Town of Mamaroneck
July 16, 1954.
Meeting was called to order by Supervisor Burton at
10:05 P. M.

Upon motion duly seconded it was voted to dispense
with the reading of the minutes of meetings not yet approved.
The Clerk reproted the receipt of communications
from the State Highway Department in relation to the fixing
of the Boston Post Road between Premium River Road and Dean
Place, stating that the road had been repaired as requested.
The communications were ordered noted in the minutes and
placed on file.
A communication from the Association of the Woods
of Larchmont was received and read, inquiring as to the
disposition of matters that were brought to the attention
of the Board at its last meeting. The Clerk was instructed
to reply, stating that the matters are receiving attention.
The Superintendent of Highways brought up the :matter
of having a hydrant installed on Fifth Avenue, and urged
that the Inter Urban hater Company be_ directed to have the
same installed. Whereupon the following resolution was
offered and upon Roll Call unanimously adopted:
RESOLVED: that the New York Inter Urban dater
_Company be and it hereby is authorized, re-
quested and directed to install a hydrant on
Fifth Avenue in the Town of Mamaroneck, the
location of same to be under the supervision
of the Superintendent of Highways.
The mater of gas mains on Weaver Street from the
Post Road to Howell Avenue was then considered by the
Board, and upon recommendation of the Superintendent of
Highways it was upon Roll Cali. unanimously
RESOLVED: that the Westchester Lighting Company
be and they are hereby requested and directed
to have their gas mains installed on Weaver
Street running from the Post Road to Howell
Avenue under the supervision and direction
of the Superintendent of Highways.
Mr. Harold LeFu.rgy appeared before the Board and re-
quested the installation of lights on Rockland Avenue. Upon
the recommendation of the Superintendent of Highways it was
unanimously upon Roll Call
RESOLVED: that the Westchester Lighting Company
be and they hereby are requested and directed
to have the street lights on Rockland Avenue
installed under the supervision and direction
of the Superintendent of Highways.
Supervisor Burton reported the organization of the
Westchester Union Water Forks and recommended the appointment
of an engineer to represent the Town of Mamaroneck on the
Board of Engineers of the water works district. Upon motion
duly seconded it was unanimously
RESOLVED: that Robert H. Stevens, a resident
of the Town of Mamaroneck, be and.he hereby
is employed as engineer of the Town of
Mamaroneck to look after the Town's interests
in the mater district.
The Superintendent of Highways recommended the re-
moving of rock jutting out upon the highway at Palmer Avenue
adjacent to the Pendegast Homestead and also at the northerly
side of Forrest Avenue westerly of Bungalow Road. Upon his
recommendation it was unanimously
RESOLVED: that the Superintendent of Highways be and
he hereby is authorized and empowered to have the
rock -removed on Palmer Avenue adjacent to the
Pendegast Homestead and also at the northerly side
of Forrest Avenue westerly of Bungalow Road.
Mr. William E. Lyon, Jr. , appeared before the Board and
spoke in relation to the conference at Larchmont with the
several municipalities and the officials of the trolley company
affecting the fare question of the New York & Stamford Railway
Company. After a full discussion of the matter it was upon
motion duly seconded
RESOLVED: that Supervisor Burton and Counsellors Esser
and Gamble be and they hereby are authorized to
appear at the conference in Larchmont between the
officials of the municipalities interested and the
officials of the trolley company.
rJHEREAS, the Larchmont Gardens Company, a New
York Corporation, acquired title in the year
1911 to several farms in the Town of Mamaroneck,
the deeds of which farms were bounded westerly
by a public highway known as Weaver Street and
carried the title to the easterly side thereof:
and
Whereas, the Larchmont Gardens Company there-
after had a map of said property made, entitled
",Plan of lots called Larchmont Gardens Situated
in the Town of Mamaroneck, County of Westchester
and State of New York, Sub-divisions 1 and 2 by
Long & Miller, Civil Engineers, dated August 16,
1921,1 and caused said map to be filed in the
Office of the Register of the County of West-
chester on September 11, 1911, as Map No. 19€9
(hereinafter called "Map of Larohmont Gardens") ;
and
"
W=EAS, the aforesaid map shows a street
somewhat wider than the public highway,
Weaver Street on the easterly side thereof,
as is evidenced by the strip of land shown
on the map as existing between the easterly
line of Weaver Street and the westerly line
of the tier of lots fronting on Weaver Street
on said map, which strip of land was private
property at the time the map was made; and
WHEREAS, after the filing of said map the
Larchmont Gardens Company proceeded to sell
and convey large numbers of lots by refer-
ence to the map, said conveyances being
made without further descriptions than the
lot numbers upon the said map, including
lots fronting on Weaver Street; and
WHEREAS, the making and filing of a map and
conveying lots by it constitutes an offer
of dedication of the streets thereon shown
to public use; and
THEREgS, the making and filing of the Map of
Larchmont Gardens and the conveying of
various lots on this map by the owners there-
of constitute an offer of dedication of the
said narrow strip of land which forms a
private street upon the :yap of Laro'nmont
Gardens between the easterly line of Weaver
Street, as legally opened, and the westerly
line of the Weaver Street lots on the Map
of Larchmont Gardens, which has never been
withdrawn or revoked; and
WHEREAS, it is deemed wise to accept the offer
of dedication of this narrow strip of land,
which forms a private street upon the Map of
Larchmont Gardens, and thus widen Weaver
Street on the easterly side to the front line
of the lots shown on the Map of Larchmont
Gardens and thus fix the easterly line of
'Weaver Street as a public highway as the
westerly line of the Weaver Street lots on
the Map of Larchmont Gardens; and
WHEREAS, in consideration of the premises,
the Superintendent of Highways and the Sewer
Commission have recommended that said action
be taken -
NOW, THEREFORE, be IT RESOLVED, by The Joint
'mown Board that the Town of Mamaroneck do and
hereby does accept the aforesaid offer of
dedication of the aforesaid narrow strip of
land which forms a private street upon the
Map of Larchmont Gardens along the easterly
side of 'Weaver Street hereinafter described,
heretofore made by the Larchmont Gardens
Company, and does hereby accept as a Public
Town Highway the following described road,
street and way, or portion thereof, as shown
on the map entitled "Plan of Lots called
Larchmont Gardens, Situated in the Town of
X87
Mamaroneck, County of Westchester and State
of New York, Surveyed for Clifford B. Harmon,
51 East 42nd Street, New York City, New York,
Sub-Divisions 1 and 2, by Long & Miller, Civil
Engineers, dated August 15, 1921," and describ-
ed as follows:
ALL that certain narrow strip of land which
forms a private street upon the aforesaid map,
bounded as follows:
On the west by a public highway known as Weaver
Street as legally bounded; on the south by the
right of way of the N.Y., N.H. & H.R.R. ; on the
east by the westerly line of the Weaver Street
lots on the Kap of Lare'nriont Gardens; on the
north by the point of intersection of the south-
erly boundary line of the Development or Sub-
Division known as "Colonial Park" and the
northerly boundary line of the Development or
Sub-Division known as "Larchmont Gardens".
And be it
IYURMR RESOLVED, that the afore-described strip
of land and private street be and the sane hereby
is made and declared to be a public highway; and
BE IT FURTHER RESOLVED, that the Town Clerk be
and he is hereby empowered and directed to re-
cord the aforesaid deed; and
BE IT FURTHER RESOLVED, that the Superintendent
of Highways be and he hereby is authorized and
empowered to execute and record whatever documents
or certificates are necessary according to law to
vest title to the Town in said portion of street,
and to bring this resolution into full force and
effect; and
BE IT FURTHER RESOLVED, that nothing herein con-
tained shall be construed as an acceptance of
the offer of dedication of any other Roadg,
Streets or ways or portions thereof shown on
said map, this said acceptance of dedication
being specifically limited and confined to the
strip of land and private street herein describ-
ed; and
BE IT FURTHER RESOLVED, that the Town of Mamaroneck
shall be kept safe and harmless from any claim or
damage of any nature or character whatsoever in
anywaise arising from the improvements of the afore-
said streets, anything to the contrary notwithstand-
ing.
Upon motion the meeting adjourned at 11:55 P. M.
