HomeMy WebLinkAbout1918_12_05 Town Board Minutes (2) Meeting of the Town Board of the Town of Mamaroneck held December 5th, 1918. The meeting was called to order by Supervisor Burton at 9:05 P.M. The Clerk reported the following present: Geo. W. Burton, Supervisor; Justices Boyd; Dudley and Shafer; J.C. Fairchild, Town Clerk and Ralph A. Gamble, Counsel. On motion the reading of the minutes previous meetings not yet approved was dispensed with. Dr. Carribean, President of the Woods of Larchmont Association, was present and presented a petition signed by nineteen taxpayers residing in the Woods of Larchmont, asking for the establishment of an Ash and Garbage District to conform to the lines of Fire, Lighting and Water Supply District No.1, and for the removal of ashes and garbage therefrom by the Town. Mr. Brewer appeared in behalf of the Larchmont Gardens Association on the same matter. On the motion of Justice Shafer seconded by Justice Dudley, it was RESOLVED that the petitions presented by Messrs. Marshall, Arnold and Dr. Carribean in relation to the establishment of an ash and garbage district and providing for the removal of ashes and garbage therefrom be received and placed on file. The petitioners present were heard in relation to the matter. Counsel informed the Board regarding certain steps to be taken, and after discussion it was, upon motion duly made, seconded and carried, RESOLVED that the reading of the minutes be re-considered, and that all minutes not yet approved be now read. The Minutes of the Meetings of September 24th, 1918, October 4th, 1918, October 8th, 1918 and November 21st, 1918 read and upon motion duly approved. A communication from Randolph Chrisinas of 129 Mendham Street. Brooklyn, N.Y. was referred to the Town Clerk for his attention. A communication from Weaver Street Fire Company was re- ferred to the Joint Town Board. The financial Statement of the Receiver of Taxes for the month of November 1918 was received, read, and upon motion duly ordered spread upon the minutes and placed on file. Counselor Gamble reported that he had concluded his investiga- tion in regard to the Hefner Tax matter and had drafted a resolution which covered the matter, and that the same had been approved by Mr . Howell who had stated that if the matter was handled in the manner provided for in the resolution, it would be very satisfactory. Counsel presented the resolution which was offered by Justice Boyd, seconded by Justice Dudley. WHEREAS, there appears upon the Tax Sales Book of the Receiver of Taxes a Tax Sale held on October 9th, 1883 for the Tax of 1882 affecting Lots 7-4-15 and 25 Map of Chatsworth, at which sale the Town of Mamaroneck became the purchaser, and said premises were thereafter in 1884 leased to the Town; and WHEREAS from entires in the Sales Books it appears that about 1887 the Town of Mamaroneck assigned the aforesaid Tax Leases to one Charles D. Sheppard and is credited with having paid the amount due as owner, but which fact cannot be checked in as much as the Cash Book for the year 1887 cannot be found; and WHEREAS the said Charles D. Sheppard thereafter recorded the leases for Lots 14-15 and 25, Map of Chatsworth, in the office of the Register of Westchester County, N.Y. in Liber 1161 of Deeds, but the lease of Lot 7 has nearer been recorded; and WHEREAS it further appears that Lot 7 was never assigned as is evidenced by the fact that the records of the Town Clerk shops no assignment, and the original lease is actually in the posession of the Town of Mamaroneck, a copy of which is in the Record of Leases of the Town Clerk; and WHEREAS from these facts it would therefore appear that the Sales Book is in error in showing the assignment of Lot 7 to Charles D. Sheppard, when in fact the lease is in the possession of the Town of Mamaroneck; THEREFORE BE IT RESOLVED that the Receiver of Taxes be and he hereby is authorized and empowered to correct the apparent error in the Sales Book of 1883, showing the assignment of Lot 7, Nap of Chatsworth to Charles D . Sheppard about the year 1887 in such a manner that said Sales Book will show and record the lease of Lot 7 Map of Chatsworth as still in the possession of the Town of Mamaroneck in accordance with the facts as they appear from the records of the Town of Mazaroneck; and BE IT FURTHER RESOLVED, that nothing herein contained shall in any manner release any unpaid taxes, interest, penalties or any other sum which may be due and unpaid, or which may come due on said Lot 7. A vote having been taken, the same was unanimously adopted . Upon motion the meeting adjourned at 10 P.M. Town Clerk. i I i I
