HomeMy WebLinkAbout1922_12_06 Town Board Minutes (2) Meeting of the Joint Town Board TOWN OF MAMARONECK, held, December 6th, 1922. The meeting was called to order by Supervisor Burton at 9.50 P.M. PRESENT: Supervisor Burton, Justices Collins and Dudley, Supt. of Highways Anthes, Counsellor Gamble. The minutes of the meetings of November 15th and Nov- ember 1st, 1922, were read and upon motion approved. The report of the Supt. of Highways for the month of November was received, read, ordered noted in the minutes and placed on file. The Clerk reported the receipt of releases from Richard C. Heather and his wife Grace Heather and from L. Harold Bayly and his wife Lulu M. Bayly, in the matter of the application of the Larchmont Gardens Company to alter and lay out Garden Road as a Town highway. The receipt of the releases were ordered noted in the minutes and filed with the Clerk. The Supt. of Highways reported that the Palmer Avenue pavement is completed and the road is now open for traffic. The matter of the extensions of water mains in several sections of the unincorporated district was discussed by the Board and upon the recommendation of the Supt. of Highways, it was RESOLVED, that the New York Inter Urban Water Company be and it hereby is re- quested, required and directed to extend its water mains in and along Chatsworth Avenue from its present mains in Forest Avenue to Glen Road and to install two fire hydrants along the line of said ex- tension on the westerly side of Chats- worth Avenue, one of said hydrants being located at the corner of Glen Road and the other fire hydrant midway between Forest Avenue and Glen Road. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. Upon the recommendation of the Supt. of Highways, RESOLVED, that the New York Inter Urban Water Company be and it hereby is requested, required and directed to extend its water mains in and along Hillcrest Avenue from the end of the present main easterly to Weaver Street and to install one fire hydrant on the southerly side of Hillcrest Avenue four hundred feet westerly from Weaver Street. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. Upon the recommendation of the Supt. of Highways, RESOLVED, that the New York Inter Urban Water Company be and it hereby is re- quested, required and directed to ex- tend its water mains in and along Garden Road from its present main in Weaver St. a distance of 250 feet easterly in said Garden Road, and to install one fire hydrant at the end of said extension on the southerly side of Garden Road. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. Mr. Taylor of the Holt Manufacturing Company was present and addressed the Board in relation to selling the Town a snow tractor. Mr. Chulew representing the Mamaroneck Sales and Service also addressed the Board ral'ative to the purchase of a fordson tractor. Counsel presented the matter of the taking over of certain streets in Larchmot Gardens as Town highways and upon motion by Justice Collins seconded by Justice dudley the follow- ing resolutions were upon ROLL CALL, unanimously adopted: 2nd proceeding WHEREAS, the owners of the fee and or the rights of way in certain streets in the development or district of the Town of Mamaroneck known as Larchmont Gardens have heretofore filed a petition with this Board and the Superintendet of Highways of the Town of Mamaroneck offer- ing to dedicate and deed said streets or portions thereof to the Town of Mamaro- neck and requesting said Town and Supt. of Highways to accept said streets as Town Highways, and WHEREAS, said petition has been considered by this Board and the Town Supt. of High- ways, and the deeds of said streets pre- sented, and WHEREAS, THE Supt. of Highways has examined said streets or portions thereof and has recommended that they be accepted as Town Highways of the Town of Mamaroneck, now therefore be it RESOLVED, that the Town of Mamaroneck do and it hereby does accept the aforesaid offer of dedication heretofore made by the Larchmont Gardens Company and others and the deeds and releases to the Town of Mamaroneck presented hereto, and does hereby accept as Town Highways the follow- ing described roads, streets and ways or portions thereof as shown on a map entitled "Plan of lots called Larchmont Gardens" situated in the Town of Mamaroneck, County of Westchester and State of New York sur- veyed for Clifford B. Harmon 51 East 42nd Street, New York City, New York, subdivision No. 1 and 2, by Long and Miller, Civil Engin- eers dated August 16, 1911, and filed in the office of the Register of Westchester County on September 11, 1911, as Map No. 1949, and described as follows: (1) All that certain section of the street or road designated on said map as Garden Road and shown on said map to be bounded as follows: On the west by East Brookside Drive: on the north by Block No. 419 and Cherry St; on the east by the easterly line of Cherry Street; and on the south by Cherry Street and Block No, 407. (2) All that certain. section of the Street or road designated on said map as Cherry Street and shown on said map to be bounded as follows: On the west by Block No. 407; on the north by Garden Road; on the east by Block No. 415 and on the south by Hickory Grove Drive. I (3) All that certain section of the street or drive designated on said map as Hickory Grove Drive and shown on said map to be bounded as follows: On the west by East Brookside Drive; on the north by Block No. 407; Cherry Street, and the southerly side of Block No. 415 from Cherry Street to the easterly line of Rocky Road as extended to Block No. 415; on the east by the easterly line of Rocky Road as extended to Block No. 415; on the south by Rocky Road, Block No. 404 and the northerly line of Falls Park. (4) All that certain street or road desinted on said map as Rocky Road and shown by the said map to be bounded as follows: On the west by Block No. 404; on the north by Hickory Grove Drive; on the east by Block No. 414; on the south by Lakeside Drive. (5) All that certain section of the street or drive designated on said map as West Brook- side Drive and shown by the said map to be bounded as follows; On the west by Block No. 426 and Lansdowne Drive; on the north by the westerly line of Lansdowne Drive as extended to Block No. 431; on the east by the brook flowing southwards to the north- erly line of Lernrfcod Road as extended to Block No. 419; on the south by the northerly line of Fernwood Road as extended to Block No. 419. (6) All that certain section of the street or drive designated on said map as East Brook side Drive and shown by the said map to be bounded as follows; On the west by the brook flowing southwards into Valley Lake, Valley Lake and the brook fllowing southwards to the northerly line of Fernwood Road as extended to Block No. 419; on the north by the westerly line of Lansdowne Drive as extended to Block No. 431 and the southerly line of Block No. 431 as extended to Valley Lake; on the east by Valley Stream Road, Block No. 425, Little Farms Road, and Block No. 419; on the south by the northerly line of Fernwood Road as extended to Block No. 419. (7) All that certain section of the street or drive designated on said map as Lansdowne Drive and shown by the said map to be bounded as follows; On the west by the westerly line of Clover street as extended to Block No. 429, and Block No. 429, on the est by Block No. 426; on the south by Clover Street. (8) All that certain street or place designated on said map as Clover Street and said map to be bounded as follows: On the west by Block No. 425; on the north by Lans- downe Drive; on the east by the westerly line of Block No. 426 as extended to Block No. 428; on the south by Orchard Road. (9) All that certain section of the street or road designated on said map as Orchard Road and shown on said map to be bounded as foll- ows: On the west by Block No. 427; on the north by the westerly line of Clover Street as extended to Block No. 427; on the east by Clover Street and the westeriy line of Block No. 426 as extended to Block. 427; on the south by Fernwood Road. And be it further RESOLVED, that the afore described roads, streets, and ways or portions thereof, be and the same hereby are made and declared to be Public Town Highways; and be it further RESOLVED, that the Town Clerk be and he hereby is empowered and directed to record the aforesaid deeds and releases; and be it futher RESOLVED, that the Superintendent of Highways be and he hereby is authorized and empowered to execute and record whatever documents or certificates are necessary according to law to vest title to the Town in said streets, and to bring the aforesaid resolutions into full force and effect; and be it further RESOLVED, that the Town of Mamaroneck shall be kept safe and harmless from any claim or damage of any natue or character whatsoever in anywise arising from the improvements of the aforesaid streets anything to the con- trary herein contained notwithstanding. The following resolution was presented by Justice Dudley and seconded by Justice Collins. RESOLVED, that the stipulation made by J. Henry Esser, Counsel for the Town of Mamaro- neck before William A. Davidson, Referee, on July 26th 1922, in a proceeding relating to the assessment of damages upon the grant- ing of a temporary injunction be, and the same hereby is ratified to the extent that the referr's fees shall not exceed a total charge in the proceeding of $500, and that the stenographer's fees shall not exceed the amount contained in said stipulation. The question being taken upon the foregoing resolution, same was upon ROLL CALL, unanimously adopted. The following resolution was presented by Justice Collins and seconded by Justice Dudley: WHEREAS, a petition has been presented to this Board and the Supt. of Highways requesting the Town of Mamaroneck to accept the offer of dedication (heretofore made) of Vine Street from its northerly junction with the southerly side of Myrtle Avenue to irs sourtherly terminus in the Town of Mamaroneck and to convey whatever rghts they may have in said streets and or rights of way therein, and requesting said Town and Supt. of Highways to accept said street or portion thereof as Town Highways; and WHEREAS, said petition has been considered by this Board and the Town Supt. of Highways and WHEREAS, the Supt. of Highways has examined said street or portions thereof and has rec- commended that it be accepted as a town high- way of the Town of Mamaroneck; now therefore be it RESOLVED, that the Town of Mamaroneck do and it hereby does accept the aforesaid offer of dedication heretofore made the deeds and ­releases to the Town of Mamaroneck presented hereto, and does hereby accept as town high- ways the following described road, street, and way or portions thereof as shown on a certain map entitled "Portion of Map 115 lots at Larchmont, Mamaroneck, Westchester County, New York, the property of Archibald B. Duffie, Esq., and filed in the office of the Register of Westchester County as Map No. ­and described as follows: All that certain section or portion of the street or drive designated on said map as Vine Street and shown and described on said map as follows: BEGINNING at the corner formed by the inter- section of the northerly side of Myrtle Avenue and the easterly side of Vine Street, thence southerly along the easterly side of Vine St. to the southerly terminus of Vine Street, thence westerly and across Vine Street, westerly side (as shown on said map) thence northerly and along the westerly side of Vine Street to the corner formed by the intersection of the westerly side thereof with the southerly side of Myrtle Avenue, thence easterly and along the southerly side of Myrtle Avenue to the point or place of beginning; and be it further RESOLVED, that the afore described road, street, and or way or portions thereof be and the same hereby is made and declared to be a Public Town Highway; and be it further RESOLVED, that the Town Clerk be and he hereby is empowered and directed to re- cord the aforesaid deeds and releases; and be it further RESOLVED, that the Supt. of Highways be and he hereby is authorized and empowered to execute and record whatever documents or certificates are necessary according to law to vest title to the Town in said street or portion thereof and to bring the aforesaid resolutions into full force and effect; and be it further RESOLVED, that the Town of Mamaroneck shall be kept safe and harmless from any claim or damage of any nature of character whatso- ever in anywise arising from the improvements of the aforesaid street or portion thereof anything contrary herein contained notwith- standing. The question being taken upon the foregoing resolution same was upon ROLL CALL, unanimously adopted. Upon the recommendation of the Supt. of Highways it was, upon motion of Justice Dudley, unanimously adopted. RESOLVED, that the Supt. of Highways be and he hereby is authorized and directed to in- struct the Westchester Lighting Company install overhead intersecting street lights at the following points in the Town of Mamaroneck: 1. At the intersection of Weaver Street and the Post Road. 2. At the intersection of Weaver Street and Palmer Avenue. 3. At the intersection of Weaver Street and Myrtle Avenue. 4. At the intersection of Murray Avenue and Forest Avenue. 5. At the intersection of Murray Avenue and Myrtle Avenue. The question being taken upon the foregoing resolution same was upon ROLL CALL unanimously adopted. A communication from Mr. Gagliardi was received and read enclosing deed of property purchased by the Sewer Comm- ission for sewer purposes, the deed being from Jeanette B. and Frederick P. Boehm. It was voted that the communication be noted in the minutes and the feed placed on file. Upon motion, the meeting adjourned at 11.20 P.M. Frederick M. Sherman Town Clerk.
