PRT;SYETT: Supervisor Burton Justices Boyd,Colli:ns,Howell & Leads Town Clerk Sherman Counsellor Gamble. Mr. R.C.Heather appeared before the Board in relation to the acceptance of heather Lane as a. Town highway. Mr. Heather stated that he had been in touch with Mr. Coles, who is ill in bed, and reported that he is in favor of the acceptance of Heather Lazne as a Town Highway. The Supervisor stated that he had also been in touch with Mr. Coles, and that the Superintendent of Highways recommended the acceptance; thereupon the following resolution was presented and upon Holl Call unanimously adopted. THEEEAS, a petition has been presented to the Board and the Superintendent of Highways requesting, the Town of Mamaroneck to accept as a Town highway a certain street or lane in the property of R.C.Heather lying and being within the Town of Mamaroneck, as shown on a certain map entitled "Survey and Subdivision of Part of the Bonny Farm situated in the Town of Mamaroneck, County of Westchester and State of New York," and S'HFaZIAS, in filing said map said Heather made an offer of dedication of said street or lane shown thereon as a public highway to the Town of Mamaroneck, and SEAS, the aforesaid offer of dedication has never been withdrawn by said Heather or anyone in his behalf; and WHEREAS, Heather still desires and has requested that the said offer of dedication of said street or lane shown on the aforesaid map be accepted as a Town highway of the Town of Mamaroneck, and WHEREAS, said Heather has agreed to deliver to the Town of Mamaroneck a duly executed deed o -f said street or lane in proper form and has executed a contract with the Town of Mamaroneck to improve said street and construct sidewalks thereon in the manner set forts in said contract, and WHEIMEAS, said petition has been considered by this Board and the Town Superintendent of Highways has recommended that the same be accepted as a Town highway, now, therefore, be it RESOLVED, that the Town of Mamaroneck do-- and o__and it hereby does accept the aforesaid offer - of dedication heretofore made by the said R.C.Heather to dedicate to the Town of Mamaroneck as a public Town highway the street or lane lying and being within the Town of tlamaroneck,New York, and shown on a certain map entitled "Survey & Subdivision nm - of Part of The Bonny Farm situated in the Town of Mamaroneck, County of Westchester and State of New York," and be it FURTHER RESOLVED, that the street or lane shown on the aforesaid Snapp to-wit,Heather Lane, be and the same hereby is :Wade and declared to be a public Town highway, and be it FURTHER RESOLVED, that the Superintendent of Highways be and he hereby is authorized and empowered to execute and record what- ever documents or certificates are necess- ary according to law to vest title to the aforesaid street and highway in the Town and to bring this resolution into full force and effect, and be it FURTRER RjSOLVw_.,D, that the Town reserves the right to revoke and cancel the accept- ance of the aforesaid offer of dedications and the acceptance of the aforesaid street or lane and the deed of the same should Heather fail or refuse to carry out the terms and conditions of a certain agreement entered into on the 21st day of December, 1925, between the Town of Mamaroneck, and R.C.Heather, anything hereinabove to the contrary notwithstanding, and be it FURTHER =,,SoLVED, that the Town of Mamaro- neck shall be kept safe and harmiess of any claim or damage of any nature or character whatsoever in_any wise arising from the improvement of the aforesaid street anything to the contrary notwithstanding. A Committee on the Change of Street Names reported that they had diet with the Committee from the Village of Larchmont, and had agreed upon changes of street names within Larchmontt postal district and requested that their report be submitted to Counsel on the legal requirements, if any, in connection with changing the names of streets. Upon motion duly seconded, it was voted that the report of the Cozl,^nittee on Change of Street Names be noted in the minutes and -that the same be referred to Counsellor Gamble for his report. Mr. Gagliardi -:on behalf of Mr. Gordon E. Ferguson, Right-of-way 11ligineer of the Westchester County Parr Commission, requested the Board for an expression of opinion as to whether or not the Board would be disposed to accept for dedication a forty(40) foot street between HigUl and and Hillwood Roads -through ?property owned by the Siebert Realty Corporation -near Rockland Avenue, in the Town of Mamaroneck, New York. Mr. Gagliardi also stated that this proposed road would be p-roperly widened, graded and otherwise improved and that the necessary legal documents, such as deeds and releases, would be submitted for approval to the 1211 Town Counsel and that if the Board could see its tray clear to snake an exception in this case owing to the width of the road being less than fifty (50) feet, the Westchester County Park Commission would be able -to save a substantial amount of money in their transaction with the Siebert Realty Corporation in the acquisition of property affected by the Hutchinson River Parkway. Mr. Gagliardi also exhibited to members of the Board a map showing the location of the proposed roadway and added that in view of the fact that the Parkway runs parallel with and adjoins said proposed roadway it will not be necessary to have any concrete walk laid as the Parkway Commission is likely to construct a foot path similar to the many foot paths constructed on the Bronx Parkway Reservation. After the ;scatter was considered at some length, Justice Leeds offered for adoption the following resolution, be it RESOLVED, that it is the sense of this Board if and when Kane Avenue shad have been properly widened to a width of 40 feet between Highland and Hillwood Roads- andshall have been graded and otherwise improved to the satisfaction of the Town Superintendent of Highways and the necessary deeds and releases shall have been furnished and approved by the Town Counsel, that said Kane Avenue be accepted as a Town highway notwithstanding the fact that same is 40 feet in width.
