HomeMy WebLinkAbout1996_4_17_Local_Law_No_9 LOCAL LAW NO. 9- 1996 This Local Law is for the purpose of amending Chapter 54 of the Code of the Town of Mamaroneck originally adopted December 20, 1967. Section 1. Purpose: As a result of the limitations placed on available parking by other nearby communities and the limited available-parking within the Town,the purpose of the Local Law is to restrict the issuance of parking permits in Town owned parking Lots 1 and 3 to residents of the Town. This law further makes minor administrative changes in the provisions for placement and transfer of parking permits. Section 2. Resident Parking: Section 54-8 shall be amended by adding a new Section C which shall read as follows: C. The Town Clerk may only issue permits to residents of the Town for parking in Lots 1 and 3. At'the time of.application for a parking permit for either Lot 1 or Lot 3,the applicant shall submit proof of residency to the Town Clerk. Section 3. Attachment of Decal: Section 54-9 (A) and (B)are amended to read as follows: A. The Town Clerk, upon issuing a permit,shall also issue a decal,which can be affixed to the rear bumper,bearing the permit number assigned,the name of the Town, the lot number for which it is issued and the expiration date. B. The decal issued by the Town Clerk must be affixed to the left rear bumper of the automobile for which it is issued. Section 4. Transfer of Ownership: Section 54-11 is amended to read a follows: Upon the sale or other transfer of an automobile for which a permit has been issued,the permittee shall remove the decal,return it to the Town Clerk and upon proper application and payment of a fee to be fixed by Town Board resolution,have a replacement assigned for the unexpired term of the original permit. Under no circumstances shall the fee for the unexpired term be refunded. Section S. Severability: Should any provision of the Local Law be declared invalid or unconstitutional by any court of competent jurisdiction,such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. Section 6. Effective Date: This Local Law shall take effect immediately.
