HomeMy WebLinkAbout1923_09_25 Town Board Minutes (2) Meeting of the Joint Town Board TOWN OF MAMARONECK held September 25th, 1923. Meeting was called to order by Supervisor Burton at 10.30 P.M. PRESENT: Supervisor Burton, Justices Boyd, Collins, Dudley & Shafer, Town Clerk Sherman. The minutes of the meetings of August 15th and September 5th, 1923 were read and upon motion approved. A communication from Mrs. Estelle G. Woods was received and read, requesting the laying and installing of a water main in and along Villa Road in the woods of Larchmont. The question was duly considered and upon motion by Justice Shafer, seconded by Justice Boyd, the following resolution was unanimously adopted: RESOLVED, that the New York Interurban Water Company be and hereby is authorized and re- quired to extend and lay a water main in and along Villa Road, a public highway of the Town of Mamaroneck, from the end of the present main, in a westerly direction for a distance of two hundred (200') feet. The Superintendent of Highways spoke of the lights needed on several highways in the Town of Mamaroneck and upon his reco- mmendation, the following resolution was unanimously adopted: RESOLVED, that the Westchester Lighting Co. be and hereby is authorized and required to install the following street flights upon the public highways hereinafter named, which said public highways are situated within the Town of Mamaroneck, New York, viz: a. 2 street lights on Villa Road between Vine Road and Boulder Road. b. 2 street lights on Spruce Road east of Rockingstone Avenue, c. 1 street light on Maple Street, west of Myrtle Avenue; and be it further RESOLVED, that the above street lights be in- stalled under the supervision of the Town Super- intendent of Highways. A communtation from the Board of Sewer Commissioners was received, read, ordered placed on file as follows: Honorable Town Board, September 25, 1923. Mamaroneck, N.Y. Gentlemen: i The Residents of Larchmont Gardens and Colonial Park have petitioned the Town and the Sewer Commission to have sewers constructed in their district. Your Honorable Board has turned this matter over to the Sewer Commission and the Commission is ready to construct these sewers but find that certain of the streets are not Town Streets. The Sewer Commission will be unable to construct these sewers until such a time that the Town accepts them as Town Streets. The following streets are the ones in which the Commission desires to construct sewers: Harmon Drive, Windsor Street, Myrtle Blvd., East Brookside Drive, West Brookside Drive, Lake Side Drive, Falls Road and also Sheldrake Ave., in Colonial Park and Colonial Ave., on Chatsworth. Heights. Enclosed is a map showing the roads mentioned marked in red. We earnestly request that your Honorable Board take over these streets as early as possible in order that our work may not be delayed. The Superintendent of Highways recommended the acceptance of the streets, namely Harmon Drive, Windsor Street, Myrtle Blvd., East Brookside Drive, West Brookside Drive, Lake Side Drive, Falls Road, Sheldrake Ave. and Colonial Avenue. Whereupon the following order and certificate was duly executed and signed by this Joint Town Board and the same was order- ed filed in the office of the Town Clerk. The undersigned, being a majority of the members of the Town Board of the Town of Mamaroneck, New York, hereby consent that the Town Superintendent of Highways of said Town make an order accept- ing by dedication and laying out the highways and parts of highways hereinafter described pursuant to the application of the Larchmont Gardens Company and the request of the Board of Sewer Commissioners of the Town of Mamaroneck, New York, under the provisions of Section 191 of the Highway Law. Said proposed highways and parts of high- ways are more particularly bounded and described as follows: Harmon Drive ALL the land lying in the bed of all that part of Harmon Drive extending from its intersection with the easterly line of Weaver Street to the westerly boundary line of the Village of Mamar- oneck, as laid down on a certain map entitled "Plan of Lots called Larchmont Gardens, situated in the Town of Mamaroneck, County of Westchester and State of New York, surveyed for Clifford B. Harmon and Company, 42nd Street and Madison Avenue, New York City, N.Y., Subdivisions No. 1 and 2", by Long & Miller, Civil Engineers, dated August 16, 1911 and filed in the Register's office of West- Chester County on September 11, 1911 as Map #1949. Windsor Street ALL the land lying in the bed of Windsor Street, as laid down on the aforesaid map; and also Part of West Brookside Drive, consisting of ALL the land lying the bed of West Brookside Drive from the extreme northerly end of that portion of West Brookside Drive, which has heretofore been dedicated to and accepted by the Town of Mamaroneck westerly for a distance of 350 feet as measured along the southerly line of said West Brookside Drive, as laid down on the afore- said map; and also Part of East Brookside Drive, consisting of ALL the land lying in the bed of East Brookside Drive from the intersection of said East Brookside Drive with Valley Stream Road, westerly to its intersection with Briarcliff Road, as laid down on the aforesaid map; and also Sheldrake Avenue ALL the land lying in the bed of Sheldrake Avenue extending from its intersection with the northwesterly line of Forest Avenue northerly to its intersection with the southerly line of Rockland Ave., as laid down on a certain map entitled "Subdivision Tow, Map of Colonial Park, in the Town of Mamaroneck, Westchester County, New York, the property of Rosina Lorenzen", made by Fletcher Herdt, Civil Eng- ineer and Surveyor, Mamaroneck, N.Y., dated February 2, 1907 and filed in the office of the Register of Westchester County on December 3,1907 as Map #1765; and also Colonial Avenue ALL the land lying in the bed of Colonial Avenue from its intersection with Murray Avenue easterly to its intersections with Weaver Street, as laid down on a certain map entitled "Map of Colonial Park, in the Town of Mamaroneck, Westchester County, New York, the property of Rosina Lorenzen", made by Fletcher Herdt, Civil Engineer and Surveyor, Mamaroneck, N.Y., dated June 1906 and filed in the office of the 'Register of Westchester County on August 3, 1906 in Volume 23 of Maps, at page 21. This consent is granted upon Condition that proper deeds of dedication and releases to effectuate the dedication and laying out of the above named highways and parts of highways to be approved by counsel are filed with the Town Clerk of this Town. Sherman Town Clerk, The Superintendent of Highways spoke of the matter of im- proving Weaver Street and upon his recommendation the following reso- lution was upon ROLL CALL unanimously adopted: WHEREAS, pursuant to Section 9B of the Highway Law, the Town Superintendent of Highways shall cause any highway that is damaged or destroyed by the elements or otherwise, or shall become unsafe for public use and travel, to be immed- iately repaired with the approval of the Town Board; and WHEREAS, a statement has been prepared by the Town Clerk of the Town of Mamaroneck from which it appears that the cost of repairing Weaver Street, a public highway within said Town from the intersection of Boston Post Road in a gen- erally northerly, direction to a point about 500 feet from the point formed by the intersection of Murray Avenue and Weaver Street; and WHEREAS, said statement has been signed in dupli- cate by a majority of the Town Board, the original of which was filed with the Town Clerk and the counterpart thereof has been delivered to the Supervisor for filing with the Clerk of the Board of Supervisors of Westchester County. NOW, THEREFORE, be it RESOLVED, that pursuant to Section 96 of the Highway Law this Board borrow on the faith and credit of the Town of Mamaroneck the sum of $5,000.00 to pay the cost of repairing said highway; and be it further RESOLVED, that a certificate of indebtedness of the Town of Mamaroneck be and the same hereby is directed to be issued and sold by the Super- visor at not less than par, in the amount of $5,000.00 to be dated October 3, 1923 and to be- come due and payable on the first day of July, 1924, to bear interest at a rate not to exceed 6% per annum and to be signed by the Supervisor and attested by the Town Clerk under the corporate seal of said Town and to be in the following form with the blanks properly filled out STATE OF NEW YORK COUNTY OF WESTCHESTER TOWN OF MAMARONECK CERTIFICATE OF INDEBTEDESS NO. 1 $ 5,000.00 KNOW ALL MEN BY THESE PRESENTS, that the Town of Mamaroneck a municipal corporation within the County of Westchester, State of New York, acknowledges itself to be indebted to and for value re- ceived, promises to pay to the its successors and assigns, the seam of Five thousand ($5,000.00) Dollars, lawful money of the United States, on the 1st day of July, 1924, with interest thereon at the rate of 5-1/2% per annum. This certificate is issued in pursuance of a resolution of the Town Board of said Town duly adopted at a meeting held on October 3, 1923 under the provisions of Section 96 of the Highway Law and is issued for the purpose of paying the cost of repairing Weaver Street, a public highway within the Town of Mamaroneck from the intersection of Boston Post Road in a generally northerly direction to a point distant about 500 feet from the point formed by the intersection of Murray Avenue and Weaver Street. IN WITNESS WHEREOF, the Town of Mamaroneck, by its Town Board, has caused this certificate to be signed by its Supervisor and to be countersigned by the Town Clerk and its seal to be affined the 3rd day of October, 1923. Seal RESOLVED, that the said certificate of indebtedness be sold by the Supervisor at not less than its par value and shall be paid out of the taxes to be collected in the year 1924; and be it further RESOLVED, that the Supervisor certify the amount and interest of the said certificate of indebted- ness to the Board of Supervisors and have the same assessed and levied as provided by law; and be it further RESOLVED, that there be levied and assessed upon the real property of the Town of Mamaroneck, out- side of the Villages of Larchmont and Mamaroneck, a tax to pay said certificate of indebtedness and the interest to accrue thereon to July 1, 1924.
