HomeMy WebLinkAbout2009_07_07 Town Board Minutes July 7, 2009 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON JULY 7, 2009, BEGINNING AT 4:30 PM IN CONFERENCE ROOM A AND CONTINUING AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O’Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION Town Web Site Tiffany Torres of Brian Foy Consulting presented the latest version of the Web Site redesign. Ms. Torres heard the Board’s comments and will make adjustments accordingly. The Board will be receiving a link to a final version for their comments. Human Rights Commission The Board reviewed the proposed Resolution dissolving the Commission. The Board will send this resolution to the Commission for review. The Board would like to have the foundation of a Committee for Human Rights established, prior to approving the resolution of dissolution. Parking Deck Mr. Altieri reported that there was some bubbling of the membrane due to the weather, adding, 48 hours of dry weather is needed to apply the second coat of membrane. Parking Lot #1 Mr. Altieri explained that beginning this fall Metro North will offer a train directly to Giants Stadium in New Jersey for the New York Giants and the New York Jets Football games. The New Haven Line will stop only in Rye and Larchmont. This could mean that for 16 Sundays during the NFL Football Season the Town could see an influx of cars attempting to use Lot#1 on weekends. The Board discussed a potential charge for parking on Sundays, except for resident permit holders. The Town will contact the Village of Larchmont for coordinating potential policy. The Board will continue this discussion at a future meeting. Traffic – Harmon Drive The following residents of Harmon Drive were present: Mr. and Mrs. Autorino, 133 Harmon Drive Mr. and Mrs. Amoruso, 134 Harmon Drive Emma DeEsso, 122 Harmon Drive Pat Guadagnolo, 18 Harmon Drive Lt. Mike Cindrich of the Town Police Department was also present. Mr. Autorno addressed the Board with his concern as to how the matter of a stolen vehicle which ended up on his property was handled. He also spoke about resident concerns regarding speeding and truck traffic along Harmon Drive. The Board discussed various options to thwart speeding and truck traffic. The Board will need to 1 July 7, 2009 follow up with the Village of Mamaroneck with respect to signage for truck weight. This matter will be referred to the Traffic Committee for further discussion. Key Box Law Chief Sean McCarthy and Deputy Chief Brendan Collins were present to discuss the proposed Local Law. The Board discussed the Local Law and will set a Public Hearing during this evening’s Regular Meeting. Sanitation Department Building The Board reviewed a proposal, at their request, for replacement of the current trailers versus replacement with modular or metal pre-fabricated buildings at Maxwell Avenue. The Board reviewed a memo prepared by the Town Administrator analyzing the various options and costs. Mr. Altieri will follow up with the Village of Larchmont to review the proposals and options. Mr. Altieri reminded the Board that $350,000.00 of funding for this project was included in the 2009 bonding. Proposed Amendments to the Employee Manual Mary Stanton reviewed the changes with the Board. She stated that these changes were reviewed with Department Heads at a recent meeting. The next step would be to take these changes to the Union representatives. Memorial Park Study This was adjourned due to the late hour. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Board unanimously agreed to enter into Executive Session to discuss Employment History a Lease Agreement and Litigation. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 9:00 PM, she then pointed out the location of exits. Supervisor O’Keeffe welcomed the guest in the audience from Senator Oppenheimer’s Office, Bea Wyman. Ms. Wyman spoke briefly. The Board asked Ms. Wyman to speak with Senator Oppenheimer about the Town’s concern for its current Home Rule Legislation for a Special Parking District. PUBLIC HEARING — “Towing of Illegally Parked Motor Vehicles” Law. The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING Adjourned from June 17, 2009 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on July 7, 2009 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled “Towing of Illegally Parked Motor Vehicles” Law. 2 July 7, 2009 Purpose The Town Board finds that illegal parking is or has the potential of becoming a major problem in the Town of Mamaroneck. To combat this problem, the Town Board hereby exercises its power under the New York State Vehicle and Traffic Law to authorize the towing, impounding and storage of illegally parked motor vehicles. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: June 5, 2009 On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously re-opened. Mr. Maker explained the Local Law, emphasizing with the imminent opening of the new Parking Deck; it was prudent to move forward with this Local Law. Supervisor O’Keeffe asked if anyone wished to speak for or against the proposed Law. On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously closed. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed Local Law “Towing of Illegally Parked Motor Vehicles” Law, is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA) requiring no further action. The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was adopted: Local Law No. 2 - 2009 This Local Law shall be known as the “Towing of Illegally Parked Motor Vehicles” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck 3 July 7, 2009 Section 1 — Purpose: The Town Board finds that illegal parking is or has the potential of becoming a major problem in the Town of Mamaroneck. To combat this problem, the Town Board hereby exercises its power under the New York State Vehicle and Traffic Law to authorize the towing, impounding and storage of illegally parked motor vehicles. Section 2 — Addition of a current section to the Mamaroneck Code: The following section 2 19-2 hereby is added to the Code of the Town of Mamaroneck: §219-1. Removal of illegally parked motor vehicles. A. The Town Administrator of the Town of Mamaroneck is authorized to enter into contracts on behalf of the Town of Mamaroneck with one or more companies to tow, impound and store motor vehicles which are parked where or during times when stopping, standing or parking is prohibited in the parking lots owned by the Town of Mamaroneck or on the streets located within the Town of Mamaroneck (other than streets located within the corporate limits of either the Village of Mamaroneck or the Village of Larchmont or highways maintained by the State of New York). B. Each such contract shall specify (a) that the company performing the service shall only charge the owner of a motor vehicle for its fees in towing, impounding and storing such motor vehicle (b) that such charge(s) shall be reasonable and (c) that the Town of Mamaroneck shall not be liable to the company for payment of any fees whatsoever. It is not mandatory that such contracts provide for the company to pay a fee to the Town of Mamaroneck; however, at the Town Administrator’s discretion, he/she may request proposals for such contracts that would require each company participating in the process to designate either by a fixed sum or by a percentage of revenue collected, the amount that it would pay to the Town of Mamaroneck during the term of such contract. C. Each company which enters into a contract with the Town of Mamaroneck to tow, impound and store illegally parked motor vehicles shall supply proof satisfactory to the Town Administrator of the Town of Mamaroneck (a) that it is insured against personal injury and for property damage in an amount per occurrence that is satisfactory to the Town Administrator of the Town of Mamaroneck and (b) that it possesses all of the licenses required to tow, impound and store motor vehicles. On or before the expiration or termination date of any insurance policy or license which a company is required to maintain pursuant to the preceding sentence, that company will supply the Town Administrator of the Town of Mamaroneck with proof that such insurance policy has been renewed or replaced by an insurance policy which is satisfactory to the Town Administrator of the Town of Mamaroneck and that such license has been renewed, as the case may be. D. Each company which enters into a contract with the Town of Mamaroneck to tow, impound and store illegally parked motor vehicles shall act in accordance with all applicable laws, rules and regulations concerning the towing, impounding and storage of motor vehicles. Section 3 — Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. The terms of the grant require the Town to contribute 5% of the total cost. On July 1, 2009 the Town publicly opened and read one (1) bid for Contract # TA-09-11. Funding for this project is also through a grant from the Federal Government. On July 1, 2009 the Town publicly opened and read one (1) bid for Contract # TA-09-12. AFFAIRS OF THE TOWN 1. Set Public Hearing — Key Box Law Mr. Altieri explained the purpose of the proposed Local Law as follows: 7 July 7, 2009 The Town Board finds that in order to protect the health, safety and welfare of the citizens of the unincorporated area of the Town of Mamaroneck, during fires or when other emergencies arise, the Fire Department must be able to gain access to buildings of a certain size or which contain a certain use and to properties where access is restricted. One recognized method for providing access to firefighters and other emergency responders is the installation of “Key Boxes”. Key Boxes are located outside buildings. They contain keys to locks within the building which lock areas, such as mechanical rooms, to which firefighters need access to, for example, shut off electrical service during a conflagration. To maintain security, only the Fire Department will have the keys that open the Key Boxes. For properties to which access is restricted by locked fences or gates, Security Padlocks or Key Switches provide access to firefighters and other emergency responders when there is an emergency. As with Key Boxes, for security purposes, only the Fire Department will have the keys that unlock . the Security Padlocks or turn the Key Switches On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the proposed “Key Box Law”, for August 12, 2009 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. 2. Set Public Hearing — No Parking Zone — Maxwell Avenue Mr. Altieri explained that cars are frequently parking on the east side of Maxwell Avenue making it virtually impossible for large trucks to pass when vehicles are traveling in both directions. This is creating an unsafe condition for the flow of trucks to the Town Yard. On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the proposed “No Parking Maxwell Avenue”, for August 12, 2009 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. 3. Set Public Hearing — Washington Square Overnight Parking Adjourned 8 July 7, 2009 4. Authorization — New York State Court Grant On motion of Councilwoman Seligson, seconded by Councilman Odierna, the following was unanimously approved: WHEREAS, annually the New York State Office of Court Administration accepts applications for grants for local justice courts. Each year the Town has submitted an application for funding and had been approved for such things as office equipment, computers and the court’s metal detector. NOW THERFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the submission of a grant application in an amount not to exceed $30,000 for funding through the New York State Justice Court Assistance Program; and BE IT FURTHER, RESOLVED, that the Town Supervisor is hereby authorized to execute the grant application. 5. Report of Bids: a) TA-09-06 New Community Services Office/New Town Conference Rooms On June 17, 2009, the Town publicly opened and read seven (7) bids for the New Community Services Office/New Town Conference Rooms. On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was 9 July 7, 2009 RESOLVED, that the Mamaroneck Town Board does hereby reject the bids for Contract # TA-09-06 - New Community Services Office/New Town Conference Rooms. The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye b) TA-09-08 Construction and Installation of Concrete Sidewalks, Curbs & Sidewalk Curb Ramps at Hommocks Road Mr. Altieri explained that this contract is for the pedestrian improvements at the intersection of Hommocks Road and the entrance to the Hommocks School. This project was a priority for the Safe Routes to School Committee. On July 2, 2009 the Town publicly opened and read ten (10) bids. The following report of bid is entered into the record as: (SEE ATTACHMENT A and B) On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that the Mamaroneck Town Board does hereby award Contract # TA-09-08 Construction and Installation of Concrete Sidewalks, Curbs & Sidewalk Curb Ramps at Hommocks Road, to the lowest responsible bidder Acocella Contracting, Scarsdale, NY, in the amount of $34,845.00. This truck would replace the six wheel dump truck which is 17 years old. Again, this is included in the 2009 capital equipment plan. Supervisor O’Keeffe read the mission statement of the newly formed Consolidation/Shared Services Committee: To identify where sharing of services/consolidation of municipal functions of the Town of Mamaroneck and the Villages of Larchmont and Mamaroneck might produce material cost savings while maintaining or improving services and to suggest where such results might be feasible, therefore meriting in- depth study of these functions. 8. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS None 16 July 7, 2009 SUPERVISOR’S REPORT Supervisor O’Keeffe discussed her recent meeting with neighboring officials, Mayor Savolt of the Village of Mamaroneck, Mayor Liz Feld of the Village of Larchmont, Mayor Joan Feinstein of Rye Brook and Mayor Denis Pilla of the Village of Port Chester. Their discussion centered around consolidation and shared services, not only of Local Municipalities but also on the County and State level. Of particular note was a discussion of the dissolution of the Town of Rye, if the Villages of Port Chester and Rye Brook became coterminous, the Suozzi Study, as well as publications from the Department of State regarding consolidation. She noted this publication should be distributed to the Town’s newly formed Consolidation/Shared Services Committee. Supervisor O’Keeffe stated this was a very informative and productive discussion on consolidation and shared services. This group of Officials will meet again next month. REPORT OF COUNCIL Councilman Odierna noted it was a week of parades, noting in particular the wonderful Fireman’s Parade. Of particular interest was the first Memorial Park Concert highlighting the Beatles. Councilman Odierna noted the safe passage home of his son rd who partook of the Bermuda Race; a six day race at which he took 3 in his division. It was noted that the Human Rights Commission meeting was adjourned. Councilwoman Wittner noted the Coastal Zone Management Committee was cancelled rdth for June 23. She attended the LISWIC meeting on June 26, noting they had two speakers from the Department of Environmental Conservation’s Bureau of Water Quality. The speakers presented a power point on the Nitrogen Problem in Long Island Sound, specifically regarding ‘Total Maximum Daily Load’, adding this is a term you will certainly hear a lot more about in the future. th Councilwoman Seligson attended the Zoning Board of Appeals Meeting on June 30 and tomorrow she will attend the Planning Board Meeting. Councilwoman Seligson also th attended the LISWIC Meeting on June 26. Of particular note and excitement was the sighting of a large school of dolphins in Long Island Sound - a great sign of improved water quality. Councilman Fishman attended the Traffic Committee Meeting, noting the continued stream of residents complaining about speeding on Edgewood Avenue. The Traffic Committee has discussed installing large signs alerting drivers of their speed. Mr. Altieri gave an update on the Parking Deck, noting the weather has been a significant factor in the delay of the opening. ADJOURNMENT On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner the meeting was unanimously adjourned at 10:40 PM in memory of Mr. Jessie Smith, father of Town Police Officer Danny Smith; also Mr. Michael Patetta a long time resident of Mamaroneck who was 96 years old and is survived by his wife Ann and their three children; and Mrs. Francis Braiotta the mother-in-law of Carol Braiotta.
