REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK,
HELD OCTOBER 3 , 1945
In the Council Room of the 'Thaver Street Fire House , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern Standard Time) .
Present : Supervisor Mandeville
Councilmen Keeler , Stiner , Embury , F,atson
The presence was also noted of Town Clerk Payne, Town
Attorney Delius , Assessor Smith , and Accountant Finson.
The minutes of the meetings of September 5th and Sep-
tember 19th , 1945, were approved with corrections.
The Supervisor requested the Town Clerk to read the
communications.
The Town Clerk reported that there were no communications.
The following reports for the month of September , 1945,
were received and ordered filed : Report of the Receiver of Taxes
and Assessments; Report of the Building Inspector: Report of the
Plumbing Inspector ; Report of the Westchester County Dog Protective
Association.
The Town Clerk presented and read the affidavit of the
publication of the advertisement which appeared in the Daily Tines
on September 24, 1945, for the sale of Town-owned properties.
The Supervisor informed those present that it would be
in order to proceed with the opening of the bids. He asked if there
was any one present who wished to file a sealed bid for the property
offered. No one replied. The Supervisor then directed the Town Clerk
to open the bids which showed as follows:
For the property described as eight (B) parcels in the Larchmont Ridge
and Fenimore Cooper Park area in the unincorporated section of the
Town, the following bid was received:
From Mr. Alan L. Carnoy , as broker , on behalf of Westchester
Land & Homes Company - Bid $30 ,000. ($12 ,000 in cash, $18 ,000.
• in purchase money mortgage for three years to bear interest at
rate of 6%. ) A certified check in the amount of $3 ,000 was
attached to the bid.
No other bids were offered on this property.

The members of the Board decided to defer action on the
above bid until later in the meeting.
For the property described as Block 934, Parcel 29 on the assessment
map of the Town, also known as Lots 29, 30 , 31 , 35 and 36 on map en-
titled "Map of Eagle Hummocks" Town and Village of Mamaroneck, West-
chester County , New York, the following bids were received:
MORRIS STERN AGENCY, on behalf of Jacob Ackerman and John
Baltz , $4,350. cash. A certified check for $435. was attached.
PETER C . DOERN, JR. , INC . , on behalf of George M. Mayer ,
$7,150. One-half cash , balance on terns. A certified check
for $715. was attached .

BARNEY EPSTEIN, INC. , on behalf of Bernard Feterson, $5,250.
cash. A certified check for $525. was attached .
The members of the Board decided to defer action on the
above bids until later in the meeting.
The Supervisor asked if any of the bidders who were present
wished to say anything. No one responded. The Supervisor then asked
if there was any one present who wished to address the Board.
Mr. Richard Wood appeared and asked if he might discuss
with the members of the Board the matter of settlement on the tax
liens against the properties in the Pockcliffe Estates , Inc. Mr.
Wood offered to pay the face amount of the tax liens on the property
on Bonnie ray and Briar Close on which the torn has brought foreclosure
proceedings.
There was some discussion as to what this would amount to
in dollars and cents. As there were no figures at hand , it was decided
to defer consideration of this offer until the amount could he de-
termined.
The Supervisor asked if there was any one else who wished
to appear before the Board. There being no one , he suggested that
the meeting proceed with the reports of committees.
Councilman Watson stated that there was nothing to report
for his Departments. He presented and read the following petitions
received from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes .
On notion by Councilman Watson, seconded by Councilman
Embury, the following resolution was , upon roll call , unanimously
adopted :
WHEREAS , the Assessor has presented petitions for
the correction of the assessment roll for certain
years , pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 , as amended , known
as the Westchester County Tax Act ; and
WHEREAS , after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll ;
NOW, THEREFORE , BE IT
RESOLVED, that the assessment roll for the year 1945,
taxes of 1946 , which shows property now appearing on
the roll as follows :

Councilman Embury stated that he wished to call to the
attention of the members of the Board the publicity given the im-
proved area between the Town Railroad Station and the Platform. He
pointed out that it is being recognized as a beauty spot. He referred
to items in a New York newspaper , the local newspaper and the Rider' s
Digest , a Railroad publication. Copies were passed around to the
members of the Board. It was noted in the articles that credit was
due to the cooperation of the Town Park Commission, the Railroad
Company , and groups of interested citizens.
Councilman Embury stated that while there would be dis-
cussion later on the tentative budget for 1946 , he wished to say at
this time that the Park Commission contemplates putting in one-half
of the total estimated cost of the proposed permanent war memorial ,
the idea being to try to get the Village of Larchmont to stand their
proportionate share . He suggested that the Surervisor contact the
Mayor of the Village of Larchmont.
The Supervisor made some recomrendntions which included
spreading the cost of the construction of the Memorial over a period
of two years. The matter was left until later discussions are held
on the budget.

Councilman Stirrer stated that he had only one matter to
report and that is that the Garbage collection service has improved .
Councilman Keeler reported for his Departments by stating
that the new oil storage tank for the Fire House and Community Build-
ing had been installed. Also that the paid men had painted the wood-
work on the exterior of the building.
The Supervisor informed the Board that since the last meet-
ing he was successful in getting Mr. Frank Guadagnolo to increase his
offer for the purchase of the liens on Block 126 , Parcel 11. He re-
commended that the sale be approved.
It was on motion by Councilman Stiner, seconded by Council-
man Fmbnry , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized , empowered
and directed to sell by assignment to Mr. Frank
Guadagnolo, the following tax liens on property
known as Block 126 , Parcel 1 , at the face amount
of the liens , provided payment is made within
thirty days:

The Supervisor reported that due to negotiations started
by Mr. Richard Wood for settlement of tax liens on the properties held
in the name of one of his corporations that the offer of Mr. Alan L.
Carnoy for the purchase of the liens be declined. The Supervisor
explained that the Town would benefit by a greater amount of money
from the present owners.
On motion duly made and seconded , the Supervisor was
authorized to return the bid check of $1,000. to Mr . Carnoy of Glenn
Building Corporation.
The Supervisor informed the members of the Board that he
had at hand a letter from Mr. Neal R. Andrews with a check attached
in the sum of 82,000 as proof of good faith with his offer of $20 ,463.38
for full payment of all taxes and tax liens held by the Town on property
at Edgewater Point , which is listed on the assessment roll in the name
of either Satan' s Toe , Inc. , or Neal R. Andrews. This amount , he said ,
represents the face amount of the unpaid taxes.
The members of the Board discussed the proposal with the
Supervisor, and it was secided that if. the Supervisor could determine
the time in which Mr. Andrews would complete his full payment that
the Board would he inclined to take the offer.
Following further discussion, it was on motion by Council-
man Keeler , seconded by Councilman Stiner , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized , empowered
and directed to accept payment of the following
tax arrears on the following described properties ,
at the face amount without penalties and interest ,
to be assigned to Neal R. Andrews , 730 Fifth Avenue ,
New York City:

submitting herewith an offer to purchase the tax liens

purchase of tax liens owned by the Village on a similar
basis . Same was approved at the special meeting of the
im Village Board on October 1st , and the offer as made , was
contingent upon the approval of the Town Board for the
above enumerated liens.
Your early consideration is appreciated. If the above
offer is acceptable, completion of the transaction will

be concluded with 10 days from acceptance.

The members of the Board discussed the proposal at length
following which it was on motion by Councilman Keeler , seconded by
Councilman Enbury, upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized , empowered
and directed to accept payment of the following
taxes on property known as Block 932 , Parcel 46 ,
at the face amount of the liens , to be assigned
to Henry Schultz and Lilyan Schultz , 1385 Broadway ,
New York City , providing payment is made within
thirty days:

The Supervisor read a letter dated October 2 , 1945, re-
ceived from Village Manager Wm. H. Johnson in which Mr. Johnson
advised that the Mamaroneck Village Board had approved of the sale
of four parcels of land by resolution at their meeting held October 1 ,
1945. Certified copies of the resolutions were attached. Fe asked
that the Town Board consider the sale of these properties.
After a lengthy discussion , it was on motion by Councilman
Stiner, seconded by Councilman Keeler, upon roll call , unanimously
resolved: `
`WHEREAS , the Village of Mamaroneck has heretofore
acquired by referee ' s deed or deed in lieu of fore-
closure , property known as Section 8, Block 82,
Lots 24, 25, 26 , on the tax assessment map of the
Village of Mamaroneck.; and
WHEREAS , the Town of Mamaroneck owns certain tax
liens upon the sane property which is known upon
the tax assessment map of the Town of Mamaroneck
as Block 819, part of Parcel 23 , representing
arrears of taxes due it which were heretofore
levied against said property; and
WHEREAS , the Village of Mamaroneck , by resolution
duly adopted October 1 , 1945 accepted an offer from
Dominick Lanza for the purchase of the property in
the amount of 51 ,461 .00 , which acceptance , however ,
is conditioned upon similar action being taken by
the Town Board of the Town of Mamaroneck; and
WHEREAS , this Board considers it to the best interest
of the Town of Mamaroneck to approve such offer and to
authorize the sale to the end that the property may he
sold free and clear of all taxes and the proceeds of
sale , if any , divided ,

NOW , THEREFORE , BE IT
RESOLVED , that the Town Board of the Town of Mamaroneck
agrees that property known as Section 8, Block 82 ,
Lots 24, 25, 26 on the tax assessment map of the Village
of Mamaroneck, and known upon the tax assessment map of
the Town of Mamaroneck as Block 219 , part of Parcel 23 ,
be sold for the sum of 51 ,461.00.
FURTHER RESOLVED, that the net proceeds of such sale
shall be divided between the Town of Mamaroneck and the
Village of Mamaroneck proportionately to the amount due
each as of the date of such sale.
On motion by Councilman Stiner, seconded by Councilman Keeler ,
the following was , upon roll call , unanimously adopted:
WHEREAS, the Village of Mamaroneck has heretofore
acquired by referee ' s deed or deed in lieu of fore-
closure , property known as Section 8, Block lee ,
Lots 5, 6, 7, 20 , 21 , 22, 27 , 24, on the tax
assessment map of the Village of Mamaroneck; and
WHEREAS , the Town of Mamaroneck owns certain tax
liens upon the sane property which is known upon
the tax assessment map of the Town of Mamaroneck
as Block 826 , Parcel 445 and Block 826 , Parcel 353 ,
representing arrears of taxes due it which were
heretofore levied against said property; and
WHEREAS , the Village of Mamaroneck, by resolution
duly adopted October 1 , 1945 accepted an offer from
Hanriness Laundry , Lrc . , for the purchase of the
property in the amount of $1 ,680.00 , which accept-
ance , however , is conditioned upon similar action
being taken by the Town Board of the Town of
Mamaroneck; and
WHEREAS , this Board considers it to the best interest
of the Torn of Mamaroneck- to approve such offer and
to authorize the sale to the end that the property
may be sold free and clear of all taxes and the
proceeds of sale , if any , divided ,
NOW, THEREFORE , BE IT
RESOLVED, that the Town Board of the Town of Mamaroneck
agrees that property '1nown as Section 5, Block 100,
Lots 5, 6 , 7 , 20 , 21 , 22 , 23 , 24 on the tax assessment
map of the Village of Mamaroneck, and known upon the
tax assessment map of the Town pf Mamaroneck as Block
826 , Parcel 445 and Block 826 , Parcel 353 , be sold
for the sum of 51 ,680.00.

shall be divided between the Town of Mamaroneck and
the Village of Mamaroneck proportionately to the

liens upon the same property which is known upon
the tax assessment map of the Town of Mamaroneck
as Block 823 , part of Parcel 9, representing arrears
of taxes due it which were heretofore levied arainst
said property: and
WHEREAS , the Village of Mamaroneck , by resolution
duly adopted October 1 , 1945 accepted an offer from
Westchester Wholesale Warehouse , Inc. , for the pur-
chase of the property in the amount of R3 ,500.CC ,
which acceptance , however , is conditioned upon
similar action being taken by the Town Board of
the Town of Mamaroneck: and
WHEREAS , this Board considers it to the hest in-
terest of the Town of Mamaroneck to approve such
offer and to authorize the sale to the end that
the property may be sold ree and Ilea- of all
taxes and the proceeds of sole , if any , divided ,
NOW , THEREFORE , BE IT
RESOLVED , that the Town Board of the Town of
Mamaroneck agrees that property known as Sec-
tion 8 , Block 112 , Lots 75 to '48 inclusive , on
the tax assessment man of the Village of Mamaro-
neck, and known upon the tax assessment map of
the Town of Mamaroneck as Block 823 , part of
Parcel 9, be sold for the sum of C3 ,500.CO.
FURTHER RESOLVED, that the net proceeds of such
in sale shall be divided between the Torn of Mamaro-
neck and the Village of Mamaroneck proportionately
to the amount due each as of the date of such sale.
On motion by Councilman Stiner , seconded by Councilman
Keeler , the following was , upon roll cell , unanimously adopted:
WHEREAS , the Village of Mamaroneck has heretofore
acquired by referee ' s deed or deed in lieu of fore-
closure , property known as Section 8 , Block 112,
Lots 49 to 55 inclusive, on the tax assessment
map of the Village of Mamaroneck: and
WHEREAS , the Town of Mamaroneck owns certain tax
liens upon the same property which is known upon
the tax assessment man of the Town of Mamaroneck
as Block 823 , part of Parcel 9, representing arrears
of taxes due it which were heretofore levied against
said property: and
WHEREAS , the Village of Mamaroneck, by resolution
duly adopted October 1 , 1945 accepted an offer from
Polcini Realty Company , for the purchase of the pro-
perty in the amount of $3 ,500.00 , which accertance ,
however , is conditioned upon similar action being
taken by the Town Board of the Town of Mamaroneck:
and
WHEREAS . this Board considers it to the hest in-
terest of the Town of Mamaroneck to approve such
offer and to authorize the sale to the end that
the property may he sold free and clear of all
taxes and the proceeds of sale , if any , divided ,

NOW , THEREFORE , BE IT
RESOLVED , that the Town Board of the Town of
Mamaroneck agrees that property known as Sec-
tion 8, Block 112 , Lots 49 to 55 inclusive , on
the tax assessment map of the Village of Mamaro-
neck, and known upon the tax assessment map of
the Town of Mamaroneck as Block 823 , part of
Parcel 9, be sold for the sum of $3 ,500.00.
FURTHER RESOLVED , that the net proceeds of such
sale shall he divided between the Town of Mamaro-
neck and the Village of Mamaroneck proportionately
to the amount due each as of the date of such sale.
The Supervisor recommended the following , which was
on motion by Councilman Stiner, seconded by Councilman ' atson,
upon roll call , unanimously
RESOLVED, that the following are appointed as
Sanitation Men in the Garbage Deportment at an
annual salary of '$1,920 each:
David Lyde , effective as of September 17, 1945
John Catoe, effective as of September 20, 1945
Curtiss Mnjor , effective as of October 2, 1945
FURTHER RESOLVED, that the above arrointnents nre
subject to the approval of the Personnel Office ,
County of Westchester.
The Supervisor suggested that at this time consideration
[ be given to the bids submitted earlier in the meeting.
[` There was full discussion, following which , it was on
motion by Councilman Keeler , seconded by Councilman Embury , upon
roll call , unanimously '
RESOLVED, that this Board accepts the offer of
George M. Mayer , in the sum of 57,150. made
through the office of Peter C . Doern, Jr. Inc . ,
to purchase the prorerty known and described
as foil ours:
The plot or parcel of land consisting of
Lots Nos. 29 , 30 , 11, 35 and 1.6 as shown
on a map entitled "Map of Eagle Hommocks ,
Town and Village of Mamaroneck, Westchester
County, New York, " made by A.J. Foote En-
gineering Corporation, July 10th, 1929 and
filed in the office of the Clerk of the
County of Westchester , Divis1on of Land
Records , Parch 15th , 1930 as Map No. 3571,
and also known and designated on the Tax
Assessment liar of the Town of Mamaroneck
as Block 934, Parcel 29.
L Upon the terms stated in said offer , to it: Fifty
( 50 ) per cent in cash and fifty ( 50%) Per cent upon
a first mortgane to mature in three years from date ,
with interest at 4.50% per annum , and containing a
release clause providing for release of portions

FURTHER RESOLVED, that the Town Attorney be and he
hereby is instructed to draw the necessary contract
for the sale of the property in aceordance with the
terns of the offer and acceptance , and that the Surer-
visor be and he hereby is authorized to acknowledge and
deliver the deed accordingly.
FURTFFR RESOLVED , that the acceptance of this offer is
subject to the approval by the Board of Trustees of the
Village of Mamaroneck in vied of their interest as owners
and holders of tax liens due the Village of Mamaroneck
upon the premises.
The members of the Board discussed the hid of Mr. Alan L.
Carnov , as broker , on behalf of the Westchester Land and Homes Company ,
and it was agreed that in principal the sere be accepted . It was de-
cided that the Town. Attorney be requested to study the terms of the
proposed sale . Following further discussion , it was on motion by
Councilman Stiner , seconded by Councilman Keeler , upon roll call ,
unanimously
RESOLVED , that the bid of Westchester Iand and Tomes
Company , through Alan T. Mr rroy , Peal Istate Broker ,
in the sum of $30 ,0,00 „with G12 ,000 in cash and 018,000
to remain as a purchase money nortga_re on the property
described as eight parcels in the Larchnoni and
Fehimore Cooper Far'; sections he er,d it ''hereby is ap-
proved in principal .
FJRT£LR, that the Torn Attorney be and he hereby is
directed to study and prepare a contract of sale which
rill afford the Torn full protection in the mortgage ,
which shall run for a term not longer than three years
and which shall have releases on the individual. parcels .
The Supervisor asked the members of the Board if they wished
to discuss the application made by Mr. Richard rood earlier in the
meeting for the settlement of the action brought by the Town on tax
arrears.
There was discussion at length follo'ring which the Supervisor
was authorized to negotiate further with Mr. Wood and resort back at
the next meeting.
The Supervisor presented and read the following letter:

resignation as a member of the Zoning Board of Appeals
and request that the same take effect immediately.

The members of the Board expressed their appreciation for
the work performed by Mr. Raynor over a period of years in connection
with the Zoning Board of Appeals. The resignation was accepted and
the Town Clerk was requested to send a letter to Mr. Raynor expressing
regret and conveying the thanks of the members of the Board on behalf
of the people of the Town for his services to the community.
The Supervisor informed the members of the Board that for
some time there has been discussion at the meetings of the Westchester
Joint Water Works No. 1 Board regarding the basis presently used for
the distribution of the pumping costs to the three municipalities in-
terested . He said that the present plan had been incorporated in the
original Act setting up the water distribution system and that in order
to change the method of distribution costs the Act would have to be
amended by the Legislature. He pointed out that the Village of Mamaro-
neck is on a level with the Pumping Station but that the Town of
Mamaroneck and the Town of Harrison are on a higher grade , and because
of this situation the Village has been protesting that they are sharing
in the pumping costs which should be chargeable primarily to the other
two municipalities as the expenses involved are created by the necessity;
of pumping water to the two municipalities. A survey was prepared show-
ing the inequality of charging the Village of Mamarnneck for these
pumping costs on the basis of water consumed. The survey outlined the
initial steps necessary to remedy the alleged inequality. The survey
was referred to the Town Attorney for further report and study and it
was decided that the Town Attorney contact the attorneys of tine other
municipalities and daft a uniform resolution which would be submitted
to eacb of the Boards interested and would be the first step towards
having the Act amended.
The Town Attorney recommended the following resolution:
RESOLVED, that the tax Lien now held by the Town of
Mamaroneck for the state , county , town and school
taxes for the year 1942 ( sale of 1943) upon the
premises known as Block 304 , Parcel 1 , on the
tax assessment map of the Town he compromised at
$2 ,067.79 plus interest at 12% per annum from the
date of sale to the date of payment, and that uron
receipt of same on or before the 25th of November ,
1945, the Receiver of Taxes be and he hereby is
authorized to issue a receipt in full for said
tax lien and to cancel same upon his records.
FURTHER RLSOLVED, that the Receiver of Taxes and
Assessments be and he hereby is authorized to re-
ceive and collect the taxes upon the property known
and described on the tax assessment nap of the Town
of Mamaroneck as Block 304, Parcel 1 , owned by
Johnethel Realty Corporation by payment on or before
the 25th of November , 1945, of the face amount of the
state , county , town and school taxes as originally
levied plus penalties and interest as follows:
For the year 1943 ( sale of 1944) - S594.95
For the year 1944 ( sale of 1945) - S350.40

FURTHER RESOLVED , that upon receipt of the face amount
of the taxes with penalties and interest as aforesaid ,
the Receiver of Taxes and Assessments is authorized
and directed to furnish the Johnethel reeity Corporation ,
or any other person paying the taxes , a receipt showing
payments as above specified.
On motion by Councilman Keeler , seconded by Councilman Stiner ,
the foregoing resolution was adopted by the following vote:
Ayes: Councilmen Stiner , Keeler,
Watson , Embnry
NOT VOTING: Supervisor Mandeville
