Robson, Town Administrator Allison May, Town Clerk From: William Maker,Jr., Attorney for the Town Subject: Waiver of fess for land use approvals under limited circumstances Date: June 26,2025 At the Town Board's May 7th meeting, the Board referred to the Planning Board a proposed local law that will excuse payment of a fee to renew certain land use approvals. The Building Inspector pointed out to me that the law as proposed would not aid persons whose approvals already had expired. Consequently,I stopped the referral to the Planning Board to allow me to advise this Board of the Building Inspector's observation and to propose a variation for this Board to consider, my logic being that rather than ask the Planning Board to review two laws, it would be better for the Town Board to entertain (or reject) my suggestion so that the Planning Board will only have one proposed law to analyze. I attach a revised proposal which, in a redline of the law that the Board has seen, carves out an exception from the general rule, that to avoid having to pay fees, a request to extend must be made before an approval expires, for persons whose approvals already have or will expire in 2025 so long as they apply by January 30,2026(the 31st being a Saturday).Since the law,if enacted, will not go into effect until near the end of the third quarter of this year, at the earliest, this timeline affords a '2025 expiree' three to four months to take advantage of the exception. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board.for a report as required by Mamaroneck Town Code§240-92B. Page 5 of 109 Local Law No. -2025 This local law shall be known as the "Waiver of Fees for Renewing Variances or Site Plan Approvals or Wetlands Permits" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Variances, site plan approvals and wetland permits expire if building permits for the work they approved are not issued within a fixed time period. There are times when the Building Inspector cannot issue a building permit for the work authorized by a variance within the statutory time period because an agency outside the Town's jurisdiction (e.g. the Army Corps of Engineers) must grant its approval before the Building Inspector can act. Similarly, a property owner may obtain a variance to do restorative work necessitated by a natural disaster for which the owner is eligible for financial aid from an outside source but either the owner has not received such aid, or the outside source has not acted upon the property owner's request for such aid. These same situations occur for persons who have been issued site plan approvals (residential or commercial) or wetlands permits. To preserve their variances, site plan approvals or wetland permits, persons are required to pay a fee to renew them. The Town Board finds that a property owner should have one reprieve from having to pay a renewal fee when a building permit is not issued for one of the reasons recited above. Section 2—Addition of a new section to the Mamaroneck Code: The Code of the Town of Mamaroneck hereby is amended to add a new section 240-91 thereto. §240-91 Waiver of Fees under Certain Limited Circumstances. A. As used in this article, the following terms shall have the meanings indicated: Outside Agency A governmental agency that is not affiliated with or under the control of the Town. Town Approval A variance, a site plan approval granted pursuant to either Chapter 177 or Chapter 178 of the Code of the Town of Mamaroneck or a wetlands permit. Page 6 of 109 B. A person shall not be required to pay a fee for requesting the extension of a Town Approval if either (1) approval by an Outside Agency is required before a building permit can be issued for the work permitted by the Town Approval or (2) the application. for Town Approval arose out of a natural disaster which makes the owner or the applicant entitled to financial aid from a municipal agency and (i) the owner or the applicant has filed for the approval of such Outside Agency or for such financial aid and (if) the owner or the applicant produces satisfactory evidence to the Building Department showing that the approval from such Outside Agency or the approval of financial aid has been prosecuted diligently and either (lll) the approval of such Outside Agency has not been obtained or the claim for financial aid was approved but the owner or the applicant has not received such aid or (iv) a decision on whether the owner or the applicant is entitled to receive financial aid has not been made. C. A person is entitled to have the fee for requesting the extension of a Town Approval waived once for each Town.Approval that such person seeks to extend. D. To be eligible for an exemption from paying the fees for requesting the extension of a Town Approval, the holder of such approval must apply for such extension before the Town A royal. ex Tres. As counsel to and on behalf of the Planning Board, I hereby report that at the August 13 regular meeting of the Planning Board, members unanimously expressed support for the proposed law entitled "Waiver of Fees for Renewing Variances or Site Plan Approvals or Wetlands Permits." Planning Board members further stated that the proposed local law should not be limited to municipal agencies; it should also be applicable to state and federal agencies and also in the case of private insurance. Robson,Town Administrator Allison May, Town Clerk From: William Maker,Jr.,Attorney for the Town Subject: Elimination of Renewals for one type of Special Permit Date: July 18, 2025 I attach a proposed local law that, if adopted, will amend section 240-64 of the Code to eliminate the need to renew special permits issued for the construction of multifamily dwellings. (Section 240-4 of the Code defines a multifamily dwelling as "[a] building or portion thereof containing three or more dwelling units"). To facilitate your review, I attach a copy of existing section 240-64. The purpose of the law is to provide equivalent treatment for multifamily dwellings in the Service Business-Residential District and the Business-Residential District. Currently, permission for a multifamily dwelling on property located in the Service Business-Residential District requires a special permit from the Planning Board which must be renewed every two years. On the other hand,approval of a multifamily dwelling on property located in the Business- Residential District undergoes only a one-time site plan review. There is no reason for this disparity. This law would continue to require a special permit from the Planning Board for a multifamily dwelling on property in the Service Business-Residential District;however,it would eliminate the need to have that permit renewed periodically. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board.for a report as required by Mamaroneck Town Code§240-92B. Page 11 of 109 Local Law No. -2025 This local law shall be known as the "Elimination of Renewals of Special Permits for Multifamily Dwellings" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Under the Town's zoning ordinance, the Service Business-Residential District allows multifamily dwellings only pursuant to a special permit issued by the Planning Board. In contrast, the Business-Residential District allows multifamily dwellings as of right but requires an applicant to obtain site plan approval. Thus, permission from the Planning Board for a multifamily dwelling is required for properties in each of these districts. Where the disparity in procedure becomes problematic is section 240-64 of the zoning ordinance. That section limits the maximum duration of special permits to two years at which time they must be renewed. Approved site plans, on the other hand, do not have to be renewed. While periodic review of certain uses may be appropriate as a means of judging their effect upon the community, multifamily dwellings are not such a use. If it were, the Town would have made multifamily dwellings in the Business-Residential District a special use, requiring a special permit that periodically would have to be renewed instead of allowing it to be regulated by the Planning Board only once through site plan review. This local law eliminates that disparity by ending the requirement to renew special permits for multifamily dwellings in the Service Business-Residential District. Section 2—Amendment of a current section of the Mamaroneck Code: Section 240-64 of the Code of the Town of Mamaroneck hereby is repealed, and the following is substituted in its place: §240-64 Conditions and safeguards. The Planning Board shall attach such conditions and safeguards to the special permit as are necessary to ensure continued conformity with all applicable standards and requirements. Except in the case of multifamily dwellings, special permits shall be issued for a period of no more than two years. Before the expiration of a special permit, the holder of that permit must apply for an extension of the special permit and demonstrate that there has been no change in circumstances in the area which would require the Planning Board to deny such extension. Special permits for multifamily dwellings, whether issued before, on or after the effective date of this local law, shall be for an indefinite duration. Page 12 of 109 Section 3-Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. If the Town Board considers this proposed law worthy of public discussion, it may set a public hearing and after the hearing is closed, decide whether to enact it. Page 16 of 109 Local Law No. -2025 This local law shall be known as the "Year-Round Use of Non-Gasoline-Powered Leaf Blowers" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1-Purpose: The absolute prohibition on the use of leaf blowers during the summer months was enacted at a time when most leaf blowers were powered by noisy gasoline motors. Now that the use of gasoline-powered leaf blowers has been outlawed and there are modern leaf blowers, powered by electricity, that produce less sound when operating, the Town Board finds that there is no need to continue the absolute prohibition on the use of leaf blowers during the summer months. Section 2-Amendment of a current section of the Mamaroneck Code: Section 141-18 B. of the Code of the Town of Mamaroneck hereby is repealed, and the following is substituted in its place: "B. It shall be lawful to use a leaf blower that is not a gasoline-powered leaf blower in the unincorporated area of the Town of Mamaroneck during any month of the year except at those times and on those days where use of leaf blowers is prohibited by§ 141-18 A." Section 3-Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4-Effective Date: This Local Law shall become effective upon filing with the Secretary of State. August 15,2025 Page 17 of 109 Article Ill Restrictions on Operation of Leaf Blowers [Adopted 5-8-2024 by L.L. No. 1-2024] § 141-15 Title. This article shall be known as "Restrictions on the Operation of Leaf Blowers." § 141-16 Purpose. A. In 1995, citing the unacceptable noise levels heard by residents in dozens of homes surrounding the site where a gasoline-powered leaf blower is being used, the negative impact of their constant use on the peace, quiet, health and welfare of the community, and noting that their use diminishes the quality of life in our community, the Town passed a local law that limited the use of such devices to certain months and to certain hours. B. Much more is now known about the effects of gasoline-powered leaf blowers upon the environment. They emit greenhouse gases into the atmosphere and noxious fumes at ground level that can be inhaled by persons and animals in the vicinity of their use. They generate a louder noise over a longer distance than leaf blowers that are not powered by internal combustion engines. Moreover, advances in technology have made electric-powered leaf blowers increasingly more efficient and a viable alternative to gas-powered ones. C. Accordingly, the Town Board finds that for the benefit of the overall health and welfare of the community, the use of gasoline-powered leaf blowers in the unincorporated area of the Town of Mamaroneck should be phased out. § 141-17 Definitions. As used in this article,the following terms shall have the meanings indicated: GASOLINE-POWERED LEAF BLOWER Any leaf blower powered by an internal combustion engine which discharges a stream of forced air and which is used or designed to move grass, leaves, clippings, dust, dirt or other matter by blowing them with air emitted by such device. A leaf blower which itself is not powered by an internal combustion engine but is being used while plugged into a generator which is powered by an internal combustion engine shall be deemed a gasoline-powered leaf blower. LEAF BLOWER Any motorized device that is used or designed to move grass, leaves, clippings, dust, dirt or other matter by blowing them with air emitted by such device. PERSON An individual, a firm, an association, a partnership, a limited liability company or a corporation. § 141-18 Restrictions. A. Times of day when operation of leaf blowers is unlawful. It shall be unlawful for any person in the unincorporated area of the Town to operate any leaf blower before 8:0o a.m. or after 9:00 p.m. on any weekday and before io:oo a.m. or after 5:oo p.m. on Saturdays, Sundays and on New Year's Day, Dr. Martin Luther King, Jr. Day, Presidents Day, Memorial Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. B. Month i Page 18 of 109 C. Phase-out of gasoline-powered leaf blowers. On and after January 1, 2025, it shall be unlawful for any person in the unincorporated area of the Town to operate a gasoline-powered leaf blower. D. The restrictions contained in § 141-18A, B and C shall not apply to the Town of Mamaroneck, the County of Westchester, the State of New York, the Mamaroneck Union Free School District, utility companies or persons engaged by any of the foregoing to perform such work. E. The restriction contained in § 141-18C shall not apply to properties located in the zoning district known as the Recreation District: R. § 141-19 Suspension of Article Ill. In the case of a severe weather or non-weather-related event, the Supervisor, in such official's sole and unfettered discretion, may suspend this article for such period of time as the Supervisor deems necessary or desirable to protect the overall welfare of the residents of the unincorporated area of the Town. § 141-20 Penalties for offenses. A. A person shall be guilty of an offense if such person operates a leaf blower in violation of any provision of this article. B. A person shall be guilty of an offense if such person employs a person to operate a leaf blower and that person operates such leaf blower in violation of any provision of this article. C. A person who owns or leases property where a violation of this article occurs shall be guilty of an offense. D. Required items for approval include the RRFB checklist, a plan sheet showing the RRFB location and layout, and an RRFB detail. An agreement is established between the New York State Department of Transportation (hereinafter referred to as the Department) and the Requestor to provide for an RRFB at the location described above subject to the following conditions: Work and Equipment 1. All traffic signal equipment covered by this agreement, including,but not limited to beacon poles, foundations, signal heads, signals, light standards, wiring, power components, etc., shall conform to the standards and specifications of New York State, and no such equipment shall be installed without the prior written approval of the Department. 2. All work required to provide for the installation of the RRFB authorized by this agreement shall be performed under the supervision and to the satisfaction of the Department. 3. Following any installation, modification, replacement, or removal of the RRFB, the RRFB work area must be restored to its original condition. The Requestor is responsible for all work associated with restoration. Should the Requestor fail to restore the work area to its original condition, the Requestor shall reimburse the State for all costs incurred by the State for restoration of the work area. Page 28 of 109 4. Upon completion of construction of the above identified highway, the Requestor shall, at their own expense, maintain the RRFB on or along such highway. Such maintenance shall include, but not be limited to: • Repair of equipment which may be damaged from any cause. • Replacement of equipment which may be damaged from any cause, such replacement material to be of equal character to the replaced equipment and is contained on the NYSDOT Office of Traffic Safety and Mobility Qualified Products List (QPL) or Approved Product List(APL). • Furnishing power to the RRFB twenty-four hours a day, seven days a week, at no cost or obligation to the State. 5. The Requestor shall be responsible for any improvements on their property that are associated with the installation, modification, or operation of the RRFB. 6. It is the responsibility of the Requestor to notify the State immediately of any unsafe or hazardous conditions which would affect continued occupation of property whether actually or constructively known by Requestor. Beacon Requirements 1. All RRFB's shall meet the requirements in the current edition or the MUTCD and any applicable NYSDOT specifications 2. The RRFB shall normally be dark, shall initiate operation only upon pedestrian actuation, and shall cease operation at a predetermined time after the pedestrian actuation. This time should be calculated by adding 7 seconds to the calculated pedestrian clearance interval specified in the MUTCD. Work Permits and Insurance 1. Use of New York State highway right of way must be carried out and completed in accordance with terms and conditions of a highway work permit issued by the Commissioner of Transportation or his duly assigned agent, in accordance with New York State Highway Law, Article 3, Section 52. Securing a highway work permit requires the Requestor to post performance security, such as a Performance Surety Bond, Protective Liability Insurance, and provide documentation of having done so in a form acceptable to the Department. 2. Indemnification.New York State Department of Transportation shall not be liable for any damage or injury occurring to the Requestor, nor the Requestor's agents or employees, nor to any persons or property at the site for activities related to signal maintenance or construction whether such activities are performed by the Department, the Requestor's own forces, or by agents working on the Requestor's behalf. Requestor shall hold harmless, indemnify, and defend the People of the State of New York, the Department, and the Department's Commissioner, employees and agents against any losses, liabilities, and claims arising out of, or relating to personal injuries, wrongful Page 29 of 109 death, property damage, and/or environmental claims associated with the permitted work/operations. 3. Liability insurance. Requestor seeking an agreement to install a traffic signal permitted under 17 NYCRR section 125.11, shall be required to have a commercial general liability insurance policy with limits of liability of not less than $5,000,000 per claim/occurrence. Policies of insurance shall be endorsed to provide coverage to "The People of the State of New York and/or the Commissioner of Transportation and all employees of the State Department of Transportation" for claims arising from the agreement work. The required insurance shall be documented by means of a certificate of insurance, upon a form satisfactory to the department, furnished by the Requestor before the commencement of any work/operations. Self-insurance is permissible from municipalities, federal agencies, public authorities, public benefit corporations, public utilities, transportation corporations and railroads, by use of an undertaking agreement acceptable to the department. Self-insurance from other Requestors in lieu of the required liability insurance may be accepted upon satisfactory proof that Requestor has the financial resources and an established self-insurance program to adjust and pay liability claims. 4. Protective liability insurance requirements. In addition to the requirement to provide general liability coverage, if the estimated value of agreement work in state right-of-way is $250,000 or more, Requestor is required to provide protective liability insurance in connection with the construction. Such policy of protective liability insurance shall be issued to, in the name of and covering the liability of the "the People of the State of New York and/or the Commissioner of Transportation and all employees of the State Department of Transportation." Such policy shall carry limits of liability of not less than $1,000,000 per occurrence/$2,000,000 aggregate. The policy shall be written for the agreement project and shall be kept in force at the expense of the Requestor for the duration of the project. The policy shall provide primary coverage to the State of New York against any claim arising in any way from the agreement work within the area covered by the agreement. 5. Workers' Compensation and Disability Insurance.As required by State Finance Law §142 and Workers' Compensation Law Section 57, the Requestor shall maintain in force workers' compensation insurance upon forms required by or acceptable to the Workers Compensation Board for all of Permittee's employees. As required by Workers' Compensation Law Section 220 (8), Requestor shall also maintain disability insurance as required by the Disability Benefits Law of the State of New York. Agreement Responsibility 1. The person executing this agreement on behalf of the Requestor hereby certifies that the person has full authority to execute this agreement and, if the Requestor is a municipal board, the person has annexed hereto a certified copy of a resolution by such body authorizing that person to execute this agreement. Requestor is responsible for assuring that its occupancy shall be in compliance with all applicable Federal, state and local laws, ordinances, codes, rules and regulations affecting the use of the property for the purposes indicated within this agreement. 3. This agreement shall not be assigned or transferred without the prior written consent of the Commissioner of the New York State Department of Transportation. The Requestor shall notify the Department 30 days prior to the sale of the property identified above at which the RRFB has been installed and shall inform the buyer of the property of the existence of this agreement. The Requestor shall be responsible for the terms of this agreement until a new agreement is issued. 4. If any of the provisions of this agreement are held invalid, such invalidity shall not affect or impair other provisions herein which can be given effect without the invalid provisions, and to this end the provisions of this agreement are severable. 5. The Requestor shall not deny another party the use of the traffic signal to gain access to the state highway from another approach if required by the Department on such terms and conditions that the Department deems appropriate. 6. This agreement may be cancelled by the Department on thirty (30) days written notice except for cause, in which event cancellation may be made on ten (10) days written notice. 7. Attachment/s: RESOLUTIONS - WC Complete Streets 09 03 2025 Page 33 of 109 RESOLUTION # RESOLUTION DEMONSTRATING FINANCIAL COMMITMENT TO THE PROPOSED WESTCHESTER COUNTY COMPLETE STREETS PROJECT AND AUTHORIZATION TO EXECUTE A GRANT AGREEMENT WHEREAS, the Town of Mamaroneck is requesting grant funding through the Westchester County Complete Streets Municipal Assistance Program to support the "Town Safety and Economic Renaissance" Roundabout Project, which aims to address longstanding safety issues, harmful vehicle emissions, and resiliency challenges at the intersection of Madison Avenue,New Jefferson Street, and the I-95 Exit 17 ramp; and, WHEREAS, the Town determined a total project cost of$5,333,000 based on a cost estimate prepared for the project; and, WHEREAS, the Town received funding in the amount of$2,000,000, or 37% of the total project cost, through FY2024 Community Project Funding,which is allocated under the Transportation, Housing and Urban Development, and Related Agencies (THUD) spending bill; and, WHEREAS, the Town is seeking $2,666,500, or 50% of the total project cost, through the Westchester County Complete Streets Municipal Assistance Program; and, WHEREAS,the Town will provide the remaining balance of$666,500, or that which is not covered by grant funds, through municipal funds. THEREFORE,BE IT RESOLVED that this resolution, adopted by the Town Board of the Town of Mamaroneck on the 3rd of September 2025, demonstrates financial commitment to this project by combining the federal funding from the US Department of Transportation and the THUD spending bill with county funding through the Westchester County Complete Streets Municipal Assistance Program. The project scope involves the demolition of the existing 1 V/2 story structure and construction of a new modern building intended to serve the respective Town Highway Department operations. The new building was designed for compliance with all current commercial building codes and included numerous energy efficient design elements such as heat pumps, spray foam insulation and provisions for future integration of solar panels, EV charging and a backup generator. Bids for the project were previously rejected in June 2024 that resulted in several value engineering changes to be building design. The Town also entered into a Project Labor Agreement (PLA) with the Building & Construction Trades Council of Westchester and Putnam Counties, to serve for construction. Utilization of the PLA allows the Town to award a single-prime construction contract for the project, in lieu of separate prime contracts for individual trades as required by Wicks Law for contracts greater than $1.5M. On August 22nd, 2025, one (1) bid proposal was received as summarized on the attached bid tabulation table. The sole proposal was provided from "Pierotti Corp", at the total base bid of $2,898,500. The Town had positive experience working with Pierotti Corp as part of the Hommocks Rink Locker Room renovation. The submitted proposal amount remains significantly higher than the March 2025 construction estimate prepared by Calgi Construction based upon the modified building design. Additional bid proposals would have been desirable to better evaluate current construction market costs for the project. Additional cost reduction strategies have been identified for the Parks Building project. These include substitution of the proposed lighting controls equipment for a more economic system, and simplification of the finish on the building's exposed foundation surface. Installation of asphalt pavement in the parking lot and re-constructed walkways can also be structured as a contract "add- alternate" to provide the Town flexibility to potentially include the work as part of its regular annual Page 37 of 109 paving contract, without negatively impacting the project schedule. Based upon these considerations, the Engineering Depailment recommends that the submitted bid should be rejected to allow for incorporation of additional cost savings measures into the project. This budget year is still seeing a fluctuating economy. Interest rates are unstable, prices for purchases and projects remain in flux. The most significant revenues the Town relies upon include mortgage tax and sales tax revenue. As inflation causes general prices to increase, sales tax is expected to meet the budget. Although home sales are slow, mortgage tax is tracking slightly less than budget. The Town's finances are budgeted conservatively and monitored closely. As a result, it is anticipated that there are positive results in both the revenues and expenses through year end. REVENUES In total, revenues are collectively 5% higher in 2025 than 2024 for the first half of the fiscal year. It is anticipated that revenues will exceed the $53.1 million budget by $1.8 million mainly as a result of the water district fee increase for the Rye Lake Filtration Plant. The most significant budget variances are as follows: Tax Collection The 2025 Town & County tax collection began on April 1st and collection has been strong as usual. As of August 5,2025, the Town has collected 99.3% of the 2025 Town & County levy as compared to 99.2% of the 2024 levy. The The Town has the following outstanding taxes due as of August 5,2025: 2025 Town & County (.7% of levy) $557,811 2024/25 School Tax (.4% of levy) 595,301 2024 and Prior 1,079,916 Total Delinquent Taxes Due $2,233,028 Mortgage Tax Mortgage tax is based on an October- September fiscal year and is paid semi-annually in June and December of each year. The County Clerk has reported that the Town's mortgage tax for 6 months (October 2024 — March 2025) is $879k as compared to the same period in 2024 of$83 1k. Revenue is higher in 2025 by $63k or 6% on a year-to-date basis. 1 Page 46 of 109 The 2025 budget of $1.3m is based on the actual 2024 collections given the current financial climate, rising interest rates and the housing market. Year-to-date revenue represents 65% of the $1.3m budget as compared to 69% in 2024. Overall, if the trend continues, mortgage tax revenue will meet or slightly exceed the 2025 budget. As a point of reference, the average revenue for the 9 years prior to covid was $1.3 million. Interest rates were projected to decline this year, however they have only declined slightly over the past seven months. Annual revenue is estimated to exceed the $1.2 million budget by $$250k at this point. Tax Penalties/Interest The 2025 Adopted Budget anticipated legislation to be adopted that limited the penalty rates to the prime rate on delinquent taxes. That legislation has been vetoed by the Governor. As a result, penalty and interest revenue on late taxes are anticipated to exceed the budget of $557k by $193k, for a total of $750k in the General Fund. The projected revenue is much lower in 2025 than in 2024 as there are a few large penalties collected on houses with large outstanding balances. Building Permits Building permit revenue continues to remain strong and is anticipated to meet the $1.1m budget. EXPENSES The current expense savings is projected to be $1.0 million. This savings is largely a result of: Vacancies $165k, Employee benefits $583k and a water contingency of $300k for capital projects that has not yet been needed this year. The Town anticipated filling these vacancies in the coming months. Currently there are 4 vacant positions. You will note that the Part Town Fund and the Ambulance District Fund are anticipated to exceed their budget however they will be monitored and budget amendments will be submitted as needed. FUND BALANCE Although all of the fund balances are in compliance and anticipated to remain that way through year end, it is important to note that fluctuating pricing, interest rates and slowing home sales will be monitored and may continue to affect the projected use of fund balance. The fund balances below provides the Town with the resources to weather unexpected events. In addition, keep in mind that taxes are not collected until April of each year and we need to have at least $19m on hand for expenses for the first four months of each year. We also make the School and County whole each year for their levies. The Adopted Budget included the use of $2.2 million of fund balance. As a result of the revenue and expense positive variances outlined above, $1.7 million will be added to the Water fund balance for the Rye Lake Filtration Project and $748k will be utilized 3 Page 48 of 109 in all other funds. A net savings to budget of $1.0 million. To put that in perspective that is a 1.8% budget variance. Based on the current projection, the Town's fund balance will be 39% of revenues. This reflects the method in which Moody's performs the calculation as one of the criteria for the Town's bond rating. They have indicated during our last bond rating call that our fund balance should be at 40% of revenues to maintain the Town's AAA bond rating. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. The standard Seagrave Limited Warranty will apply as provided for in the mutually agreed specifications and change orders. The mutually agreed specifications and change order documents and approval drawing shall be delivered to the Purchaser for their signature in not more than 31 days from contract receipt at Seagrave or not more than five days from pre-construction meeting, if so provided. Delays due to change orders, strikes, failures to obtain materials, or other causes beyond Seagrave's control will be just cause for delay in delivery. If the contract includes Dealer Furnished Equipment and services,the apparatus will be delivered to the customer and payment made, less five (5)percent of the Contract Price that is held by the fire department until all items and services are provided by the Dealer. The 5%Final Payment and Acceptance will be made once the terms of the contract are satisfied by the Dealer. 5.1 This bid price does not include the impact of tariffs on imported goods implemented since January 01, 2025, as the application or impact of such tariffs is not currently clear. In the case that no final inspection is made by the Purchaser at the factory prior to shipment and the Purchaser desires to test the Apparatus and Equipment upon receipt, such test shall be made within three (3)days after arrival at the delivery destination specified above. A written report of such test shall be delivered forthwith to the Seller at its principal office at Clintonville, Wisconsin. If no such test be made, or if no such report be made by the Purchaser within three (3)days after arrival,then the Apparatus and Equipment shall be considered as fully complying with the contract specifications. 7. It is agreed that the Apparatus and Equipment covered by this contract shall remain the property of the Seller until the Apparatus and Equipment is delivered and accepted by the Purchaser, such acceptance shall not be unreasonably withheld or delayed. In the event that any applicable Federal or State Regulations(DOT,FMVSS,EPA, etc.),National Fire Protection Association Standards or import tariffs which are enacted during the course of this contract, and which requires a change in the contract specifications and purchase price in order for the Apparatus and Equipment to comply with such regulation,the parties will execute a change order describing the change in the specifications and increasing the purchase price by an amount equal to the increase in the costs of producing the Apparatus and Equipment. 9. Any dispute or claim relating to this contract shall be determined exclusively in the state courts located in New Castle County,Delaware. Each party hereby consents to and waives any objection to the exclusive jurisdiction of such courts. 10. Except for damages, claims or losses due to Seagrave's acts of gross negligence,Purchaser or user,to the extent permitted by law,will indemnify and hold Seagrave and Seagrave's property, free and harmless from any liability for losses,claims,injury to or death of any person,including Purchaser or user, or for damage to property arising from Purchaser or user using and possessing the Apparatus and Equipment or from the acts or omissions of any person or persons,including Purchaser or user,using or possessing the Apparatus and Equipment with Purchaser or user's express or implied consent. The Building Inspector pointed out to me that the law as proposed would not aid persons whose approvals already had expired. Consequently,I stopped the referral to the Planning Board to allow me to advise this Board of the Building Inspector's observation and to propose a variation for this Board to consider, my logic being that rather than ask the Planning Board to review two laws, it would be better for the Town Board to entertain (or reject) my suggestion so that the Planning Board will only have one proposed law to analyze. I attach a revised proposal which, in a redline of the law that the Board has seen, carves out an exception from the general rule, that to avoid having to pay fees, a request to extend must be made before an approval expires, for persons whose approvals already have or will expire in 2025 so long as they apply by January 30,2026(the 31st being a Saturday).Since the law,if enacted, will not go into effect until near the end of the third quarter of this year, at the earliest, this timeline affords a '2025 expiree' three to four months to take advantage of the exception. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board.for a report as required by Mamaroneck Town Code§240-92B. Page 68 of 109 Local Law No. -2025 This local law shall be known as the "Waiver of Fees for Renewing Variances or Site Plan Approvals or Wetlands Permits" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Variances, site plan approvals and wetland permits expire if building permits for the work they approved are not issued within a fixed time period. There are times when the Building Inspector cannot issue a building permit for the work authorized by a variance within the statutory time period because an agency outside the Town's jurisdiction (e.g. the Army Corps of Engineers) must grant its approval before the Building Inspector can act. Similarly, a property owner may obtain a variance to do restorative work necessitated by a natural disaster for which the owner is eligible for financial aid from an outside source but either the owner has not received such aid, or the outside source has not acted upon the property owner's request for such aid. These same situations occur for persons who have been issued site plan approvals (residential or commercial) or wetlands permits. To preserve their variances, site plan approvals or wetland permits, persons are required to pay a fee to renew them. The Town Board finds that a property owner should have one reprieve from having to pay a renewal fee when a building permit is not issued for one of the reasons recited above. Section 2—Addition of a new section to the Mamaroneck Code: The Code of the Town of Mamaroneck hereby is amended to add a new section 240-91 thereto. §240-91 Waiver of Fees under Certain Limited Circumstances. A. As used in this article, the following terms shall have the meanings indicated: Outside Agency A governmental agency that is not affiliated with or under the control of the Town. Town Approval A variance, a site plan approval granted pursuant to either Chapter 177 or Chapter 178 of the Code of the Town of Mamaroneck or a wetlands permit. Page 69 of 109 B. A person shall not be required to pay a fee for requesting the extension of a Town Approval if either (1) approval by an Outside Agency is required before a building permit can be issued for the work permitted by the Town Approval or (2) the application. for Town Approval arose out of a natural disaster which makes the owner or the applicant entitled to financial aid from a municipal agency and (i) the owner or the applicant has filed for the approval of such Outside Agency or for such financial aid and (if) the owner or the applicant produces satisfactory evidence to the Building Department showing that the approval from such Outside Agency or the approval of financial aid has been prosecuted diligently and either (lll) the approval of such Outside Agency has not been obtained or the claim for financial aid was approved but the owner or the applicant has not received such aid or (iv) a decision on whether the owner or the applicant is entitled to receive financial aid has not been made. C. A person is entitled to have the fee for requesting the extension of a Town Approval waived once for each Town.Approval that such person seeks to extend. D. To be eligible for an exemption from paying the fees for requesting the extension of a Town Approval, the holder of such approval must apply for such extension before the Town A royal. ex Tres. (Section 240-4 of the Code defines a multifamily dwelling as "[a] building or portion thereof containing three or more dwelling units"). To facilitate your review, I attach a copy of existing section 240-64. The purpose of the law is to provide equivalent treatment for multifamily dwellings in the Service Business-Residential District and the Business-Residential District. Currently, permission for a multifamily dwelling on property located in the Service Business-Residential District requires a special permit from the Planning Board which must be renewed every two years. On the other hand,approval of a multifamily dwelling on property located in the Business- Residential District undergoes only a one-time site plan review. There is no reason for this disparity. This law would continue to require a special permit from the Planning Board for a multifamily dwelling on property in the Service Business-Residential District;however,it would eliminate the need to have that permit renewed periodically. If the Town Board considers this revised law worthy of public discussion, it should refer it to the Planning Board.for a report as required by Mamaroneck Town Code§240-92B. Page 74 of 109 Local Law No. -2025 This local law shall be known as the "Elimination of Renewals of Special Permits for Multifamily Dwellings" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Under the Town's zoning ordinance, the Service Business-Residential District allows multifamily dwellings only pursuant to a special permit issued by the Planning Board. In contrast, the Business-Residential District allows multifamily dwellings as of right but requires an applicant to obtain site plan approval. Thus, permission from the Planning Board for a multifamily dwelling is required for properties in each of these districts. Where the disparity in procedure becomes problematic is section 240-64 of the zoning ordinance. That section limits the maximum duration of special permits to two years at which time they must be renewed. Approved site plans, on the other hand, do not have to be renewed. While periodic review of certain uses may be appropriate as a means of judging their effect upon the community, multifamily dwellings are not such a use. If it were, the Town would have made multifamily dwellings in the Business-Residential District a special use, requiring a special permit that periodically would have to be renewed instead of allowing it to be regulated by the Planning Board only once through site plan review. This local law eliminates that disparity by ending the requirement to renew special permits for multifamily dwellings in the Service Business-Residential District. Section 2—Amendment of a current section of the Mamaroneck Code: Section 240-64 of the Code of the Town of Mamaroneck hereby is repealed, and the following is substituted in its place: §240-64 Conditions and safeguards. August 15,2025 Page 80 of 109 Article Ill Restrictions on Operation of Leaf Blowers [Adopted 5-8-2024 by L.L. No. 1-2024] § 141-15 Title. This article shall be known as "Restrictions on the Operation of Leaf Blowers." § 141-16 Purpose. A. In 1995, citing the unacceptable noise levels heard by residents in dozens of homes surrounding the site where a gasoline-powered leaf blower is being used, the negative impact of their constant use on the peace, quiet, health and welfare of the community, and noting that their use diminishes the quality of life in our community, the Town passed a local law that limited the use of such devices to certain months and to certain hours. B. Much more is now known about the effects of gasoline-powered leaf blowers upon the environment. They emit greenhouse gases into the atmosphere and noxious fumes at ground level that can be inhaled by persons and animals in the vicinity of their use. They generate a louder noise over a longer distance than leaf blowers that are not powered by internal combustion engines. Moreover, advances in technology have made electric-powered leaf blowers increasingly more efficient and a viable alternative to gas-powered ones. C. Accordingly, the Town Board finds that for the benefit of the overall health and welfare of the community, the use of gasoline-powered leaf blowers in the unincorporated area of the Town of Mamaroneck should be phased out. § 141-17 Definitions. As used in this article,the following terms shall have the meanings indicated: GASOLINE-POWERED LEAF BLOWER Any leaf blower powered by an internal combustion engine which discharges a stream of forced air and which is used or designed to move grass, leaves, clippings, dust, dirt or other matter by blowing them with air emitted by such device. A leaf blower which itself is not powered by an internal combustion engine but is being used while plugged into a generator which is powered by an internal combustion engine shall be deemed a gasoline-powered leaf blower. LEAF BLOWER Any motorized device that is used or designed to move grass, leaves, clippings, dust, dirt or other matter by blowing them with air emitted by such device. PERSON An individual, a firm, an association, a partnership, a limited liability company or a corporation. § 141-18 Restrictions. A. Times of day when operation of leaf blowers is unlawful. It shall be unlawful for any person in the unincorporated area of the Town to operate any leaf blower before 8:0o a.m. or after 9:00 p.m. on any weekday and before io:oo a.m. or after 5:oo p.m. on Saturdays, Sundays and on New Year's Day, Dr. Martin Luther King, Jr. Day, Presidents Day, Memorial Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day. B. Month i Page 81 of 109 C. Phase-out of gasoline-powered leaf blowers. On and after January 1, 2025, it shall be unlawful for any person in the unincorporated area of the Town to operate a gasoline-powered leaf blower. D. The restrictions contained in § 141-18A, B and C shall not apply to the Town of Mamaroneck, the County of Westchester, the State of New York, the Mamaroneck Union Free School District, utility companies or persons engaged by any of the foregoing to perform such work. E. The restriction contained in § 141-18C shall not apply to properties located in the zoning district known as the Recreation District: R. § 141-19 Suspension of Article Ill. In the case of a severe weather or non-weather-related event, the Supervisor, in such official's sole and unfettered discretion, may suspend this article for such period of time as the Supervisor deems necessary or desirable to protect the overall welfare of the residents of the unincorporated area of the Town. § 141-20 Penalties for offenses. A. A person shall be guilty of an offense if such person operates a leaf blower in violation of any provision of this article. B. A person shall be guilty of an offense if such person employs a person to operate a leaf blower and that person operates such leaf blower in violation of any provision of this article. C. A person who owns or leases property where a violation of this article occurs shall be guilty of an offense. D. In any prosecution under this article, it is an affirmative defense that the person who owns the property where a violation of this article occurs: (1) Entered into an agreement with a tenant of such property that either allows the tenant to engage, or places upon the tenant the responsibility to engage persons who use leaf blowers; and (2) Did not engage the persons who used leaf blowers on the date and at the time specified in the summons issued to the owner. E. In any prosecution under this article, it is an affirmative defense that the person who leases the property where a violation of this article occurs: (1) Did not enter into an agreement with the owner of such property that either allows the tenant to engage, or places upon the tenant the responsibility to engage persons who use leaf blowers; and (2) Did not engage the persons who used leaf blowers on the date and at the time specified in the summons issued to the tenant. F. A person convicted of an offense under this article shall be punished as follows: (1) For the first offense during a calendar year, with a fine of not less than $125 and not more than $250; (2) For a second offense during the same calendar year, with a fine of not less than $25o and not more than $500; and (3) For additional offenses during the same calendar year, with a fine of $50o for each such offense. The current draft construction drawings are included with this agenda item. A Highway Work Permit, issued by NYSDOT, is required for the construction of the improvements within the State right-of-way. The permit application requires a municipal resolution authorizing installation of the improvements and execution of a maintenance agreement as provided from NYSDOT. The agreement outlines the Town's responsibility for installation, operation, and maintenance of the RRFBs and associated crossing improvements on the state highway. Required items for approval include the RRFB checklist, a plan sheet showing the RRFB location and layout, and an RRFB detail. An agreement is established between the New York State Department of Transportation (hereinafter referred to as the Department) and the Requestor to provide for an RRFB at the location described above subject to the following conditions: Work and Equipment 1. All traffic signal equipment covered by this agreement, including,but not limited to beacon poles, foundations, signal heads, signals, light standards, wiring, power components, etc., shall conform to the standards and specifications of New York State, and no such equipment shall be installed without the prior written approval of the Department. 2. All work required to provide for the installation of the RRFB authorized by this agreement shall be performed under the supervision and to the satisfaction of the Department. 3. Following any installation, modification, replacement, or removal of the RRFB, the RRFB work area must be restored to its original condition. The Requestor is responsible for all work associated with restoration. Should the Requestor fail to restore the work area to its original condition, the Requestor shall reimburse the State for all costs incurred by the State for restoration of the work area. Page 91 of 109 4. Upon completion of construction of the above identified highway, the Requestor shall, at their own expense, maintain the RRFB on or along such highway. Such maintenance shall include, but not be limited to: • Repair of equipment which may be damaged from any cause. • Replacement of equipment which may be damaged from any cause, such replacement material to be of equal character to the replaced equipment and is contained on the NYSDOT Office of Traffic Safety and Mobility Qualified Products List (QPL) or Approved Product List(APL). • Furnishing power to the RRFB twenty-four hours a day, seven days a week, at no cost or obligation to the State. 5. The Requestor shall be responsible for any improvements on their property that are associated with the installation, modification, or operation of the RRFB. 6. It is the responsibility of the Requestor to notify the State immediately of any unsafe or hazardous conditions which would affect continued occupation of property whether actually or constructively known by Requestor. Beacon Requirements 1. All RRFB's shall meet the requirements in the current edition or the MUTCD and any applicable NYSDOT specifications 2. The RRFB shall normally be dark, shall initiate operation only upon pedestrian actuation, and shall cease operation at a predetermined time after the pedestrian actuation. This time should be calculated by adding 7 seconds to the calculated pedestrian clearance interval specified in the MUTCD. Work Permits and Insurance 1. Use of New York State highway right of way must be carried out and completed in accordance with terms and conditions of a highway work permit issued by the Commissioner of Transportation or his duly assigned agent, in accordance with New York State Highway Law, Article 3, Section 52. Securing a highway work permit requires the Requestor to post performance security, such as a Performance Surety Bond, Protective Liability Insurance, and provide documentation of having done so in a form acceptable to the Department. 2. Indemnification.New York State Department of Transportation shall not be liable for any damage or injury occurring to the Requestor, nor the Requestor's agents or employees, nor to any persons or property at the site for activities related to signal maintenance or construction whether such activities are performed by the Department, the Requestor's own forces, or by agents working on the Requestor's behalf. Requestor shall hold harmless, indemnify, and defend the People of the State of New York, the Department, and the Department's Commissioner, employees and agents against any losses, liabilities, and claims arising out of, or relating to personal injuries, wrongful Page 92 of 109 death, property damage, and/or environmental claims associated with the permitted work/operations. 3. Liability insurance. Requestor seeking an agreement to install a traffic signal permitted under 17 NYCRR section 125.11, shall be required to have a commercial general liability insurance policy with limits of liability of not less than $5,000,000 per claim/occurrence. Policies of insurance shall be endorsed to provide coverage to "The People of the State of New York and/or the Commissioner of Transportation and all employees of the State Department of Transportation" for claims arising from the agreement work. The required insurance shall be documented by means of a certificate of insurance, upon a form satisfactory to the department, furnished by the Requestor before the commencement of any work/operations. Self-insurance is permissible from municipalities, federal agencies, public authorities, public benefit corporations, public utilities, transportation corporations and railroads, by use of an undertaking agreement acceptable to the department. Self-insurance from other Requestors in lieu of the required liability insurance may be accepted upon satisfactory proof that Requestor has the financial resources and an established self-insurance program to adjust and pay liability claims. 4. Protective liability insurance requirements. In addition to the requirement to provide general liability coverage, if the estimated value of agreement work in state right-of-way is $250,000 or more, Requestor is required to provide protective liability insurance in connection with the construction. Such policy of protective liability insurance shall be issued to, in the name of and covering the liability of the "the People of the State of New York and/or the Commissioner of Transportation and all employees of the State Department of Transportation." Such policy shall carry limits of liability of not less than $1,000,000 per occurrence/$2,000,000 aggregate. The policy shall be written for the agreement project and shall be kept in force at the expense of the Requestor for the duration of the project. The policy shall provide primary coverage to the State of New York against any claim arising in any way from the agreement work within the area covered by the agreement. 5. Workers' Compensation and Disability Insurance.As required by State Finance Law §142 and Workers' Compensation Law Section 57, the Requestor shall maintain in force workers' compensation insurance upon forms required by or acceptable to the Workers Compensation Board for all of Permittee's employees. As required by Workers' Compensation Law Section 220 (8), Requestor shall also maintain disability insurance as required by the Disability Benefits Law of the State of New York. Agreement Responsibility 1. The person executing this agreement on behalf of the Requestor hereby certifies that the person has full authority to execute this agreement and, if the Requestor is a municipal board, the person has annexed hereto a certified copy of a resolution by such body authorizing that person to execute this agreement. Requestor is responsible for assuring that its occupancy shall be in compliance with all applicable Federal, state and local laws, ordinances, codes, rules and regulations affecting the use of the property for the purposes indicated within this agreement. 3. This agreement shall not be assigned or transferred without the prior written consent of the Commissioner of the New York State Department of Transportation. The Requestor shall notify the Department 30 days prior to the sale of the property identified above at which the RRFB has been installed and shall inform the buyer of the property of the existence of this agreement. The Requestor shall be responsible for the terms of this agreement until a new agreement is issued. 4. If any of the provisions of this agreement are held invalid, such invalidity shall not affect or impair other provisions herein which can be given effect without the invalid provisions, and to this end the provisions of this agreement are severable. 5. The Requestor shall not deny another party the use of the traffic signal to gain access to the state highway from another approach if required by the Department on such terms and conditions that the Department deems appropriate. 6. This agreement may be cancelled by the Department on thirty (30) days written notice except for cause, in which event cancellation may be made on ten (10) days written notice. 7. Utilization of the PLA allows the Town to award a single-prime construction contract for the project, in lieu of separate prime contracts for individual trades as required by Wicks Law for contracts greater than $1.5M. On August 22nd, 2025, one (1) bid proposal was received as summarized on the attached bid tabulation table. The sole proposal was provided from "Pierotti Corp", at the total base bid of $2,898,500. The Town had positive experience working with Pierotti Corp as part of the Hommocks Rink Locker Room renovation. The submitted proposal amount remains significantly higher than the March 2025 construction estimate prepared by Calgi Construction based upon the modified building design. Additional bid proposals would have been desirable to better evaluate current construction market costs for the project. Additional cost reduction strategies have been identified for the Parks Building project. These include substitution of the proposed lighting controls equipment for a more economic system, and simplification of the finish on the building's exposed foundation surface. Installation of asphalt pavement in the parking lot and re-constructed walkways can also be structured as a contract "add- alternate" to provide the Town flexibility to potentially include the work as part of its regular annual Page 100 of 109 paving contract, without negatively impacting the project schedule. Based upon these considerations, the Engineering Depailment recommends that the submitted bid should be rejected to allow for incorporation of additional cost savings measures into the project.
