This Local Law shall be known as "Amendment to Local Law No. 10 of 1985 Tree
Preservation Law".
Section 1. Purpose:
The purpose of this amendment is to modify the make up of the Tree Preservation
Commission.
Section 2. Amendment:
Section 76A-3 shall be amended to read as follows:
A) The Town Board shall create a Tree Preservation Commission which
shall consist of the Environmental Coordinator, Building Inspector, Highway
Superintendent or his designee, and two members of the public with knowledge
and expertise in arboriculture. Each shall serve during his or her term of office in
the case of public officials who are members and each of the two volunteers shall
serve for one year terms.
B) In addition to its other duties as provided for in this Local Law, the Tree
Preservation Commission shall advise the Town Board in its selection, purchases,
placement, and planting of trees and shrubs on municipal property and shall
maintain an inventory and management plan for the continued maintenance and
improvement of municipal plantings.
Section 3. Severability:
Should any provision of this Local Law be declared illegal or unconstitutional by a
court of competent jurisdiction, to the extent that the other provisions of this Local
Law can be implemented without such illegal or unconstitutional provisions, such
other provisions shall remain in effect.
Section 4. Effective Date:
This Local Law shall take effect immediately.
