Th s Local Law shall amend Local Law No. 10-1993 Procedures and Standards
fo the Regulation of Rates for Basic Cable Service and Equipment.
Segltion 1. Pur ose:
They purpose of t:his 'local law is to amend Local Law No. 10--1993 in order to provide
for, the possibility of preemption of certain areas of regulation of rates by the
New l York State Cable Commission.
Secition 2. Amendments:
The local law shall be amended by adding the following provision:
0.2 To the extent the New York State Cable Commission establishes final
rules for rage regulation that must be followed by franchising authorities,
those rules will govern as if fully set forth herein. However, to the extent
the Irules of the New York State Cable Commission allow franchising authorities
to follow different or additional rules, the provisions set forth herein that
may be enforced consistent with the rules of the New York State Cable Commission
shall continue to apply.
Section 3. ' Severability:
Should any provision of this local law be declared invalid by a court of competent
jUrisdietion, such declaration of invalidity shall not effect any other section of
thi, local law which. may be otherwise capable of enforcement:.
SIecition 4. Effective Date:
Thi local law shall take effect immediately.
