MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JUNE 23, 2015, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was
unanimously opened at 5:00PM.
Mr. Altieri noted that the paperwork was not completed yet for the bid documents for TA-15-05 – Road
Resurfacing, just opened yesterday, and the accompanying Intermunicipal Agreement (IMA), and asked the
Town Board if they would be available for a special meeting next week to approve the bid and authorize
the IMA, and the Board replied yes.
Review of 2015 Goals and Objectives

Discussion – Durham Road – Stormwater and Access Maintenance Agreement
Mr. Maker explained that a condition for approval of the Durham Road Subdivision is for the developer to
construct and maintain a system to control storm water runoff pursuant to the plans approved by the
Planning Board’s consulting engineer. Mr. Maker continued and gave details of the Form of Access
Easement and Maintenance Obligation 1 Durham Road. Mr. Maker stated that this form is an attachment
that is part of the certified resolution of the Planning Board.
Review of Request – Pryor Manor Association
Additionally Present: Kimberly Pardiwala, representing the Pryor Manor Association
Mr. Altieri’s memo dated June 4, 2015 explains that ‘the Pryor Manor section of the Town is made up of
Pryor Manor Road, Dogwood Lane and Pheasant Run. The area is somewhat unique because the City of
New Rochelle and the Town of Mamaroneck border intertwines throughout the neighborhood. Residents
are often confused about where they live and who provides municipal services.”
Ms. Pardiwala explained that the Association, made up of 40 homes in the area, have joined together to
work on resolving issues in the area such as speeding, cut through traffic, loitering, and illegally parked
cars. The Association has been working with the City of New Rochelle, and Steve Altieri on changes to
signage that they believe will help solve these issues. Ms. Pardiwala explained the street signs and traffic

signs being proposed. The Association has hired a traffic consultant engineer, whose proposals the Town

Board reviewed. The Town Board agreed to view the area and discuss further at the July 22 Town Board
Meeting.
Review of 2014 Financial Audit – O’Connor Davies
Alan Kassay and Larry Feldman presented the 2014 Financial Statements and Auditor’s Report, as well as
the Communication of Internal Control Matters Identified in the Audit to the Town Board. The Town Board
reviewed the highlights of the financial statements with Mr. Kassay.
Mr. Kassay will present the 2104 Financial Audit to the public this evening.
On motion of Supervisor Seligson, seconded by Councilwoman Elkind Eney, the Board unanimously agreed
to enter into an Executive Session to discuss an appointment to the Planning Board and interview a
possible candidate.

Assessment Administration Update
Additionally Present: Pamela Valenza, Town Assessor and Daniel Pietrosanti, Deputy Town Assessor
The Town Board reviewed the presentation for this evening and Supervisor Seligson stated that residents
may be in attendance.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed
to enter into an Executive Session to discuss an appointment to the Planning Board and interview a
possible candidate.

to resume the Regular Meeting.
Discussion – Westchester County – Sewer System Evaluation and Repairs
The Town Board reviewed the Agreement that is on the Regular Agenda for this evening. The Town Board
emphasized the need for outreach to the public, and to further discuss the insurance option. The timing of
the local law for January 2016 is also important to keep in mind, and Supervisor Seligson reminded the
Town Board that the local law is to televise the sewer lines, not to fix them.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed
to enter into an Executive Session to discuss an appointment to the Planning Board and interview a
possible candidate.

On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed
to resume the Regular Meeting.
Discussion - Proposed Water Rate Increase
The Town Board reviewed a memo from Mr. Altieri dated June 19, 2015 explaining the proposed water rate
increase. Factors for this increase are the New York City water rate increase of 10% and several capital
project improvements to the water transmission system and compliance with the New York State Health
Department requirements for filtered water.

The Town Board will move the actual vote of an increase until the July 23 Town Board meeting so a
presentation can be made to the public.
Discussion – Community Choice Aggregate Legislation

The Town Board reviewed the legislation and discussed setting the public hearing for the July 23 Town
Board Meeting.
On motion of Councilwoman Katz, seconded by Councilman Murphy, the Board unanimously agreed to
enter into an Executive Session to discuss Certiorari involving Stanley and Linda Quittman.

CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
SUPERVISOR’S SUMMARY REPORT
I know there has been some confusion about the assessment update letters that were sent out June 1.
Tonight we will have a presentation from the Town Assessor and Gar Associates with help from Steve
Altieri to clear up any confusion. I would like to remind people that the Town completed a revaluation
two years ago for the first time since 1968. It cost the Town $1.3 million and we did it because we were

having difficulty defending our assessment role. Lots of people were filing grievances and claims
forcing the Town to pay lawyers and settlements because we couldn’t defend such an old role. We also
wanted to make sure that we were apportioning the taxes fairly. The reassessment brought the
assessments of all parcels to full market value or 100% valuation. We are now obligated to keep those
assessments at 100% in order to keep full market value and not waste the money we spent on the
reassessment.
Hommocks Pool, owned by the school district and used mostly by the Town of Mamaroneck, is now
open for summer hours. I hope everyone enjoys that. There is a new street sign at Central School and
Palmer Ave. called Sal’s Crossing honoring Sal Margliotta, the long-time and well-loved crossing guard
there who passed away a few months ago. The MHS Varsity Baseball team won the Double AA NY
State Championship! Congratulations!
I want to congratulate and welcome Justin Datino who was sworn in as the first Village Administrator
of the Village of Larchmont. We look forward to working with him. There is a new event deck on the
Hommocks ice rink floor for the summer to allow for indoor play and sports for the Town’s summer
camp. The Town’s outdoor summer concert series starts Monday July 6 at 7:00 pm and runs for four
consecutive Mondays. These are wonderful community events at Memorial Park.
There is a fire district referendum in progress. If you live in the unincorporated part of the Town of
Mamaroneck you are eligible to vote in the referendum at the Mamaroneck Fire House on Weaver
Street. The polls close at 9:00 pm and we look forward to hearing the results later this evening.
Please remember that gasoline powered leaf blowers are banned in the three municipalities from June
1 to September 30. That means you may not use them. Today was a very hot day and extreme heat
puts pressure on the power grid. It is possible to have black outs and brown outs. People should be
prepared for a temporary power outage. Please remember that in the event of a power outage you
need to call Con Ed directly. They need to hear from residents and their addresses directly.
CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not.
PRESENTATION – Assessment Update
Additionally Present: Town Assessor, Pamela Valenza, Deputy Town Assessor, Daniel Pietrosanti, Dave
Barnett, GAR Associates
Ms. Valenza began by giving a PowerPoint with an overview of the recent questions asked by residents
over the last few weeks. Mr. Barnett continued with the presentation, to explain the methodology used by
the Town to determine which assessments the Town would update. Mr. Altieri continued the presentation
by explaining the difference between assessment and taxes.
Ruth Campanelli addressed the Town Board and stated that the biggest problem was lack of
communication. There was no warning of this coming and hence there was a lot of chatter and a lot of
misinformation.
George Roniger addressed the Town Board stating that although he understands that a lone home ‘knock
down’ with a significantly larger home being built, would not affect your assessment, he questions how
multiple ‘knock downs’ of a homes can affect your assessment. Mr. Roniger also asked if everyone’s
assessment went up 10%, Mr. Barnett responded no there were different percentages.
PRESENTATION – 2014 Financial Audit
Supervisor Seligson introduced Alan Kassay and Larry Feldman of O’ Connor Davies, LLP. Supervisor
Seligson stated that Mr. Kassay and Mr. Feldman presented the financials to the Town Board during this
evening’s Work Session and is here to present the Auditor’s Report to the public.

1. Set 2015 Sewer Rent Rate
The following Notice of Public Hearing is entered into the record as follows:
NOTICE OF PUBLIC HEARING
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New
York, and pursuant to a resolution of the Mamaroneck Town Board adopted on June 3, 2015 a
Public Hearing will be held on Tuesday, June 23, 2015 at 8:00 PM or as soon thereafter as is
possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider, setting
the Sewer Rent Charge for 2015.
Purpose:
Local Law #7 adopted in 2014 provides for the charging a sanitary rent as an alternative to the ad
valorem tax used in the past. Section174-3 of the legislation provides that the Town Board will
annually set the rate per gallon based upon water consumption. This hearing is to discuss the
Sewer Rate rent charge for 2015.

Mr. Altieri presented a PowerPoint to explain the Sewer Rent Fee.
On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, it was
RESOLVED, that the Mamaroneck Town Board finds that the adoption of the Sanitary Sewer
Rent Fee, provided for in Local law 7-2014, is hereby declared to be a Type II Action, with no
impact under the New York State Environmental Quality Review Act (SEQRA) and requiring
no further action.

On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the following was approved,
WHEREAS, Local Law 7-2014 provides for the charging of a sanitary sewer rent as an alternative to

the ad valorem tax that as provided by Section 174-3 of the legislation provides that the Town
Board will annually set the rate per gallon based upon water consumption.
NOW THEREFORE, BE IT

will be held on Tuesday, June 23, , 2015 at 8:00 PM or as soon thereafter as is possible at the Town Center,
740 W. Boston Post Road, Mamaroneck, New York to consider, “Restriction on Parking on a Section of the
East Side of Palmer Avenue and on the Entire Length of Howell Avenue, Hawthorne Road and Carleon
Avenue” Law.
Section 1 – Purpose.
Commuters continue to park on Palmer Avenue, Howell Avenue, Hawthorne Road and Carleon Avenue to
the detriment of the neighborhood. To relieve that intrusion upon the peace and tranquility of the
residents, the Town Board has decided to prohibit parking for part of each weekday, thereby preventing
long term parking by commuters.

Local Law No. 7 - 2015
This local law shall be known as the “Restriction on Parking on a Section of Sheldrake Avenue on
School Days” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The Town Board finds that it is prudent to outlaw parking and standing of motor vehicles during
certain hours on school days on the section of Sheldrake Avenue that runs between Forest Avenue and
Holly Place. This law does that.
Section 2 – Regulation of Parking on a section of Sheldrake Avenue:
When school is in session, no motor vehicle shall be parked or shall stand on that section of the
east side of Sheldrake Avenue that runs between Forest Avenue and Holly Place between 8:00 AM and 9:00
AM (prevailing time) and between 2:30 PM and 3:30 PM (prevailing time).
Section 3 – Sign(s) to be Erected and Painting to be Done:

An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on
the surface of Sheldrake Avenue indicating where and when parking is prohibited by this law.
Section 4 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions.
Section 5 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

4. “Restriction on Parking on a Section of the West Side of Palmer Avenue and the Expansion of Overnight
Parking on a Section of the West Side of Palmer Avenue” Law
The following Notice of Public Hearing is entered into the record as follows:
NOTICE OF PUBLIC HEARING
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York,
and pursuant to a resolution of the Mamaroneck Town Board adopted on June 3, 2015 a Public Hearing
will be held on Tuesday, June 23, 2015 at 8:00 PM or as soon thereafter as is possible at the Town
Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Restriction on Parking on a
Section of the West Side of Palmer Avenue and the Expansion of Overnight Parking on a Section of the
West Side of Palmer Avenue” Law.
Section 1 – Purpose:
Palmer Avenue between Weaver Street and Richbell Road has traffic congestion issues due to the
proximity of Central School, particularly when the students are being dropped off or picked up. During
those periods especially there would be a distinct advantage in having two southbound lanes of traffic
so that while the left lane serves as a queue for motor vehicles making a left turn into the Central
School campus, the right lane can carry traffic southbound unimpeded by motor vehicles waiting to
make left turns.
There also is a need for overnight parking for both the residents of Palmer Avenue between Blossom
Terrace and Richbell Road and the residents of the nearby Larchmont Acres apartments.

subsequently it will be adjourned.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was
unanimously adjourned until July 23, 2015.

The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Murphy,
seconded by Commissioner Elkind Eney, the Board of Fire Commissioners was unanimously declared open.

DISTRICT TO PAY THE COST THEREOF", duly adopted by the Board of Fire Commissioners of
said Fire District on the 13th day of May, 2015, be approved?

PROPOSITION NO. 2: FIRE-FIGHTING VEHICLES
Shall the bond resolution entitled: “BOND RESOLUTION DATED MAY 13, 2015.
A RESOLUTION AUTHORIZING THE PURCHASE OF FIRE-FIGHTING VEHICLES FOR THE
MAMARONECK FIRE DISTRICT IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY,

5) On the 9 day of June, 2015 a meeting of the Inspectors of Election was held at the time and

place specified in the Resolution of the Board of Fire Commissioners adopted May 13, 2015. At said meeting
a register of all persons entitled to vote in the election was prepared containing the names of all persons
residing in said Fire District and qualified to vote in said election whose names were on the registration list
certified and supplied to said Fire District by the Westchester County Board of Elections as of a date twenty-
three days before the date of said election. All of the votes described above were of voters whose names
appear on the register prepared at such meeting.

9.Authorization – Durham Road – Stormwater and Access Maintenance Agreement
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the Form of Access Easement
and Maintenance Obligation 1 Durham Road, amended to remove the word ‘mortgage’ from term
number 15 in the agreement, and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to sign said Agreement on
behalf of the Town.

11. Appointment of Planning Board Chair.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy , the following was
approved,
WHEREAS, with the resignation of John Ortiz as Member C and as Chair of the Town of
Mamaroneck Planning Board, a vacancy now exists.
NOW THEREFORE, BE IT
RESOLVED, that Ralph Engel be moved from the status of Alternate Member to
Member C of the Planning Board, and
BE IT FURTHER

1. Set Public Hearing - Community Choice Aggregation Legislation
On motion of Councilman Murphy, seconded by Councilman Odierna, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on the “Establishment of a Community Aggregation (Energy) Program in the
Town of Mamaroneck” Law, for July 23, 2015, at 8:00PM in the Court Room of the
Town Center, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said Notice, be
posted.
2.Report of Bids – TA-15-03 Town Center Roof Replacement
On motion of Councilman Murphy, seconded by Councilman Odierna, it was determined that
WHEREAS, based on the recommendation of the Town’s Construction Manager, the fact that bids
received were higher than expected, and that the amounts shown for the alternates by the bidders
indicates that there may have been some misunderstanding of the alternates, it is recommendation
of the Town Administrator that the bids be rejected.

4.Authorization – County of Westchester - Sewer System Evaluation & Repairs
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved,
WHEREAS, the Town of Mamaroneck owns and operates tributary sewer system (s) that use the
Westchester County sewer system and are subject to the provisions of the Westchester County
Environmental Facilities (WCDEF) Sewer Act set forth in Chapter 824 of the Laws of Westchester
County, and

WHEREAS, Westchester County conducted the “Long Island Sound Sanitary Districts Flow
Monitoring Report (dated September 2012, revised June 2013) in accordance with its obligations
under an Order on Consent with the New York State Department of Environmental Conservation
entered into in 2004 and amended in 2008, which requires among other things, the reduction of
inflow and infiltration into the County trunk sewer and tributary systems, and
WHEREAS, the Town of Mamaroneck agrees to, among other things set forth in this agreement,
submit to the WCDEF, by April 1, 2015, a proposed work plan for a Sewer System Evaluation Study
(SSES) of their entire sanitary sewage collection system tributary to the County’s trunk sewer
system, develop a Capacity Management Operation Maintenance (CMOM) Program, submit
quarterly reports to the WCDEF documenting their progress, commence its CMOM program on or
before December 31, 2015, complete its SSES on or before June 30, 2017, submit to the WCDEF and
NYSDEC an approvable construction schedule on or before August 31, 2017, and by January 1, 2016,
prepared and submit to its governing body a local law prohibiting storm water and sump pump
connections to the sanitary sewers.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve the Agreement between the
County of Westchester and the Town of Mamaroneck, for the sewer system evaluation and repairs,
and
BE IT FURTHER
RESOLVED, that the Town Administrator is hereby authorized to sign said Agreement on
behalf of the Town.

On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved,
WHEREAS, the Town has received a local foundation grant to replace the walk signal buttons at the
intersection of North Chatsworth Avenue and Myrtle Boulevard with newer buttons that are larger
and easier for senior citizens and disabled persons to use when crossing.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Comptroller to
transfer the donated funds in the amount of $4,200 into the Traffic Control Operating Budget
Account as detailed by the Town Comptroller in the following schedule:

REPORT OF COUNCIL
Councilman Murphy attended the LMC-TV Awards Night, noting it was a wonderful event. Councilman

Murphy announced the upcoming Fireman’s Parade on July 1 and the always fantastic July 4 Fireworks at
Harbor Island.
Councilman Odierna also noted his attendance at the LMC-TV Awards, with a special congratulations to

Tom Murphy for being nominated for his show. On June 16 Councilman Odierna attended the Summit
th
Meeting, at which Supervisor Seligson presented. On June 13 at the Larchmont Yacht Club, the Rotary
Club installed its District Governor, additionally they are working on the bike rack installations. He
attended the Larchmont Gardens’ Civic Association’s Annual Meeting, the big topic being the Assessment
thth
Update. The Health Fair on June 6 was another successful event. On June 4 Councilman Odierna
attended the Village of Mamaroneck Chamber of Commerce Meeting. He looks forward to graduation for
his grandson Noah, a senior at Mamaroneck High School, and graduation for his granddaughter, Ruby, from
Hommocks Middle School.
Councilwoman Katz attended an exciting meeting of the Coastal Zone Management Commission last night
as they were shown the plans for the renovated Lorenzen Field, a project that the Fields for Kids is helping
to fund. The Coastal Zone Management Commission continues to work on the Local Waterfront
Revitalization Plan. Councilwoman Katz attended the Traffic Committee Meeting, a large topic was the
proposals from the Pryor Manor Association, of which the Town Board addressed this evening in
Worksession. She also attended the Library Board Meeting, adding that they continue with fundraising for
the Transformation Project, set to start in January 2016.
Councilwoman Elkind Eney noted that many of the meetings and events she attended her colleagues have
spoken about. Councilwoman Elkind Eney added that she attended the Recreation Commission Meeting,
noting the pool is open for summer hours, residents can renew permits through the Recreation Office.
Town Clerk Christina Battalia announced that her son, Liam Monaghan, will graduate from Mamaroneck
High School tomorrow evening – the last of the Monaghan’s.
