The meeting *as called to order by Supervisor Burton at 10 P.. Y. Present: Supervisor Burton Justices Boyd, Collins, Howell and Leeds Superintendent of Highways Coles Town Clerk Sherman Counsellor Gamble Upon motion, duly seconded, it ,,Taa VOTED, to dispense �riith the reading of the minutes of meetings not yet approved, the Clerk voting in the negative ,upon the adoption of the resolution. 11r. Addor appeared before the Board and requested the extension of water mains in Senate Terrace and Colonial Avenue, which extension had heretofore been laid over by this Board. The Clerk presented the estimate prepared by the Super- intendent of the ,later Department and after discussion and consid- eration, it was, upon motion, duly seconded RESOL7ED, ` —E=ZAS, this Board requests the irstallation of 1125 feet of 6 inch water main on Senate Terrace from hurray Avenue to Forest -venue and 375 feet of 6 inch v,ater main on Colonial. Avenue, together with two hydrants along said extensiorTz, therefore be it HESOLVED, that the Westchester Joint 7hlater ',`Yorks, 11o. 1, be and it hereby is authorized and empowered to install for the Town of Ifa,maroneck, the said main and hydrants, and to charge the Town of Ham»roneck the actual cost thereof as ascertained and approved by the Board of Trustees of the said Westchester Joint Water Uorks, No. 1. A communication from hr. R. C. Tygert was received and read, complaining of the location of a street light in front of his residence at 72 Vine Road. The communication was ordered received, placed on file aad_ referred to the Superintendent of High,,rays for his attention. The Clerk presented a communication from. l_r. C. w% Toody together with a blue. print showing the streets in the Bonnie Briar Section of Ro-uken Glen, the layout of ;r.hich hr. Moody requests be approved by the Board, subject to offer of dedication. The same was referred to the Superintendent of nighways and Counsel for reaort and recorrc?3endation. i P� Counsel stated that he was ready to report on the request heretfore made to the Board by Hr. R. C. Nye, asking that the Board cancel the Easement heretofore granted to the xown of LaLna.roneck through his property. . Counsel also stated that he was familiar with the transaction; that by an agreement dated kay 23, 1924, the Morrell Realty Company, the owner of record of the property hereinafter described, and 'H,rances w. i-ye who had contracted to purchase the aforesaid _property and beld an ecuita-ble interest therein, had granted to the To,.'rn of Yanaroneck a nerpe c,ual easement right of .,*ay and right to lay, construct and use sewer pipe lines', sewer pipes, in through and under the lot hereinafter described; that the plan of the Board of Server Commissioners of Sewicr District No. 1 of the To-.-.,,n of Hamaroneck at that time vas to run a trunk line from Caerleon Avenue thr^--gh the 1Tye -orperty in order to reach the property of the Har- mo Corporation then being developed, and that said easement had been granted for said purposes That thereafter, due to certain engineering difficulties, it had been more 'practi.cable and less ex-ensive to Enter this property fror"i the Boston Post Road side, ;°:rich had been done, and that the easement had not been used, nor any pipes laid thereunder, and that the Board of Sewer Commissioners had no intention of ever using it, and had_ not fui, the-- use for it, and had advised ,he Board that under these circumstances it could be released and Vcancelled. Couxse1 stated that the easement had been granted by the aforesaid parties without cost to the To-=, and under the circumstances it seemed equitable that inasmuch as the Town was not going to use the ease- inert, that it be released and cancelled. Af= discussion, upon motion, duly seconded, it was. IrTSOLVFD, that this Board approves of the release and cancellation of a certain Faae- meat and right of r<ay heretofore granted by the Howell Realty Company and Frances 11. Iye to the Town of T:la.aroneck, dated I;ay 23, 1924, in,. through and under 9I.3f that certain lot, piece or parcel of ground, lying being and situate in the Town of Hamaroneck,. County of '-d"estchEster,. State of Few York, being, a -oast of lots 18 and toe Block 3 as shown on !Tap of HorJell Park, Town of !'Tamaroneck, Westchester County, lTew York, made by Carpenter and Duffy,. dated Tan. 1913, filed in the office of the Register of Westahester County Feb. 8th, 1913 as Map #2007, the said portion of said lots being more particularly bounded and described as follows: BFCINI'�TIN at the most southerly point of said Dot 19; the said point being at the intersection of the dividing property line bet.,reen said Howell Park ]property, the property of Harimo Corp- oration and property of the Post Road Realty Corporation, ruhning thence with the rear line of lots 18 and 19 and the boundary line Of property of Post Road Realty Corporation (1) north 44 degrees 14 minutes wrest 28..06 feet (2)V north 52 degrees 26 minutes crest 110 feet to its intersection with dividing line between lots 17 and 18 Howell Park thence with �aid dividing line (3) north 16 degrees 55 minutes 10 seconds east 230.77 feet to its intersection 4°rith the southerly line of Caerleon Avenue, thence- (4) ,,;ith said sine line of Caerleon Avenue by a curve with a radius of 2.35.54 feet an arc_ of 10.02 feet and a chord bearing south 73 degrees 03 minutes 50 seconds east 10 feet thence (5) by a line parallel to and distant 10 feet at right angles from the dividing line between lot 17 and 18 south 16 degrees 65 minutes 10 seconds i,--!est 223.85 feet, to a. line parallel to and 10 feet at right angles from the rear line of lots 1S and 19, thence (6) -xith said parallel line south 52 degrees 26-rainutes east 103.80 feet (7) south 44 degrees 14 minutes east 29.06 feet to the property of the Harimo Corporation, thence (8) write said property south 47 degrees 22 minutes 50 seconds rest 10 feet to the point or place of beginning. Mamaroneck, and to deliver a release and cancellation of the aforesaid easement in such form and apori such terms as Counsel may direct, and to -- execute and deliver any further documents tthich may be necessary in the premises, Upon motion, the meeting adjourned at 10:3.0 P.
