MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD JANUARY 2nd,
1964, IN THE COUNCIL ROOM OF THE WEAVER STREET
FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.
welcoming aboard Councilman Anthony G. Quadrine and
Town Attorney James J. Johnston.

ORGANIZATION MATTERS
The Supervisor presented the organization matters for
1964 which, after due consideration and on motions duly
made and seconded, were authorized by unanimous adoption
of the following resolutions:
1. Salaries of Elected Officials
(As provided in the 1964 budget)
RESOLVED, that the salaries of the elected officials
of the Town of Mamaroneck for the year 1964 are to
be the salaries stated and appropriated in the annual
budget or estimate for that year as follows:

Town Offices, be and it hereby is abolished as of
12 o'clock midnight on January 2, 1964.
3. Appointment and Salary
(Appointed Officials)
RESOLVED, that the following persons are hereby
appointed as Town Officials as of January 1, 1964
in accordance with the provisions of the Town Law
to serve for the respective terms of office and at
the annual salary or rate of compensation herein-
after stated, such salary or compensation to be
paid from the amounts appropriated in the annual
budget or estimate for the year 1964, or so much
thereof as shall be sufficient to pay the salary or
compensation as hereby fixed:

4. Bonds for Elected Officials
RESOLVED, that the following bonds for elected
officials are hereby required pursuant to Town
Law and approved as follows:
Bond, George D. Burchell as Supervisor of
the Town of Mamaroneck, conditioned for
the faithful performance of his duties in-
cluding the payment of all school moneys
pursuant to Section 25 of the Town Law, up-
on which the National Surety Corporation is
surety in the penal sum of $25, 000. for a
term of two years.
Bond, Charles J. Gronberg as Clerk of the
Town of Mamaroneck, conditioned for the
faithful performance of his duties including
the depositing of all funds or moneys of the
Town of Mamaroneck received by him pur-
suant to Section 25 of the Town Law, upon
which the National Surety Corporation is
surety in the penal sum of $4, 000. for a
term of two years.
Bond, Anthony J. Vitetta as Justice of the
Peace of the Town of Mamaroneck, con-
ditioned for the faithful performance of his
duties including the depositing of all funds
or moneys of the Town received by him pur-
suant to Section 25 of the Town Law, upon

which the Sun Insurance Company is surety
in the penal sum of $4, 000. for a term of
four years.

RESOLVED, that pursuant to Town Law, a bond is
required for the faithful performance of the duties
of each of the appointed officials and employees

Civil Service shown in the budget or estimate are
hereby continued, and the annual compensation for
the same in the year 1964 is hereby fixed and shall
be paid from the amounts appropriated in the an-
nual budget or estimate for the year 1964, or so
much thereof as shall be sufficient to pay such an-

RESOLVED, that the employment of the last named per-
il sons to the aforesaid positions is in accordance with the
classifications made by the County Personnel Officerun-
der the provisions of the Civil Service Law of the State,
and any vacancies which now exist, or which may occur
in said positions from time to time, are to be filled at
salaries set in accordance with the provisions of the
salary scale adopted by the Town Board, and in con-
formity with the Civil Service rules and amendments
thereto for towns, villages, and special districts in
Westchester County, New York.
7. Salary - Secretary to Attorney
(Part Time)
RESOLVED, that the compensation of the part-time
secretary to the Town Attorney be and it hereby is
fixed in the amount of $2. 50 per hour as provided in
the 1964 budget.
8. Bi-weekly Salary Payment
RESOLVED, that the salary of all officials and em-
ployees of the Town of Mamaroneck be paid on a
bi-weekly basis, effective January 1, 1964.
9. Appointment of Deputy Comptroller

RESOLVED, that this Board hereby establishes
the office of 'eputy Comptroller of the Town of
Mamaroneck as provided in Section 20 3 (d) of
Article I of the Town Law, and hereby appoints
Leo N. Orsino, Receiver of Taxes, as Deputy
Comptroller, authorized to assist the Comp-
troller in the performance of his duties, and if
and when said Comptroller is absent or unable
to perform the duties of his office, to have full
power and authority to perform those duties.
and be it further
RESOLVED, that this appointment shall be for
a term of one year, effective as of January 1,
1964, and compensated at the rate of $400. 00
per annum commencing as of that date.
10. Appointment of Deputy Tax Receiver
RESOLVED, that in accordance with the request
of the Receiver of Taxes, this Board hereby ap-
proves the appointment of Mrs. Donna Comstock,
Intermediate Account Clerk, as Deputy Receiver
of Taxes, authorized to receive tax money, give
proper receipt therefor in her name, enter such
payments upon the records, and deposit tax
money in the bank for the year ending December
31, 1964.
11. Appointment of Person Authorized
to Receive Tax Money
RESOLVED, that in accordance with the request
of the Receiver of Taxes, this Board hereby ap-
proves the appointment of William Kirtland, In-
termediate Clerk, as a person authorized to re-
ceive tax money, give proper receipt therefore
in his name, enter such payments upon the rec-
ords, and deposit tax money in the bank for the
year ending December 31, 1964.
12. Appointment of Deputy Town Clerks
RESOLVED, that in accordance with the Town
Clerk's certificate, the appointment of Mrs.
Donna Comstock and Mrs. Lavenia Brewer as
Deputy Town Clerks of the Town of Mamaroneck
for the year 1964 be and it hereby is approved.
13. Appointment of Registrar of Vital Statistics
RESOLVED, that Charles J. Gronberg be and he
hereby is appointed Registrar of Vital Statistics
of the Town of Mamaroneck, for a term of office of

two years beginning on January 1, 1964 and term-
inating on December 31, 1965;
and be it further
RESOLVED, that the Supervisor be and he hereby
is authorized to sign the Certificate of Appointment
of the Registrar of Vital Statistics, to be filed with
the New York State Department of Health.
14. Appointment of Constables
RESOLVED, that the following persons be and they
hereby are appointed Civil Officers of the Town of
Mamaroneck with the powers and duties of Con-
stables in civil actions and proceedings only as
provided in Section 20, 1 (a) of the Town Law; said
persons to serve without salary for a term of one
year starting January 1, 1964 and terminating De-
cember 31st, 1964:

15. Bonds for Constables
RESOLVED , that the appointed Constables, Frank
Comblo, Dominick Faillace and Joseph Tezzi each
file a bond in the amount of $4000. for the faithful
performance of his duties, said bond to be for one
year and approved by the Town Attorney, with
premium for same paid from Town funds.
16. Appointment of Trustee - Police Pension Fund
RESOLVED, that Town Councilman C. Benjamin
Brush, Jr. be and he hereby is appointed a mem-
ber of the Board of Trustees of the Police Pen-
sion Fund of the Town of Mamaroneck, to serve
for a term of one year beginning January 1, 1964
and terminating on December 31 of that year.
17. Appointment of Board of Police Commissioners
RESOLVED, that Messrs. A. C. Viebranz of
49 Eton Road, Alan M. Welty of 5 Kenmare Road,
and Thomas F. Moore, Jr. of 334 Weaver Street,
Town, be and they hereby are appointed as mem-
bers of the Board of Police Commissioners of
the Town of Mamaroneck, to serve at the pleasure
of the Board;
and be it further
RESOLVED, that the Clerk be and he hereby is
directed to so advise the persons hereinabove
named.

18. Reappointment - Member of Park Commission
RESOLVED, that Mr. M. P. Medwick of 1000 Feni-
more Road, Town, be and he hereby is reappointed
a member of the Park Commission, to serve for a
term of office of five years beginning January 1,
1964 and terminating on December 31, 1968;
and be it further
RESOLVED, that the Clerk be and he hereby is dir-
ected to notify Mr. Medwick and the Board of Park
Commissioners to this effect.
19. Appointment of Auditors - 1964
RESOLVED, that the firm of Glick-Freedman, Cer-
tified Public Accountants, New Rochelle, New York,
be and it hereby is appointed to audit the records of
the Town of Mamaroneck for the year 1964; such
service to be rendered for a fee of $2700. as appro-
priated in the annual budget or estimate for the
year 1964.
20. Approval of Supervisor's Appointment
of Members of Examining Board of Plumbers
RESOLVED, that this Board hereby approves the Su-
pervisor's appointment of the following persons to
the Examining Board of Plumbers, each to serve for
the term of office herein designated:
Councilman Kane for a four-year term of office
terminating December 31, 1967.
Mr. Sam Paonessa for a two-year term of of-
fice terminating on December 31, 1965.
Mr. Victor J. Kriss for a one-year term of
office terminating on December 31, 1964.
21. Appointment of Board Committees
RESOLVED, that in accordance with the Supervisor's
recommendation, the following Committees of the
Board are hereby designated for the year 1964:

Councilman Brush - Fire, Insurance and Police
Councilwoman Helwig - Parks and Recreation
Councilman Quadrine - Assessments, Civil Defense

22. Fixing of Dates for Town Board Meetings
RESOLVED, that regular meetings of this Board be
held at 8:15 p. m. in the Council Room of the Wea-
ver Street Firehouse, Weaver Street, Town of Ma-
maroneck, on the first and third Wednesday of each

month with the exception of the months of June,
July, August and September when the Board
shall sit only on the first Wednesday of the
month.
23. Designation of Official Newspaper
RESOLVED, that "The Mamaroneck Daily Times"
be and it hereby is designated as the official news-
paper of the Town of Mamaroneck for the purpose
of publishing notices.
24. Designation of Depositories - 1964
RESOLVED, that the following Banks and Trust
Companies are hereby designated as depositories
for funds of the Town of Mamaroneck for the year
1964, and that the escrow agreements between
these banks and the Town of Mamaroneck pres-
ently in effect shall be continued:

of George D. Burchell, Supervisor of the Town of
Mamaroneck, or Peter F. Kane, Deputy Super-
visor, and the counter-signature of Joseph Altieri,
Comptroller, or Leo N. Orsino, Deputy Comp-
troller.
25. Contract with Westchester Shore
Humane Society, Inc. ($2090. )
RESOLVED, that the Supervisor be and he hereby
is authorized to execute the contract between the
Town of Mamaroneck and the Westchester Shore
Humane Society, Inc. for the year 1964 in the
amount of $2090. as provided in the 1964 annual
budget or estimate.
26. Contract with Larchmont Public Library
($41, 316. 06)
RESOLVED, that the Supervisor be and he hereby
is authorized to execute the contract for 1964 be-
tween the Town of Mamaroneck, the Village of

Larchmont and the Larchmont Public Library in
the amount of $41, 316. 06 as provided in the an-
nual budget or estimate for the year 1964.
27. Dues for 1964 Membership
Association of Towns - ($250. )
RESOLVED, that the Town of Mamaroneck con-
tinue its membership in The Association of Towns
of the State of New York for the year 1964.
28. Dues for 1964 Membership
Municipal Finance Officers Association -($30. )
RESOLVED, that the Town of Mamaroneck con-
tinue its membership in The Municipal Finance
Officers Association of the United States and
Canada for the year 1964.
29. Lease for Town Offices - 1964
RESOLVED, that the Supervisor be and he hereby
is authorized to execute the lease for the rental of
the premises used for the Town of Mamaroneck
Offices at 158 West Boston Post Road in the Vil-
lage of Mamaroneck, said lease being in the amount
of $5700. for the year 1964 as provided in the an-
nual budget or estimate .
30. Amendment of Compensation Plan for 1964
RESOLVED, that the salary scale of Civil Service
employees of the Town of Mamaroneck, adopted
January 2, 1963, be and it hereby is amended as

OLD BUSINESS
1. Resolution - Incinerator Facilities
Upon presentation of the resolution pertaining to appli-
cation for a federal interest free loan to finance the cost
of preparation of plans for the proposed incinerator fa-
cility expansion presented by Councilman Kane at the
last meeting and held over in the Engineer's absence
pending disposition of several questions raised thereon,
following the Engineer's review of a conference with the
federal authorities and explanation of the items under
question, on motion by Councilman Kane, seconded by
Councilman Brush, the following resolution was adopted
by unanimous vote of the Board with all members pres-
ent and voting:
WHEREAS, the Town Board of the Town of Mamar-
oneck, acting for and on behalf of Refuse and Gar-
bage District No. 1 of the Town of Mamaroneck
(hereinafter called the Board), after thorough con-
sideration of the various aspects of the problem
and study of available data has hereby determined
that the construction of certain public works, gen-
erally described as "Proposed Expansion of Incin-
erator Facilities Including Air Pollution Control"
is desirable and in the public interest and to that
end it is necessary that action preliminary to the
construction of said works be taken immediately;
and
WHEREAS, the Town of Mamaroneck is in receipt
of a resolution, dated February 28, 1963 and an
amendment thereto, dated December 7, 1963,
from the Larchmont-Mamaroneck Joint Garbage
Disposal Commission, wherein said Commission
deems it desirable to perform certain work on
the incinerator plant;
and
WHEREAS, the participating share of the Town of
Mamaroneck would be 56. 07% of the cost of such
work if such work be undertaken, and similarly
the share of the Village of Larchmont would be
43. 93%;
and
WHEREAS, the Town Board has reviewed a cer-
tain report by Seelye, Stevenson, Value & Knecht,
dated June 1961 and entitled, "Proposed Expansion
of Incinerator Facilities";
and
WHEREAS, under the terms of Public Law 560,
83rd Congress, as amended, the United States of
America has authorized the making of advances to
public bodies to aid in financing the cost of engin-
eering and architectural surveys, designs, plans,
working drawings, specifications or other action
preliminary to and in preparation for the construc-
tion of public works;
and

WHEREAS, the Board has examined and duly con-
sidered such act and the Board considers it to be
in the public interest and to its benefit that an ap-
plication be filed under said act and to authorize
other action in connection therewith;
and
WHEREAS, the total estimated costs for the pro-
posed work are as follows:
Construction - $379, 000.
Final plans & specifications - 28, 500.
Shop drawings & supervision - 9, 100.
Legal & administrative con-
tingencies - 15, 500.
Total $ 432, 100.
and
WHEREAS, the estimated costs of the Town's
share of this improvement would be in the amount
of $242, 278. 47 and the Village of Larchmont's
share of the cost would be in the amount of
$189, 821. 53;
NOW, THEREFORE, BE IT
RESOLVED, by the Board as follows (provided a
similar resolution is adopted by the Board of
Trustees of the Village of Larchmont):
1. That the construction of said public works is es-
sential to the best interests of the Refuse and
Garbage District No. 1 of the Town of Mamaroneck
and to the end that such public works may be pro-
vided as promptly as practicable it is desirable
that action preliminary to the construction thereof
be undertaken immediately;
2. That the Board of Control of the Larchmont-
Mamaroneck Joint Garbage Disposal Commis-
sion (hereinafter called the Commission) be here-
by authorized to file in an application (in form re-
quired by the United States and in conformity with
said act) for an advance to be made by the United
States to aid in defraying the cost of final plans
which shall consist generally of "Expansion of In-
cinerator Facilities Including Air Pollution Con-
trol";
3. That if such advance be made, the Commission
provide or make necessary arrangements to
provide such funds, in addition to the advance, as
may be required to defray the cost of the plan prep-
aration of such public works;
4. That this Board approves and authorizes "The
Expansion of Incinerator Facilities Including
Air Pollution Control" as set forth in said report of
Seelye, Stevenson, Value & Knecht, provided that
final plans are to be approved by this Board and

provided further that similar action is taken by the
Board of Trustees of the Village of Larchmont of
the final plans contemplated in this resolution;
5. That certified copies of this resolution be in-
cluded as part of the application for an advance
to be submitted to the United States;
6. That the Supervisor, on behalf of Garbage and
Refuse District No. 1 of the Town of Mamaro-
neck and acting as a member of the Board of Con-
trol of the Larchmont-Mamaroneck Joint Garbage
Disposal Commission, be and he hereby is au-
thorized to execute any necessary forms and reso-
lutions in applying for an interest-free federal
loan to cover the cost of the Town's share of the
preparation of the final plans and specifications,
which share is 56. 07% of $28, 500. , being the sum
of $15, 979. 95;
7. That this resolution supercedes a resolution
adopted by this Board on April 3, 1963 pertain-
ing to this same subject.
NEW BUSINESS
1. Authorization of Delegate and Alternate
Annual Meeting--Association of Towns
In compliance with the request contained in the Asso-

pose of voting at the 1964 Association of Towns
Annual Meeting;
and be it further
RESOLVED, that all Town Officials and Heads
of Departments are hereby authorized to attend
any sessions of the Annual Meeting of the Asso-
ciation of Towns in New York City, February
10 - 12, 1964 at Town expense;
and be it further
RESOLVED, that the Comptroller is hereby au-
thorized to audit the claims for expenses of
those persons who attend the Meeting, said ex-
penses to be paid from the proper items in the
1964 budget.
COMMUNICATIONS
1. Petition - Bonnie Way Drainage

The Clerk presented a petition carrying the signatures
of 15 residents of Bonnie Way, addressed to him by Mr.
Lee Gagliardi of Clark, Gagliardi, Gallagher & Smyth
under date of December 23, 1963 for presentation to the
Town Board, requesting the Board to take such action
as necessary to correct the flow of surface water into
the brook or trench adjoining plots of land facing the
northerly side of Bonnie Way so as to prevent its over-
flowing its banks and damaging adjoining lands and
houses.
The Board ordered the petition, which was received
and filed, referred to the Engineer and Town Attorney
for study and report at the next meeting and directed
that Mr. Gagliardi be notified accordingly.
2. Letter from State Traffic Commission
(Prohibition of Parking - Post Road near Alden Road)
For informational purposes, the Clerk presented a
letter addressed to the Board by the State Traffic Com-
mission under date of December 26, 1963 stating that
parking would be prohibited on the Boston Post Road
(U. S. 1) between Alden Road and a point 260 feet east-
erly therefrom, which was ordered received and filed.
3. Request of Assessor - Attendance of
Assessors' Association Conference
Pursuant to the Assessor's request, on motion by
Councilman Kane, seconded by Councilman Brush, it
was unanimously
RESOLVED, that this Board hereby authorizes
the Assessor to attend the New York State Asses-
sors' Association Conference on Assessment Ad-
ministration, to be held at the Hotel Syracuse, Sy-
racuse, New York, January 20 - 22, 1964, with
expenses in an amount not to exceed the sum of
$125. 00 to be paid from the proper item in the 1964
budget for the Assessor's Department.
4. Request for Acceptance of Lakewood Lane
The Clerk presented a memorandum addressed to the
Board by the Engineer under date of December 23, 1963
advising that Protano, Inc. requested acceptance of
Lakewood Lane (subdivision off Weaver Street) which was
herewith ordered received and filed for the record.
Following report by the Engineer that a sewer manhole
was functioning improperly and pursuant to his request,
the matter was deferred to the next meeting, or such
time as the condition above referred to is corrected.

5. Notice of Hearing - Village of Mamaroneck
Creation of Marina Service District
(Not on Agenda)
The Clerk presented a notice of public hearing before
the Board of Trustees of the Village of Mamaroneck on
January 13, 1964 for the purpose of considering the de-
sirability of amending, changing and revising the Zoning
Ordinance by creating a new district to be known as the
"Marina Service District", which was herewith ordered
received and filed.

The Clerk presented the following report which was or-
dered received and filed:

neck, for the period from January 1 through November
30, 1963.
The Supervisor --
1. Establishment of Office and
Appointment of Deputy Supervisor
The Supervisor strongly recommended the establish-
ment of the office of Deputy Supervisor in the Town of
Mamaroneck so that the duties of the office of Super-
visor would be continued without interruption in the
event of the Supervisor's absence or inability to act,
further stating that if this met with the Board's ap-
proval, it would be his pleasure to appoint Peter F.
Kane, Senior Councilman, as his Deputy if he were
willing to so serve.
Councilman Kane expressed his appreciation and his
willingness to so serve provided such service was with-
out additional compensation, and thereupon since the
Board was unanimously in favor of this recommenda-
tion, on motion by Councilman Brush, seconded by
Councilwoman Helwig, it was
RESOLVED, that this Board hereby establishes the
office of Deputy Supervisor of the Town of Mamar-
oneck, said Deputy to be appointed by the Supervi-
sor to serve without compensation at his pleasure,
and authorized and empowered to perform all the
duties of the office of Supervisor in case of va-
cancy of that office or the absence or inability of
the Supervisor to act as provided for in Section 42
of Article 2 of the Town Law.
And thereupon, on motion by Councilwoman Helwig,

seconded by Councilman Brush, the following resolu-
tion was adopted by majority vote, Councilman Kane
abstaining from voting:
RESOLVED, that this Board hereby approves
the Supervisor's appointment of Peter F. Kane,
Senior Town Councilman, as Deputy Supervisor
of the Town of Mamaroneck, to be effective im-
mediately and to serve without salary at the
pleasure of the Supervisor;
and be it further
RESOLVED, that the bond for the office of
Deputy Supervisor required pursuant to Town
Law is hereby approved as follows:
Bond, Peter F. Kane as Deputy Supervi-
sor of the Town of Mamaroneck, con-
ditioned for the faithful performance of
his duties pursuant to Section 25 of the
Town Law, upon which the National
Surety Corporation is surety in the penal
sum of $25, 000. 00 for a term of two
years.
2. Retention of John L. Delius
Attorney at Law
Pursuant to the Supervisor's recommendation, on
motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED, that this Board retain John L.
Delius, Attorney at Law, to represent this
Board as petitioners, in the proceeding now
pending in the Supreme Court of Westches-
ter County entitled, "In the Matter of the
Application of the Town of Mamaroneck,
George D. Burchell et al constituting the
Town Board of the Town of Mamaroneck,
and as such Commissioners of Water Supply
District #1 of the Town of Mamaroneck, Pe-
titioners against Westchester Joint Water
Works No. 1 et al, Respondents", for a fee
to be fixed at the rate of $25. 00 per hour
for time actually and necessarily spent in
the prosecution of this Proceeding and un-
til its termination;
and be it further
RESOLVED, that the Supervisor be and he
hereby is authorized to enter into a con-

tract with the said John L. Delius cover-
ing the services as aforesaid.
And thereupon, on the Supervisor's further recom-
mendation, on a motion offered by Councilwoman
Helwig and seconded by Councilman Brush, the follow-
ing resolution was adopted by unanimous vote:
RESOLVED, that this Board retain John L.
Delius, Attorney at Law, to represent this
Board in the matter of the sale and convey-
ance of certain real property owned by
Sewer District #1 to the Trustees of Union
Free School District No. 1 of the Town of
Mamaroneck, and the negotiation and exe-
cution of an agreement for its joint use by
the School District and the Town for Town
recreation purposes, for a fee to be fixed
at the rate of $25. 00 per hour for time
actually and necessarily spent on the fore-
going matter until its completion;
and be it further
RESOLVED, that the Supervisor be and he
hereby is authorized to enter into a con-
tract with the said John L. Delius cover-
ing the services as aforesaid.

Councilwoman Helwig --
1. Death of Town Historiam
Mr. William G. Fulcher
Councilwoman Helwig called to the Board's atten-
tion the loss of the Town Historian, William G. Fulcher,
who passed away in Florida on December 29th, and fol-
lowing each of the Councilmen's expression of sorrow
and tribute to Mr. Fulcher, on motion by her, seconded
by Councilman Brush, it was unanimously resolved that
this meeting stand adjourned this evening in honor of
his memory and that the following resolution be adopted
in memoriam to him, to be spread upon the minutes of
this meeting and forwarded to Mrs. Fulcher with deepest
sympathy and condolences:
In Memoriam
Wh e r e a s , William Gershom Fulcher served
with great distinction as official Historiam of the
Town of Mamaroneck from March 26, 1947 until
his death on December 29, 1963; and
Wh e r e a s , not only during his tenure as Town
Historian but throughout his life as a resident of
the Town, he constantly devoted his great talent
for research to the study of local history; and
Whereas , his genuine scholarly enthusiasm
played a vital part in promoting a revival of in-
terest in our heritage both through his histori-
cal publications and through the inspiration he
gave to the 275th and 300th Anniversary cele-
brations of the Purchase of Mamaroneck; and
Whereas , his distinguished contributions to
knowledge of local history have been recognized
not only by the residents of the Town of Mamar-
oneck but throughout Westchester County and
the State of New York;
Now , Therefore ,
Be It
R e s o l v e d , that we, the members of the Town
Board of the Town of Mamaroneck, do hereby
record the appreciation of the Town and all of
its residents for the many contributions of this
fine public servant, and our appreciation of his
devoted and outstanding service to the
community;
and be it further
Resolved , that this tribute to Mr. Fulcher be
spread upon the minutes of this meeting and a
copy thereof be conveyed to Mrs. William G.
Fulcher with deepest sympathy as an expression
of our sense of loss and grief.

2. Recreation
a) Ice Skating, Memorial Park
Councilwoman Helwig reported on the past 10 days
of excellent skating at the Park, stating that about
3700 were in attendance with about 70% of that figure
being children. She paid high compliment to the Rec-
reation Superintendent, Mr. Kronenberger, and to
the Park Department men.
b) Roller Skating - Murray Avenue
Councilwoman Helwig also reported on the excel-
lent attendance at the Roller Skating at Murray Ave-
nue School during the 7 days it was open during the
Christmas holidays.
3. Thruway Noise Abatement
Councilwoman Helwig reported briefly on the status
of the proposed legislation for 1964, requesting the
Board's support of the bill or bills to be introduced on
February 13th, submitting for approval the following
resolution which, on her motion seconded by Council-
man Kane, was adopted by unanimous vote to be for-
warded to Senators Meighan and Speno and Assembly-
men Feinberg and Gioffre:
WHEREAS, many of the populated areas of villages,
cities, and towns of our state are adjacent to heav-
ily travelled highways, interstate routes, and thru-
ways, which are used by trucks, tractor-trailers
and other heavy highway equipment which produce
loud noises constituting a substantial nuisance to
the residents of these municipalities, and
WHEREAS, there is a need for the establishment of
a state-wide standard that will enable state and lo-
cal authorities to accomplish the elimination of
these excessive and unnecessary traffic noises
wherever such action is needed,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of Ma-
maroneck urges the amendment of the Vehicle and
Traffic Law to establish measureable and enforce-
able noise limits and a method of measurement of
noise to enable equitable enforcement thereof;
and be it further
RESOLVED, that this Board urges and requests the
Board of Supervisors of Westchester County and The
Association of Towns of the State of New York to
support legislation that will accomplish the afore-
said results;
and be it further

be forwarded to Senator Hunter Meighan, Senator
Edward J. Speno, the Chairman of the Senate Corn-
mittee on Motor Vehicles and Transportation and

Gioffre, and Assemblyman Robert J. Feinberg, the
Chairman of the Assembly Committee on Motor

Councilman Kane --
1. Authorization of Overtime
for Highway Laborers
Pursuant to Councilman Kane's request and on his
motion, seconded by Councilman Brush, it was
unanimously
RESOLVED, that pursuant to Section 92 of the Gen-
eral Municipal Law, this Board hereby authorizes
that Highway Laborers be compensated for over-
time (over regular 8-hour day) at the rate of time
and a half per hour.
2. Request for Transfer of Funds
(Hommocks Drain)
Pursuant to memorandum of the Town Accountant,
dated January 2, 1964 requesting authorization for
transfer of funds herewith presented and filed for the
record, on motion by Councilman Kane, seconded by
Councilwoman Helwig, it was unanimously
RESOLVED, that this Board hereby authorizes the
transfer of the sum of $850. 00 from General Town
Contingency to General Town - Item - Miscellan-
eous a/c 510 - in the 1963 budget for payment of
claim for the Hommocks Drain installation as of
December 31, 1963.

1. Change of Date for
Next Town Board Meeting
Councilman Brush called to the Board's attention that
it had been requested that the next meeting be held on
the 22nd rather than the 15th, and therefore on his mo-
tion, seconded and adopted unanimously, it was
RESOLVED, that the date for the second regular
meeting this month be changed from the third
Wednesday, January 15th, to the fourth Wednes-
day, January 22nd, 1964.

OTHER BUSINESS
1. Petition for Sewer District
Mr. William Shroder
Mr. Shroder of 60 Underhill Avenue, Scarsdale, and
Mr. Dolph Rotfeld, Consulting Engineer, presented a
petition signed by 12 residents of Griffen Avenue and 2
of Old White Plains Road, requesting the extension of
Sewer District No. 1 or the creation of a new sewer
district to service that area and a proposed 28-home de-
velopment to be constructed by Mr. Shroder on the Ed-
ward Basso property on Old White Plains Road.
Mr. Shroder, in reply to question by the Board, ad-
vised that he had appeared before the Planning Board
and that that Board had recommended that he submit the
subject petition to the Town Board at as early a date as
possible since building construction was planned to
start in March.
The Board, following some discussion, ordered the
petition received and filed and referred to the Town En-
gineer and Attorney for study and further report.
ADJOURNMENT
There being no further business to come before the meeting,
on motion duly made and seconded, it was declared adjourned
in honor of the memory of William G. Fulcher, Town His-
torian, at 9:25 p. m. , to reconvene on January 22nd, 1964.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was con-
vened immediately upon the adjournment of the Town Board
meeting.
