Ms. Cooney asked if all documents to be discussed this evening had been posted on the Town's website for more than 24 hours, Ms. Sheeky answered yes. MINUTES The Board discussed the draft minutes of the April 17, 2024,meeting. Motion: To adopt the draft minutes of April 17, 2024. Moved by Ira Block seconded by Edmund Papazian Action: Approved Abstained: Ron Mandel, Sarah Dunn Application #1 - 2399 Boston Post Road- 2399 Boston Post Road Rlty Co.- Site Plan, Wetlands & Watercourses Permit, Special Use Permit—Consideration Janet Giris and Anne Klein, counsel, Richard Hein, architect, Brian Dempsey, DTS Provident, Jeri Barrett, R.L.A., Joshua Turner, Thomas Kohany, Paul Jaehnig, Wetlands and Soil Consultant, Frank Cantatore, and Greg Katsaros,property owner, were present on behalf of the Applicant to address the Board. Ms. Giris presented revised plans for two (2)residential buildings with a total of thirty-six (36) units and fifty-eight (58)parking spaces. Ms. Giris stated that since their last appearance before the Planning Board at the January meeting, they have updated the application, including the acquisition of property at 14 Deane Place and elimination of a portion of the property at 2417 Boston Post Road. Ms. Giris explained that they recently learned that the applicant does not have title to a ten (10) foot strip on a portion of property located at 2417 Boston Post Road, which is shown on the site plan. She further explained that the acquisition of the parcel at 14 Deane Place would ensure that the project would comply with all zoning requirements while they continue to work to resolve the title issues at 2417 Boston Post Road. She further stated that they plan to demolish the existing single-family house at 14 Deane Place and the property will remain as open space. Representatives of the applicant and members of the Planning Board discussed the ten(10) foot strip of land on a portion of the 2417 Boston Post Road property. Ms. Giris stated that prior to the issuance of a building permit, all of the contiguous separate parcels which comprise the site plan will be merged to create one zoning lot. Ms. Giris further stated that if and when title issues for the disputed strip of property at 2417 Boston Post Road are resolved, the applicant intends to amend the site plan. Representatives of the applicant and members of the Planning Board discussed parking, with specific discussion of guest parking and parking with EV chargers. Representatives of the applicant and members of the Planning Board discussed potential traffic impacts. Ms. Giris stated that the Town Traffic Committee had met and expressed support for continuing to allow left turns in and out of the site. In response to prior comments by the Town and consulting engineers,representatives of the applicant and members of the Planning Board discussed issues related to public sewers and storm drains. Representatives of the applicant and members of the Planning Board discussed a previous oil spill at the site, which has been resolved, and plans for mitigation during construction, if necessary. Representatives of the applicant and members of the Planning Board and Ms. Aitchison, the Town Environmental Planner, discussed landscaping and trees. Ms. Aitchison stated that the application should be referred to the Town's Coastal Zone Management Commission, which is next scheduled to meet on May 20th. 2 Ms. Murray, Deputy Town Engineer, stated that staff would like to retain a consultant, at the applicant's expense, to review the potential impacts related to school attendance and traffic, based upon reports provided by the applicant. There were no objections stated by representatives of the applicant. Ms. Murray stated that the staff will make necessary referrals of the application to outside agencies and departments.
