This Local Law shall amend Local Law No. 9 - 1992" Solid Waste/Recycling".
Section 1. Purpose:
The purpose of this Local Law is to amend and clarify
provisions of Local Law No. 9 of 1992 entitled "Solid
Waste/Recycling".
Section 2.Amendments:
Local Law No. 9-1992 shall be amended to read as follows:
Section 14. Enforcement
The Commission may promulgate such regulations as it
deems necessary to effect the provisions of this Local Law.
Any regulations-promulgated by the Commission which will
directly impact the residents of the Town of Mamaroneck shall
be subject to the approval of the Mamaroneck Town Council.
All provisions of this Local Law shall be enforceable by the
Building Inspector and the Building Inspector's designated
deputies and/or assistants.
Section 19. Penalties
c. Any violation of this Local Law shall be punishable by a fine of
up to Two Hundred Fifty ($250.00) Dollars for each such violation
or by imprisonment by the third and each subsequent offense
within a one-year period, not to exceed fifteen (15) days, or both.
Each day during which a violation exists shall be considered a
separate and distinct violation punishable as a separate violation.
Section 3. Severability:
Should any provision of this Local Law be declared illegal or
unconstitutional by a court of competent jurisdiction,to the
extent that the other provisions of this Local Law can be
implemented without such illegal or unconstitutional provision,
such other provisions shall remain in effect.
Section 4. Effective Date:
This local law shall become effective immediately upon filing with
the Secretary of State.
