This local law shall amend Local Law No. 8 of 1992 Surface Water,
Erosion and Sediment Control.
Section 1. Purpose:
The purpose of this local law is to amend Local Law No. 8 of 1992.
in order to provide for more efficient and administration of that
law. After several months it has been found that the law as
drafted places an unintended burden on small property owners with
small projects. This amendment will relieve some of the burdens
placed upon those property owners while still maintaining the
integrity of the law and protecting the environment.
Section 2 . Amendments:
. The following sections shall be amended to read as set forth
below:
Section 7 (E) Any addition to a structure of 100 square feet
or less or any structure of 100 square feet or less and/or any
deck.
Section 10 (D) Existing and proposed contours of the site and
adjacent land within approximately 250 (two hundred fifty) feet of
the boundaries , drawn at no greater than two-foot contour
intervals and critical spot elevations. This provision shall not
take effect until the Town has prepared base maps for the area for
which an application is submitted and which shall be made
available by the Town to applicants for preparation of the contour
maps required by this section. However, to the extent practicable
all other provisions of this law shall be enforced pending the
preparation of the base maps.
Section ll (A) A performance bond or cash bond shall be posted
with the Town by the applicant prior to the issuance of the
permit. The bond shall be in an amount sufficient to ensure
completion of the work covered by the permit and shall be fixed by
the Building fhspector in consultation with the Town Engineer. In
cases where a fresh water wetlands permit has been issued to the
same applicant and the bond fixed for the fresh water wetlands
permit is no less than one thousand ($1,000. 00) dollars, the
building inspector may allow a single bond for both permits if it
is determined that such bond is sufficient for the purposes of
this law and the Fresh Water wetlands Law. Any bond submitted
under this law shall be released one year after completion of work
covered by said permit, provided such work is found to be in
accordance with the provisions of the permit and such other
ordinances as may apply and is completed to the satisfaction of
the Town Engineer.
Section 12 (A) (1) Filing Fee: One hundred fifty ($150.00)
dollars for each existing one or two family dwelling and three
hundred fifty 1$350.00) dollars for all o' her residential and
commercial applications.
Section 3. Severability:
Should any provision of this local law be declared invalid by a
court of competent jurisdiction , such declaration of invalidity
shall not effect any other section of this local law which may be
otherwise capable of enforcement.
Section 4 . Effective Date:
This local law shall take effect immediately.
