations found in surrounding communities. Charging Rate Cost Comparison & Adjustment The Town of Mamaroneck's current fee rate of$0.30 per kWh was set through the original adoption of Local Law No. 3-2020 and has not been adjusted to account for current electrical supply and station maintenance costs. Please refer to the attached summary table of regional rates as obtained through the ChargePoint Station Network portal. The Engineering Depai tiiient recommends increasing the Town's fee rate to $0.40 per kWh that remains below the surveyed regional average of$0.44 per kWh and helps the Town to cover station operating costs for data subscriptions and maintenance. It should be noted that the survey table excludes public EV chargers in the Village of Mamaroneck Hunter Lot and Westchester County Center that do not charge for electrical power. Visitors to these charging stations remain responsible for other conventional parking fees charged by the respective government owner. Idle Fee Implementation Idle fees are assessed to EV charging customers whose vehicles that remain connected after the charging session is completed. Vehicles that fail to vacate the parking stall after charging limit availability of the station to other potential users. Wasp, P.E., C.D.T. engineering@townofmamaroneckNY.gov •FOUNDED1661• Town Engineer The following is a summary of recommended terms for implementation of a new Idle Fee: • Proposed Structure: A fee of$5.00 per hour. • Grace Period: Idle fees begin only after a 30-minute grace period once the charging session is complete. **The Town's Chargepoint station management portal allows customization for hours/days of the week when Idle fees are applicable but does not allow different grace periods (i.e. 30 mins versus 6 hours) to be programmed as part of that schedule. • Regional Context: The recommended fee aligns with neighboring communities such as Scarsdale and New Rochelle. **The Engineering Department has not located any regional EV charging stations that limit the hours where Idle fees are assessed. Recommendation The Engineering Department recommends that the Town Board consider increasing its EV charging station fee rate to $0.40 per kWh rate and adopt a new $5.00/hour Idle Fee. Robson, Town Administrator CC: Pamela Valenza, Town Assessor Re: Senior Citizen with Limited Income Exemptions Date: March 4, 2026 The Town currently offers a "Senior Citizen with Limited Income" tax exemption for qualified residents. Approximately 226 residents benefit from these exemptions as result of their "income" falling at or below the maximum level of$58,399.99. The tax exemption calculations directly impact the Town's final assessment roll. In her memo, Assessor Pamela Valenza outlines 2 methods which may be utilized to determine tax exemption calculations. Currently, the Town uses Method 1. At this time, Pamela is requesting the Board review the methods to determine whether or not they would like to change the exemptions offered. If the Board decides to continue using Method 1, no action is needed at this time. Should the Board wish to adopt a different method, a local law will need to be drafted. Approximately 226 parcels benefit from this exemption as result of resident(s)"income"falling at or below the maximum level of$58,399.99. This exemption decreased the Town's 2025 taxable assessed value by$61,000,000,or approximately $117,000 yearly. The County of Westchester adopted an alternate New York State method of calculating income that does not include "untaxed social security benefits."This new methodology was implemented on our 2025 assessment roll for County tax purposes only and resulted in approximately 36 more seniors qualifying for the exemption in contrast to the Town's methodology of including untaxed social security benefits for Town tax purposes.Based on our 2025 assessment roll exemption data,the impact to the Town in aligning with the County's adopted income methodology would be a decrease the Town's taxable assessment of approximately $6,300,000,or an additional$15,200 yearly. If the Town decides to remain with the current option,no action is required. • Page 1 Page 8 of 28 METHODOLOGY OPTIONS SENIOR CITIZEN (467): Both options are identical but vary with the inclusion or exclusion of untaxed Social Security benefits. METHOD 1: (NYS default criteria, currently used for Town tax purposes,) Income includes untaxed Social Security benefits. • Take the amount shown on Form 1040 Line 11(Federal Adjusted Gross Income) • Add the amount shown on Form 1040 Line 2a(Tax-exempt interest) • Subtract the amount shown on Form 1040 Line 4b(Taxable IRA distributions). • Add the non-taxable Social Security benefits. Robson, Town Administrator Allison May,Town Clerk Richard Polcari,Building Inspector From: William Maker,Jr.,Attorney for the Town Subject: Revision in the setback requirements for central air conditioning units Date: February 27, 2026 The Building Inspector has opined that the Town's current side and rear yard setback requirements for central air conditioning systems has become antiquated due to improvements in technology that have reduced the noise generated by such systems significantly. I attach a proposed local law that, if adopted, will amend section 240-59 of the Code to reduce the side and rear yard setback for central air conditioning systems to five feet. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board. for a report as required by Mamaroneck Town Code §240-92B. 11\ Page 11 of 28 Local Law No. -2026 This local law shall be known as the "Setback Requirements for Air-Conditioning Systems" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1-PurPose: On December 5, 2001, the Town Board passed Local Law No. 8 of 2001 which added section 240-59 to the Code of the Town of Mamaroneck. That new section regulated the location of central air conditioning systems by requiring them to comply with the setback requirements of the zoning districts in which they were placed. The primary concern at that time was to create distance between neighboring properties to lessen the impact of the noise created by central air conditioning systems. Twenty-five years later, technology has evolved to the point that central air conditioning systems no longer generate significant noise. As a result, the Board of Appeals has granted variances from the setback requirements on a regular basis. The Town Board has determined that section 240-59 should be amended due to current technological advances. In 2025, of the 80 applications for variances heard by that Board in 2025, 23 were for variances from the setback requirements for central air conditioning systems. By doing so, not only will the Code be modernized but the number of applications to the Board of Appeals should be reduced. Section 2-Amendment of a current section of the Mamaroneck Code: Section 240-59 of the Code of the Town of Mamaroneck hereby is amended by adding the following new Subsection D. D. The side and rear yard setbacks requirements for a central air conditioning system shall be 5 feet notwithstanding the side and rear yard setback requirements of the zoning district in which a central air conditioning system is installed. Section 3-Severabilityv: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Attachment/s: Disclosure policy 02-27-26 Page 14 of 28 Policy for Compliance with the Notification Required In connection with Disclosure of Disciplinary Records New York Public Officers Law § 87(6) requires agencies subject to the Freedom of Information Law (article 6 of the Public Officers Law) to develop a policy for notifying their former and current employes of requests for the disciplinary proceedings brought against them. The following is the Town's policy for complying with New York Public Officers Law§ 87(6) (1) When used in this policy, the term "employee"means both current and former employees of the Town of Mamaroneck. (2) Upon receipt of a request for the disciplinary records of an employee,the Town's records access officer shall send written notice of such request to the employee as soon as possible. That notice may be either hand delivered to the employee, or mailed, by certified and first class mail, to the employee in an envelope addressed to him or her at the last postal address known to the Town for the employee, or transmitted to the employee by electronic mail if the record access officer is reasonably certain that such electronic mail address is the employee's then current electronic mail address. The Town shall not be obligated to assure that an employee actually receives such notice. (3) If asked by the employee, the Town's records access officer shall provide the employee with a copy of the request for the employee's disciplinary records and the response given to the person making such request. (4) Nothing in this policy shall be construed as providing an employee greater rights to object to the release of the employee's disciplinary records than the rights provided to that employee by article 6 of the Public Officers Law. (5) Responding to a request for disciplinary records before an employee receives notice of the request will not be a violation of this Policy. (6) The Town Board may amend this policy from time to time. Robson, Town Administrator Allison May,Town Clerk Richard Polcari,Building Inspector From: William Maker,Jr.,Attorney for the Town Subject: Revision in the setback requirements for central air conditioning units Date: February 27, 2026 The Building Inspector has opined that the Town's current side and rear yard setback requirements for central air conditioning systems has become antiquated due to improvements in technology that have reduced the noise generated by such systems significantly. I attach a proposed local law that, if adopted, will amend section 240-59 of the Code to reduce the side and rear yard setback for central air conditioning systems to five feet. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board. for a report as required by Mamaroneck Town Code §240-92B. 1+11\ Page 24 of 28 Local Law No. -2026 This local law shall be known as the "Setback Requirements for Air-Conditioning Systems" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1-PurPose: On December 5, 2001, the Town Board passed Local Law No. 8 of 2001 which added section 240-59 to the Code of the Town of Mamaroneck. That new section regulated the location of central air conditioning systems by requiring them to comply with the setback requirements of the zoning districts in which they were placed. The primary concern at that time was to create distance between neighboring properties to lessen the impact of the noise created by central air conditioning systems. Twenty-five years later, technology has evolved to the point that central air conditioning systems no longer generate significant noise. As a result, the Board of Appeals has granted variances from the setback requirements on a regular basis. The Town Board has determined that section 240-59 should be amended due to current technological advances. In 2025, of the 80 applications for variances heard by that Board in 2025, 23 were for variances from the setback requirements for central air conditioning systems. By doing so, not only will the Code be modernized but the number of applications to the Board of Appeals should be reduced. Section 2-Amendment of a current section of the Mamaroneck Code: Section 240-59 of the Code of the Town of Mamaroneck hereby is amended by adding the following new Subsection D. D. The side and rear yard setbacks requirements for a central air conditioning system shall be 5 feet notwithstanding the side and rear yard setback requirements of the zoning district in which a central air conditioning system is installed. Section 3-Severabilityv: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Attachment/s: Disclosure policy 02-27-26 Page 27 of 28 Policy for Compliance with the Notification Required In connection with Disclosure of Disciplinary Records New York Public Officers Law § 87(6) requires agencies subject to the Freedom of Information Law (article 6 of the Public Officers Law) to develop a policy for notifying their former and current employes of requests for the disciplinary proceedings brought against them. The following is the Town's policy for complying with New York Public Officers Law§ 87(6) (1) When used in this policy, the term "employee"means both current and former employees of the Town of Mamaroneck. (2) Upon receipt of a request for the disciplinary records of an employee,the Town's records access officer shall send written notice of such request to the employee as soon as possible. That notice may be either hand delivered to the employee, or mailed, by certified and first class mail, to the employee in an envelope addressed to him or her at the last postal address known to the Town for the employee, or transmitted to the employee by electronic mail if the record access officer is reasonably certain that such electronic mail address is the employee's then current electronic mail address. The Town shall not be obligated to assure that an employee actually receives such notice. (3) If asked by the employee, the Town's records access officer shall provide the employee with a copy of the request for the employee's disciplinary records and the response given to the person making such request. (4) Nothing in this policy shall be construed as providing an employee greater rights to object to the release of the employee's disciplinary records than the rights provided to that employee by article 6 of the Public Officers Law. (5) Responding to a request for disciplinary records before an employee receives notice of the request will not be a violation of this Policy.
