TOWN OF MAMARONECK,
held, December 27th, 1922.
The meeting was called to order by Supervisor Burton
at 10.00 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins and Shafer,
Town Clerk Sherman,
Counsellor Gamble.
The minutes of the meetings of December 6th and 20th,
were read and upon motion approved.
Supervisor Burton reported that the plans for the
additional cost of the Weaver Street improvement had been app-
roved by the Board of Supervisors and he further reported that
the takings along the Highway will be taken in a few days.
The Supervisor spoke of the need of lights on Chats-
worth Avenue between Glen and Forest Avenue and upon motion
duly seconded, it was upon ROLL CALL,
RESOLVED, that the Supt. of Highways be
and he hereby is authorized and empow-
ered to direct the Westchester Lighting
Company to install three street lights
on Chatsworth Avenue between Glen Road
and Forest Avenue.
A communication from County Supt.of Highways, Charles
McDonald was received and read enclosing application of the
Westchester Lighting Company asking permission to open the con-
crete pavement on Palmer Avenue and also enclosing a bond in
the amount of $5,000. The permission to open the roadway was
granted and the bond was ordered received and placed on file.
A communication from the New York Inter Urban Water
Company was received in reply to the letter sent by the Clerk
demanding the installation of water mains and hydrants along
Hillcrest Avenue, Garden Road and Chatsworth Avenue, stating
the terms upon which the said installations would be made.
Whereupon the following resolution was presented
and upon ROLL CALL, was unanimously adopted:
WHEREAS, the Board has heretofore adopted
a resolution directing the New York Inter
Urban Water Company to extend the water
main through and along Chatsworth Avenue
south of Forest Avenue, a distance of
1142 feet; and
WHEREAS, the water company has refused to
lay said extension unless the Town under-
takes to guarantee a grows income of 25%
of the estimated cost thereof for a period
of ten years; and
WHEREAS, the cost of excavating the trench
for laying said main along Chatsworth Ave,
has been estimated at about $1,500.00; and
WHEREAS, it is the sense of this Board that
it would not be advisable to undertake on
behlaf of the Town to guarantee the water
company any income in view of the order
granted by Mr. Justice Seeger, directing
the water company to lay other mains in the
Town of Mamaroneck, upon the same state of
facts as exist in the case in question;
and
WHEREAS, the Appellate Division of the
Supreme Court has unanimously affirmed the
order of Mr. Justice Seeger; and
WHEREAS, this Board has been advised by
Counsel to lay the mains and install the
hydrants in Chatsworth Avenue and seek to
recover from the water company the amount
it may be compelled to expend in the per-
formance of such work after the refusal
of said water company to do so; and
WHEREAS, this Board is of the opinion that
an emergency exists and that it would be
for the best interests of the Town to have
the water main along Chatsworth Avenue
south of Forest Avenue extended forthwith,
thus providing for the installation of two
or more fire hydrants along said highway,
Now, Therefore be it
RESOLVED, that the sum of $1,500.00 is
hereby levied and assessed against the tax-
able property of the Town of Mamaroneck
lying outside the Villages of Larchmont
and Mamaroneck, and collected, for the
purpose of defraying the cost of extending
the water main and installing fire hydrants
along Chatsworth Avenue south of Forest
Avenue according to a demand heretofore
made by the Town Board upon the New York
Inter Urban Water Company; and be it
further
RESOLVED, that the Supervisor be and he
hereby is authorized and directed to cause
said extension to be made according to the
demand heretofore made by the Town Board
upon the New York Inter Urban Dater Company,
at a cost not exceeding $1,500.00 and to
Pay for it out of any moneys in his hands
not otherwise appropriated.
Upon motion, the meeting adjourned at 11.00 P.M.
