HomeMy WebLinkAbout1922_06_07 Town Board Minutes Meeting of the Joint Town Board TOWN OF MAMARONECK, held, June 7th, 1922. The meeting was called to order by Justice Boyd at 10.15 P.M. PRESENT: Justices Boyd, Dudley and Shafer, Supt. of Highways Anthes, Town Clerk Sherman. Upon motion, it was voted to dispense with the reading of minutes of meetings not yet approved. Supt. of Highways Anthes submitted his report for the month of May, 1922, which was received, read, ordered placed on file and is as follows: The Honorable Town Board, June 7th, 1922. Town of Mamaroneck, N.Y. Gentlemen: I herewith respectfully submit my report as Supt. of Highways for work performed in the department for the period extending from May 1st to May 31st, 1922 as follows:- Work on Rockland Avenue completed, material used, cinders and stone. Work on Myrtle Avenue completed with blue stone and tarvia. Patched Fifth Avenue with stone. Patched Palmer Lane, Brookside Drive, and Lakeside Drive with blue stone and tarvia. Patched holes and rolled Weaver Street. Cleaned gutters on roads in Larchmont Gardens and Larch- mont Woods. Received from Connecticut Quarries 2 cars 1/4" and 2 cars screenings. Received from Barrett Co. 25 bbls Tarvia K.P. Respectfully submitted, Sgnd, Fred'k Anthes. A communication with bill attached was received from the Village of Larchmont in the amount of $212.26 being damage caused by break in water main on Murray Avenue caused by the blasting in laying; the Town Sewer. The matter was referred to the Sever Commission. A communication from Mr. Fred C. Ackerman of 165 Chats- worth Avenue was received and read in relation twenty feet of cement sidewalk missing in front of his property. The matter was referred to the Supt. of Highways and the Clerk was instructed to reply to the communication. A communieetion from Mr. A. Stirling Smith in relation the overcharging of rates of the taxi men at the Larchmont Station was received and read and after full discussion, the matter was referred to the Police Commission. Judge Boyd presented a certified copy of an Act passed by the Board of Supervisors of Westchester County at their meet- ing held on June 5th, 1922, authorizing this Board to issue and sell Weaver Street, Part 1, Highway improvemenet Bonds in the amount of $13,500.00. Thereupon a motion was duly made and seconded and unanimously carried directing the Clerk to spread the said Act on the minutes, which is as follows: AN ACT authorizing the Town of Mamaroneck, Westchester County, New York, to borrow the sum of $13,500.00 and to issue and sell its bonds therefor to pay the addit- ional cost of constructing and improving at an additional width, a certain highway in said Town and to provide for the pay- ment of the principal and interest of said bonds. Passed pursuant to the authority conferred by sections 1 8 A and 142 of the Highway Law at a regular meeting of the Board of Supervisors of the County of Westchester, held on the 5th day of June, 1922, 35 votes (being the vote of more than two thirds of the members elected to said Board) being in favor thereof and no votes being against its passage. The people of the County of Westchester in the State of New York represented in the Board of Supervisors of said County, at a session thereof duly convened, do enact as follows: Section 1. The Town of Mamaroneck in the County of West- chester, New York, is hereby authorized to borrow upon its faith and credit the sum of $13,500.00 and issue its bonds therefor for the purpose of paying the additional cost of constructing and improving at an additional width, the highway known as Weaver Street, Part 1, County Highway, a highway lying within the bound- aries of the said Town for the cost of construction and improve- ment of which said Town to liable to taxation in whole or in part. Section 2. Said bonds shall be issued in the name and under the seal of said Town in denominations of $1,000.00 each, except the first, which shall be in the denomination of $500.00 numbered 1 to 14 inclusive, dated June 1st, 1922, and payable as follows: Bond Number 1 on June 1st, 1927 Bond Number 2 on June 1st, 1928 Bond Number 3 on June 1st, 1929 Bond Number 4 on June 1st, 1930 Bond Number 5 on June 1st, 1931 Bond Number 6 on June 1st, 1932 Bond Number 7 on June 1st, 1933 Bond Number 8 on June 1st, 1934 Bond Number 9 on June 1st, 1935 Bond Number 10 on June 1st, 1936 Bond Number 11 on June 1st, 1937 Bond Number 12 on June 1st, 1938 Bond Number 13 on June 1st, 1939 Bond Number 14 on June 1st, 1940, with interest thereon at the rate of 5% per annum payable semi- annually on the first days of December and June after the date thereof until the principal is fully paid. Said bonds shall be signed by the Supervisor and attested by the Town Clerk of said Town under the seal thereof, shall be registered and made payable at the First National Bank of Mamaroneck, New York, in New York Exchange, and shall be negotiated and sold by the Supervisor of said Town at a price of not less than par. Section.3. Said bonds shall be in substantially form as follows, the blanks therein being properly filled, viz: UNITED STATES OF AMERICA STATE OF NEW YORK, COUNTY OF WESTCHESTER, TOWN OF MAMARONECK No. $ WEAVER STREET, PART 1, HIGHWAY IMPROVEVENT BOND. KNOW ALL MEN BY THESE PRESENTS, that the Town of Mamaroneck, a municipal corporation in the County of Westchester and State of New York, for value received, hereby acknowledges itself indebted and promises to pay to legal representatives, successors or assigns, the sum of dollars, lawful money of the United States of America, on the 1st day of June, in the year nineteen hundred and at the First National Bank of Mamaroneck, Mamaroneck, New York, together with the interest thereon at the rate of 5% per centum per annum, payable semi-annually on each 1st day of December and June after the date hereof, until the principal is fully paid. The interest and principal of this bond, as the same becomes due will be paid to the registered holder in New York Exchange. This bond is registered in the office of the Town Clerk of said Town and is transferable only upon presentation to said Clerk, with a written assignment duly acknowledged or proved, such transfer to be noted on the books kept by said Clerk for that purpose, and upon this bond, and is one of an issue of bonds of said Town aggregating the sum of $13,500.00, numbered 1 to 14 inclusive, of like date, amount and tenor, but maturing at diff- erent times, except that bond No.1 is for $500.00 issued pursuant to the Laws of the State of New York, known as Section 135-A and 142 of the Highway Late, being Chapter 30 of the Laws of 1909, as amended and added, and Sections 13 and 14 of the County Law, being Chapter 16 of the Laws of 1909, for the purpose of paying the additional cost of constructing and improving, at an addition- al width, the highway known as Weaver Street, Part 1, County Highway, a highway lying within the boundaries of the said Town, for the cost of such construction and improvement of which said Town is liable to taxation in whole or in part, and pursuant to proceedings and resolutions in all respects authorizing the same. It is hereby certified that all conditions, acts, and things essential to the validity of this bond, exist, have happ- ened, and have been done, and that every requirement of law aff- ecting the issue thereof has been duly complied with, and that the total indebtedness of said Town, including the issue of bonds is within every debt and other limit prescribed by the Constitut- ion and Laws of said State, and that the faith and credit of said Town are hereby irrevocably pledged to the punctual payment of the interest and principal of this bond according to its terms. IN WITNESS WHEREOF, these presents have been signed for and on behalf of said Town of Mamaroneck by the Supervisor thereof, and attested by the Town Clerk under the seal of said Town, as of the first day of June, 1922. TORN OF MAMARONECK, By Supervisor. ATTEST: Town Clerk. There shall be printed upon the back of said bonds a form of registration substantially as follows: Date of Registry--In whose name Registered--Town Clerk--Registrar Section 4. The Supervisor of said Town, before the delivery of said bonds, shall enter into a joint and several bond to said Town with at least two sureties, or furnish a surety company bond at the expense of said Town, in the penal sum of $1,000.00 which amount is deemed as adequate security conditioned for the faithful performance of his duty in issuing said bonds, and the lawful application of the funds arising there- from and of the funds which may come into his hands, which shall be approved by the County Judge of said County, and filed in the office of the Town Clerk of said Town. Section 5. The proper officers of said Town shall pro- vide for raising annually, by tax, as required by law, a sum suff- icient to pay the interest and principal of said bonds as the same shall become due. Section 6. This Act shall take effect immediately. NOTICE OF SALE OF TOWN OF MAMARONECK WEAVER STREET PART I; HIGHWAY IMPROVEMENT BONDS. NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Mamaroneck will receive sealed proposals at the office of the Town Clerk, 6 Elm street, in the Village of Mamaroneck, New York, on the 22nd day of June, 1922, at 8; 0 o'clock, p.m. (daylight saving time) for the purchase of the following bonds of said Town, to wit: Fourteen Weaver Street, Part 1, Highway Improvement Bonds, in denominations of $1,000.00 each, except, the first which shall be in the denomination of $500.00, numbered 1 to 14 inclusive, dated as of June 1, 1922, hearing interest at the rate of 5% per annum, payable semi-annually on the first days of December and June, after the date thereof and maturing as follows: Bond No. 1 for $500.00 on June 1, 1927, Bond No. 2 for $1,900.00 on June 1, 1928, Bond No. 3 for $1,900.00 on June 1, 1929, Bond No. 4 for $1,000.00 on June 1, 1930, Bond No. 5 for $1,000.00 on June 1, 1931, Bond No. 6 for $1,000.00 on June 1, 1932, Bond No. 7 for $1,000.00 on June 1, 1933, Bond No. 8 for $1,000.00 on June 1, 1934, Bond No. 9 for $1,000.00 on June 1, 1935, Bond No. 10 for $1,000.00 on June 1, 1936, Bond No. 11 for $1,000.00 on June 1, 1937, Bond No. 12 for $1,000.00 on June 1, 1938, Bond No. 13 for $1,000.00 on June 1, 1939, Bond No. 14 for $1,000.00 on June 1, 1940. All bids must be accompanied by a certified check in the amount of at least 10% of the bid, payable to the order of the Town of Mamaroneck. The bonds will be sold to the bidder offering to take them at the highest rate of premium. The Town Board reserves the right to reject any and all bids. Dated, June 7th, 1922.
