TOWN OF MAMARONECK
held, December 20th, 1922.
The meeting was called to order by Supervisor Burton
at 10.20 P.M.
PRESENT: Supervisor Burton,
Justices Boyd, Collins and Shafer,
Supt. of Highways Anthes,
Town Clerk Sherman,
Counsellor Gamble.
Upon motion it was voted to dispense with the reading
of minutes of meetings not yet approved.
Mr. E. L. Crans of the Monarch Tractor Company was present
and addressed the Board relating to the purchase of a tractor.
No action taken.
Mr. T. B. Tully appeared before the Board asking permis-
sion to operate a bus line through the highways of the unincorp-
orated section of the Town of Mamaroneck. He was asked to submit
his proposition in writing at the next meeting.
The Town Supt. of Highways' estimate for highway pur-
poses for the year 1923 was received and considered and upon
Mr. Anthes' recommendation, it was
RESOLVED, that the following sums be
allowed and approved for each pros-
pective item:
Item #1, allowance $13,000.00
Item #3, allowance 2,000.00
Item #4, allowance 5,000.00
The question being taken upon the foregoing resolution,
same was upon ROLL CALL, unanimously adopted.
The Board thereupon proceeded to execute the estimate
of the Supt. of Highways for highway purposes, hereto approved
and adopted.
A communication from the State Commission of Highways
in relation to the improvement of Weaver Street in the Town of
Mamaroneck, was received, read, ordered spread upon the minutres
and is as follows:

Mamaroneck, New York.
Dear Sir:
Plans, specifications and estimate of cost for the
improvement of the Weaver Street, Part 1, County Highway No. 1645,
Westchester County, in connection with which improvement your
town has heretofore requested extra work, have been revised
by this Commission. The total estimated cost of this improvement
as revised is $84,400.00, of which your town will be required
to pay $15,700.00 for the extra work requested. As your town
has heretofore made an appropriation of $13,500.00 toward this
extra work, and additional appropriation of $3,200.00 is re-
quired.
I attach hereto resolution in duplicate providing for
the approval of the plans as revised and the appropriation in the
sum of $3,200.00, additional, by your town for the extra work
requested. Will you kindly present this resolution at the next
meeting of your town board (together with the plans which will
be forwarded to you by the Clerk of the Board of Supervisors of
Westchester County) and, if adopted, execute the plans in the place
prepared and return same with certified copy of the resolution
to this office.
I also attach certificates of deposit covering the add-
itional appropriation of $3,200.00. This certification with the one
for $13,500.00, forwarded to you under date of May 18, 1922, should
be executed by you and filed in this office and also in the office
of the State Comptroller when the officials of your town have
deposited funds with the State Comptroller amounting to $16,700.00
for the extra work which your town has requested in connection
with this improvement.
Arrangements should be made by your town officials to
deposit these fundswith the State Comptroller on or before the
day upon which proposals for the work are received by this Com-
ission. In no case can a contract be awarded until the funds are
on deposit with the State Comptroller.

The following resolution was presented by Justice Boyd
and seconded by Justice Collins:
ADDITIONAL APPROPRIATION BY THE TOWN OF
MAMARONECK ON THE WEAVER STREET, PART 1
COUNTY HIGHWAY No. 1645, WESTCHESTER COUNTY.
which amount is hereby ordered deposited
with the State Comptroller who is hereby
authorized und directed to pay the same
at any time upon the requisition and
draft of the State Commission of Highways
and the State Comptroller of the State of
New York.
IT BEING UNDERSTOOD, that the State Comp-
troller is to refund to the proper town
authorities any/expended balance of said
appropriation upon the completion of the
work and after written notice to the State
Comptroller from the State Commission of
Highways to the effect that no further
drafts will be made upon the said approp-
riation.
The question being taken upon the foregoing resolution
same was upon ROLL CALL, unanimously adopted.
The following was presented by the Town Supt. of
Highways;
We, the undersigned members of the Town Board of
the Town of Mamaroneck, do hereby certify that the cost of
improving Palmer Avenue with concrete pavement, curb and
gutter from Weaver Street, sourtherly to the Larchmont Village
line, a distance of 0.26 miles in the Town of Mamaroneck,
New York, was the sum of $23,886.65 as more specifically
appears by the contract for the improvement of the same be-
tween the Town of Mamaroneck and Fleming & Sheppard, Inc.,
a domestic corporation, dated September 18th, 1922, and by
the final estimate of Charles McDonald, County Supt. of
Highways;
And we do further certified that we have examined
the accounds of the Supt. of Highways of the Town of Mamaro-
neck and that there is not sufficient funds on hand to pay
the total cost of said improvement.
We do further certify that the improvement of said
highway was necessary and was duly authorized by this Board
and that the cost thereof was $3,000.00 in excess of the
amount on hand from motor vehicle fees and the amount received
from the New York & Stamford Railway Company on account of
its share of the cost for the improvement of the other section
of Palmer Avenue, lying between Weaver Street and the westerly
boundary line of the VIllage of Mamaroneck.

After the above certification had been duly executed
by the members of the Town Board, the following resolution was
presented by Justice Shafer and seconded by Justice Collins:
WHEREAS, pursuant to section 93 of the
Highway Law, the Town Supt. of Highways
shall cause any highway that is damaged
or destroyed by the elements or other-
wise, or shall become unsafe for public
use and travel, to be immediately re-
paired or rebuilt with the approval of
the Town Board, and
WHEREAS, the said Supt. of Highways did
with the approval of this Board, enter
into a contract for the construction of
Palmer Avenue from Weaver Street south-
erly to the Larchmont Village Line, with
concrete pavement, curb and gutter, a
distance of 0.26 miles in the Town of
Mamaroneck, New York, with the belief
that there was a sufficient amount of
money in the highway fund to pay the
cost of said improvement, and
WHEREAS, said Highway has been improved
in accordance with the plans and speci-
fications prepared by the County Supt. of
Highways, and
WHEREAS, a statement has been prepared
showing the cost of rebuilding said
highway, which said statement has been
signed in duplicate by a majority of
said Town Board, one of which has been
filed with the Town Clerk and the other
has been delivered to the Supervisor,
which statement shows that the cost of
rebuilding said highway over and above
the amount of motor vehicle fees on hand
to be used for that purpose, will be the
sum of $3,000.00
NOW THEREFORE, be it
RESOLVED, that pursuant to Section 96 of
the Highway Law, this Board borrow on the
faith and credit of the Town of Mamaroneck,
the sum of $3,000.00, to pay the balance
of the expense incurred for rebuilding said
highway, and be it further
RESOLVED, that a certificate of indebted-
ness of the Town of Mamaroneck be and the
same is hereby directed to be issued in
the amount of $3,000.00, to be dated Dec-
ember 20th, 1922 and become due and payable
on the first day of May, 1923 at the First
National Bank of Mamaroneck, New York, to
bear interest at a rate not exceeding 6%
per annum and to be signed by the Super-
visor and attested by the Town Clerk under
the corporate seal of said Town and to be
in the following form with the blanks
property filled out:

CERTIFICATE OF INDEBTEDNESS.
No. 1 $3,000.00
KNOW ALL MEN BY THESE PRESENTS, that the Town
of Mamaroneck, a municipal corporation within the County of
Westchester, State of New York, acknowledges itself to be
indebted to and for the value received, promises to pay to the
FIRST NATIONAL BANK OF MAMARONECK, N.Y.
its successors and assigns, the sum of three thousand
($3,000.00) Dollars, lawful money of the United States, on
the first day of May, 1923, with interest thereon at the rate
of 6% per annum.
This certificate is issued in pursuance of a res-
olution of the Town Board of said Town, duly adopted at a
meeting held on the 20th day of December, 1922 and pursuant to
the provisions of Sectio 96 of the Highway Law and is issued
for the purpose of paying the balance of the cost incurred
in the improvement of Palmer Avenue from Weaver Street south-
erly to the Larchmotn line, with concrete pavement, curb and
gutter, a distance of .26 miles in said Town of Mamaroneck,
New York.
IN WITNESS WHEREOF, the Supervisor of said Town
has subscribed his name and the Town Clerk of said Town has
countersigned his name and affixed the seal of said Town as
of December 20th, 1922.

RESOLVED, that the said certificate be
sold by the Supervisor on behalf of the
Town at not less than its par value and
shall be payable out of the taxes coll-
ected by the Town of Mamaroneck for the
year 1923, and be it further
RESOLVED, that the Supervisor certify
the amount and interest of the certificate
to the Board of the Supervisors and have the
same assessed, levied, and collected as
provided by law, and be it further
RESOLVED, that there be levied and assessed
upon the real property of the Town of Mama-
roneck outside of the Villages of Larchmont
and Mamaroneck, a tax to pay certificate
and the interest thereon as the same shall
become due.
The question being taken upon the foregoing resolution
same was upon ROLL CALL, unanimously adopted.
Supervisor Burton reported that the Committee of this
Board had met with Committees from other municipalities and
had taken up the water situation affecting the different munic-
ipalities. It was the sense of the Board that the Committee
continue the investigations.
Upon motion, the meeting adjourned at 11.45 P.M.
