HomeMy WebLinkAbout1920_11_30 Town Board Minutes Meeting of the Joint Town Board TOWN OF MAMARONECK held November 30th, 1920 The meeting was called to order by Supervisor Burton at 9.15 P.M. PRESENT: Supervisor Burton, Justices, Boyd, Collins, Shafer, Supt. of Highways, Anthes, Deputy Clerk, Sherman, Counsellors, Gamble & Esser. Upon motion, the reading of minutes not yet approved were dispensed with. The meeting was called upon the application of two Justices and the Supervisor to consider adopting a resolution in relation to fare rates on the Westchester Street Railway Co. to be presented to the Public Service Commission at a hearing to be held in New York City, Hall of Records, on December 1st,1920. Whereupon Justice Shafer offered the following resol- ution which was seconded by Justice Boyd. WHEREAS, the Westchester Street Railroad Company is operating within the village and Town of Mamaroneck certain franchises subject to the rights respectively of the Village and Town of Mamaroneck reserved in and accepted by said Westchester Street Railroad Company or its privies or grantors as hereinafter set forth, to regulate the rate of fare to be charged on the line of said railroad to from and within said Village and Town for carryirg passengers on said line; and WHEREAS, the said Westchester Street Railroad Company is the successor in interest of the Tarrytown, White Plains. and Mamaroneok Rail- way Company in respect to the said franchises heretofore granted to the said Tarrytown, White Plains and Mamaroneck Railway Company and has duly assumed all the conditions and reservat- ions retained respectively by the Village and Town of Mamaroneck in and about the same and is operating said franchises under such con- ditions and reservations; and WHEREAS, the Westchester Street Railroad Com- pany a modification of the franchise from the Village and Town of Mamaroneck respectively dated June 26th, 1913, covering the Boston Post Road Line in said Village and Town subject to the rights respectively of said Village and Town to establish the rate of fare to be charged for carrying passengers over said road; and WHEREAS, the Shore Line Electric Railroad Com- pany is the successor in interest of the Tarry- town, White Plains and Mamaroneck Railroad Co. in respect to the Boston Post Road Section of the Mamaroneck Avenue Line in said Village and Town of Mamaroneck and the Westchester Street Railroad Company is the lessee of said franchise and line and has agreed to comply with and carry out all the terms of said franchises imposed in the grant thereof and having assum- ed the same; and WHEREAS, the Westchester Street Railroad Com- pany has made application to abandon all of said lines and for the cancellation of said lease of the Shore Line Railway; NOW THEREFORE IT IS HEREBY RESOLVED, that for the period of two years from the date of this resolution the Town of Mamaroneck hereby waives in favor of the Public Service Commission its rights of regulating the rate of fare to be charged by said railroad within said Town for the conveyance of passengers over its lines without prejudice to its resuming all rights under said franchises at the expiration of said period and all other legal rights which the Town may have in the premises provided, however, that no change in existing or other fares shall be made by the Public Service Commission without a previous hearing upon due notice in which the said Town may be allowed to examine the books of the Railroad Compary or the Receiver thereof for the purpose of ascertaining the justice of any proposed increase or reduction of fares; also that at any time during the said two years the said Town may apply to have the rate of fare re- duced. Provided also that the said Westchester Street Railroad Company operate the entire line from the New York Central Station in the City of White Plains to the present termination of the route in the Village of Larchmont for all of the period of which this waiver is granted, otherwise the forgoing waiver to cease and end immediately. The question being taken upon the foregoing resolution, same was declared adopted by the following vote. AYES: Messrs, Burton, Boyd, Collins, Shafer, Anthes and Sherman. Nays: None.
