BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O’Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia, Town Clerk Mary Stanton, Assistant to the Town Administrator William Maker, Jr., Town Attorney ABSENT: Stephen V. Altieri, Town Administrator WORK SESSION Report from Lt. Cindrich - Incident at Memorial Park Lt. Cindrich briefed the Board on an incident at Memorial Park; there appears to be much conflicting information reported to Board members via the Community. Lt. Cindrich explained that Police were called to Memorial Park Bridge for an intoxicated teen. During the incident an 18 year old was arrested. Lt. Cindrich was waiting for a more detailed report from the officer at the scene. Lt. Cindrich will report back to the Board with a detailed report. At this time there are no voluntary statements or depositions from bystanders with regards to any additional charges being pressed. Safe Routes to School Program Mary Stanton updated the Board on the application for the Mamaroneck School District from the Department of Transportation’s Safe Routes To School Project Grant in the amount of $360,810. The Town provided consultation during the grant writing process and will provide infrastructure enhancements at the Hommocks School and Central School, including new signage, crosswalk enhancements and sidewalk repair. The Town will need to budget these improvements for the year 2009; all expenses will be reimbursed through the grant. The School Board further understands that any signage would be subject to review by the Traffic Committee. Wetlands and Water Courses Legislation The Board received two pieces of correspondence from the Coastal Zone Management Commission (CZMC), one to Town Attorney William Maker, the second to Supervisor O’Keeffe. The correspondence to Supervisor O’Keeffe recommends the Town consider amending Section 114-6 Exempt Activities of the Town Code under Chapter 114 Wetlands & Watercourses. In the letter from CZMC, the Commission states that a homeowner was able to avail himself of a (10%) percent loophole provision in section 114-6 of the Wetlands and Watercourses Law entitled Exempt Activities. The 10% disturbance grew to 16% damage to the wetlands buffer and neither the initial construction nor the remediation was presented to the CZMC. The Board discussed the property and the construction that took place; agreeing that preventing the buffer violation in the first place is always preferable. Mr. Maker was instructed to review whether the CZMC could have the authority to grant the permit. The second letter from the CZMC related to Removal of Illegal Sewer Connections, Local Law No. 6-2005. The CZMC writes ‘while the CZMC understands and appreciates the need for the Town to control illegal connections to storm water and sanitary sewer lines’, there are many parcels in the Town underlain, at shallow depths, by bedrock, making it impossible for homeowners to divert the storm water into drywells on their 2 MAY 21, 2008 property, or directly into a public storm water sewer. In these situations where homeowners may direct the flow onto grass and landscaped areas, it is virtually impossible for a plumber to determine upon an inspection whether such installations violate the Law by flowing “directly onto or directly toward a street, sidewalk or right-of- way.” The CZMC also questions the ‘practicality of having the Discharge Compliance Certificate expire 60 days after issuance, as this discourages homeowners from correcting possible violations in advance of a sale, thus prolonging the illegal condition.’ Mr. Maker was asked to review the Law and determine if this is in fact an actual issue. Mary Stanton will contact the Building and Highway Departments for their input. Parking – Relocation of 24 Hour Parkers, Discussion of Handicapped Spaces The Board voiced their displeasure in not knowing sooner that the plan for the temporary use of Memorial Park for the 24 Hour Parking Permit holders had gone out for an RFP and the cost for the project had doubled. The Board discussed the proposal to use Vine Street and Baldwin Place as alternatives to the Temporary lot at Memorial Park. The Town Clerk noted that she has not yet sold out the Meter Permits in Lot #1. She is recommending that the remaining metered spaces in Lot # 1 be converted to Daytime spaces and the Daytime spaces along Vine street be converted to 24 Hour Parking for the displaced Lot #3 parkers. The removal of the Daytime spaces along Vine Street would be replaced within Lot #1 by removing the meters. The Board approved moving forward with this proposal. The Board agreed to revoke their previous Resolution approving the temporary use of Memorial Park at this evening’s regular meeting. Community Development Block Grant Applications Anna Danoy, Director of Community Services, was present to explain the grants and the project objectives. The Board reviewed the grant applications in preparation for this evening’s Public Hearing. Traffic Committee Update Councilman Fishman gave the Board an overview of the recent Traffic Committee Meeting. The Traffic Committee continues to be concerned with the intersection of Myrtle Blvd. and N. Chatsworth. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:25 PM she then pointed out the location of exits. PRESENTATION – Larchmont Library Board Chair – Children’s Room Renovations Miriam Curnin, Chair of the Larchmont Library Board presented the final architectural drawings for the Children’s Room renovations. She thanked the Town Board for their support in funding the infrastructure repairs with the Village of Larchmont. She announced that with the initial bequest of $755,000 from former Town Supervisor and Judge George Burchell and his wife Peggy, as well as private donations, the Library needs an additional $250,000 to complete the project. A current fundraising campaign is asking each family in our community to send $100.00 toward the project, which would raise the needed $250,000. The Board thanked Miriam Curnin for this presentation, noting how important our Library is to our community. 3 MAY 21, 2008 PUBLIC HEARINGS – Proposed Community Development Block Grant Application The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on May 21, 2008 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the filing of applications for Community Development Block Grants. Purpose To consider the filing of applications for Community Development Block Grants to benefit the rehabilitation and potential construction work at the building presently housing the Larchmont-Mamaroneck Senior Citizen Center and the David Potts Post Veterans of Foreign Wars in the Town of Mamaroneck. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. Boston Post Road Mamaroneck, New York. PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: May 12, 2008 On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Public Hearing was unanimously opened. Anna Danoy, Director of Community Services and Housing, gave an overview ofmoving the Senior Center from the Larchmont Community Room to the David Potts, Jr., Veterans of Foreign Wars (VFW) Post 1156 building in August of 2007. She further explained the long term goal of the Town to secure a long term interest in the property to improve and expand the Senior Center and to develop affordable housing on the site. Ms. Danoy than gave an overview of the two grant proposals. Supervisor O’Keeffe asked if anyone wished to speak for or against the grant proposals. Abby Katz, 40 Cooper Lane, asked if a variance would be needed. Supervisor O’Keeffe responded, there is no intention of the need for a variance. Councilman Fishman noted although there are many thresholds’ to be met, this is intended to be a partnership with the VFW; they will have a permanent home here. Councilman Odierna noted this was a wonderful opportunity for shared services. Harriet Kline, with the Larchmont Gazette, asked who would be receiving the grant. The Board responded that the Town applies for the grant. 4 MAY 21, 2008 On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilman Fishmam, it was unanimously RESOLVED, that the Mamaroneck Town Board finds that the Community Development Block Grant funding applications are hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA) requiring no further action. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the following was unanimously approved; WHEREAS, Westchester County Department of Planning will be accepting applications for Community Development Block Grant funding for the years 2009-2011;and WHEREAS, the Town of Mamaroneck will submit two applications; one for renovations for the operation of the Senior Center for the 2010 grant year and one for the VFW site, in relation to the development of affordable housing in conjunction with the Senior Center for the 2011 grant year, and WHEREAS, required by the Community Development Block Grant Funding Program the Town of Mamaroneck held a Public Hearing on May 21, 2008. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does herby approve the applications for Community Development Block Grants for the VFW site and authorizes the Town Administrator to submit these applications on behalf of the Town. PUBLIC HEARING – Parking Ordinance – Colonial Avenue The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on May 21, 2008, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled “No Parking Zone on Colonial Avenue” Law Purpose To create a no parking zone on the north side (school side) of Colonial Avenue between Murray Avenue and Daymon Terrace. The no parking zone would be in effect from 7:30AM to 9:00AM and from 2:00PM to 3:30PM. During school drop off and pickup parking on Colonial Avenue severely inhibits the flow of the traffic and the safety of pedestrians, particularly between Murray Avenue and Daymon Terrace. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK 5 MAY 21, 2008 CHRISTINA BATTALIA TOWN CLERK Published: May 12, 2008 On motion of Councilman Fishman, seconded by Councilwoman Wittner, the Public Hearing was unanimously opened. Councilman Fishman as Town Board Liaison to the Traffic Committee gave a history of this recommendation by the Traffic Committee. Supervisor O’Keeffe asked if anyone wished to speak for or against the proposed law. The following residents spoke very much in favor of the proposed Local Law: Hyla Melnick, 2 Colonial Ave Susan Tepley, 32 Colonial Ave Eric Dreyfus, 18 Colonial Ave Abby Katz, 40 Cooper Lane, although in favor of the parking restriction, cautions the Town on what she sees as the domino effect; these restrictions will ultimately result in problems somewhere else. On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously closed. On motion of Councilman Fishman, seconded by Councilwoman Seligson, the following Local Law was adopted: Local Law No. 3 - 2008 This local Law shall be known as the “Second Amendment of Local Law No. 7 - 2007” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: This Local Law amends section 3 of Local Law No. 7 – 2007 by extending the areas where parking is prohibited at times on a section of Colonial Avenue. Section 2 – Regulation of Parking on a section of Colonial Avenue: th On school days from September 1st of each year to and including June 30 of the immediately following year, no vehicle shall be parked on the section of the north side of Colonial Avenue that lies between the point where Daymon Terrace terminates at Colonial Avenue and the point where Colonial Avenue terminates at Murray Avenue between the hours of 7:30 AM and 9:00 AM (prevailing time) and the hours of 2:00 PM and 3:30 PM (prevailing time) on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of each week. This law shall not apply on holidays. Section 3 – Signs to be Erected: An appropriate sign or signs shall be erected on the north side of Colonial Avenue. Section 4 – No Further Amendments: Except as amended hereby, Local Law No. 7 – 2007, as amended by Local Law No. 12 – 2007, shall remain in full force and effect. Section 5 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. 6 MAY 21, 2008 Section 6 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye PUBLIC HEARINGS – Parking Ordinance – Forest Avenue at Sheldrake Avenue The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on May 21, 2008, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled “No Parking Zone Forest Avenue/Sheldrake Avenue” Law Purpose To create a no parking zone of approximately 20 feet at the corner of Sheldrake Avenue and Forest Ave. Cars routinely park very close to the corner on Forest Avenue at the southeast corner of Sheldrake Avenue, creating a serious visual obstruction. The full text of this Local law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was unanimously 7 MAY 21, 2008 RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed Local Laws Regulating Parking on a section of Colonial Avenue and a No Parking Zone on Forest Avenue/Sheldrake Avenue, is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA) requiring no further action. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following Local Law was adopted: Local Law No. 4 – 2008 This local law shall be known as the “No Parking on Forest Avenue near the Point Where Sheldrake Avenue Terminates” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The purpose of this local law is to create a no parking zone on Forest Avenue near the point where Sheldrake Avenue terminates as a means of improving sight lines at that location and thereby improving safety. Section 2 – No Parking: Parking on the north side of Forest Avenue for a distance of twenty (20) feet southwesterly from the point where Sheldrake Avenue terminates at Forest Avenue is prohibited. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on, and striping shall be painted on the surface of Forest Avenue indicating the area where parking is prohibited. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Other Fire Department Business Commissioner Seligson reminded Commissioner Wittner to ask Fire Council for a report of fire truck repairs every few months. The Weaver Street Fire House ‘Open House’ will be June 7 from 12:00 – 3:00PM. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Odierna, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Authorization – Inter Municipal Agreement – Westchester County Personnel Protective Equipment 9 MAY 21, 2008 On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was approved WHEREAS, Westchester County through a Federal grant to the State of New York is authorized to purchase Personnel Protective Equipment in connection with incidents related to chemical and biological agents, and WHEREAS, the equipment will be provided at no cost to the Town; however, the Town is responsible for upkeep and maintenance. NOW THEREFORE, BE IT RESOLVED, that the Town Board does hereby authorize the Inter Municipal Agreement with County of Westchester and the Town of Mamaroneck for the provision of Personal Protective Equipment to respond to Weapons of Mass Destruction; and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the town. Authorization – Historic Cemetery Evaluation Supervisor O’Keeffe explained that the Town has been discussing a proposal to evaluate the Town’s 9 historic cemeteries to determine future courses of action for their care and maintenance. With assistance from Donald March, the Town Historian, a proposal from Stone Faces and Sacred Spaces of Mineral Point, WI, has been received and evaluated. The Town requested minor changes to this proposal and feels comfortable with its current language. The total cost of the evaluation is $11,335.00 including travel and lodging expenses. A grant has been obtained from Assemblyman George Latimer in the amount of $5,000.00. Donations from the private sector as well as local historical societies, combined with funding from Assemblyman George Latimer, will be combined to offset the majority of the total cost. On motion of Councilman Fishman, seconded by Councilwoman Wittner, it was RESOLVED, that the Mamaroneck Town Board does hereby award the Historic Cemetery Evaluation to Stone Faces and Scared Spaces of Mineral Point, WI, for an amount not to exceed $12,000.00 including expenses for transportation, food and lodging. Set Public Hearing - Designation of Fire Chief Parking Space – Alden Road On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the Designation of a Fire Chief Parking Space – Alden Road for June 4, 2008, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. 4. Authorization – Transfer of Funds Settlement of Sanitation Commission Litigation On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was approved WHEREAS, on May 7, 2008 the Mamaroneck Town Board ratified the Sanitation Commission’s Decision to settle the litigation regarding the closure of the Croton Point Landfill, and WHEREAS, being a Joint Commission, the Town of Mamaroneck and the Village of Larchmont will divide the $72,000.00 settlement equally. NOW THEREFORE, BE IT RESOLVED, that the Town Board does hereby authorize the transfer of $36,000.00 from the unreserved balance of the Town’s Garbage District into Town budget account SR8160.4251; the account used to transfer money from the Town budget to the Sanitation Commission. Repeal – Temporary Parking Lot at Memorial Park On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby repeal its resolution of April 16, 2008 in which it approved the temporary use of Memorial Park as a parking lot for the 24 Hour Parking Permit holders during construction of the new parking deck at Lot #3. 6. ADDED ITEM 8. Change of Date – Town Board Meeting On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was unanimously RESOLVED, that the Town Board Meeting scheduled for July 2, 2008 be changed to July 9, 2008. ORAL COMMUNICATIONS Abby Katz, Larchmont Gardens’ Civic Association, announced the Association’s Annual Meeting a success, thanking Supervisor O’Keeffe, Steve Altieri and Louis Martirano for attending and speaking. WRITTEN COMMUNICATIONS None SUPERVISOR’S REPORT Supervisor O’Keeffe announced the dates and times for the various Memorial Day events. She and other Board Members attended the R.A.D.A.R. Meeting at the Larchmont Avenue Church, commenting that the use of drugs and alcohol by teens and the pressure on kids is a daunting situation, to say the least. The Board members further thanked the students who spoke for their candor and honesty. The Board was also impressed with the film that was shown. The Board noted how well attended the Kemper Memorial Day event and Essay Contest was. REPORT OF COUNCIL Councilwoman Wittner attended the Westchester Municipal Officials Meeting, noting it was Valerie O’Keeffe’s final meeting as President. Councilman Odierna attended the Recreation Commission Meeting, one discussion focused on adjusting the seeding schedule for the Hommocks Field. Councilwoman Seligson was pleased to announce that the soft opening of the th Greenway Trail on May 19 was a wonderful event. September 28 is the potential date for the Grand Opening. She recently attended the I.C.L.E.I. conference in New Mexico, at which she learned a lot about communities and carbon footprint. She is preparing a formal presentation for the Board for an upcoming meeting. Supervisor O’Keeffe, attended the ‘Greasestock’ event at which the Town’s Veggie Truck was showcased. Councilman Fishman attended the Traffic Committee Meeting. The proposed changes for New Jefferson Street will be discussed at the next Town Board Meeting. The Traffic Committee will also bring to the Town Board suggestions for the intersection of Myrtle Blvd. and N. Chatsworth. Little league is currently holding its All Star games; Steve Spina is being remembered and honored for his work with the League by having the games renamed as the Steve Spina All Star Games. 14 MAY 21, 2008 Councilman Odierna added he attended the Summit Meeting at which they discussed affordable housing and the grant proposals for the VFW. ADJOURNMENT On motion of Councilwoman Wittner, seconded by Councilman Fishman the meeting was unanimously adjourned 10:25 PM in memory of Louise Germano, a long time resident of Mamaroneck and an active member of our community.
