The meeting was called to order by Supervisor Mandeville at 8"15 p.me, (Eastern va . Present*, supervisor Mandeville Councilmen Griffin, Embury , Keeler Absent: Councilman Stiner The presence was also noted of Town Clerk Payne, Attorney Delius , Assessor Smith , Comptroller Orsino , Town Engineer and Supt. of Highways Foote , and Building and Plumbing Inspector Rate. The minutes of July 12 , 1944, were approved as presented, The Supervisor requested the Town Clerk to read the communi- cations. A letter dated July 12 , 1944, was received from Posner & Posner , attorneys and agents for the Larchmont Gables Apts. East Post Road, Larcmont , N.Y. , in which they requested that the Town Board refuse to join with those who are urging rent control in Westchester County. They supplied figures showing their experience in the cost of operating apart- ment house property and suggested that landlords be allowed to charge i ten per cent more than the amount of the present rent as of December 31, 1943. The supervisor explained to the members of the Board that the matter had already been presented to the Board of supervisors and that the result of a vote taken was against requesting the W.P.A. to es- tablish rent ceilings in the Counter. The letter was ordered received and filed, The Town Clerk presented a copy of the proposed renewal. of contract between the Westchester County Dog Protective Association, Inc. and the Town of Mamaroneck. He advised that the old contract had ex- pired o July 15, 1944 and that Mr. Allen, a representative of the Association, was presenting the renewal to the Department of Agriculture and Markets at Albany for approval.. The following reports for the month of July , 1944, were re- ceived and ordered filed: Report of the Town Clerk; Report of the Re- eiver of Faxes and Assessments; Report of the Building Inspector; Re- port of the Plumbing Inspector; Report of the Mamaroneck Health Center, The supervisor suggested that the meeting proceed with the reports of committees. Councilman Griffin presented the report for the Derartment 137 On motion by Councilman Embury , seconded by Councilman Keeler , the following resolution was unanimously adopted WHEREAS the Assessor has presented petitions for the correction of the assessment roll for certain years , pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916 , as emended, known as the Westchester County Tax Act; and WHEREAS after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE , BE IT RESOLVED, that the assessment roll for the year 1943 taxes of 94 which shows property now appearing are the roll as follows, Section Block Lot Owner Land Imp. . Total 9 16 74 Town of Mamaroneck $ 3,500 $ 39500 942--392) 9 74 17 to 942-405) 19 Town of Mamaroneck $13,500 $13,500 Councilman Griffin stated that up to date he had not been satisfied with the operation of the incineration plant and that he had read the proposed plan laid out for the operation of same and that he heartily approved of the new plan. He said that it should work out very 139 Councilman Embury stated that there was nothing to report for his departments only that it has been found that there is room for approximately 150 to 200 names on the Honor Roll bef ore it will be ne- cessary to enlarge same. He stated that in view of the reduction of the number of men being called to service and the present situation in Europe that it was hoped that both wars there would be no need to add more space to the Honor Roll. He added that there were some suggestions about illuminating the Honor Roll. Councilman Keeler reported that the 1925 Ford floodlight truck was no longer being used by the Fire Department and that the desired to dispose of same. He advised that he had taken the ratter up with the Supervisor and both agreed that it should e disposed of. He explained that this piece of equipment is composed of a chassis with an additional motor installed to generate power for flood lights, The Supervisor informed the members of the Board that it is being stored at the Town Yard. Following some discussion, it was on motion by Councilman Keeler , seconded by Councilman Griffin, upon roll calf. , unanimously RESOLVED, that the Town Clerk be and he hereby is authorized to publish the following notice NOTICE The Town Board of the Town of Mamaroneck will receive bids for the sale of the following described duipment at a meeting to be held at 8:15 P.M. on September 6 , 1944 in the Council Room of the lea' e Street Firehouse , Town of Mamaroneck , New York: - 1. one (1) Model T Ford Truck chassis (with two motors) formerly used as the flood light truce. One motor operates Westinghouse KW generator, 2. Grant Portable Multi Versal -Tonitor eater Nozzle 4 tips - 2" 1 1/3" 1 1/2" 1 3/8". Couplings and nozzle tip are chromium manufactured by Akron Brass Co. of Ohio. The above equipment can be seem at the Town yard off Palmer .Avenue near Weaer Street , every day except Sunday, between the hours - A. . to 4:30 PeTJ The Town Board reserves the right to reject any and all bids, By order of the Town Board, Town Clerk The Supervisor asked if here was anyone present who wished to address the Board, Mr. A.F. Beringer appeared to request that the Board consider 141 Mr. Beringer stated that before he could determine anything about the street it would be necessary to obtain a title search rich would cost him approximately $200.00. The members of the Town Board referred to other properties owned by the Town to the rear of this property. Also the holdings of the ohnet el Realty Corp. , and while there was another mapped street border- ing the parcel in question and running into the rear property , it was de- cided to inspect all of the property in this location ,before making a decision The ratter was laid over until the next meeting of the Town Board. Mr. DeBartolo appeared before the Board to appeal from the decision of the Building Inspector against granting a permit for in- stalling garage doors in are opening at the side of his residence front ing on Emerson place Members of the Board recalled proceedings Trihich were brought against certain uses of Mr. DeBartolo ' s property and it was pointed out that any such permit would be in violation to the ordinances. After some discussion, Mr. DeBartolo was advised that in view of this the Board could not rule against the decision of the Building Inspector, The Town Attorney presented and recommended the following resolution, which was on motion by Councilman Keeler , seconded by Council- man Griffin, upon roll call , unanimously RESOLVED, that pursuant to section 96A to Chapter 62 of the Laws of 1909, as amended , the Town Board of the Town of Mamaroneok does hereby authorize and empower the Receiver of taxes of the Town of Mamaroneck to col- lect the 1944 school taxes for Union Free School. Dis- trict 1 To 2 , Town of Scarsdale ,, New York, which , under the provisions of Chapter 105 of the Laws of 1916 , as amended, known as the Westchester County Tax Law be- come a lien and are payable on September 1 , 1944, in two partial payments each amounting to fifty per cent (50%) of any such school tax as levied; FURTHER RESOLVED, that the Receiver of Taxes of the Town of aria onec is authorized and empowered to. receive the payment of such partial payments or instalments of the 1944 school taxes for Union Free School District No. 1 in the Town of Mamaroneck, and School District No 2 Town of Scarsdale , New York, at any -time but subject to the same penalties as are specified and provided in Sec- tion 18 of Chapter 105 of the Laws of 1916 for the neglect to pair the total amount of the school taxes after the levy thereof. FURTHER RESOLVED, that the acceptance of any such partial or instalment payment of the 1944 school taxes for Union Free School District No. 1 in the Town of Mamaroneck, and . School District No. 2 , Town of Scarsdale , New York, shall 143 On motion duly made and seconded the following resolution was unanimously adopted RESOLVED, that this Board do and it herebv does designate "The Daily Times ," a daily nevyspaper published in the village and town of Mamaroneck, for the purpose of publishing the notice of the collection of the 1944 school taxes as required by law, and be it FURTHER RESOLVED , that said notice be published in "'The Daily Times" on Tuesday , August 15, 1944 and be it FURTHER RESOLVED , that in accordance with the pro- visions of section 26 of the Weschester County Tax Act , the Town Board do and it hereby does direct the Receiver of Taxes and Assessments to mail to each tax- payer of the Town of Mamaroneck, whose address is known to said Receiver of Taxes and Assessments , a tax bill for 1944 school taxes , the expense. thereof to be a Town charge. The supervisor presented a letter dated August 9 1944 , re- ceived from Henry R. Dillon, Receiver of Taxes in which he advised that the Atlantic Municipal Corporation had offered to purchase tax liens from the Town of Mamaroneck, on Block 823 , Parcel 74 , at the fact amount of the tax liens at the rate of six per cent. Following discussion, it was on motion Councilman Griffin, seconded by Coucilman Embury , upon roll call , unanimously RESOLVED, that the Town of Mamaroneck sell and assign to Atlantic Municipal Corporation the, following de-- scribed tax liens now owned by the Town of Mamaroneck at the ariount set opposite the lien which represents the amount of the lie , ' plus six per cent interest per annum frori date of sale Year of Interest Amount Sale Block Parcel Total lien at 6% Due 1942 823 74 $425.74 57.47 $483.21 1943 444.22 33.3 477.53 1944 364.77 5.47 379.24 The Supervisor informed the members of the Board that a Western Union message had been received from Arthur H. Haaren, advising that the Fitzpatrick heirs had sold a major portion of property known as Block 720 , Parcel. 1, and that they wished to have the assessment educed for prior gears and interest and penalties waived on tax arrears. It was agreed that the Board did not have any power to make an adjustment on the assessment , and following some discussion, it was decided that final penalties and interest would not be waived but that the Board would consider the payment of the liens with interest at six per cent. The Supervisor dictated a letter in reply to the telegram It was stated in the letter that comparisons had been made with like townships in the County and that following deliberation, it was unanimously agreed that a new salary range should be established. The members of the Board examine d the papers attached , which included a statent of the salaries paid by the townships of Greentrg Harrison, Eastchester and Scarsdale. Following a lengthy discussion, it was on motion by Councilman Embury , seconded by Councilman Griffin, upon roll call , unanimously RESOLVED, that the compensation plan for employees classified as competitive and non-competitive , under the Civil Service Law of the state of New York, as approved by this Board by, resolution adopted at a regular meeting held January 15, 1944, is er g amended so as to fix the minimunm and maximum saloary or compensation of the members of the Police Depart- ment of the Town of Mamaroneck as follows Position Minim Maxinum Police chief , 3,000.00 $4,500.00 Police Lieutenant 2,800.00 3,850.00 Police Sergeant 2,600.00 3,400.00 Patrolman 2 ,000.00 2,950 .00 Detective 2,150.00 3,100.00 (Patroi;man de- signated for de- tective service) FURTHER RESOLVED, that said amendment is to become effective as of January 1 , 1945. The Town Attorney recommended the following resolution, which Was On motion by Councilman Keeler , seconded by Councilman Embury, upon roll call, unanimously adopted... WHEREAS , heretofore writs of certiorari were obtained by THERESE H. SEMON and NELSON . ASIEL, et al , as Trustees , etc. , successive owners of property de-- scri ed on the assessment map and assessment roll of the Ton of Mamaroneck Block 333 , Parcel 1 for the rears 1942 and 1943 taxes of 1943 and 1944) and WHEREAS , the Assessor and Board of Review of the Town of Manaroneck, duly filed returns to said grits and WHEREAS , Lawrence Hazzard , Esq. was heretofore appointed to hear the testimony and report his findings and con- clusions to the Court , and no further proceedings have been had; and
