Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, the Work Session was unanimously opened at 5:00PM. Premium Marsh Access Road Residents in Attendance: Mrs. DiBiccari, 23 Dillon Road Michelle and Timothy Doherty, 7 Dillon Road Mrs. Gilliam, 21 Dillon Road John Kish, 39 Dillon Road Mr. Altieri explained that the reason these residents are present at this evening’s meeting is to make a request for more maintenance of the right-of-way to the Premium Marsh Conservation area off Dillon Road. Currently the Town provides basic maintenance and snow removal services. This dirt road is used by three residents to access their homes. Originally the residents at 21 and 23 Dillon Road accessed their homes by way of a driveway easement with Mr. Kish at 39 Dillon Road. These residents have stopped using this access because they feel it is too steep and poses a hazard. A number of years ago Mr. Kish closed off the driveway at the request of the residents due to safety concerns. After an initial meeting, Mr. Altieri asked David Goessl, the Town Engineer, to do an evaluation of an improved dirt road. This would entail adding drainage to either side of the road by installing roughly 225 yards of stone aggregate. The surface would be fine graded with a crown for drainage and treated with liquid calcium chloride and rolled, resulting in a relatively hard surface. Routine maintenance would need to be provided several times per year. The cost of the project is estimated at $24,000.00. The residents stated they have no acceptable way to enter their homes. They stated there were issues with ice during the heavy storms this winter. Supervisor O’Keeffe explained the difficulty in expending government funds on a situation that is primarily a neighbor to neighbor issue. Supervisor O’Keeffe added that the residents need to address other means of rectifying the situation with Mr. Kish. The Board emphasized to the residents that they do in fact have access to their homes; it’s just not acceptable to them. Councilwoman Wittner stated that the application of calcium chloride is a hardener and feels it would not be appropriate for this area. Councilwoman Wittner would want a professional to give an opinion as to whether modifying the access road would not be detrimental to the marsh. Councilwoman Wittner requests that any additional meetings on this subject include other residents of the area, especially those that flood on a regular basis, and whose backyards abut the right-of-way. 2 May 4, 2011 Mr. Maker stated that the document demonstrating when the Town acquired the land from the County would be needed to determine if any stipulations needed to be addressed prior to making any modifications to the access road. Mr. Maker will follow up with the Town Assessor to determine whether her office might have the necessary documents before contacting the County for any documents. Revaluation Present were Tony Siligato, Town Comptroller and Susan Thomas, Town Assessor. The Town Board reviewed a memo outlining the Project Financials for a Revaluation Project. The State will not allow financing for more than five years, so the Board reviewed estimates based on five years. Ms. Thomas noted that the projections for Tax refunds for 2010 are most definitely low as her office has not finished the Small Claims process. Councilwoman Seligson stated her concern for awarding a contract of this scale during the month of August. Mr. Altieri stated that if the contract were to be awarded in September than realistically the Town would be looking at a revaluation for the 2014 Tax Roll. Mr. Siligato stated that a contract could not be awarded prior to the 60 day permissive referendum stipulated in the bonding. Therefore, the timing of the bonding and awarding of the contract is crucial. Mr. Maker addressed the warranty provision. Mr. Maker suggests a threshold be established for grievances, somewhere in the 500 to 1,000 mark; excluding any properties in which the Assessor changed the valuation given by the contractor, and those in which entry was denied. The warranty would stipulate that the contractor not be paid his final payment until after the Small Claims process. It would also require the contractor bear the cost of defending small claims above the established threshold. The final wording for a warranty will be drafted by Mr. Maker and inserted into the final Request for Proposal. Mr. Altieri noted that the warranty will be discussed with the bidding contractors during the pre- submission contractor meetings. The Town will be open to their comments, as well as any alternative warranty concept that the contractor might put forth. Mr. Altieri stated that the warranty will undoubtedly add to the price. Community Development Block Grant Cycle In evaluating projects, it would appear that the replacement of the Senior Citizen’s busses would be the only project eligible for federal funding. The Board believes alternative sources for funding of the busses would be more appropriate. The Town will not apply for funding during this grant cycle. Vehicle Immobilization Law (“Booting Law”) Mr. Altieri explained that currently the Town encounters scofflaws that have failed to pay a number of parking tickets. There has been discussion about how best to address this problem. The Police Department would like to investigate the adoption of a “Booting Law”. This would allow the Police to immobilize a vehicle until fines are paid or arrangements are made with the Court. The Board asked Mr. Altieri and Mr. Maker to work on a draft of this proposed Law. Other Business Councilwoman Wittner noted that the Fire Department has asked if the Town has addressed their concerns 3 May 4, 2011 with respect to the Ethics Law. Mr. Maker stated he will work on this. Councilwoman Wittner also noted that the Fire Department continues to have concerns with house numbering and visibility of same. Board of Assessment Review The Board discussed additional members, as well as Jeanne Kiernan’s status as an Alternate. The Board will add Ms. Kiernan’s appointment as a full Member to the Regular Agenda for this evening. The Board also discussed the resume of Nancy Wasserman as a potential additional Member to the Board of Assessment review. The Board discussed the need to get any new and additional members trained before Grievance Day. Therefore, the Town Clerk should send the Law enlarging the Board of Assessment Review out to the State immediately so as a Special Meeting can be set to appointment additional members. The Board asked Mr. Maker if a stipend needed to be specified in the law, Mr. Maker responded that this should be handled by resolution and did not need to be in the law. Dog Shelters Mr. Altieri stated that he spoke with Mr. Feldtmose, of the New Rochelle Humane Society, regarding his willingness to reduce the contract fee to $11,000, with the understanding that the contract would be reviewed next year. Mr. Maker and Mr. Altieri will prepare an agreement for the Board to review at a future meeting. On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, the Board unanimously agreed to enter Executive Session to discuss Collective Bargaining- Police. EXECUTIVE SESSION Collective Bargaining - Police On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, the Board unanimously agreed to reenter Work Session. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:30 PM, she then pointed out the location of exits. Supervisor O’Keeffe noted the agenda items discussed during Work Session, reiterating to the audience that the Work Session is open to the public. PUBLIC HEARING (S) – Expansion of the Board of Assessment Review The following Notice of Public Hearing is entered into the record as follows: 4 May 4, 2011 NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, May 4, 2011 at 8:00 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider Enlarging the Board of Assessment from three Members to five. Purpose: The Town Board finds that having only three members on the Board of Assessment Review there are times when it is difficult to maintain a quorum. Therefore it is the recommendation of the Town Board to increase the number of members from three to five. The full text of this Amendment may be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: April 26, 2011 On motion of Councilman Fishman, seconded by Councilwoman Seligson, the Public Hearing was unanimously opened. Mr. Maker explained that with the dramatic increase in the number of grievances the work load for the Board of Assessment Review has become quite strenuous, adding it is difficult at times to maintain a quorum. Therefore, the recommendation is to enlarge the Board of Assessment Review from three members to five. Supervisor O’Keeffe asked if anyone wished to comment on the proposed Local Law. On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Supervisor O’Keeffe, it was unanimously RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed Local Law “Set the Number of Members of the Board of Assessment Review at Five, Continue the Supersession of the Portions of Section 523 1. (b) of the New York Real Property Tax Law that were Superseded by Local Law No. 11- 2005 and Supersede Portions of Section 523 1. (c) in the Town of Mamaroneck” Law is hereby declared to be a Type II Action, with no impact under the New York State Environmental Quality Review Act (SEQRA) and requiring no further action. On motion of Councilwoman Seligson, seconded by Councilman Odierna, the following Local Law was approved: Local Law No. 5 – 2011 This Local Law shall be known as “Set the Number of Members of the Board of Assessment Review at Five, Continue the Supersession of the Portions of Section 523 1. (b) of the New York Real Property Tax Law that 5 May 4, 2011 were Superseded by Local Law No. 11-2005 and Supersede Portions of Section 523 1. (c) in the Town of Mamaroneck” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows: Section 1 – Purpose. The Town Board concludes that the increased workload caused by the unusually high number of complaints regarding assessments filed in the last few years necessitates increasing the number of members of the Board of Assessment Review from its current three, plus one alternate member, to five, plus one alternate member. Section 2 - Amendment to an Existing Section of the Code of the Town of Mamaroneck § 5-7. Board of Assessment Review. A. Portions of section 523 1. (b) and (c) of the New York Real Property Tax Law hereby are superseded. Words enclosed in brackets are eliminated therefrom. Italicized words are new matter added thereto. Section 523 1. (b) and (c) of the New York Real Property Tax Law, as superseded below, shall apply in the Town of Mamaroneck. “Section 523 1.(b) The board of assessment review shall consist of not less than three nor more than five members and one alternate member appointed by the \[legislative body of the local government or village\] Town Board. The alternate member shall substitute for a regular member if such member is absent or is unable to participate because of a conflict of interest. When the alternate member sits in the place of a regular member, the alternate member shall possess all the powers and responsibilities of such regular member of the board. Members shall have a knowledge of property values in the \[local government or village\] Town (including its incorporated areas). Neither the assessor nor any member of his or her staff may be appointed to the board of assessment review. A majority of such board shall consist of members who are not officers or employees of the \[local government or village\] Town. (c) Except as modified by the last sentence of this section, the terms of office of members of the board of assessment review shall be five years and shall commence on the first day of October and terminate on the thirtieth day of September, five years thereafter. \[In the case of the first board appointed under the provisions of this title, however, the terms shall be of such length that not more than one will expire in each of the first five years after the members of such board are appointed.\] Since the positions of Member A, Member B, and Member C existed prior to the effective date of this local law, the dates on which the current terms of Member A, Member B and Member C expire shall remain the same. In order to provide for an orderly succession whereby only the term of one member expires in any given year, the first term of Member D shall expire on September 30, 2016, the first term of Member E shall expire on September 30, 2017 and the current term of the Alternate Member shall expire on September 30, 2012, instead of September 30, 2011.” B. The Board of Assessment Review, previously established by the Town Board, shall continue to exist. It shall consist of five members and one alternate member. The members shall be known as Member A, Member B, Member C, Member D, Member E and the Alternate Member. All of the members shall be appointed by the Town Board. In accordance with § 523(1)(e) of the New York Real Property Tax Law, annually the members of the Board of Assessment Review shall designate which of them shall serve as the Chairperson for that year. C. Except as modified in § 5-7D of the Code, the term of office of each member shall be five years and shall expire on the 30th day of September of the year in which the term expires. D. The term of office of: (1) Member A shall expire on September 30, 2013; (2) Member B shall expire on September 30, 2014; (3) Member C shall expire on September 30, 2015; (4) Member D shall expire on September 30, 2016; (5) Member E shall expire on September 30, 2017 and (6) the Alternate Member shall expire on September 30, 2012. E. If a person is appointed or qualifies as a member after October 1 of the year in which the term of that person's office was scheduled to begin, that person's term shall expire on September 30th of which that person's term is scheduled to expire even though the person shall have served less than five years. 6 May 4, 2011 Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye ADDED ITEM On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, the following was unanimously approved, WHEREAS, with the resignation of Jaine Elkind Eney a vacancy exists on the Board of Assessment Review. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby appoint Jeanne Kiernan, formerly an Alternate Member, to be Member B of the Board of Assessment Review, and BE IT FURTHER RESOLVED, that the foregoing appointment shall be effective immediately upon appointees taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on September 30, 2014. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O’Keeffe then on motion of Commissioner O’Keeffe, seconded by Commissioner Wittner, the Board of Fire Commissioners was unanimously declared open. Meter Charges 100.00 Total: 1,832.04 The above resolution was put to a roll call vote: Commissioner Fishman Aye Commissioner Seligson Aye Commissioner Odierna Aye Commissioner Wittner Aye Commissioner O’Keeffe Aye 2.Other Fire Department Business Commissioner Wittner read the Fire Report for the Month of April as submitted by Chief Collins as follows: April 2011 ALARM TYPE NUMBER Generals 25 Minors 18 Stills 1 Out of Town (Mutual Aid) 3 EMS 15 Drills 4 TOTAL 66 Total number of personnel responding: 856 Total time working: 33 hours and 58 minutes Commissioner Wittner noted that the Commissioners had received the Fire Council Minutes of April 4, 2011. 8 May 4, 2011 Commissioner Wittner read from the memo prepared for the Board by Mr. Altieri, detailing the recent fire in Saxon Woods. The fire covered a one half acre of the park and was contained by the Town Fire Department with assistance from the County’s Special Operations helicopter. Members of the Fire Department also entered the woods on foot to contain the fire. A terrific coordination effort took place between the County and the Town, with the Villages ready on hand. Fortunately, there were no injuries, but this was a serious event. Commissioner Fishman commended the Highway, Police and Fire Departments, for their rapid and tireless response to the fallen tree on Edgewood Avenue. Councilman Fishman noted how scary something like this can be when a tree falls on a windless night. Within minutes all emergency services were at the site. Six to eight homes were without power. Commissioner Wittner noted that the Fire Department will hold a Memorial Day Ceremony prior to the Larchmont Mamaroneck Parade on May 26 at 6:30pm. Commissioner Wittner noted that the Fire Council continues to talk about houses without clear or proper house numbers. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Update – Property Revaluation Mr. Altieri gave an update of the Revaluation Project. Mr. Altieri stated that the Request for Proposal was almost final and that Mr. Maker was working on a warranty provision. The document should be available on the Town’s web site by next week. With the contract not being awarded until August and the importance of collecting accurate data, the time frame for a revalued Assessment Roll will be 2014. The next step for the Town in this process is the appointing of a project manager. 2. Authorization – Project Administrator Property Revaluation Mr. Altieri explained the importance of a project manager. This role is similar in significance to a construction manager. The Board has met and interviewed Tom Frey, of Frey Appraisal & Consulting Services, Inc. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was, RESOLVED, that the Mamaroneck Town Board does hereby appoint Thomas Frey, of Frey Appraisal & Consulting Services, Inc. as Project Manager for the Town’s Property Reassessment Project at the monthly stipend of $5,500.00 to a maximum of 143,000.00, starting May 2011 thru June of 2013, for a total of $143,00.00, and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby approve an hourly rate of $75.00 per hour for services to assist the Town in grievances between June 2013 and September 2013. 9 May 4, 2011 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye 3. APPROVAL OF MINUTES On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of April 20, 2011. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS None SUPERVISOR’S REPORT Supervisor O’Keeffe announced the retirement of David Birch from the Larchmont Library Board, and read the following Proclamation: 11 May 4, 2011 PROCLAMATION - DAVID L. BIRCH WHEREAS: David L. Birch has been a member of the Larchmont Public Library Board of Trustees since June 1996; and WHEREAS: David has faithfully served during these past fifteen years by representing the Town of Mamaroneck; and WHEREAS: During his tenure David participated in, among other projects, the renovation of the library’s building and expansion of its services. WHEREAS: Because of his dedication and attention to the many aspects of this project, our community now enjoys the benefits of an updated building with a new and expanded Children’s Room; and WHEREAS: David has been a dedicated and diligent trustee truly exemplifying the kind of person who reflects what our community is all about. NOW, THEREFORE, BE IT RESOLVED, that I, Valerie Moore O’Keeffe, Supervisor of the Town of Mamaroneck, and the Town Board members hereby thank DAVID L. BIRCH for his many years of service to our community and our children and extend best wishes for whatever endeavors he pursues in the future. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 4th day of May 2011. 12 May 4, 2011 REPORT OF COUNCIL Councilman Fishman noted there were no Zoning Board Meetings over the past two months, also adding there were no applications. Councilwoman Seligson attended the Complete Streets presentation on April 28. Complete Streets is working on pedestrian and bicycle friendly streets. On April 28 LMC-TV hosted Awards Night, adding what a special event this was, a mini academy awards! Jen Graziano Mangano and her father were quite the host duo. Recipients seemed moved to receive their awards. Councilwoman Seligson stated how lucky the Town is to have such a comprehensive and excellent local access station. Supervisor O’Keeffe thanked Councilwoman Seligson for standing in for her during her absence. Councilwoman Wittner also stood in for Supervisor O’Keeffe at a Special Meeting of the Westchester Joint Water Works (WJWW). Councilwoman Wittner stated the importance of water conservation, adding this is not a renewable resource. Rates will continue to rise and there is not much more municipalities can do about it. Councilwoman Wittner noted the excellent article written by Joan Walsh, Harrison’s Supervisor. Supervisor O’Keeffe noted that at a recent meeting with the City of New York, there was discussion regarding water pressure problems. In certain areas last summer, residents were heavily watering their lawns causing pressure problems. The Westchester Joint Water Works will be monitoring irrigation by residents more carefully. Supervisor O’Keeffe also noted that the WJWW may consider a monthly billing system versus quarterly billing so residents will be able to monitor their usage more carefully. Councilwoman Wittner attended the Fire Council’s Meeting on May 2. Councilwoman Wittner announced th the upcoming celebration of Anderson’s Book Store’s 65 Anniversary this Saturday from 12:00-4:00 pm. th On May 19 the Washingtonville Housing Alliance will be honoring Supervisor O’Keeffe at their annual gala. th Councilman Odierna will attend the Planning Board Meeting on May 11. They will be focusing on Emerald th Tree Care located at 16 5 Avenue. The Mamaroneck Chamber of Commerce will meet tomorrow. The League of Women Voters will meet this Friday morning at Hector’s in Mamaroneck Village.
