Meeting of the Joint Town. Board
TOWN OF iiAMABONECK
held March 9th, 1927.
The meeting was called to order by Supervisor Burton
at 9:30 P. K.
PRESENT: Supervi so r Burton,
Justices Collins, Howell, Leeds,
Supt. of Highways Coles,
Town Clerk Sherman
The Supervisor stated that the meeting was a con-
tinuation of the public meeting heretofore held on the app-
lication of the T.Vestchester Street Transportation Company,
Ina.
she Committee appointed at the last meeting of the
Board consisting of Justices Leeds and Collins and Counsel
reported that they had conferred with the officials of the
Westchester Street Transportation Company, Inc. regarding
the application ani the form of the resolution to be adopted
by the Town Board.
Supervisor Burton stated the position of the Town
Board in cohnect ion with said matter.
After discussion, it was upon motion duly seconded,
RES01VM. ), that the Committee heretofore
appointed be requested to again confer
with the westchester Street Transport-
ation Company Inc. in regard to the
matter of the consent and that the
Committee report back its findings, and
it was furthe r
RESOLVED, that Mr. Lyons be made a member
of said Committee.
Mr. Lyons was present any stated to the Board that
he would be glad to act with the Committee, that he had taken
much interest in the transportation situation and had held
many conferences with the Railway Company and that he believed
the Company would render good service and that they would be
glad to further discuss the matter with the Committee appointed.
The Supervisor reported that after extensive negot-
iations with t1D attorneys for the New York, 'Westchester and
Boston Railway Compaay and the New Haven Railroad Company, he
had received an offer to settle the claim fcr damages sustained
by the Towa of Mamaroneck by reason of the change of grade of
Myrtle Avenue west of Chatsworth Avenue in front of and adjoin-
ing the premises owned by Carmine Torterella for the sum of
$1,000. and stated that in his opinion the offer was fair and
advantageous to the Town of Mamaroneck, and requested that he
be authorized to accept said offer and execute the proper
release in order that he might effect the settlement in question.
After some discussion, Justice Leeds offered for
adoption the following resolution:

Be it
RESOLVED, that the Supervisor be and
hereby is authorized and empowered to
accept the offer of $1,000. made by
the New Yolk, Westchester and Boston
Railway Company and the New Haven Rail-
road Company in settlement of the
claim of the Tovn of Mamaroneck fnr
damages sustained by reason of
the change of grade of Myrtle Averse
west of Chatsworth Avenue in front of
arri adjoining the premises owned by
Carmine Tortorella occasioned by the
construction of additional tracks and
the extension of the Chatsworth Avenue
bridge ; and be it further
RESOLVED, that the Supervisor and the
Town Clerk be and they hereby are auth-
orized and empowered to execute such
releases and other instruments as may
be necessary and proper in order to
effectuate said settlement.
Upon a vote being taken upon the adoption of the
foregoing resolutions, the same were declared unanimously
adopted.
