Board, Town of Mamaroneck, held
October 8th, 1919.
The meeting was called to order by Supervisor
Burton at 9 P.M.
PRESENT: Supervisor Burton,
Justices Collins, Boyd, Dudley and Shafer,
Superintendent Hickey,
J. C. Fairchild, Town Clerk.
Upon motion, it was
VOTED, that the reading of minutes of meet-
ings not yet approved be dispensed with.
A communication from County Superintendent of High-
ways McDonald was presented to the meeting and ordered filed.
The report of the Superintendent of Highways for the
month of August was submitted, ordered filed, and is as follows:

Mamaroneck, New York.,
Gentlemen:
i herewith report the following work on Highways since
August 11, 1919:
Applied 2074 gallons of #4 Road Oil on the following streets:
Palmer Ave to Weaver Street, Howell Avenue, Carelteon Avenue,
Rockland Avenue, Chestnut Avenue, Chestnut Street,
Cleaned all catch basins,
Layed 180 feet of pipe and trunk ditch on Fernwood Road,
Repaired 12" pipe at the intersection of Rockingstone and
Glen Road,
Filled in Edgewood Road where culvert was built and reset
Sidewalk,
Cleaned all ditches along Myrtle Avenue and Winfield Avenue
Bridge near completion. Work on Palmer Avenue well under way.

Superintendent Burton reported that he had received
through Counsel a check for $1000.00 from Mr. Lorenzen in accor-
dance with the resolution of this Board accepting Forest Avenue.
Upon notion duly seconded, it was
VOTED, that the Superintendent of Highways
be directed to communicate with the County
Engineer and request him to prepare plans
and secifications for the construction of
a Bridge on Forest Avenue, said plans and
specifications to also provide for the con-
struction of a full 50 feet of roadway and
walks; and an alternate plan for a 30 foot
roadway.
On motion made and seconded, it was
VOTED, that the Superintendent of Highways
be authorized and directed to procure the
necessary lights on Forest Avenue between
Weaver Street and Rockland Avenue.
On motion, duly seconded upon roll call, it was
unanimously
VOTED that N. J. Stevens be paid a salary
of $18.00 per month for the care of the
safety lamp at the corner of Murray and
Chatsworth Avenues and that the same be
made a proper Town charge.
On motion duly seconded, it was
VOTED, that Counsel be and he hereby is re-
quested to prepare a resolution to release
and discharge the bond given to the Town of
Mamaroneck by J. J. Burnett, as Commissioner
of Highways, and the sureties on said bond,
Messrs. McKeand and DeCicco
On motion duly seconded, and on roll call, it was
unanimously
VOTED , that the Supervisor be authorized and
directed to procure the services of an in-
spector to act for the interests of the ToWN
on the Palmer Avenue paving contract.
Supervisor Burton submitted a written report recom-
mending the establishment of a sewer district, pursuant to a.
petition which had been presented therefor. The report, to-
gether with two certificates of the Board of Assessors annexed
thereto, were presented, read, ordered filed and are as fol-
lows:
"Gentlemen of the Town Board:
I am pleased to report that such progress has
been made in connection with the proposed establishment
of the sewer district that I have with me for filing
with this Board a complete petition signed and acknow-
ledged by a sufficient number of taxpayers who own over
one-half in value of the taxable real property therein.
This petition has been checked with our assess-
ment rolls and I have obtained from the Town Board of
Assessors two certificates, one as to the value of the
taxable real property lying within the proposed sewer dis-
trict and the other as to the value of the property owned
by those who have signed the annexed petition. I accor-
dingly recommend the establishment of the sewer district
and the appointment of three sewer commissioners.

We, the undersigned, a majority of the Town Board
of Assessors of the Town of Mamaroneck, New York, DO
HEREBY CERTIFY, that we have examined the assessed valu-
ation of the property lying within the proposed Sewer
District as snown by map prepared by L.E. Van Etten,
Civil Engineer and Surveyor, and that the same amounts
to nine hundred twenty-one thousand three hundred twenty-
five dollars ($921,325.00) according to the 1918 assess-
ment roll of said Town.

of Assessors of the Town of Mamaroneck, New York, DO HEREBY
CERTIFY, that we have examined the assessed valuation of
all the property owned by the various persons and corpora-
tions whose names are subscribed to the annexed (6) petitions
and which lies within the proposed sewer district as shown
by Asap prepared by L. E. Van Etten, Civic Engineer and Sur-
veyor according to the 1918 assessment roll of said Town
and that the same amounts to four hundred seventy nine
thousand one hundred eighty-five ($479,185.00) dollars.

Upon motion duly seconded, it was
VOTED, that the petitions be ordered placed
onfile with the Town Clerk.
Upon the recommendation of Superintendent Hickey
and on motion duly seconded and on roll call, it was
unanimously
VOTED, whereas a pettion signed and acknow-
ledged by owners of real property in a pro-
posed Sewer District representing more than
one-half in value of the taxable real prop-
erty therein, as appears by the last pre-
ceding completed assessment roll, as as pro-
vided by Section 230 of the Town Law of the
State of New York, has been duly filed with
this Board, which said petition describes
the proposed Sewer District and states the
maximum amount proposed to be expended in
the constructich of said sewer system; that
opposite the name of each pettioner appears
the assessed valuation of the real property
owned by him or her in such district, ac-
cording to the last preceding assessment
roll, and
WHEREAS, there is annexed to and presented
with and made a part of said petition a map
and plan of the proposed sewer system, with
specifications of dimensions and connections
and outlet and/or sewage disposal works, which
has been prepared by a competent engineer,
and
WHEREAS, said petitioners ask the Town Board
to make an order establishing the sewer dis-
trict described in said petition and stating
the amount proposed to be expended in the con-
struction of said sewer system, and
WHEREAS, in said petition asking for the
establishment of a sewer system the petitioners
likewise pray as provided under Section 230-a
that a portion or portions only of the system
designed ultimately to serve the entire district
shall be constructed in the first instance and
have described the said portion or portions in
their petition and indicated the same on the
said map and plan annexed to said petition and
have specified the maximum amount proposed to
be expended in the construction of such por-
tion or portions of the said system, and said
petitioners further ask that the Town Board
may include in its order establishing the said
sewer district a direction that the Sewer Com-
missioners shall construct only the portion or
portions of the said system designated in the
said petitions until extensions thereto shall
be authorized, as provided by law, and
WHEREAS, the Town Board is satisfied that the
petitioners are owners of real property in the
proposed district and own more than one-half in
value of the taxable real property therein, and
that all provisions of the law relating to the
establishment of a sewer district have
been complied with,
THEREFORE, BE IT RESOLVED that a Sewer
District to be known and designated as
"Sewer District No. 1 of the Town of
Mamaroneck" be and the same hereby is
established in the district bounded and
described as follows, and that a. certi-
ficate to this effect be executed and
filed in the office of the Town. Clerk:
Beginning at a point on the westerly side
of Chatsworth Avenue 110 feet south of t'ne
intersection of the southerly side of
Myrtle Avenue and the westerly side of Chat-
sworth Avenue at which the intersection
of the boundary lines of the Village of
Larchmont and the Town of Mamaroneck con-
verge, running thence southerly and along
said westerly side of Chatsworth Avenue
which is also the boundary line of said
Village of Larchmont and Town of Mamaron-
eck 125 feet to the northerly boundary
line of the Village of larchmont running
thence westerly along the northerly boundary
line of the Village of larchmont 2400 feet
to a point where said village line if con-
tinued would intersect the easterly boundary
line of the City of New Rochelle, thence
northerly along said bound line between
the: Town of Mamaroneck and the City of New
Rochelle, 5600 feet to a point 625 feet
north of the northerly side of Forest Avenue
at which point said Forest Avenue intersects
the aforesaid boundary line thence easterly
1150 feet and nearly parallel with said Forest
Avenue, thence northerly 200 feet thence
north easterly 300 feet, thence southerly
500 feet and again easterly and parallel
with Forest Avenue 400 feet to its inter-
section with the westerly side of Murray
Avenue thence southerly 150 feet along said
westerly side of Murray Avenue to the point
of intersection of the northerly side of
Forest Avenue with the westerly side of
Murray Avenue, thence easterly and across
Murray Avenue to the north east corner for-
med by the intersection of said streets
thence southerly and across Forest Avenue
to the south east corner formed by the in-
tersection of said streets thence easterly
and along the southerly side of Forest
Avenue 100 feet, thence southerly and par-
allel withnsaid Murray Avenue, 525 feet,
thence easterly 150 feet and across Senate
Terrace to the easterly side of said street,
thence northerly along the easterly side
of said Senate Terrace 125 feet, thence
northeasterly and parallel with Senate
Place, 425 feet to a point directly opposite
the northerly end of said Senate Place,
thence southeasterly and across the north-
erly end of Senate Place and across Colonial
Avenue 500 feet to a point which is 100
feet south of the easterly side of Colonial
Avenue and 100 feet west of the westerly side
Of Weaver Street, to land formerly of Senator
Palmer (now of Stieglitz) thence 100
feet northeasterly to the westerly side
of Weaver Street, thence southerly along
said westerly side of Weaver Street to the
point of intersection with the northerly
side of Chestnut avenue, thence easterly
across said Weaver Street on a line with
the northerly side of Chestnut Street if
prolonged, a total of 200 feet, thence
southeasterly and south and parallel with
Weaver Street and from 150 to 100 feet
esterly therefrom as it curves, to the
northerly side of the N. Y. N. H. & H.
R. R. Company's Right of Way, thence
straight across the said Right of Way of
said N. Y. N. H. & H. R. R. and southerly
and still parallel with the easterly side
of said Weaver Street across Palmer Avenue
to a point 100 feet easterly from the
easterly side of Weaver Street and southerly
from the southerly side of Palmer Avenue
100 feet, thence easterly and southerly in
conformity with the easterly side of Weaver
Street and continuing approximately 100 feet
easterly therefrom, to a point 100 feet south-
east from where the southerly side of Caerlson
Avenue would intersect the easterly side of
Weaver Street, thence westerly 100 feet to
the easterly side of Weaver Street, thence
across said Weaver Street to the corner
formed by the intersection of said southerly
side of Caerleon Avenue with said westerly
side of Weaver Street thence southerly 150
feet along the westerly side of Weaver Street,
thence easterly and parallel with said
Caerleon Avenue 400 feet, then again southerly
and parallel with Weaver Street and crossing
the westerly end of Beech street 300 feet,
thence westerly 75 feet thence southeasterly
to the northerly side of the Boston Post Road
at a point approximately 500 feet from the
corner formed by the intersection of the wes-
terly side of Weaver Street and the northerly
side of the Boston Post Road, thence straight
across said Boston Post Road at right angles
with said north side of same, to a point 100
feet southerly from the southerly side of
said Boston Post Road, thence westerly and
parallel with the southerly side of the Boston
Post Road 800 feet to the point of intersection
of the said boundary line of the Town of
Mamaroneck with the easterly boundary line of
the Village of Larchmont, said point being
about 100 feet southerly from the south side of
the Boston Post Road, thence northerly and
along said easterly boundary line of the Vil-
lage of Larchmont and across the Right of Way
of the N. Y. N. H. & H. R. R., to the junction
of said easterly boundary line of said Village
of Larchmont with the northerly boundary line
of said Villlage, thence westerly, northerly
and westerly and along said northern boundary
line of the said Village of Larchmont to the
point or place of beginning; and all of which
said proposed sewer district is more specifi-
cally shown and set forth on a certain map
entitled "Town of Mamaroneck, Westechester Co.,
New York, a general plan of proposed sewers in
certain districts the outlet from which is
through District 1, Larchmont. By L.E.
Van Etten, Civil Engineer, February 7th,
1918."
And be it
FURTHER RESOLVED, that the Sewer Com-
missioners to be hereafter appointed
under the provisions of Section 231 of
the Town Law are hereby directed and em-
powered to construct, obtain by purchase
agreement or otherwise in the first in-
stance only the portion or portions of
the said sever system designated in the
said petition at a cost of not to exceed
$20,000.00, until extensions thereto
shall be authorized as provided by law
which portion or portions are described
as follows:
I. The outlet sewer for the aforesaid
proposed sewer district and sewer system,
lying outside of the proposed sewer dis-
trict, the establishment of which is herein
petitioned for, which said outlet sewer is
specifically shown and indicated on the
aforesaid map and plan of the said proposed
sewer system above referred to; said portion
or portions being more particularly described
as follows:
BEGINNING at apoint on the northerly boundary
line of the V illage of Larchmont, which point
is 150 feet westerly of a point from an ex-
tended line of the of line of the Village
of Larchmont where it intersects the northerly
boundary line of the New York, New Haven and
Hartford Railroad Company property thence
southerly a total distance of 225 feet to the
center line of Woodland Avenue at a point 2,00
feet from the easterly boundary line of said
Village of Tarchmont, thence westerly 175 feet
along the center line of said Woodland Avenue
thence southeasterly 300 feet to the center
line of Palmer Avenue, thence southwesterly
along the center line of Palmer Avenue, 175
feet, thence southerly at the junction of
Vanderberg and Roosevelt Avenues 100 feet to
the center line of Roosevelt Avenue, thence
generally in a southeasterly direction along
said Roosevelt Avenue to the point where
Roosevelt Avenue turns west at a right angle
and continuing south at this point to the
center line of Forest Park Avenue thence
easterly along the center line of Forest Park
Avenue If extended, and southerly to connect
with the existing outlet Sewer of the Village
of Larchmont as constructed to its terminus
in Long Island Sound. The above described
outlet sewer being in part already built by
the Village of Larchmont and in operation by
said Village, the balance to be constructed,
all of said outlet sewer to be used, as to
that part now constructed, and as to the bal-
ance to be constructed and operated, under a
certain agreement between the Village of
Larchmont and the Town of Mamaroneck for its
use as an outlet sewer by the Town of Mamaron-
eck upon the payment to said Village of Larch-
mont of a certain agreed sum and in-
terest thereon for the use of the exist
ing sewer and for the payment of a cer-
tain agreed proportionate share of the
expense of construction of that part to
be jointly constructed and used, and
II. The sewer in the aforesaid proposed
sewer system specifically shown and indi-
cated on the azoresaid map and plan in
Palmer Avenue and more specifically descri-
bed as follows:
BEGINNING at a point in the center of the
proposed new intersection of Weaver Street
and Palmer Avenue, running, thence westerly
through the center line of said Palmer
Avenue, 1450 feet to the easterly boundary
line of the Village of Larchmont.
And it is
FURTHER RESOLVED, that for all pu- oses. of
taxation and assessments this Resolution
and the Certificate herein authorized to be
filed shall take effect immediately, and
that all of said costs incurred in said
Sewer District No. 1 of the Town of
Mamaroneck for the purposes of constructing
and operating said sewer system shall be
levied and assessed in accordance with the
law provided therefor and shall be: and become
a lien on said property located within the
said District, as is provided by law; and be
it
FURTHER RESOLVED, that any and all acts of
this Board or its predecessors in office in-
consistent herewith be and the same are
rescinded and declared to be of no effect,
with the exception, however, that nothing
herein shall delay or defeat the collection
of taxes and assessments at present a lien.
Upon motion duly seconded, and upon roll call, it
was unanimously
VOTED, whereas, the Town Board has established
a Sewer District, to be known as "Sewer Dis-
trict No. 1 of tie Town of Mamaroneck", and
WHEREAS, under Section 231 of the Town Law
three tax payers therein must be appointed as
Sewer Commissioners to hold office at the
pleasure of this Board,
THEREFORE, BE IT RESOLVED, That Robert H.
Stevens, H. R. Mitchell and William I.
Palmer, taxpayers in said sewer district,
be and they hereby are appointed Sewer
Commissioners of "Sewer District No. 1 of
the down of Mamaroneck" to hold office
at the pleasure of the Town Board; and
BE IT FURTHER RESOLVED, that the said
Sewer Commissioners shall each be paid
for their services the sum of $3.00
per day for each day actually and nec-
essarily spent in the business of the
Sewer District, which said sum shall be
payable quarterly upon the presentation
of proper voucher therefor and shall be
deemed and made a part of the expense of
maintaining the said sewer system and
shall be collected and paid as provided
in Section 243 of the Town Law for ex-
pense of maintenance of said sewer system;
and
BE IT FURTHER RESOLVED, that each Com-
missioner shall, before entering upon the
duties of his office, take the constitutional
oath of office and file with the Town Clerk
an undertaking in the sum of $10,000.00 in
form satisfactory to the Town Counsel.
Upon motion duly seconded, and upon roll call,
it was unanimously
VOTED, that the Commissioners be notified of
their appointment and of the requirements and
qualifications of their office, and that
they be asked to immediately qualify therefor.
Upon motion, the meeting adjourned at 10:20 P.M.
