V_ Present: Justices Boyd, Collins, Howell and. Leeds Superintendent of Highways Coles Town Clerk Sherman Counsellor Gamble In the absence of the Supervisor, on notion, duly made and seconded, Justice Boyd took the chair. The Town Clerk reported having received from Yr. Yac Donald, the County Engineer, a communication dated July 18th, 1928, in relation to the Murray Avenue improvement which on motion, duly made and seconded was read and ordered placed on file. The Town Clerk also presented tracings of the plans for the improvement of that portion of Murray Avenue which lies between its intersection with Chatsworth Avenue on the south and Edgewood Avenue on the north,. prepared by County Engineer Mae- Donald, and known as County Highway No. 74. Thereupon Justice Leeds offered for adoption the follow- - ing resolution: WHEREAS, by a petition dated March 28, 1928, this Board did apply to the Board of Supervisors of -Westchester County to designate Xurray Avenue between Weaver Street (known as County Eighway No. 16-48) an the north and Chatsworth Avenue on the south, in the Torn of .Lgamaroneck, West- chester County, New York, a length of approximately .9 miles for construction as a County road in adcordance with the provisions of County Road Act heretofore duly adopted by said Board of Supervisors, which act permits the building of County roads jointly by the County and Town or Towns; and MOPLEAS, pursuant to an act heretofore duly adopted by -said Board of Supervisors, Kurray Avenue was duly designated for con- struction as County road Ne. 74, as provided by said County Road Act; and VdHERFAS, the County Engineer has accordingly prepared and submitted to this Board for approval plans and specifications for the improvement of a portion of said 2urray Avenue, said portion being between Edgewood Avenue on the north and Chatsworth Avenue on the south; and _v'nM3-AS, the County Yngineer has estimated the cost of said improvement to be borne by the Town in the s.um of �3&,.000.00; now there- fore, be it 149 RESCLUED, that said plans and specifications and estimate prepared by said County 'Engineer for the improvement of said portion of said Murray Avenue, be and the same hereby are in all respects approved;. and be it further RESOLVED:, that there is hereby appropriated the sum of $38,000.00 being the amount re- _ quired of the Townlbr its share of the cost of said improvement and that for the raising of the said sum of $38,000.00 the Supervisor be and hereby is authorized and empowered to borrow upon the faith and credit of the Town of Mamaroneck the said sum of $Za,000.00 for which sum he shall issue in the name and under the seal of said Torn a certificate of indebt- edness, being the share of the Town of iamaron- eck for the cost of improving said portion of Murray Avenue, as provided by the Highway Law. Said certificate to be sold for not less than the par value thereof, to bear interest at a rate not to exceed a per annum and to mature at such time as the Supervisor may determine, nat exbeeding, however, one year from the date thereof. Said certificate shall be paid by the bonds to be sold under the provisions of Sections 158-a and 142 of the Highway Law, being Chapter 30 of the Laws of 1909 and acts amendatory thereof and supplemental thereto and pursuant to Sections 13 and 14 of the County Law being Chapter 16: of the Laws of 1909 and acts amendatory thereof and supplemental thereto; and it is further RESOLVED, that the Supervisor and Town Clerk be and they hereby are authorized and empowered to sign and execute such papers and documents as may be necessary to effect the sale of said . certificate.. The question of the adoption of the foregoing resolution was put to a vote with the following result: Ayes; 6 _,Noes: none Tyr. Coles reported that in company with Judge Leeds and County Engineer Mac Donald, he had recently inspected Fenimore Road and the bridge on Fenimore Road. That as a result of said inspection he had reached the c:oncluzion.which was shared by the others that both Fenimore Road and the bridge needed imFnediate attention and reco=ended that the bridge be inbuilt and that Fenimore Road from the Village line to Cornell Street be improved. Thereupon Justice Leeds offered for adoption the follow- ing resolution; BESOLVED-, that the recommendation. of Town Superintendent of Highways Coles be and the same hereby is in all respects approved; and - - it is further RgSOLVED, that County Engineer Mac Donald be requested to draw and prepare suitable plans and specifications for the construction of the bridge on Fenimore Road and for the improvement of Fenimore Road between the Village of Mamaron- eck line and Cornell Street, in the Town of liamaroreck, 1`T. Y., with all convenient speed, 151 and that in the event it is found that Yr. Mao Donald cannot conveniently draw and prepare said plans and specifications at this time that the Supervisor and Town Superintendent of.Highways Be authorized and empowered to employ another engineer for that purpose and that the cost thereof be..maade.a,.proper Tom .charge: The question of the adoption of'the foregoing resolution Was put to a vote with the following result:.
