TOWN OF MAMARONECK
held December 29th, 1920.
The meeting was called to order by Supervisor Burton
at 8.45 P.M.
PRESENT: Supervisor Burton.
Justices, Boyd, Collins, Dudley and Shafer,
Supt. of Highways Anthes,
Deputy Clerk, Sherman.
The minutes of the meetings of December 3rd and 10th,
1920, were read and upon motion duly seconded were unanimously
approved.
Supervisor Burton stated that the meeting was called
in relation to the Highway, Bridge and Miscellaneous report, and
he addressed the Board, as follows:
I received a communication from the County Supt. of
Highways, Charles, McDonald in relation to the Highway, Bridge
and Miscellaneous report, the letter dated December22nd having
been received the 25th of December wlaich letter stated that the
blanks are being sent under seperate cover. The blanks had not
yet been received. I so reported in person on Monday last to Mr.
McDonald who reiterated that the blanks had been mailed. At my
request Supt of Highways Mr. anthes, today went to White Plains
to secure duplicate copies of said report blanks, but he was in-
formed that there were none to be had at this time. Therefore,
as Supervisor, I would ask that when we adjourn, we adjourn to
meet tomorrow night, Thursday December 30th, 1920 at 8 P.M.
The Supervisor presented a cornnunication from Mr. J
Henry Esser, dated December 23rd, 1920 in relation to data for
the extension of gas mains in Larchmont Gardens. Same was order-
ed filed with the Supervisor.
Justice Shafer presented the following resolution
which was seconded by Justice Collins;
RESOLVED, that the Supervisor be and
he hereby is authorized and empowered
forthwith to take all necessary steps
to have gas mains extended in the un-
incorporated section of the Town of
Mamaroneck, over such highways as he
may be advised that the Westchester
Lighting Company should extend the
same, in order to furnish proper gas
service, and that the said Supervisor
be authorized and empowered to employ
Special Counsel to prosecute any court
proceeding or action in the name of the
Town of Mamaroneck, if he shall deem
such employment advisable and necessary.
The question being taken upon the forgoing resolution,
same was declared adopted by the following vote.
Ayes: Messrs, Burton, Boyd, Collins , Dudley, Shafer, Anthes and Sherman
Nayes; None.
The Supervisor presented a communication from Counsel-
lor Ralph A. Gamble congratulating the Town on the decision of the
Public Service Commission in relation to its fight of the abandon-
ment of the Westchester Street Railroad Company. Same was ordered
filed mith the Supervisor.
Justice Dudley presented the following resoluion
which was seconded by Justice Shafer;
WHEREAS, decision has been handed
down by the Public Service Commission
Second Department, in the matter of the
application of the Westchester Street
Railroad and the Shore line Electric
Railroad Companies for the abandonment
of their lines , which order of the Pub-
lic Service Commission is to be contrued
as a verdict in favor of the municipalities
and very clearly shows that the attitude of
this Town Board in opposing the application
was of good judgement, and
WHEREAS, mention is made in said order of
the Public Service Commission, Second Dep't
referring to the able manner in which the
Town's interest was protected by Counsel and
further refers in the decision to the test-
imony of witnesses who willingly aided in
the defense;
THEREFORE BE IT RESOLVED, that this Town
Board express its appreciation to Counsell-
ors Ralph A. Gamble, J. Henry Esser and Ernest
A. Eckley for the able manner in which they
represented the Town of Mamaroneck in the
proceedings and also to the many citizens
who so willingly gave of their time and ex-
pression in behalf of the Town's interest and
be it further
RESOLVED, THAT a copy of this resolution be
spread on the minute book of the proceedings
of the Joint Town Board.
The question being taken upon, the foregoing resolution,
same was declared adopted by the following vote.
Ayes: Messrs, Burton, Boyd, Collins, Dudley, Shafer, Anthes and sherman.
Nayes; None.
A communication was received from the Village Clerk of
Larchmont in relation to the duplicate numbers and names of streets
in the Larchmont Postal area. Same was ordered filed with the Clerk
and upon motion duly deconded it was voted,
That the Supervisor appoint a Committee
of two with on Assessor to investigate
the matter of duplication of street
names and to report back to this Board
with their recommendation.
The question being taken upon the forgoing motion, same
was declared adopted.
The following Committee was appointed by the Supervisorl
Justices Collins and Shafer and Assessor Maddock.
Upon motion, the meeting adjourned at 10.15 P.M.
