HomeMy WebLinkAbout1918_06_03 Town Board Minutes Minutes of a Public meeting of the Citizens of the Town of Mamaroneck held at the Town Hall, Mamaroneck, New York, on June 3rd, 1918 at 8:30 P.M. The meeting was called to order by Supervisor Burton who presided on roll—call. The following members of the Joint Town Board were present: George W. Burton, Supervisor, W. A. Boyd, ) G. B. Dudley, ) Justices, E . P. Shafer, ) P. H. Collins, ) John C. Fairchild, Town Clerk, John Hickey, Superintendent of Highways, Ralph A. Gamble, Counsel. The Clerk read the call of the meeting as advertised, which upon motion duly made, seconded and carried, was duly approved: Richbell Press, May 30, 1918. PUBLIC NOTICE: To the Citizens of the Town of Mamaroneck, N. Y. Notice is hereby given that there will be a Public Meet- ing of the Citizens of the Town of Mamaroneck, on Monday Evening, June 3rd, 1918, at 8:30 o'clock, at the Town Hall, Mamaroneck, for the consideration of the application of the Westchester Street Rail- road Company for an INCREASED FARE on its railroad from five (5) cents to six (6) cents, for the period June 1st, 1918, to July 31st, 1918, on the around that said Company claims that its financial condition is serious, and that it is now impossible to meet operative expenses of the Road. The matter more particularly for consideration will be that portion of their lines running from Chatsworth Avenue, in the Village of Larchmont, to the a Mamaroneck-Harrison town line on the White Plains—Mamaroneck branch; for temporary relief pending an investigation now being made by the Public Service Commission, Second Department. Signed: Town Board, Town of Mamaroneck, George W. Burton, Supervisor, John C. Fairchild., Town Clerk, John Hickey, Superintendent of Highways, Dated May 28, 1918. The Clerk was instructed to note in the Minutes the presence of a number of the citizens of the Town who were interested in the matter to be considered. Mr. McKinley, Counsel, and Mr. Calhoun, Superintendent of the Westchester Street Railroad Company were present on behalf of the Railroad. The Supervisor spoke at length upon the question of the increase of fare asked by the Railroad Company, of the status of the proceedings before the Public Service Commission, Second District, and of the negotiations with the Railroad. He also stated that the Board desired to know the consensus of opinion of the citizens of the Town concerning the matter. Mr. McKinley and Mr. Calhoun spoke at length on behalf of the Railroad in favor of the increase. A number of citizens present were heard. After considerable discussion it was the consensus of opinion of the meeting that the application for an increase of fare should be granted. Upon motion duly made and seconded the following Resolution was adopted by a majority vote of the citizens present. RESOLVED that it is the sense of this public meeting that - the Joint Town Board approve the application of the Westchester Street Railroad Company for an increase of fare from five (5) to six (6) cents for the period from June 10th 1918 to July 31st,1918 and that a proper resolution to this effect be adopted by said Board. There being no further business, upon motion the Public Meeting adjourned. . The Joint Town Board was thereupon called to order by Supervisor Burton, in accordance with due notice, all members of the Board being present Pursuant to the resolution of the Public Meeting just held, recommending that the Joint Town .Board approve the application of the Westchester Street Railroad Company for an increase of fare to six (6) cents for the period June 10th to July 31st,. 1918. It was, upon motion duly made, seconded and carried, Resolved: WHEREAS, the Westchester Street Railroad Comppany has made application to the Town of Mamaroneck for an increased fare on its railroad on the ground that said company claims that its financial condition is serious and that it is impossible to meet operating expenses of the road; and WHEREAS, application has been made by the City of White Plains to the Public Service Commission, Second District, for an investigation as to whether or not it is necessary that such rate of fare be increased and as to whether or not the service furnished by the company can be improved, and if so, in what specific ways; and WHEREAS, the said railroad company claims that it will be impossible to operate its railroad, unless relief is granted during the pendency of said investigation; and WHEREAS, a Public Meeting of the citizens of the Town of Mamaroneck was duly called and advertised by the Town Board for the public consideration of the said application of the Westchester Street Railroad Company for an increased fare; and WHEREAS, the said Public greeting was duly held, as adver- tised, at the Torn Hall, Mamaroneck, N. Y., on June 3rd 1918, at which time a resolution was duly offered and adopted, that it was the sense of the meeting that the Town Board approve the aforesaid application for an increase of fare from five cents (5¢) to six cents (6¢) for the period from June 10th, 1918 to July 31, 1918 and that a proper resolution to this effect be adopted. THEREFORE, BE IT RESOLVED, that the franchises or consents heretofore granted by the Town of Mamaroneck to the Westchester Street Railroad Company, its predecessor of predecessore and accepted by said com- panies be and the same hereby are modified temporarily so as to permit the Westchester Street Railroad Corapany to charge a rate of fare of six cents (6¢) instead of the five cent (5¢) fare now in force under said franchises from the 10th day of June, 1918 to and including the 31st day of July, 1918, such increase to be entirely used for the benefit of the lines of The Westchester Street Rail. road Company and those lines only; AND BE IT FURTHER it RESOLVED, that this modification is granted upon the express conditions that it is temporary only w.d shall expire on the 31st, day of July, 1918, at v7hich ti-me the aforw said franchises and consents shall again be in fcrc�.,, subject to the same covenants and conditions as G,,her, granted and accepted; 4rID RE IT FMTHER R SQL-M, that this —modification is made :7ithout pre judi ce T,,-) any rig#its of the Torn of a'?amaronech in the preLises, and in no .gay shall b° considered an approval by the Tcrvn of Karnaronech of the proposed increase of fares as a desirable or suffici°nt method of obtaining the desired ac d.itional income.
