CALL TO ORDER
The Work Session of the Town Board was called to order by Town Supervisor Jaine Elkind
Eney. Moved by Councilmember Fiddelman, seconded by Councilmember Nambiar, the
Work Session unanimously opened at 5:05 p.m.
WORK SESSION ITEMS
1. Request for Executive Session
Moved by Town Supervisor Elkind Eney, seconded by Councilmember King, the
Town Board agreed to enter into Executive Session to discuss the employment
history of particular individuals and litigation involving the Tree Law.

Moved by Councilmember Fiddelman, seconded by Councilmember Nambiar,
the Town Board unanimously agreed to resume the Work Session.

2. Updates
Councilmember Fiddelman updated the Town Board on the Larchmont Library's 100th
Anniversary Celebration and blood drive.
3. OUT OF ORDER - Discussion - Award of Bid - TA-24-03 Resurfacing of Various
Roads
Councilmember Nambiar and Town Engineer Robert Wasp discussed the Town's
past work with Laura Li Industries. Councilmember King commented on the trend of

companies coming in over budget on projects and the need for better data from
consultants. Engineer Wasp agreed that conversations about estimates are
necessary. Councilmember Nambiar and Town Administrator Meredith Robson
discussed scaling back the project for cost efficiency. Supervisor Elkind Eney,
Councilmember King, and Engineer Wasp discussed the different consultants used
for various projects.
4. Discussion - Award of Bid - TA-24-10 - Reconstruction of Municipal Sidewalks &
Curbing
Administrator Robson stated the bid is being rejected. Engineer Wasp expressed
concerns about the lowest bid response. Engineer Wasp said the project will be rebid,
with one part of the Howell Avenue project scaled back and additional clarification
given on the scope. Project completion will be delayed. Temporary solutions and the
completion of certain sidewalks were discussed.
5. Discussion - Rejection of Bid - TA-24-11 Senior Center Renovations
Engineer Wasp reviewed the proposed Senior Center renovations and noted that the
Town had received only one response to the request for proposal (RFP). Changes in
programming at the Senior Center will occur due to the bid rejection. The timing of the
rebid and the possibility of completing the project in parts were discussed.
6. OUT OF ORDER -- Discussion - 2024 Capital Budget Amendments
Town Comptroller Tracy Yogman reviewed the proposed capital budget amendments.
Notable grants were received for virtual reality training for the Police Department, a
roundabout, and a heat pump for the Senior Center. A Transportation Alternatives
Program (TAP) grant was received for the Colonial Avenue sidewalk extension.
Supervisor Elkind Eney suggested sending a letter to area residents to notify them of
the project. The Board and Engineer Wasp discussed traffic studies and the land
ownership and grants for sidewalk construction.
7. Interim Capital Plan/Budgeting Discussion
Administrator Robson reviewed the capital plan and the status of reports.
8. Discussion - Proposed Part-time Salary Increase for EMTs and Paramedics
Administrator Robson presented the need for wage increases in the Ambulance
District.
9. OUT OF ORDER -- Discussion - Proposed Local Law Prohibiting Parking of
Mobile Homes and Trailers on Public Streets
Administrator Robson reviewed the proposed local law. The Town Board requested
an exception for residents needing to park a moving trailer overnight. A free-of-charge
permit through Town Administration was suggested for those exceptions. Town
Attorney William Maker Jr. agreed to add the exception clause to a revision of the
proposed local law.
10. OUT OF ORDER -- Discussion - Proposed 2024 Water Rate Increase
Mr. David Birdsall presented Westchester Joint Water Work's (WJWW) proposed
water rate increases. The Board and Mr. Birdsall discussed the age and replacement
plan for the mains. The Board requested further explanation for the proposed $19.5
million budget presented for Emergency/Contingency for Joint System Projects, as
well as the proposed $19.2 million budget presented for Distribution Mains and Other
Infrastructure for Local System Projects. Mr. Birdsall explained the need for a water
filtration plant and the impact of inflation and supply chain issues. Comptroller
Yogman discussed the timing of rate increases. The Board requested more
information on the local system and planned projects.

11. Discussion - 2025 Budget Calendar
This item was not discussed in the Work Session.
12. Discussion - Housing Authority - Lease Amendment and Resolution
This item was not discussed in the Work Session.
13. Additions to Regular Meeting Agenda
The Town Board added three items to the agenda for the Regular Meeting: a
certiorari, an agreement with Goldstein Hall, and an extension to a retainer agreement
with the Town's land use lawyer Lisa Hochman. Setting the public hearing for the
proposed local law `Prohibiting Parking of Mobile Homes and Trailers on Public
Streets' and the Housing Authority Lease Amendment and Resolution were both
deferred to August 14, 2024.

The Town Board meeting convened in the Courtroom Located on the second floor at the
Town Center. The Public was to view the meeting on cable access television (Optimum 76/
Fios 35) or on LMCMedia.org
CALL TO ORDER
The Regular Meeting of the Town Board was called to order by Supervisor Elkind Eney at
8:18 p.m. Supervisor Elkind Eney noted that the Town Board met for a Work Session
beginning at five o'clock this evening.
SUPERVISOR'S REPORT
1. Welcome to the July 17, 2024, meeting of the Town Board of the Town of
Mamaroneck. The Town Board convened today for a Work Session in Conference
Room A, starting at 5:00 pm, which is open to the public.
As members of the Town Board, we've thoroughly enjoyed celebrating the 4th of July
at various events around town. From fireworks to the Firemen's Parade, the Blessing
of the Fleet, and of course, those delightful BBQs! The Senior Center, with the
assistance of the Town of Mamaroneck Fire Department, hosted their annual BBQ.
The place was bustling with happy seniors, enjoying delicious food and music—a truly
memorable time for all.
We recognize that many of you are here to express concerns about traffic safety in
our community. Specifically, there's a push to encourage the Town to apply for a
USDOTSS4A grant to develop a long-term plan for pedestrian and bicycle safety.
While the Town Board intends to apply for this grant either in the current cycle or the
next, we're committed to ensuring that no other ongoing safety projects will be
adversely affected by this application. Rest assured; safety remains one of our top
priorities as we work to improve our streets.
To illustrate our dedication, I'd like to share a list of recently completed or ongoing
road safety improvements. Please refer to the attached list (see Attachment A).
These enhancements have often been funded through grants, as part of our efforts to
be fiscally responsible and save taxpayer dollars. It's important to understand that
each grant application and execution demands significant time and effort from our
staff, including our administrator and the Engineering Department. While our
department is robust, we're juggling multiple projects, including grant applications. We
believe in our ability to achieve our goals, but some things take time.
Our successful track record with grant applications reflects the care and effort we
invest in each submission. Despite residing in a relatively affluent community—a
factor that can impact grant applications—we remain committed to improving safety
for everyone.

We sincerely appreciate your support as we continue working toward the betterment
of our community.
RESIDENT COMMENTS
Supervisor Elkind Eney asked if anyone in the audience wished to address the Town
Board. Seeing that there were several residents in attendance in support of the Safe
Streets grant proposal, Councilmember Nichinsky noted that the proposed study and
all of the safety measures around Town are in compliance with the Town's new
Comprehensive Plan.
Mr. Mike Smeets stood first to address the Town Board. Mr. Smeets grew up in the
Town of Mamaroneck and has two children that attend Chatsworth Elementary. His
children are the reason he started the Safe Streets project. Mr. Smeets thanked the
Town Board for applying for the Safe Streets grant, as well as everyone both at home
and in the audience that had written or showed up in support of the Safe Streets
grant. Mr. Smeets commented that many children are driven to school now, because
it is not safe to walk or ride to school. Safety should be measured in our Town by how
safe parents feel sending their kids to school via biking or walking. Mr. Smeets noted
that the Town Board generally has to work reactively to situations and this grant will
help with planning for safety. Many streets have historically been an issue in the
Town, many for decades now. It is important that we set a foundation and bring the
community together to look at each road, consider what is needed, and prioritize the
community's needs. Thank you so much for applying for this grant. Mr. Smeets looks
forward to working with the Town.
Jordana Viuker of 214 Delancey Avenue spoke next. She also grew up here. Thank
you for the comments and the attention the Town has put into this. Ms. Viuker hopes
the Town gets the grant but mentioned there are some issues the Town already
knows about. These things can be implemented ahead of the grant. She offered grant
writing assistance. Ms. Viuker would like crosswalks to be painted more regularly;
light-up signs installed on both sides of crosswalks; no-turn-on-red signs year-round
at all lights at all times of day; bike paths installed; bike lanes painted out; signage
about the bike lanes installed; an effort Town-wide to promote safety and safe, patient
driving at the schools and in newsletters; bike and car safety training at schools;
better air quality laws; no idling laws; and greater enforcement by the police. Ms.
Viuker will email to the Town Supervisor her list of suggestions/requests.
Town Supervisor Elkind Eney said that the Town does send out safety information,
traffic information and hurricane preparedness information and much more. All
residents should sign up for alerts from the Town.
Ms. Dara Fremark, of 1 Briar Close Road, lives less than three quarters of a mile
away from Murray Avenue School. Thanked the Board for applying for the Safe
Streets grant. Ms. Fremark discussed the sidewalk extension plan on Weaver Street
and the approval delay with NYSDOT, explaining the history of the issue and the
extent of the project. Ms. Fremark mentioned that Weaver Street is dangerous and
that the speed limit in Scarsdale is 25 mph; she would like it to be lowered in the
Town. Ms. Fremark also wants more enforcement and suggested that the Town work
with other communities on all of these safety measures.
Supervisor Elkind Eney spoke briefly about the Weaver Street sidewalk that Ms.
Fremark brought up, citing delays with the purchase of land, as well as with New York
State. (Written comments submitted to the Town Board, prior to the meeting,
regarding the Safe Streets grant are included in Attachment H.)

PRESENTATIONS
1. Westchester Joint Water Works (WJWW)
Mr. David Birdsall, Chief Financial Officer of WJWW presented a proposed water rate
increase. The cost of water is currently $0.0116 per gallon. Water is purchased from
New York City at a current annual cost of$12.8 million. Operational costs and capital
improvements are key drivers of the increase in the cost of water. The water rate
increase history and five-year capital improvement plan (as included on the attached
presentation) were detailed. Mr. Birdsall proposed an increase in the water rate of
20%, stating that the revenue is needed to support the upcoming expenditures. He
highlighted that the increases are paid for directly by the water users. Mr. Birdsall
discussed the day-to-day effect of the cost increase on typical residents in the Town.
Supervisor Elkind Eney confirmed that the Town Board had discussed the proposed
increase at length with Mr. Birdsall. Councilmember Nichinsky explained further that
the rate increase is necessary to cover the costs of the required filtration plant to meet
national standards.

BOARD OF FIRE COMMISSIONERS
1. Call to Order
Commissioner Elkind Eney called the Meeting to order, then on motion of
Commissioner Fiddelman and seconded by Commissioner Nambiar the Board of Fire
Commissioners was unanimously declared open.

4. Other Fire Department Business
Supervisor Elkind Eney thanked the Fire Department for participating in the recent
parade. There being no further business to come before the Fire Commission, on
motion of Commissioner King, seconded by Commissioner Nichinsky, the
Commission unanimously adjourned and the Town Board reconvened.
AFFAIRS OF THE TOWN OF MAMARONECK
1. Consideration of Approval - Proposed 2024 Water Rate Increase
Moved by Councilmember Nambiar, seconded by Councilmember Fiddelman, it was
RESOLVED that the Town Board hereby authorizes an increase of 20% to be
applied to all applicable water use rates charged by the Westchester Joint
Water Works effective with next month's water bill.

2. Consideration of Approval - 2024 Capital Budget Amendments
Moved by Councilmember Nichinsky, seconded by Councilmember King, it was
RESOLVED that the Town Board hereby authorizes the Town Comptroller to
make the necessary budget amendments, as presented.

3. Consideration of Approval - 2025 Budget Calendar
Moved by Councilmember Fiddelman, seconded by Councilmember Nichinsky, it was
RESOLVED that the Town Board hereby approves the 2025 Budget Calendar.

4. Consideration of Award of Bid - TA-24-03 Resurfacing of Various Roads
Moved by Councilmember King, seconded by Councilmember Nichinsky, it was
RESOLVED that the Town Board hereby awards the bid for TA-24-03
Resurfacing of Various Roads received and opened on July 3, 2024, to Laura Li
Industries in the total contract amount of$1,397,920 and hereby authorizes the
Town Administrator to execute the agreement and any related documents
necessary to carry out its implementation.

5. Consideration of Rejection of Bid - TA-24-10 - Reconstruction of Municipal
Sidewalks & Curbing
Administrator Robson noted that this bid was not successful, as all five received bids
were above the Town's planned budget for the project. The project will be reviewed,
revised, clarified and rebid.

RESOLVED that the Town Board hereby rejects bid TA-24-10 - Reconstruction
of Municipal Sidewalks & Curbing due to the significant cost above budget.

6. Consideration of Rejection of Bid - TA-24-11 Senior Center Renovations
Administrator Robson noted that this bid was also not successful. The one bid
received was above the Town's planned budget for the project.

RESOLVED that the Town Board hereby rejects bid TA-24-11 — Senior Center
Renovations due to project timing.

7. Consideration to Set a Public Hearing - Proposed Local Law Prohibiting Parking
of Mobile Homes and Trailers on Public Streets — DEFERRED to August 14,
2024.
Supervisor Elkind Eney highlighted that Councilmember Nichinsky had pointed out a
loophole in this law that will be addressed prior to the setting of a public hearing.
8. Consideration of Approval - Proposed Part-time Salary Increase for EMTs and
Paramedics
Moved by Councilmember King, seconded by Councilmember Nambiar, it was
RESOLVED that the Town Board hereby approves the amendment to the Part-
time, Seasonal and Part-time Availability Salary Schedule for 2024, to include
the $4 per hour rate increase for EMTs and Paramedics, effective July 21, 2024.

9. Housing Authority - Lease Amendment and Resolution — DEFERRED to August
14, 2024
Supervisor Elkind Eney mentioned that the Town Board wanted some advice of
counsel prior to the setting of a public hearing.
10. Consideration of Adoption - "Update of the Procedures for Site Plan Review of
Non-Residential Development" Law
Town Attorney Maker explained this amendment is largely procedural. The process of
reviewing a planning board application is different from the current statute. This law
will align the statute to conform to the Planning Board's current process. As of now a
Public Hearing is conducted within 60 days. Because of a concern about the Planning
Board meeting that deadline in June, July and August, it is proposed that going
forward the deadline for a Public Hearing is to be extended to 90 days for a non-
residential site Planning Board application.

RESOLVED that the Town Board hereby approves the "Update of the
Procedures for Site Plan Review of Non-Residential Development" as presented
at the public hearing on June 26, 2024.

Moved by Councilmember Fiddelman, seconded by Councilmember King, it was
RESOLVED that the Town Board hereby approves the settlement of the
certiorari for EKI MAE Mamaroneck LLC, 149 Halstead Avenue, Section-Block-
Lot#9-1-79, resulting in a refund of$1,450.

12. Hiring of Housing Authority Specialist— Goldstein Hall
Moved by Councilmember Fiddelman, seconded by Councilmember Nichinsky, it was
RESOLVED that the Town Board hereby approves the agreement with Goldstein
Hall Attorneys at Law and hereby authorizes the Town Administrator to execute
the agreement and any related documents necessary to carry out its
implementation.

13. Land Use Lawyer - Lisa Hochman
Administrator Robson reviewed the proposed retainer with the Town Board, noting
that Attorney Lisa Hochman's fee was last increased in 2013.
Moved by Councilmember Nichinsky, seconded by Councilmember Fiddelman, it was
RESOLVED that the Town Board hereby approves the agreement with Lisa
Hochman Esquire for legal services to the Town's Planning Board, Zoning
Board of Appeals and related legal services to Town staff and hereby
authorizes the Town Administrator to execute the agreement and any related
documents necessary to carry out its implementation.

• Has been either out or on vacation since the last meeting, so has no committee
reports.
Councilmember Fiddelman
• Thanked the Village of Mamaroneck and Town of Mamaroneck Fire Departments for
the parade and also the blessing of fleet.
• Attended the Housing Authority meeting.
• Attended the Larchmont Library Board meeting. There is a blood drive tomorrow at
the Larchmont Library.
• Attended the Town's Concert in the Park last Monday. It was a lot of fun for everyone,
particularly families.
• Attended the Senior Center BBQ. Thank you to the Fire Department for their hard
work at the Senior Center BBQ.
Councilmember King
• The Town's Recreation Department is hosting two more concerts in Memorial Park:
one on Monday July 22nd and another on July 29th. One more movie night will be held,
featuring Spy Next Door on Friday, September 6th.
Councilmember Nichinsky
• Attended the Fireman's Parade and it was a ball.

TOWN ADMINISTRATOR'S REPORT
Town Administrator Robson clarified that the construction on Weaver Street is being
done by Con Edison, not the Town, and we have very little say in how they complete
their work. Town staff is working with Con Edison to help improve the flow of traffic.
TOWN ATTORNEY'S REPORT
The second half of the baseball season starts tomorrow and is hopeful that the
Yankees will step up.
Town Supervisor Elkind Eney thanked Margaret Delohery for subbing in for Allison
May, Town Clerk, this week. The Town Supervisor also thanked Attorney Maker for
helping with Town issues this past week.

General:
In compliance with the Budget Policy, the following 2024 budget amendments are recommended for
approval.
1-Town Center Parking Lot(H1648)
The repaving of the parking lot project that was completed several years ago has a remaining balance.
A budget amendment is recommended below to return the balance to the General Fund.
2-Hillside Bridge (H5163)
The renovation to the Hillside Ave Bridge has a remaining balance. A budget amendment is
recommended below to transfer those funds to the Waverly Ave bridge project that is in progress.
3.Virtual Reality Training System(H31103)
The Town has been awarded a grant from the State Law Enforcement Technology (LETECH)
Program for the purchase and implementation of an innovative interactive simulation training solution
for the Police Department. A budget amendment is recommended below to establish a capital project
for the purchase.
4.Roundabout(H5198)
The Town has been awarded a U.S. Department of Housing and Urban Development (HUD) Fiscal
Year 2024 Economic Development Initiative(EDI)-Community Project Funding(CPF)grant for the
roundabout project. This is partial funding for the project. Additional grant applications have been
submitted to complete the funding needed. A budget amendment is recommended below to establish
the capital project.
5.Parks Building-Sian Shop(H5191)
The bid to reconstruct a new building in Memorial Park for the sign shop and parks equipment must
be rebid to comply with Wicks Law that is required for projects that cost over$1.5m.The project will
be redesigned to incorporate measures for cost savings and to address the requirements of Wicks

Law. A bond will be issued to complete the funding needed based on the lowest estimate for the
project. A budget amendment to reflect the additional amount needed to bond is recommended
below.
6.Sr Center Renovation(H6758)
The Town has been awarded NYSERDA grant funding of $100,000 under the Clean Energy
Communities Program to reduce greenhouse emissions and contribute to New York clean energy
goals. The funding is to be used for building heat pump upgrades as part of the renovation plan at the
Town's Senior Center.A budget amendment is recommended to add the funding to the project.
7.Drainage Study(H5135)
The Town has been awarded a Federal Emergency Management Agency (FEMA) grant that will be
administered by the New York State Division of Homeland Security & Emergency Services
(NYSDHSES) to conduct a comprehensive storm sewer evaluation for drainage infrastructure as a
pre-disaster mitigation effort.A budget amendment is recommended to add the funding to the existing
project.
8.Long Island Sound Resilience Planning Support Program Study(B8030-4902)
The Town has been awarded a federal U.S. EPA grant through the Long Island Sound Study (LISS)
and administered through New York Sea Grant (NYSG) and Connecticut Sea Grant (CTSG). The
grant will fund a climate vulnerability assessment for three key municipally owned properties on
Hommocks Road,Boston Post Road,and Pryer Manor Road.
The study will provide current conditions, potential climate impacts, identify flood mitigation
strategies, and develop conceptual designs for priority projects. The Town will not administer this
grant but is the beneficiary. As such the Town will record the grant and the expenses as the project
progresses. a budget amendment is recommended to record the project.
9.Colonial Avenue Sidewalk(H5199) The Town
has been awarded a Transportation Alternatives Program (TAP) grant for projects that
promote alternative, environmentally friendly modes of travel, such as walking, biking or
riding mass transit. Federal Highway Administration's Transportation Alternatives Program
(TAP)are being administered by the New York State Department of Transportation. Funding
of$1,224,480 has been awarded for the improvement to Colonial Avenue to provide a safe
route for elementary school children and parents. A budget amendment to establish the
project budget is recommended below.

Dear Ms.Robson:
This letter(this"Attorney Engagement Letter")sets forth a proposal with respect to
representation of you(the"Client")by the law firm of Goldstein Hall PLLC(the"Firm")in
connection with providing legal services for the above referenced Project.
LEGAL SERVICES:In furtherance of the Project,the Firm will provide legal services
as set forth in Exhibit A.
LEGAL FEES: The legal fees for the legal services described in this Attorney
Engagement Letter are set forth in Exhibit B.
COSTS:The Client will be responsible for paying disbursements and costs incurred by
the Firm on behalf of the Client, including but not limited to court fees,third party litigation
expenses,filing fees,mailing expenses,and any other necessary fees and disbursements. Such
expenses will be payable immediately prior to incurrence or upon demand thereafter, unless
the Client and the Firm make an alternative arrangement.
BILLINGS: Unless otherwise agreed to in advance, the Firm will render invoices to
the Client for Legal Fees and Costs incurred in connection with your matter(s)on a monthly
basis. Payment is expected upon receipt of the invoice. Client expressly acknowledges that if
the invoice is not paid on a timely basis (after the application of any Retainer that may have
been deposited with the Firm as applicable),than the Firm shall add interest at a rate of one
percent(1%)per month until the unpaid balance is paid in full. If payment of the invoice is
not timely made,you agree to reimburse the Firm for any time we devote in ensuring collection
of our bills, including, but not limited to our actual attorneys' fees plus costs and
disbursements. In the event that the Firm's representation of the Client is terminated,the Client
hereby agrees to pay all bills thereafter rendered covering the period prior to the termination.

RIGHTS OF CLIENT: The Client shall have the right at any time to terminate our
services and representation upon written notice to the Firm. Such termination shall not,
however,relieve the Client of the obligation to pay for all services rendered and disbursements
and other charges made or incurred on behalf of the Client prior to the date of termination.
RIGHTS OF FIRM: The Firm reserves the right to withdraw from our representation
with the Client's consent or for good cause. Good cause may include the Client's failure to
honor the terms of the Attorney Engagement Letter,the Client's failure to pay amounts billed
in a timely manner,the Client's failure to cooperate or follow our advice on a material matter,
or any fact or circumstance that would, in our view, impair an effective attorney client
relationship or would render our continuing representation improper or unethical. If we elect
to do so,the Client will take all steps necessary to free the Firm of any obligation to perform
further services,including the execution of any documents(including forms for substitution of
counsel) necessary to complete our withdrawal, and we will be entitled to be paid for all
services rendered and disbursements and other charges made or incurred on behalf of the Client
prior to the date of withdrawal.
UNRELATED CONFLICTS:The Firm may currently or in the future represent one or
more other clients in unrelated matters or transactions in which the interests of the Client or its
affiliate(s)may or may not be adverse to those other clients. The Firm may represent other
clients on legislative or policy matters, or in administrative proceedings that may involve or
affect the Client or its affiliate(s). This Agreement confirms that the Client waives all such
conflicts of interest and consents to the Firm's current and future representation of such other
clients in any such matters without the need for any further notice or consent from the Client
even though the Client's interests are adverse,provided that such matters are not the same,or
substantially related to, a matter in which the Firm represents the Client. The Firm does not
view this advance waiver and consent regarding unrelated matters to permit unauthorized
disclosure or use of any of the Client's confidential or privileged documents or information
which the Client has not provided to the Firm as the Client's lawyers.
MARKETING INFORMATION:The Firm is pleased to include the Client among its
current and recent clients. The Client grants the Firm's permission to list the Parties' names
on our client list, and to include non-confidential general descriptive information in
promotional materials.
RECORDS: At the conclusion of the legal services described above, the Client may
request that the Firm send the file in this matter to the Client. If so,the Firm reserves the right,
at its own discretion and expense,to retain a copy of all or part of the files the Client requests.
If Client does not request the file,then the firm will store the file at its own expense for a period
of seven(7)years following the conclusion of the representation. Thereafter,unless the Firm
receives written instructions from the Client to the contrary, the Firm will destroy the file,
consistent with maintaining confidentiality,without further notice.

CONSULTATION WITH COUNSEL: In the course of representing the Client, the
Firm may consult with its own counsel on its own behalf and without cost to the Client. To
the extent that the Firm is addressing its rights and responsibilities,a conflict of interest might
be deemed to exist between the Firm and the Client, particularly if a dispute were to arise
between the Firm and the Client regarding the current representation. The Client hereby
consents to such consultation and waives any claim of conflict of interest based on such
consultation or resulting communications that could otherwise disqualify the Firm from
continuing to represent the Client or from acting on the Firm's behalf,even if doing so might
be deemed adverse to the interests of the Client.
ARBITRATION:In the event that a dispute arises between us relating to our fees,you
may have the right to arbitration of the dispute pursuant to Part 137 of the Rules of the Chief
Administrator of the Courts,of copy of which will be provided to you upon your request.
RETAINER: In connection with this Letter of Engagement,a retainer fee is due in the
amount of$0.00("Retainer Funds").
Client expressly understands that the fees and costs relating to this matter are not
predictable.Accordingly,we have made no commitment to you concerning the maximum fees
and costs that will be necessary to resolve or complete this matter. Any estimate of fees and
costs that we may have discussed,represent only an estimate of such fees and costs.It is also
expressly understood that payment of the Firm's fees and costs is in no way contingent on the
ultimate outcome of the matter.

SCHEDULE OF FEES
It is agreed that the fee to be paid by the Client for our services will be billed according to the
fees set forth in the below Fee Schedule.The Client understands that the Firm's fees are subject
to change at the Firm's discretion from time to time,which shall be communicated to Client in
accordance with this Agreement,and subject to further acceptance by Client.
Hourly rates shall be billed in 6-minute increments. For other matters not detailed in the

Re: Retainer Agreement
Dear Ms. Hochman:
This letter will serve to renew the retainer between the Town of Mamaroneck (the "Town") and
Lisa Hochman, Esq., pursuant to which you will provide legal services, as more specifically set
forth below, to the Town's Planning Board, Zoning Board of Appeals and related legal services
to Town staff.
You shall provide all general legal services to the Boards and staff. Representation shall be
provided principally by you. Pursuant to this Retainer, you shall attend one meeting per month
of each Board, and staff meetings as required for peer review and other assistance to the staff.
Services shall include review of all agendas, notices, minutes and other documents for both
Boards and staff. Upon request of the chair of either Board, you shall draft decisions,
resolutions and opinions for each Board. In the event the drafting services and any associated
research should cause your time in a given month to exceed 15 hours, you will be
compensated as set forth below. Should you not be able to provide services to the Town due
to illness, vacation or otherwise, the Town shall arrange for substitute coverage. Representing
the Boards in Article 78 proceedings or other litigation shall be outside the scope of the
retainer and subject to compensation as set forth below.
The annual retainer for the legal services described above effective July 17, 2024, shall be
$75,000.00. The retainer shall be payable in equal installments at the end of each month upon
submission of an executed claim form as supplied by the Town, supported by a statement
indicating time spent on work under this retainer. If either board meets more than once in a
single month, the Town shall pay an additional fee of five hundred ($600.00) per meeting. For
drafting services and additional research as referenced above or for your representation of the
Town in either Article 28 proceedings or other litigation, you shall be compensated at the rate
of$275.00 an hour.

Separately from, and in addition to, payment of the retainer fees as described herein, the Town
will reimburse you for reasonable out-of-pocket expenses incurred in representing the Town,
including photocopying, faxing, long distance telephone, computer research charges, and
travel outside of the Town of Mamaroneck, and the like in an amount not to exceed one
thousand dollars ($1,000.00) per year. Payment for reasonable out-of-pocket expenses shall
require the submission by you of a detail of the expenses.
It is understood that you shall not practice or appear before any Court, Board of Commission of
the Town or in the Villages of Larchmont or Mamaroneck, other than on behalf of the Town or
on behalf of yourself.
In accordance with Part 1400 of the Joint Rules of the Appellate Divisions, the Town reserves
its right to submit any unresolved fee dispute to arbitration.
Either party to this agreement may terminate it upon sixty (60) days written notice to the other.
If these terms are satisfactory, please execute both copies of this agreement and return one to
me.

Hello,
I'm a parent in Mamaroneck and I've just been informed that TOM will not be applying to the Safe Routes for School
grant.
I hope this is untrue.
The VOM and Larchmont have applied.This recent tragedy on Mamaroneck Ave should highlight the need for the towns
to come together for a unified vision of school safety.
This seems incredibly short-sighted and even callous.

My name is Angela Gamble,and I am a resident of the Town of Mamaroneck. In the last 6 months I put 1173 miles
riding my cargo bike with my 3 kids thought Larchmont and Mamaroneck. I replace car trips to food shopping,school
pickups and drop offs(between Murray and Central),town recreation sports, manor beach,etc with bike rides. So many
more in this community may be willing to do this if we had better bike lanes.
I am writing to strongly urge the Town of Mamaroneck to apply for the Safe Streets for All(SS4A)grant before the

My name is Nova Cutler. I have lived with my husband and 3 kids in Mamaroneck for over 15 years. It is a very special
town.
One of the most wonderful things about Mamaroneck is how walkable and bike able it is. We have many community
members that work hard for this-and it is meaningful! I have served on the Safe Routes to School committee for over a
decade to focus on the walkability and bikeabilty of our Town. We have come far and there is SO much further to go.
I am writing to ask that the Board apply for the Safe Streets for All grant. As you know, upgrading our streets is a long
and expensive process. Having a long term vision to guide our efforts is essential and that is what this Grant could
provide. The efforts the Town have already made are appreciated and I know how important this is to the entire
community.

I am a TOM taxpayer and was surprised and dismayed to recently learn that the TOM has not applied for
the Safe Streets for All grant, especially given the tragic traffic fatalities that we have all heard about in
Mamaroneck.
I also understand that both the VOM and Larchmont have applied for this grant so it seems even more of
an egregious oversight given that the other local municipalities have already done so,we need any
additional resources we can to ensure a tragedy like this never happens again.
I have three young children in the Mamaroneck school system and this is incredibly important to me

I am writing to convey my sincere hope that you will reconsider your position on the grant application for the bike lane
project.
We moved to Mamaroneck as it is an idyllic place to raise our children. I work in town as well,and we all walk or bike
each day to school and work,and my husband to the train. Each day, however,and increasingly, I do not feel it is safe for
us to do so. We walk or bike because we enjoy it, but with the increased traffic in the last few years,that enjoyment is
being replaced by fear and danger. Cars are in a rush and can't be bothered to slow down.

My kids have to bike on the sidewalks,and honestly,that is what I choose to do as well,sharing those same paths with
pedestrians.
We are a community,and that is what we love about living here. But we too often feel divided,angry and in danger.

connected and happy about our choice.

believe in complete streets and the ability of our residents--even the youngest ones--to have
choices about how to get around. Enough with dangerous street design that prioritizes speed and
vehicular"efficiency"-the recent tragedy of the mother and son dying on their walk to MAS only
highlights this imperative. I seek to live in a town that prioritizes people as well as cars to get around.That
will take long term vision and effort-and I urge TOM to join VOL and VOM in their applications for SS4A. I
want current and future residents of the area to live in a best in class walkable community in

My name is Matt Prestopino and I'm a local resident. My family and I moved to the area from Amsterdam,
Netherlands where we solely relied on biking as our main mode of transportation.Since moving to the
area my family and I have continued to use our bicycles to commute but are concerned with the lack of
safe cycling lanes that protect cyclists and would love to see a bigger investment in improving safety for
local cyclists.
It was brought to my attention that the Town of Mamaroneck opted out of applying for the Safe Streets
Grant while both the Village of Larchmont and Village of Mamaroneck have applied.
Please reconsider this decision.

I am writing to ask you to please help apply for the Safe Streets for All grants,which Micheal Smeets has
been promoting in the Town of Mamaroneck meetings. He will be there tonight again.The Villages have
already applied.
This is crucial for our kids'safety.We do not have school buses and not every family has a spare adult at
home who can drive kids to school.The bike lanes would allow children to go to school independently.
Now the surrounding areas of the schools are like zoos in the mornings and afternoons,with a
chaotic mix of pedestrians, bikers and too many cars. Both pedestrians and bikers are in danger.
Mamaroneck area has short distances and mild climate, and would be such a nicely bikeable area with a
few safety enhancements on the bigger roads.We could be an example for other towns on how to
promote European style healthy lifestyles by actually enabling everyone to safely bike or walk for their
errands, hobbies,visiting friends and going to school or work.When we have bike lanes,there will be a
need for fewer parking spots.There will be less chaos around schools in mornings and afternoons (I'm
sure you have seen the ridiculously long car lines).And we would not need to fear for people's safety on
Boston Post Road and other busy spots. It would be a win for everyone.
Please apply for the bike lane grants! Let's be the best town for biking in Westchester!

Hello Jaine,Anant,Sabrina,Jeffrey,and Robin-
Since transportation produces about 28% of the US's greenhouse gas emissions(according to the EPA),
why aren't we walking and biking more?
When I ask local people this question,the usual answer is "I don't feel safe".
As you all no doubt are aware, I don't use a car to get around town, having commuted by bike to work at
Consumer Reports in Yonkers and Mt.Vernon for 32 years.Since becoming an LCI, League Certified
Instructor, in 2015, I feel safer riding in traffic.
However,the Boston Post Road presents a particular problem, given its 4 lanes(for motor vehicles)and
parking which leaves no"shoulder"for bikes to ride on.That is why most schoolchildren use the
sidewalks for riding their bikes.This may seem like a good solution to you, but sidewalks are meant for
pedestrians, and bike riders need to give pedestrians the right of way while also taking special
precautions at intersections.So, unless the sidewalks are converted to bike paths,this is not an optimal
plan.
2 pedestrians were recently run over on Mamaroneck Ave. Now the Village of Mamaroneck is trying to
improve safety on the Avenue. Hopefully, no bike riders on the Boston Post Road will get hit by a motor
vehicle.The road can be fixed.Apply for the grant to see how.

I was actually on the Traffic Commission of the Village of Mamaroneck,with a special interest in promoting increased
levels of cycling in our community. Biking to&fro to the train stations,to schools, and recreational cycling are all
important in reducing the CO2 imprint along with improving ones health via the additional exercise.Cycling as an
alternative means of transportation has been gaining traction for years.

I was surprised to learn that the Town had chosen not to apply for Safe Streets 4 All(SS4A)grant funding to improve
pedestrian safety in the town.SS4A is a generous funding source,and grants have been received or are expected to be
received by both the Villages of Larchmont and Mamaroneck. I deeply hope that the failure to seek SS4A funding does
not indicate the abandonment of pedestrian safety as a Town priority.
The lack of SS4A grant funding,while disappointing,cannot be an excuse for our further failure to make progress on our
town's urgent and widely acknowledged need for pedestrian and traffic safety improvements. As a taxpayer I am
disappointed by the decision to use tax money instead of grant money for pedestrian safety, but whatever the funding
source,pedestrian safety MUST be prioritized.

My name is Lindsay Reitzes, I am a resident of the Village of Mamaroneck and one of the Committee
heads for the Rye Neck Safe Routes to School Program,which was reorganized last year. The
Mamaroneck Safe Route to School has been incredible in guiding us through the process of restarting our
committee and we are grateful to them for helping us advocate for our community.
I am writing today to urge the Town of Mamaroneck to join the Village of Mamaroneck and the Village of
Larchmont in applying for the SS4A grant.The tragic loss of Michael Volpe and his mother Molly Donovan
struck a chord in our entire community. I truly believe that street safety has become the key issue across
