HomeMy WebLinkAbout1932_10_05 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOV1 OF MAMARONECK, N . Y. held October 5th, 1932 The meeting was called to order by the Supervisor at 9 P.M. Present : Supervisor Burton Justices Boyd, Leeds , Messersmith and Burbank Town Clerk Marvin The presence was also noted of Counselor Game: and Special Counselor J. Henry Esser. The minutes of the meetings of the Town Board of July 6 , 20th, August -3 and 17th were •presented by the Town Clerk and ordered approved as printed: The regular - order of business was suspended in order to hear those present who wished to address the Board. Andrew Derby; Attorney of Larchmont , requested the Board to take up again the petition of his client Tortorella to change the zoning on a certain part of Myrtle Blvd: from Business "C" district to Commercial"D" district to allow the erection of a filling station. This petition had been presented to the Town Board in 1931 and was at that time ordered laid over. After discussion the petition was upon motion by the Clerk seconded by Justice Burbank unanimously (Justice Messersmith not voting) referred to the Board• of Appeals for report and recomXnendatio:n.• J. Lester Albertson; Attorney of New Rochelle , addressed the Board concerning the request of his client Mr. Joseph Mercadante for a refund on account of the construction of water mains in Maple Hills , Part 2, which request had previously been made Itp the Board. Counsel reported on the present status of the matter which was ordered laid over for further consideration. Chief=Captain Donald C. Howe of the Weaver Street Fire Com= pany, - ho. 1 addressed the Board and presented a letter dated October 5th requesting permission to purchase two tires for the, hook and ladder truck: Upon motion by Justice Messersmith, seconded by Justice Boyd, it was upon roil call unanimously RESOLVED, WHEREAS- EAS bids have been received for two 36 x 5 hard rubber tires for the front wheels of the hook and ladder truck; and • WHEREAS the highest bid received was in the amount of 118.80, submitted by the Overman Cushion Tire Co. ; Inc. , and • —WHEREAS it appears to the best interests of the Town to purchase the Overman tires because of their outstanding superiority over other brands , therefore be it RESOLVED, that the purchase of said Overman tires at the price given, be and it hereby is approved and that said tires .be ordered by the Town Clerk. There being no other persons present who wished to address the Board, the regular order of business was resumed. • • &5- Upon motion by Justice Messersmith seconded by the Town Clerk, it was unanimously RESOLVED, that an audit of the Town Accounts and records be continued in accordance with the recommendation of the State Auditors and as in their judgment they may direct. Justice Leeds suggested that it might be advisable to have the recently completed report of the State Auditors published in full in the Larchmont Times and the Mamaroneck Daily Times including all exhibits and schedules: The Clerk was directed to secure an estimate of the cost of . such publication. A letter dated September 19th addressed to the Town Clerk by the Department of Audit and Control regarding the recent audit of the Town' s records and accounts was ordered received and placed on file. Counsel reported favorably on a request by the Board Assessors to apportion taxes on Section 6 : Block 23, Lots 14t.i4nt and 13C as between three owners , William S. t?awter, Frederick Hymans and Avella & Co. : Inc. Upon motion by Justice Messersmith seconded by Justice Burbank, it was unanimously RESOLVED, that upon the recommendation of Counsel the Board of Assessors be and they hereby are authorized and directed to apportion taxes Breen three owners on Section 6 , Block 23, Lots 14A"71:140 and 13C , in accbr- dance with their request: The Clerk reported that he had been served with writs of certizrari on behalf of the Vigmar Realty Corp: vs. the Board of assessors, etc . , and the Graymar Realty Corp. vs. the Board of II Assessors , etc . , relating to assessments: These matters were ordered referred to Counsel. The Clerk presented a petition dated September 30th which had been filed with him signed by s property owners on Echo Drive (Harrison 1&.11-e. ) requesting a change in zoning from Class A residential District to Class B residential district , so as to permit the erec- tion of two-family houses . The petition was referred to the Board of Appeals for report and recommendation. The Clerk presented a petition dated September 26th vhich had been filed with him signed by about a score of persons living in the neighborhood of No 6 Weaver Street , complaining of the dog hos- pital and kennels at. that address. The petition was ordered referred to the County Department of Health. A letter dated September 21st was received from Eric Stein of Hawthorne , N. Y. applying for a position on the Police force: The application was referred to the Police Commission: A letter dated September 22nd was received from Charles J. Roberts requesting a refund of taxes . The matter was ordered re- ferred to Counsel. Two letters dated September 13th and September 22nd respect- ively, were received from the Receiver of Taxes concerning claims of the Bonded Municipal Corporation for refunds of taxes . These matters were ordered referred to Counsel. GTO. W. BURTON Supervisor DATED: September 9, 1932 The reports of the Receiver of Taxes for the months of May, June , July, August and September were received and ordered filed. A letter dated September 19th was received from the Building Commission, Town of Mamaroneck, acknowledging receipt of a matter re- ferred to it by the Town Board at a previous meeting regarding a letter from the Westchester County Chapter of the New York State Society of - Professiona.l Engineers , Inc. The letter from the Building Commission was ordered received and placed on file. The Clerk requested authorization to publish the usual notices regarding registration of voters and the general election. He also recommended that in view of the change in the Manner of regis- tration of voters in the Village of Larchmont , whereby - registration is now personal instead of non-personal as heretofore , it would be advisable to publish a large display advertisement in the Larchmont Times notifying voters in Larchmont of this change. Upon motion by Justice Boyd seconded by Justice Messer- smith, it was upon roll call unanimously 281 • RESOLVED, that the Town Clerk be and he hereby is authorized, empowered and directed to attend to the publication of the usual notices of registration of • voters and general election in the Larchmont Times and the Mamaroneck Daily Times ; and be it further RESOLVED, that he be authorized and directed to publish a large display advertisement in 'the Larchmont Times . for two weeks giving notice of the change from non- personal to personal registration in the Village of Larchmont. • The Clerk advised the Board that it would bd in order for the Board to fix the salaries for the Election Inspectors for the com- - ing year. He stated that the salary had been x,12. 00 per day in 1931 and recommended a salary of x}10. 00 per day for the term of office beginning September 1st , 1932. After discussion the following resol- ution was moved. by Justice Leeds , seconded by Justice Boyd. , RESOLVED, that the salary for the Inspectors of Election for the term of office beginning September lst , 1932 be and the same is set at $12. 00 per day. A vote being taken upon the foregoing resolution resulted as follows ; Ayes : Burton, Boyd, Leeds , Messersmith and Burbank . Noes : Town Clerk Marvin The Clerk advised •the Board that it would be in order .for the Board to fix the rental of the polling places; He stated that the rental had been :(;20. 00 per day in 1931 and recommended that it be s-,15; 00 per day in 1932. Upon motion by Justice Boyp.} seconded by Justice Burbank, it was ,upon roll call unanimously RESOLVED that the matter of rentals to be paid for polling places be and it hereby is referred to the Clerk with power to obtain the best figures possible. The Supervisor advised the Board that he had had prepared plans . and specifications and costs , and which costs in each project include labor, materials , supervision and incidental expenses , on four improvements in the Town, which. he recommended to be undertaken as Work Relief projects .and stated that if these im- provements were authorized by the -Board, he believed that he could obtain the approval of the projects -by the County authorities and an appropriation' therefor to cover the cost and/or share of . said projects to be borne by the County, the balance to be borne by the Town, which he explained in detail to the Board. After discussion, upon motion duly seconded, it was • RESOLVED that this. Board approve of the following 'four improvements to be undertaken as Work Relief projects in the Town, to wit; 1. Extension of the Water Main on 'Echo Drive from Palmer Avenue east to the Boston Post Road at a cost of 0 ;490.85. 2. The • cons.truction - of side walks on the Boston Post Road at a cost of t8,336. 50 3. Construction of a drain in Rouken Glen so that the Morris easement may be discontinued, at a cost of x;;868. 80. • 4. Construction of a drain and highway improvement in and along 'Howell Avenue and/or in Howell Park, at a cost of 0,830. 78: • • _283 FURTHER RESOLVED, that the Supervisor be and he hereby is authorized and._emp.owered to endeavor to obtain the approval of the County authorities to said projects and appropriations being made therefor, the same to be undertaken as Work Relief projects. FURTHER RESOLVED, that the -Supervisor upon the obtaining of said approval and appropriations as -herein provided proceed with the construction of said- Work Relief projects and that the Board of Sewer Commissioners- and Superintendent of. Highways be requested to cooperate with. him .in the construction thereof. FURTHER RESOLVED that the manner and method of financing of the Town' s share of said Work Relief projects be referred to the Supervisor and Counsel. . At 11:50 P. M. the Board. unanimously resolved to recess to meet again at the call of the chair to take up such matters as might properly come before it. • v Town Clerk
