MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON MAY 18, 2011, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, the Work Session was
unanimously opened at 5:00PM.
Police Chief Richard Rivera was in attendance.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Board unanimously agreed to
enter Executive Session to discuss employment history of particular persons, information relating to a
criminal investigation that would imperil effective Law Enforcement if disclosed and Collective Bargaining –
Police.

On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Board unanimously agreed to
reenter Work Session.
Capital Projects
Tony Siligato, Town Comptroller, was in attendance.
The Board reviewed two spread sheets prepared by Mr. Siligato. The first outlined the capital projects that
Mr. Siligato is recommending be closed out. This first schedule outlines the original budget, actual
expenditures, the sources of funding and the project fund balance or deficit. The second spread sheet
summarizes the inter-fund net transfers to finalize the closeout of the capital projects. This will be added
to the agenda of the regular meeting this evening.

350 Anniversary

Councilwoman Seligson and Christina Battalia gave an update on the plans for the 350 Anniversary. The
next committee meeting will be June 1.

Boards and Commissions
The Board discussed an additional Alternate Member of the Board of Assessment Review. The Board
would need to amend the Law recently passed. A Public Hearing will be set at the regular meeting this
evening. The Board discussed an additional stipend for the Members of the Board of Assessment Review.
Due to the added workload with respect to the large increase in grievances, it is necessary to compensate
the members accordingly. The Board will need to address how to compensate the Alternate Members.
Pryer Manor Access Road/Right-of-Way
Mr. Maker stated that he has been asked to review all the maps and easements. Mr. Maker believes there
is an existing easement that Mr. Doherty has currently covered in grass. Mr. Maker continued that if
correct, the statement by Mr. Doherty that he has no access, other than to use the right-of-way, is
incorrect. Mr. Maker is still working on the easements for 21, 23 and 39 Dillon Road. Mr. Maker also
stated that he did review the deed between the Town and Westchester County and determined that any
‘turning over’ of maintenance to the residents would not be within the rights of the current deed. The
Board is deferring a full discussion until June 1.
Westchester County Urban Consortium
Supervisor O’Keeffe noted the letter she received from Norma Drummond, Deputy Commissioner for
Westchester County Department of Planning. This letter is alerting the Town that it is time for the Urban
County Consortium to re-qualify with the Federal Government. The current agreement the Town has as a
member of the Consortium will automatically renew unless the Town chooses to opt out of the
Consortium. It is unclear to the Town whether they would be signing a renewal of the existing agreement
or a new version. The Town also discussed whether the Town would have any projects worthy of
Community Development Block Grants.
Update – Federal EPA Administrative Order
Mr. Altieri stated that there are two issues that need to be addressed before any remediation can begin.
One is to complete the DNA testing and the other is to resolve testing for sources of contamination. Mr.
Altieri stated that the EPA is not being punitive and that they are working with the municipalities to resolve
the problem. Mr. Altieri also stated that if any contamination is coming from the Village (s) there will need
to be joint funding.
CALL TO ORDER
The Regular Meeting of the Town Board was called to order by Supervisor O’Keeffe at
8:15 PM, she then pointed out the location of exits.
Supervisor O’Keeffe noted the agenda items discussed during Work Session and Executive Session,
reiterating to the audience that the Work Session is open to the public.

BOARD OF FIRE COMMISSIONERS
The meeting was called to order by Commissioner O’Keeffe, than on motion of Commissioner Wittner,
seconded by Commissioner Fishman, the Board of Fire Commissioners was unanimously declared open.

2.Other Fire Department Business
Commissioner O’Keeffe asked Mr. Altieri how the Senior Citizens’ were doing in their temporary location
at the Weaver Street Fire House.
Mr. Altieri responded that everything was working out well.
There being no further business to come before the Commission, on motion of Commissioner
Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned and the Town
Board reconvened.
Terms of Glenna Gray and Nancy
AFFAIRS OF THE TOWN
Wasserman were changed by
resolution of June 15, 2011. The
amended term for Glenna Gray expires
1.(3) Appointments – Board of Assessment Review
on September 30, 2011 and the
amended term for Nancy Wasserman
expires on September 30, 2012.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the resolution passed on April 20, 2011 appointing Glenna
Burkley Gray as the Alternate Member of the Board of Assessment Review is
rescinded, and
BE IT FURTHER
RESOLVED, that Glenna Burkley Gray be appointed as Member D of the Board
of Assessment Review, and
BE IT FURTHER
RESOLVED, that the foregoing appointment of Glenna Burkley Gray shall be
effective (A) immediately upon the appointee taking and subscribing the oath
mandated by section 25 of the New York Town Law and (B) shall expire on
September 30, 2016, and
BE IT FURTHER
RESOLVED, that Nancy C. Wasserman be appointed as Member E of the Board
of Assessment Review, and
BE IT FURTHER
RESOLVED, that the foregoing appointment of Nancy C. Wasserman shall be
effective (A) immediately upon the appointee taking and subscribing the oath
mandated by section 25 of the New York Town Law and (B) shall expire on
September 30, 2017.

Hearing on Adding an Additional Alternate to the Board of Assessment Review for June
1, 2011 at 8:00PM in the Court Room of the Town Center, and
BE IT FURTHER,

3.Report of Bids – TA-11-02 Sidewalk/Curb Replacement

On motion of Councilman Odierna, seconded by Councilwoman Wittner, the following was approved;
WHEREAS, on May 5, 2011 the Town publicly opened and read eight bids for Contract
#TA-11-02 Installation & Restoration – Sidewalks, Aprons and Curbs.
NOW, THERFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award Contract #TA-11-02
Installation & Restoration – Sidewalks, Aprons and Curbs to the lowest responsible
bidder Acocella Contracting for the total amount of $189,525.00.

RESOLVED, that the Mamaroneck Town Board does hereby approve the establishment

BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby approved the transfer of

the remaining balance of the 325 Anniversary Trust Fund into the 350 Anniversary

Trust Fund, and thereby closing the 325 Anniversary Trust fund.

5.Establish Capital Project - Property Reassessment Project
On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was
RESOLVED, that the Mamaroneck Town Board does hereby authorize the establishment
of Capital Project 2011.15 Account #H1355.0400.20111.15 Property Reassessment
Project, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby approve the transfer from
the Town-wide Unreserved Surplus to the above established account for the previously
authorized retainer fee of $25,000.00 for the Project Administrator for the
Reassessment Project.

6.Traffic Committee Recommendations – Forest Avenue & Edgewood Avenue
On motion of Supervisor O’Keeffe, seconded by Councilwoman Seligson, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on the Recommendation of the Traffic Committee to install two stop signs on
Forest Avenue for June 1, 2011 at 8:00PM in the Court Room of the Town Center, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said notice, be
posted
.
On motion of Supervisor O’Keeffe, seconded by Councilwoman Wittner, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on the Recommendation of the Traffic Committee to restrict parking on
Edgewood Avenue between the hours of 9:00 am and 10:00 am Monday – Friday, for
June 1, 2011 at 8:00PM in the Court Room of the Town Center, and
BE IT FURTHER,

RESOLVED, that as provided for in the 2011 Town Budget the Mamaroneck

Salary Authorizations – Police
With the retirement of Lieutenant Gerald McCarthy it is necessary to promote a Detective to the position of
Detective Sergeant.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Mamaroneck Town Board does hereby promote Sergeant
Matthew Mehlrose to the position of Detective Sergeant at an annual salary of
$113,910.00, effective immediately.

It is necessary to fill the position left vacant with the promotion of Sergeant Matthew Melhrose to the
position of Detective Sergeant.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Mamaroneck Town Board does hereby promote Officer Rui
Sandiaes to the position of Sergeant and will be assigned to supervisory duties in the
Patrol Division at an annual salary of $107,725.00, effective immediately.

9. Authorization – Close out Capital Projects and Inter-Fund Transfers
Mr. Altieri explained that at this time of year as the Town completes its Annual Financial Audit, all capital
projects are reviewed. Part of that process is to recommend to the Town Board closing of those projects
that are no longer active and to make the necessary transfers to finalize the close out.
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the closeout of
the following Capital Project Accounts and approves the inter-fund transfers
necessary to close these accounts as follows:
The schedule(s) prepared by Tony Siligato will be
inserted into the Minutes in the final version for
the Minute Book.

APPROVAL OF MINUTES – May 4, 2011
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was
unanimously
RESOLVED, that the Mamaroneck Town Board does hereby approve
the Board Minutes from the Meeting of May 4, 2011.
ORAL COMMUNICATIONS
George Roniger, Larchmont Gardens’ Civic Association, addressed the Board. Mr. Roniger asked about
what is done to mitigate flooding around the brook during a rain event?
Mr. Altieri responded that in advance of a storm, water levels are lowered in the reservoir and the flow
downstream is regulated through a valve. Mr. Altieri noted that the last time the brook overflowed was in
April of 2007.
Councilman Odierna stated that he feels the catch basins are not being emptied often enough.
Supervisor O’Keeffe stated that maybe the Town should consider creating a special district to address the
costs of maintaining the lake as a body of water.
Councilman Fishman noted that the Board has discussed the fact that the community at large cannot
continue to fund the maintenance of an artificial lake that wants to be a marsh.
Councilman Odierna asked Mr. Altieri if he could provide an annual report with measurements of the
amount of material being removed from the catch basins.
Mr. Roniger stated that the Larchmont Gardens’ Civic Association is not unaware of this problem.
Mr. Roniger announced the upcoming Spring Fling on May 21 and the Annual Meeting on May 23. County
Executive Astorino will address the Association at its’ Annual Meeting.

REPORT OF COUNCIL
Councilwoman Seligson thanked the Traffic Committee for all their work, adding as liaison she is very
aware of the hard work they do. Councilwoman Seligson noted that she, Christina Battalia and Jen

Mangano, as well as the entire 350 Committee, are very hard at work.
Councilwoman Wittner announced that Assemblyman George Latimer will be hosting a discussion of the
problems with Metro North at the Town Center, May 25 from 7:30-9:15PM. Councilwoman Wittner
congratulated Robert Herbst on receiving another heavyweight title.
Councilman Odierna attended the Recreation Commission Meeting on May 10, noting that camps are filling
up nicely. Councilman Odierna noted the recent meeting of the Planning Board. Councilman Odierna
attended the Board of Architectural Review on May 16. Of note was their approval of additional signage
for the High Tech Carwash. At the Meeting, there was also discussion of the historic status of the
apartment building on Boston Post Road and Dillon Road.
Supervisor O’Keeffe announced the upcoming Memorial Day events. Residents can view the full listing on
the Town’s Website.

Supervisor O’Keeffe read an announcement from the Larchmont Mamaroneck Sanitation Commission that
residents can now recycle numbers 1-7 in instead of just numbers 1-3.
Councilwoman Seligson continued stating she has been waiting years for this moment!! She emphasized for
residents that based on the recycling symbol on the bottom of all plastics that now virtually all plastics are
recyclable, including caps.
Supervisor O’Keeffe congratulated the Town Clerk on her son Myles Monaghan’s graduation from
Haverford College.
