2. Approval of Minutes
2.1. Approval of Minutes-April 29,2024
The minutes of the April 29, 2024 meeting were approved as amended.
3. Referrals
3.1. 5 Bishop Place Dock(Update from original 2023 application)
5 Bishop Place was before CZMC in January of 2023 for the proposed addition of a
dock. They reapplied to DEC/Army Corps of Engineers for the same dock permit this
in 2024 after purchasing necessary land from the neighbor. Instead of having the
applicant return to CZMC, we will notify NYSDOS that the original letter from CZMC
still applies.
3.2. 21 Edgewood Avenue -Subdivision
Vincenzo Leto of Westchester Modular Homes Construction Corp. returned with
Stephen Lopez, Landscape Architect and Anthony Pigarri, Project Engineer to present
additional information on stormwater management and tree removal.
They will be unable to preserve any additional trees due to a lack of space and
clearance. The proposed homes will be modular, requiring clearance for the crane to
lift the sections into place. The large spruce tree on Lot 1 will be in the way of the
crane. In addition, the construction of the foundation on Lot 3 will negatively impact
the root structure of the large sweetgum. As mitigation, the applicant has increased
the number of replacement trees from the Town's approved list of replacement trees
by adding more from the list. Of the 40 required replacements 32 are now being
proposed.

Stormwater will be collected in a large pipe from Lot 2. An overflow will run through
Lot 3 and tie into the existing stormwater system on Myrtle Boulevard. To mitigate
stormwater runoff, the applicant proposes the use of permeable pavers on the new
driveways. The Engineer for the Planning Board will ultimately review the design for
code compliance.
CZMC finds the proposed action to be consistent with the policies in the Local
Waterfront Revitalization Program provided that the existing system in Myrtle
Boulevard can handle the overflow from the new homes without exacerbating the
flooding conditions currently experienced by the residents in the neighborhood.
