HomeMy WebLinkAbout2005_6_1_Local_Law_No_10 Local Law No. 10 -2005 This local law shall be known as the "Addition of a Title to the List of Enforcement Officers and the Addition of Laws to Chapter 34 of the Code of the Town of Mamaroneck" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows: Section 1 — Purpose. On September 22, 2004, the Town Board added a chapter to the Code of Mamaroneck (Chapter 34) which gave certain Town officials the power to enforce the "Quality of Life Laws" identified in that chapter. Since then, the Town has enacted two new laws that fit within the definition of Quality of Life laws. This law adds these two new statutes to the list of laws which such enforcement officers may enforce. This law also adds Chapter 173 (Sewers) to the list of Quality of Life laws and adds "Fire Inspector" to the list of Town officials authorized to enforce Quality of Life laws. Chapter 173 and the position of fire inspector were omitted inadvertently when Chapter 34 was added to the Code of the Town of Mamaroneck. Section 2 -Amendment to an Existing Section of the Code of the Town of Mamaroneck Section 34-2 of the Code of the Town of Mamaroneck hereby is amended by deleting the definition of ENFORCEMENT OFFICERS in its entirety and substituting the following in its place: "ENFORCEMENT OFFICERS —The persons serving in any of the following positions in the Town of Mamaroneck: Assistant Building Inspector, Code Enforcement Officer, Director of Building Code Enforcement and Land Use Administration, Environmental Coordinator, Fire Inspector, police officer, Senior Engineer (Civil), Superintendent of Highways and Deputy Superintendent of Highways (if such a position is created)." Section 3—Amendment to an Existing Section of the Code of the Town of Mamaroneck Section 34-2 of the Code of the Town of Mamaroneck hereby is amended by deleting the definition of QUALITY OF LIFE LAWS in its entirety and substituting the following in its place: "QUALITY OF LIFE LAWS—The following chapters and sections of the Code constitute the quality of life laws: A. Chapters. (1) Chapter 58, Animals. (2) Chapter 77, Conservation Areas. (3) Chapter 95, Erosion and Sediment Control. (4) Chapter 117, Garage Sales. (5) Chapter 141, Noise. (6) Chapter 148, Parks and Fields. (7) Chapter 161, Property Maintenance. (8) Chapter 173, Sewers. 1 (9) Chapter 175, Signs. (10) Chapter 183, Solid Waste. (11) Chapter 207, Trees. (12) Chapter 231, Water. (13) Chapter 233, Waterfowl. B. Sections. (1) Section 106-49. Requirement for a Discharge Compliance Certificate. (2) Section 106-56. Duration and hours for mechanical rock removal. (3) Section 187-13. Prompt removal of snow and ice. (4) Section 219-1. Idling of Motor Vehicles." Section 4— Severability Should any court of competent jurisdiction declare any provision of this Local Law invalid or unconstitutional, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5— Effective Date This Local Law shall become effective on the date that it is filed in the office of the Secretary of State. 2005 LL No_(Amend. QL Law)approved 06-01-05 2
