JOINT MEETING OF THE BOARD AND ZONING BOARD OF APPEALS
TOWN OF MAMARONECK, NEW YORK
HELD MAY 7, 1941
At the Town Offices, 158 West Boston, Post Road, Mamaroneck, N.Y.
The meeting was called to order by supervisor McCulloch
at 8 P. M.
Present:: Supervisor McCulloch
Councilmen Bates Griffin, Mandevillille Megnniss
Absent: None
The presence was also noted of Town Clerk Payne, Assessorr
Smith Town Attorney Delius and Town Engineer Foote
The members the Board welcomed Councilman Meginniss
on his return from a trip to Florida.
The minutes of the meeting of April 16, 1941 were approved41,, vvrere approved
as presented. ;.
The supervisor read the following letter :

. - Dear supervisor:
In accordance with a law signed by Governor ;
Lehman on Sunday, April 4th, each town and grillage in
Westchester County is authorized to establish a Defense Council.
This law serves as are artiendment, knovvn as
Section A to Chapter 22 of the laws o the State of e York
of 1941. A copy of Section is enclosed and a printed copy : .
of the law will be sent you as soon as it is available.
The town and village Defense Councils accordingly
now become statutory bodies , Their members should consequently
be a pointed and sworn in by the proper officicals as public,
servants.
Suggested methods of organization of these
Defense Councils, committees to be appointed., etc , will be set forth
at the Defense Council Meeting in the County Center, White
Plains Tuesday, April 29th at 10:00 A. M.
We earnestly hope that all members of your
Defense Council as well as any other persons in your community
vitally interested in Defense, will attend this meeting.

later date.
The peers of the Board expressed their approval of
the defense plan and it was on motion by Councilman Mandeville, seconded
by Councilman Meginniss, upon roll call unanimously
RESOLVIED that pursuant to Section 4A of Chapter 22
Of the laws of the State of New York of 1941, the
following be appointed members of the Defense
Council of the unincorporated section of the town
of Mamaroneck
Henry E. Mendes , Chairman
Paul Yerick :..
William Lindale
William McCarthy
Munn Brewer ;-
FURTHER RESOLVED, that they file the statutory oath ;
of office and that the Town Clerk be directed to
notify the Westchester Defense Council
action of the Town Board
Mr. Thomas J. Morrison tendered his resignation as :...
Building Inspector of the Town of Mamaroneck to take effect as of
May 8th', 1941,, After some discussion and expressions of regret by
several members of the Board that this course was made necessary by
the ruling of the State Comptroller in connection with the State
Retirement Fund, his resignation was accepted.
Upon motion made Councilman Mandeville, and seconded
by Councilman Griffin, the following resolution was unanimously adopted:
RESOLVED that Mr. A. J. Foote be appointed Building
Inspector of the Town of Mamaroneck as of May 8th,
1941, such appointment to be without compensation
insofar as Mr. Foote now holds the office of Town
Engineer and Superintendent of Highways .
FURTHER RESOLVED that the unexpended portion of the
salary of the Building Inspector as included in the :.
1941 budget of the Town of Mamaronek, Being the sum
of $800.00, is hereby appropriated for the purpose of
meeting the charge and expense of inspecting plans for
proposed buildings., issuing building permits and super-
wising constru tion such sum to be, available to he
Building Inspector for that purpose for the balance of
the budget year of 10/41.
The Supervisor asked if there was any one present who
vvished to address the Board.
Mr. Harold Toomey attorney, appeared on behalf of
the Immigrant Industrial Savings Bank., the Berkshire Industrial Farm
Home and the Beacon Savings Bank to offer settlement of the certiorari
Following some discussion it was on motion by Councilman
Mandeville, seconded by Councilman Meginniss
RESOLVED WHEREAS, the Assessor has presented a petition
for the correction of the assessment roll. for the year
1940 taxes of 1941, pursuant to the provisions of
Section 33 of Chapter 105 of the Laws of 1916, as amended ,
known as the Westchester County Tax Act; and
WHEREAS, after clue consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE BE IT
RESOLVED that the assessment roll for the year 1940 :.
taxes of 1941, of subdivison property now gearing on
the roll as follows :

FURTHTER RESOLVED that this apportionment also cover
taxes of 1939, sale of 1940 and taxes of 1940.
Mr. Philip Zvirin, realtor appeared to inquire as to the
results of tie Board' s deliberation over the request of the Pinebrook
: Syndicate through their attorney Orson A. Raynor.
: He was advised that the property had been inspected and.
they would results the same consideration shown other taxpayers under
such circumstances .
On motion by Councilman Mandeville, seconded by Councilman
Meginniss, it was upon roll call unanimous1v
RESOLVED, that the Supervisor be and he hereby is : ..
authorized to settle tie tax arrears on Block 502, ::. .
Parcel 86, at the face amount of the tax, ayment :{ .
to be made within thirty days .
Mr. A. Davidson attornev appeared on behalf of Park Rowley
to o er settlement of certiorari proceedings instituted to review the
assessment on Block 720 Parcel 37. He stated that the village o
Larchniont had tented a reduction of $15,000 from the original figure }
on the same parcel..

Following some discussion on motion duly mace and seconded :

The Supervisor asked if there was any one else present who

RESOLVED ' that a public hearing be held- upon certain
amendments to the Zoning Ordinance or Regulations of
the Town of Mamaroneck outside the limits of incorporated
villages o n the evening of June 1941, at 8 P.M. at
the Weaver Street Fire House at the corner of Edgewood
Avenue and Weaver- Street Town of Mamaroneck, New York;
and be it
FURTHER RESOLVED that the Town Clerk be directed to
gave public notice through the official newspaper of
the torn on the 19th day of May, 1941
The members of the Zoning Board of Appeals submitted a list
of several properties in the town wliich were stated to be in violation
of the Zoning Ordinance any of the Building and Fire Prevention Codes
The down Board instructed the Building Inspector to inspect
these properties -and to invite the Fire Inspector to accompany him.
The supervisor recommended the following which was on motion :.

RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized empowered and directed
to accept ayment of the foilowing taxes on Section ,
Block 1 , Lot 1 , in the face aunt of the tax, the
liens for which are held by the ovvn., provided payment
is made within thirty days :

The hoard directed the Building Inspector to call on
Mr . van Sickle to explain the requirements of the Building Code
with reference to signs .
Following some discussion on signs the Tc m Clerk was directed
to write 1d1r.. Gerald J. Cam ber. to request that he remove the tempo-
rary signs erected in the hila le Hills Section a ver rising his pro-
perty for svale. It was mentioned that Mr. Campbell is no longer
interested in the hila le Hills Section,
Councilman Griffin presented and read the Department of
Public Welfare report for the month of April, 1941, which showed
as folloss:-

The Supervisor informed the Board that he had telephoned the :.
Selective Service Board for the names of those serving in the armed
forces He said that. they were unable to give a complete report as
some men enlisted at out of town points .
Councilman Griffin resented four petitions dated May
1941, received from the Assessor for the correction of the assessment
roll so as to permit the apportioment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Mandeville the following resolution was upon roll call unanimously
.doted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment rolls for the year
1940, taxes of 1941, pursiiant to the provisions of
Section. 33 of Chapter 105 of the Laws of 1916, as
amended, known as the Wescheter County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE BE IT

Councilman Meginniss presented the following financial
statements for the period from January 1 to March 31, 1941: 1)
summary of Receipts and. Disbursements; 2) Statement of Budget ppro
priations and Expenditures ; and. (3) Estimated Revenues.
The reports were ordered. filed.
Councilman Mande it l e reported that the Highway Deparment
Was up-to-date on its work an that the equipment was receiving a
good cleaning foIlowng the usual tspring clean-up week.
Councilman Bates reported that the men were taken From the W. P. A.
drain project at Ferndale Street to finish the pro ect at Avon Road.
Town Attorney Delius requested peril-lis ion to enter into a
sty ideation with the attorneys for the relator in the cert. or .rl Dro-
ceedings instituted to review the 1938, 1939, and 1940 assessments
on the Hommocks Country Club.
On motion by Councilman Griffin seconded by Councilman
Meginniss, it was unanimously
RESOLVED, that the Town Attorney be and he hereby
