This local law shall be known as the "2006 Amendment to the Business-Mixed Use
Business District" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 — Purpose:
This law amends the requirements of the Business-Mixed Use Business zoning district
and a related provision of the Code of the Town of Mamaroneck.
Section 2—Amendment to an existing section of the Code of the Town of Mamaroneck:
Section 240-25 E (1) (b) of the Code of the Town of Mamaroneck hereby is repealed in its
entirety and the following substituted in its place:
§240-25. Business-Mixed Use Business District: B-MUB
"(b) Maximum height shall be seven floors, excluding covered parking and
service area and lobby, up to a maximum height of 87 feet. The height shall be
calculated from the average street grade of the site at the curb of the front
yard."
Section 3—Amendment of an existing section of the Code of the Town of Mamaroneck:
The last sentence of section 240-56 A. of the Code of the Town of Mamaroneck is
repealed and the following substituted in its place:
"No structure having a height of more than 70 feet in an R-TA District, more than 87 feet
in a B-MUB District, or more than 50 feet in any other district shall be erected unless
approved by the Board of Appeals."
Section 4—Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any
court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall
not affect any other provisions of this Local Law, which may be implemented without the
invalid or unconstitutional provisions.
Section 5— Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.
