Special Meeting of the Joint Town Board,
Town of Mamaroneck, held June 25th, 1918 at 9:10 P. M.
Supervisor Burton called the meeting to order.
The Clerk reported the following present: George T. Burton,
Supervisor, Justices Collins, Boyd, Dudley and Shafer, John C . Fair-
child, Town Clerk, John Hickey, Commissioners of Highways , Ralph
A. Gamble, counsel .
On motion of Justice Shafer seconded by Justice Dudley, it
was unanimously
RESOLVED that the call of the meeting be approved .
Upon motion duly made, seconded and carried , it was
RESOLVED that the reading of he minutes of the previous
meetings not yet approved be dispensed with .
Counsellor Gamble addressed the Board on the subject of
the examination of the title to the streets in the Woods of Larchmont
and presented a resolution amending the resolution heretofore passed
in this matter, for the consideration of the Board.
Upon motion of Justice Dudley seconded by Justice Shafer ,
it was unanimously
RESOLVED:
Whereas on the 2nd day of May, 1918, the Joint Town Board
at a regular meeting adopted a resolution providing for the taking
over of certain streets in the Woods of Larchmont upon the carrying
out of certain terns and conditions therein contained and
Where as it is now desirable to amend the form of said
resolution
Therefore be it resolved that the aforesaid resolution
of May 2nd be and the same hereby is amended to read as follows:
Whereas a duly verified petition of taxpayers has been
presented to this Board requesting the Town Board to accept as Town
Highways the streets and roads in the Woods of Larchmont lying and
being within the Town of Mamaroneck as shown upon a certain map en-
titled "Map of the Woods of Larchmont, situated in the Town of
Mamaroneck and the City of Now Rochelle in the County of Westchester
and State of New York, surveyed for Clifford B. Harmon & Co. by Lane
& Harvey C. E. dated 1909 and filed March 11th , 1910 in the Regis-
trar 's office, Westchester County as May No. 1896 and
Whereas John H. Storer and Suburbs Holding Company in
filing said map made an offer of dedication of said streets and
roads there on shown to the Town of Mamaroneck which has never been
revoked and
Whereas a contract is about to by entered into between,
Suburbs Holding Company and Michael Decicco providing for work and
repairs to sidewalks and steps on said streets as have been designated
by the Superintendent of Highways and
Whereas the Suburbs have offered to deposit in the Larch-
mont National Bank the sum of Two thousand five hundred ($2500)
Dollars to be turned over to the Town of Mamaroneck upon the certifi-
cate of the Town Clerk that the streets shown on the aforesaid man
lying within the Town of Mamaroneck and hereafter named, have been
duly accepted as Town Highways by the said Towns which amount shall
be used by said Town in improving the aforesaid streets or such
portions thereof as the Superintendent of Highways and the Town
Board in their discretion may deem advisable.
THEREFORE, BE IT RESOLVED that upon the completion
of the work and repairs to certain sidewalks covered by the contract
above referred to, (copy of which contract is to be filed with
the Town Clerk) to the satisfaction of and upon the approval of
said work by said Superintendent of Highways and upon the deposit
in the Larchmont National Bank to the order of Town of Mamaroneck
of the sum of Twenty-five hundred ($2500.) Dollars to be paid in the
manner above set forth the Joint Town Board of the Town of Mamaroneck
will and it hereby binds itself to accept by proper resolution the
streets and roads in the Woods of Larchmont lying and being within
the Town of Mamaroneck as shown upon a certain map entitled "Map of
the Woods of Larchmont situated in the Town of Mamaroneck and the
City of New Rochelle in the County of Westchester and State of
New York, surveyed for Clifford B. Harmon & Company by Lane & Harvey
C. E . dated 1909 and filed March 11th, 1910 in the Register 's
office Westchester County Map No. 1.1896", by accepting the offer of
dedication of the aforesaid streets and roads made by John H. Storer
and the Suburbs Holding Company at the time of filing the aforesaid
map and
BE IT FURTHER RESOLVED, that the Town of Mamaroneck will
accept and take title to a certain right of way or strip of land ten
feet in width lying and being in Block 317 as shown on said map
running from the end of Spruce Road and connecting said Spruce Road
with Glen Road upon the receipt of a deed conveying the fee of said
strip of land to the Town of Mamaroneck, and
BE IT FURTHER RESOLVED, that nothing herein contained
shall be construed to indicate that the aforesaid streets or roads
or any of them shall be deemed to be accepted by the Town of
Mamaroneck until all of the aforesaid terms and conditions herein
provided have been complied with, and
BE IT FURTHER RESOLVED, that the Town of MAmaroneck, shall
be kept safe and harmless from any damage or claim of any nature
of character whatsoever in any wise arising from the improvement
of the said streets anything to the contrary herein contained not-
withstanding, and
BE IT FURTHER RESOLVED, that only insofar as the Resolu-
tion of May 2nd, 1918 is herein amended it is approved and ratified.
There being no further business , the meeting adjourned
upon motion at 9:25 P. M.
