HomeMy WebLinkAbout2013_01_23 Town Board Minutes January 23, 2013 MINUTES OF THE SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON WEDNESDAY JANUARY 23, 2013, AT 5:00PM IN CONFERENCE ROOM A OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator CALL TO ORDER On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Meeting was unanimously opened at 5:00PM. Additionally Present: Ms. Chateauvert, Elkan Road. Ms Chateauvert was present on behalf of her elderly parents. Mr. Altieri explained that the Town Board needs to set a Public Hearing to discuss Amending Section 458 of the New York Real Property Tax Law (“Section 458”). This section affords certain veterans of military service or certain members of their families who own real property, a limited exemption from real estate taxes based upon what the statute calls “eligible funds”. Under section 458, the maximum amount of the partial exemption is $5,000. Since properties in the Town currently are assessed at only a fraction of their actual value, a $5,000 maximum affords a veteran a reasonable exemption. However since the Town Board anticipates that the assessments of real property in the Town will be revalued to reflect their full value in time for the promulgation of the 2013 tentative tax assessment roll, the exemption allowed by section 458 will be significantly diminished if the maximum amount of the exemption remains fixed at $5,000. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Amending Section 458 of the New York Real Property Tax Law (“Section 458”) for Wednesday February 6, 2013 at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice, be posted. The Board thanked Ms. Chateauvert for attending, at which she stated that she now realizes this was a formality and will inform her parents of the same.
