Councilmen Griffin, stirrer , Embury, Keeler
Absent. None .
The presence was also noted of Town Clerk Payne , Attorney
Delius , Conptrbller Orsino, Assessor Smith , Town Engineer and Superin-
tendent of Highways Foote ,
The minutes of March 1 1944 were approved as presented,
The supervisor asked if there was any one in the room who
wished to be heard.
Mr. Thomas B. Sutton appeared before the Board to inquire
if the old real estate office building which was used on the development
opposite to the entrance of the Winged Foot Golf Club off Fenimore Road
could be offered by the Town for sale.' He stated that he believed that
the deed restrictions of the section would not permit the use of the
building as a dwelling. He advised that if it could be purchased he
had plans for the use of same at another location., although the building
is in a dilapidated conditione
Councilman Griffin recalled that some time in the past others
were interested in the building and that the Town advertised for bids ,
and following the award the successful bidder was unable to meet the
requirements for sufficient insurance to cover the Town against loss
during the removal of the building.
The Supervisor recommended that the procedure to follow vrould
be first that the members of the Board decide whether or not they wished
to offer the building for sale and if so that a public notice again he
given so that all interested parties may have an opportunity to subnit
their bids.
Following some discussion, it was on motion by Councilman
h Reeler, seconded by Councilman Stiner upon roll call, unanimously
RESOLVED, that the one-story frame building on the
premises owned by the Town at the corner of Fenimore
Road and Winged Foot Drive in the unincorporated
section of the Town of Mamaroneck be again offered
for sale and that the following public notice be
published in the Mamaroneck Daily Tines on March
27, 1944
the said building from the premises within 10 days
after being notified of the acceptande of his bid
by the Town. The Bidder is to ' obtain public lia-
bility and property damage insurance to protect the
Town, its officers or agents from any claim that may
be mace by reason of its ownership of the premises
with limits of $5,000-$10,000 for public liability
and $500-$1,000 for property damage. The right to
. reject or accept any bid is reserved by the Town
Board.. The Bidder must comply with the provisions :.
of the Labor Law of the State of New York with re-
ference to the work incidental to the removal of the
building. The Bidder is to give 48 hours ' notice
to the Westchester Lighting Company before removing
the' building as a whole,

A Ietter rated March 13 , 1943 was received from Henry R.
Dillon, Receiver of Taxes , with a statement of tax arrears on property
shown on the tax assessment map of the Town as Block 405, Parcel 396.
Also a letter dated March 6, 1944, received from Boehm & Co,, in-
creasing the previous offer to $300.00 for the purchase of the liens.
Following some discussion,, the Town Clerk vias directed to
advise Mr, Zvirin of Boehm & Co. that the matter was discussed by the
Board and it was the unanimous feeling that not less than $500.00 should
be offered by his client. Some of the members of the 'Board stated that
they wished to make an inspection oI the property before final decision
is made,
A letter dated March 14, 1944, was received from Leo N. Orsino,
comptroller , requesting authorization to transfer certain funds within
the 1944 Budget.
On motion by Councilman Keeler , seconded by Councilman Griffin,
it was , upon roll call, unanimously
RESOLVED,, that the Comptroller and the Supervisor
be and they hereby are directed to make the follow-
ing transfer within the 1944 Budget, as follows:

From: -Clerk, to Supervisor $169.50
Publishing Annual Report $169.50
The Town Clerk advised the Board that March 28, 1944 is the
date for the New York State Primaries, for the selection of delegates
to the National and state conventions'.
He presented a list of the polling places and stated that
only one change would be necessary in the polling places which have been

The Town Board directed the Town Clerk to have published
the usual Primary Notice. ..
A letter dated March 10 . 1944, was received from Mr. Walter
Haeger making a second offer on behalf of his client in the amount of
$500.00 for the purchase of property known as Block 942 , Parcels 20A
and 22B
Following some discussion, it was on motion by Councilman
Embury, seconded by Councilman Keeler, upon roll call , decided that
the offer be rejected.
The following reports were received and ordered filed:
Annual Report of the Town Clerk for the year 1943; Report of the
Town Clerk for the month of February, 1944; Report of the Mamaroneck .
Health Center for the month of February , 1944; Report of the West-
chester County Dog Protective , Association for the month of February ,
1944
The Supervisor announced that it would be in order to re
ceive the reports of the committees.
Councilman Griffin submitted the Public Welfare Department :.

He presented the following reports which were received and

He presented a petition received from the Assessor for the
correction of the assessment roll so as to permit the apportionment
of taxes,
On motion by Councilman Grin, seconded by Councilman
seiner , the following resolution was unanimously adopted
WHEREAS , the Assessor has presented a petition for
the correction of the assessment roll for certain
Tears , pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 , as amended, known
as the Westchester County pax Act* and

Councilman Embury read a letter which he received from Thomas
Aitchison, Jr. who is stationed with the armed forces at Florida and in
which he covered his best pie to the members of the Board.
Councilman Boner reported that the Dillon Park drain had been
completed and that work was started on the drain on Cooper Lane near
Falls Road. He informed the Board that Mr. Fanelli , attorney for Mr
Niklaus had called Engineer Foote and advised him his client would not
grant an easement through his property,
Councilman Stirrer advised that Engineer Foote had devised
another plan aihich would not require the easement and that the men would
go ahead with the work installing an 18" concrete drain pipe past the
Mariani driveway.
He reported that the heavy rain on Sunday night caused a f ew
cellars to be flooded and that the Highway Department had assisted the
owners in removing the water. He added that it had been explained to
the owners that there was no obligation on the part of the Town to do
this work and that the help being of offered for the purpose of assisting
them.,
Councilman Keeler reported that the War Council had held a
meeting on Thursday evening , March 9. 1944 which was very well attended.
He stated that after considerable discussion it was concluded that the
various facilities of the Council would. continue and that it o tild be
kept in preparation for any energency. He added that the next meeting
was scheduled for some time in June.
He said that he did not know whether or not the other members
of the Board had heard from Congressman Ralph A. Gamble. He read a let-
ter from Mr. Gamble who is convalescing in Florida. The menbers of the
Board expressed their wishes for his early recovery
He reported to the Board that some time ago the Supervisor re-
quested that he review the insurance at ens of the Westchester Joint
Water Works No. 1. He stated that he had prepared a report listing the
various policies and recommendationse
The members of the Board were handed a copy of this report
for study and the Supervisor thanked Mr. Keeler for his time and efforts
and said he would present the report at the next Water Board meeting

He stated that the Village of Larchmont requested the town to
increase the 1944 Library appropriation from $5,820.00 to $79133.76 , an
increase of 1,313.76.
Following some discussion it was found, that there was no way
to increase the Town' s co tributions this year and it was decided that
favorable consideration would be given at the time that the 1945 budget
as prepared
The Supervisor informed the Board that he had received an offer
in the amount of $500.00 from Mrs. Dorothy A. Woodruff on property known
as Block 211, Parcel 455. He stated that he had returned the check with
with the request that the offer be increased to not less than $687.87, which
amount represents the Town' s investment in this property as of January 1, 1944
Town Attornev Delius presented a letter dated March 8, 1944-
from the Board of Education, Union Free School District No. 1 , requesting
the town to borrow the balance of the unpaid school taxes for the 1943-
1944. He also presented a certificate from the Receiver of Taxes stating
that the abt of taxes remaining ai d as of March 15, 1944 for the
school district was $77,824.30. He stated that it was estimated that
$70,000.00 should be borrowed.
Councilman Stirrer introduced the following resolution:
RFSOLUTION AUTHORIZIFG THE ISSUANCE of $70 ,000.00 CERTIFI-
CATE OF INDEBTEDNESS IN ANTICIPATION OF UNCOLLECTED TAXES
LEVIED FOR SCHOOL PURPOSES
RESOLVED BY THE TOWN BOARD of THE TOWN OF MAMARONECK,
IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows,
Section 1. In anticipation of the receipt of taxes
levied for school purposes and unpaid in Union Free School
District No. 1 of the Town of Iva aoneck for the fiscal year
beginning Julv 1, 1943 , axed ending June 30 , 1944, the sum of
$70,000-00 shall be borrowed on the credit of the Town, pur-
suant to Chapter 105 of the Laws of 1916 of the State o f Ne
York, as amended, and a Certificate , or Certificates , of n-
de tedness of the Town in said ariount shall be issued to
evidence said loan.
Section 2. It is hereby determined and declared
(a) The total amount of taxes levied in said school dis-
trIct for school purposes for said fiscal vea.r , is
$840 ,897.450
(b) The total amount of said taxes outstanding and un-
collected is $77,824-30.
(c) The total amount heretofore borrowed and outstanding
in ntici action of the collection of said taxes , is
none,
Section 3. The following matters in connection with
said Certificates of Indebtedness are hereby determined:

Along with the above letter there was attached a copy of
letter dated January 14, 1944, from Joseph 0. Heck, Executive Assistant ,
to Mr. F. Morton Clark, Secretary-Engineer , located at the Westchester
Counter Office Building, in which it was Stated that Project 323 , Sanitary
Sewers and Storm Water Drains , with an estimate cost of construction of
$200,000 had received an allocation of $1.000 of the State ' s share of
engineering costs and $300 for extras. The letter also stated that
pursuant to Chapter 660, 'Laws of 1943 , an agreement should be signed
by the chief fiscal officer , after the approval of the Town Board is
made Copies of the agreement were distributed to the members of the
Board, along with certification from the State that the above State '
share had been approved.
Following some discussion, it was on motion by Councilman
stirrer, seconded by Councilman feeler, upon roll call, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized, pursuant to Chapter 660, Laws of 1943 ,
to, enter into agreement with the New York State
Postwar Public Works Planning Commission, for the
allocation of funds for the preparation of re-
lininar y plans , the estimate , the preparation of
detailed plans and specific tions for Scanitary
Seers and Storm eater Drainfs , as proposed and
own as Serial. -#323 of Proposed Postwar Projects.
A letter dated March 31 , 1944, was received from Mr,Percy
Bibas , Real Estate Broker, in which he advised that a client of; his
office had authorized him to offer $100.00 for the purchase of tax
liens coy ring property known as Block 409, Parcel 515, for the gears
1940, 1941 and 1942. It was explained that the lot adjoins #2 Harmony
Drive where the purchaser resides and that the purpose of the interest
of the purchaser in this lot is that he 'wishes to arrange ample drive--
way space for his property,
Following discussion, it was on motion bv Councilman Stirrer ,
, seconded by Councilman Keeler, upon roll call unanimously
RESOLVED, that the Receiver, of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to transfer by assignment the fol-
lowing described liens to Mrs. Josephine G. Krugler,

FURTHER, that he be authorized to accept the sum
of $100,00 in payment of same

The Town Clerk informed the Board that the file in connection
with the offer of Mr. H.W. Paddock through Mr. Phili[ Zvirin of Boehm p
Coo . Read. Estate Brokers . was at hand and that Mr. Philip Zvirin had

ments be and he hereby is authorized, eporerd
and directed to transfer by assignment the fol-
lowing desc ibed liens to H.W. Paddock, 80 Howell
Avenue , Larchmont , N.Y., for propertv known as
Block 405, Parcel 396.
FURTHER, that he be authorized to accept the sum
of $400.00 in payment of same.

The Town Clerk informed the Board that on March 24, 1944, there
was received a letter addressed to the members of the Board from Miss
Erma Bernheimer , in which she complained of the service of the Scarsdale :.
Bus Co.
The Town Clerk reported that he had taken the matter up with
` the Scarsdale Buss Co. and that a letter had been received from them
stating that the Public service Commission had investigated complaints
of Miss Bernhei er and that the matter had been explained to the sat-
isfaction of. the Public Service Commission Further, that Miss Bern-
--- heimer' 's complaints were the only ones which had been received since
the Company had been in operation and that they believe that she stands
alone in her convictions.
Some of the members of the Board viewed the papers and the
Town Clerk was directed to file same.
The following reports for the month of March were received
and ordered filed, Report of the Receiver of Taxes; Report of the
Building Inspector; Report of the Plumbing Inspector.
The members of the Village Board of Trustees of the Village
of Mamaroneck and other of fivers of the village arrived during the early
part ' of the meeting and at this point the Supervisor invited Mayor B.J.
Santoro and the members -- of the Village Board to sit in with the Town
Board to discuss matters of mutual. interest.

Gentlemen,
I understand that final proposals for the purchase of the
ommocks Country Club, together with all of the contents of the
club house and equipment used for the operation and maintenance
of said golf course and club house , partially described in the
map and offer of sale enclosed herewith , toge per with additional
parcels numbered 1, 2 , 3 and 4 and ' land necessary for the pumps ,
as shown on said map, will be received and acted upon on April 5th.
The passage of each day will further seriously jeopardize
the proppects for the 1944 season and I am therefore compelled to
recure that my proposal be accepted or rejected at the meeting
held by the Village and Town Boards on the evening of Wednesday ,
April 5th, and, in the event of acceptance , that possession be
given forthwith.
I propose to purchase from vou the above property for the
sum of $90,000* payable $6000. at the closing and $6000. annually
in advance in fourteen (14) installments up to and including 1959 ,
taxes , assessments, insurance and other mortgage maintenance charges
are to be included in the above purchase price , and other charges
are to be paid by the village out of same. Upon final payment ,
acceptable doctunents giving clear and marketable title are to be
delivered
At your option you may consider as an alternative bid pay-
ment of the sum of $65,000, payable $6500. at the closing and
$6500. anually in advance in nine (9) installments up to and
including 1954 , terms as in above.
An equitable prepayment provision is to be arranged.
I enclose a cashier' s check in the sum of $1000. to cover
any required deposit. The deposit is to be applied towards the
first payment.
Since these bids do not come through a broker , the above
bids are net to the Village. I propose to organize a corporation
Which will execute the formal papers.
I wish again to call to your attention that since a great
deal of work and many thousands of dollars have to be expended
by me almost immediaely to put the golf course in good, playable
condition,, the papers should be prepared with utmost speed and
the closing be held as soon as possible. I will agree to spend
not less than $7500 on the prop , during this seasons.
