BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the Work Session was unanimously opened at S:OOPM. 1. Budget Worksession Fire Department Additionally present: Fire Chief Brendan Collins and Deputy Fire Chief Noah Goldberg Chief Brendan Collins distributed the TMFD Budget Review Report and Sixteen Year Projected Capital Budget Report for discussion. Town Clerk's Office The Town Clerk distributed the Town Clerk's Budget Report for discussion and a description of the functions and duties of the Town Clerk's Office. 2. Allocation of Space/Costs—Larchmont Library The Town Board reviewed a memo prepared by Mr. Altieri dated November 15, 2012 including the attachment of the Village of Larchmont, Village Center/Larchmont Public Library Square Footage for Allocation Purposes Report. Due to renovations of the Library and Village Center, as well as the fact that the Village is now occupying different areas of the Library and Village Center, the Village of Larchmont requested a review of the space allocation to determine the exact square footage used by the Library and the Village Center. The Town Board would like Ron Carpaneto to do a control test of the information provided to the Town by the Village of Larchmont; the Town Board will review this matter again once Mr.Carpaneto has determined if this allocation is correct. 1 November 19,2012 3. Discussion of Health Insurance Benefits The Town Board discussed changing the retirement health care benefits for Elected Officials. It is being suggested that newly elected officials pay for health insurance upon retirement. The Town Board discussed 'grandfathering' currently Elected Officials. The Town Board reviewed a draft resolution from Mr. Maker outlining the proposed change. Supervisor Seligson asked the Board Members to consider at what level a contribution should be made. The Supervisor would like to resolve this matter before the end of the year. 4. Review of Proposed Revisions to Town Safety Policy The Town Board reviewed a memo from Mary Stanton dated November 14, 2012, outlining the Amended Policy. 5. Update—Proposed Zoning Amendment B/SB Zones The Town Board discussed whether to reschedule the Public Hearing set for December191" regarding the Draft Generic Environmental Impact Statement,to January. The Town Board would like the public to have more time to review the documents and understand what the Town is hoping to accomplish with this Amendment.This item was added to this evening's Regular Agenda. 6. Review of Schedule—January 2013 Board Meetings The Town Board discussed rescheduling the January Town Board Meetings'. This item was added to this evening's Regular Agenda. 7. Boards&Commissions The Town Board reviewed the roster for the Town's Boards and Commissions and discussed the new appointments and re-appointments needed to be made at the Organizational Meeting in January. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:15 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson stated that the Town is still recovering from Sandy. All residents now have power, but there is still substantial cleanup to take place. Westchester County met with the Local Municipalities to discuss the County's response to the Storm.Overall the Municipalities were happy with the County's response,adding that suggestions on how things could have been handled differently were well received. Supervisor Seligson noted that the upcoming meeting with Con Edison will not be so cordial. The Federal Emergency Management Agency is now set up at the County Center. Supervisor Seligson stated that the Town is continuing its Budget discussions, noting that this is a very difficult budget to craft in these difficult times. 2 November 19,2012 CITIZEN'S COMMENTS Steve Bartell,a 12 year resident of Washington Square,addressed the Town Board. In his capacity as president of the Rotary Club, he described the outreach taking place by the Rotary Club in response to Hurricane Sandy. PUBLIC HEARING (S) — Conforming Provisions of Chapter 195 of the Town Code to the Town's new Taxable Status of May 1" Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York,and pursuant to a resolution of the Mamaroneck Town Board adopted on November 8,2012, a Public Hearing will be held on Wednesday, November 19,2012 at 8:00 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider"Conforming provisions of Chapter 195 of the Town Code to the Town's new taxable status of May 1" Law. Purpose: By Local Law No.3-2012,the Town Board exercised the right given to it by Section 283.141 of the Laws of Westchester County,as amended by Westchester County's Local Law No.3 of 2008,to change the Town's taxable status date from June 1 of each calendar year to May 1 of each calendar year. The Town Board did so by adding a new Article IX to Chapter 195 of the Code of the Town of Mamaroneck. In doing so,the Town Board inadvertently neglected to amend other sections of Chapter 195 where the Town Code recites"June 1" as the Town's taxable status date. This Local Law is designed to make the sections of Chapter 195 lying outside Article IX recite that the Town's taxable status date is May 1. The full text of this Law may be examined and copies obtained at the Town Clerk's office during regular hours, Monday-Friday,8:30 AM to 4:30 PM, In June,July and August until 4:00 PM at 740 W. On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the Public Hearing was unanimously closed. 3 November 19,2012 On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following Local Law was approved: Local Law No. 7-2012 This local Law shall be known as the"Conforming provisions of Chapter 195 of the Town Code to the Town's new taxable status of May 1" Law. Section 3—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction,such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law,which may be implemented without the invalid or unconstitutional provisions. Section 4—Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Other Fire Department Business Commissioner Wittner noted the excellent job Chief Collins did this evening presenting and discussing his Budget during this evening's Work Session. Supervisor Seligson thought it would be appropriate to note on the Fire Claims the large items that were related to Hurricane Sandy. There being no further business to come before the Commission,on motion of Commissioner Odierna, seconded by Commissioner Wittner,the Commission unanimously adjourned and the Town Board reconvened. 5 November 19,2012 AFFAIRS OF THE TOWN 1. Preliminary Financial Report—Hurricane Sandy Mr.Altieri read from the following memo: Memorandum To:Supervisor and Town Board Re:Preliminary Financial Report-Hurricane Sandy Date:November 16,2012 It has been approximately three weeks since the Town initiated its response to Hurricane Sandy. The following is an update on current conditions and activities as well as a preliminary financial report on the costs for our response to the storm. With several minor exceptions all power has been restored to residents, businesses and public facilities in the Town. The state of emergency was rescinded on November 15 however the Town Highway Department and Sanitation Commission continue to collect storm related debris and garbage. In addition the Town has also resumed, this week, the collection of fall leaves. We have had an opening meeting with FEMA to discuss our current conditions and to become familiar with the process of seeking reimbursement of expenses for storm response. In terms of communication with the community during and after the storm, the Town, through its mass communication system issued 76,033 phone calls and e-mails. There were also regular postings to our website with updates on Hurricane Sandy. Not unexpectedly it has been an expensive three weeks for the Town. 1 am pleased to report however that our financial position has allowed us to absorb these expenses in anticipation of reimbursement from FEMA which could take as long as one year. Events such as Hurricane Sandy, is one of the reasons 1 am a proponent of having surplus funds on hand. Below is a preliminary listing of the expenses that have been accounted for to date: ➢ Overtime $125,409.13 ➢ Debris Handling to date' 67,600.00 ➢ Tree Removal by Outside Contractors 10,875.00 ➢ Fuel-Outside Contractors 1,167.00 ➢ Fuel-In house 5,594.6 gallons 10/29-11/15-12 18,154.43 ➢ Miscellaneous 5,000.00 Total $228,205.13 There will be additional costs for debris collection and disposal however those costs are unknown at this time. The staff will in the next couple of weeks hold a storm de-briefing meeting to review our response to the storm and consider any changes that may be necessary. 1 will report to the Town Board on the results of the de-briefing. Report of Bids- TA 12-14- Furnishing Home Delivered Meals 3. Report of Bids- TA 12-15—Furnishing& Delivering Congregate Meals On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS,the Town publicly opened and read one bid for Contracts TA-12-14- Delivered Meal Service,and TA-12-15-Congregate Meal Service. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contracts TA-12-14 to the lowest responsible bidder, Horizon Foods,of New Rochelle,as follows: Cold Meal Hot Meal 2013 $5.92 $7.98 2014 $5.92 $7.98 2015 $5.92 $7.98 and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby award Contracts TA-12-14 to the lowest responsible bidder, Horizon Foods,of New Rochelle,as follows: 2013 $4.63 per meal 2014 $4.81 per meal 2015 $4.99 per meal and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreements on behalf of the Town. Report of Bids—Storm Restoration Services TA-12-16A thru TA 12-16F Mr.Altieri explained that in the aftermath of Hurricane Sandy,the Federal Emergency Management Agency(FEMA)will be permitting local governments to authorize emergency work to a contractor without a competitive RFP of bid process as part of their municipalities restoration process. Preemptively the Town is awarding bids for various storm related services should the need arise. Set Public Hearing—Property Tax Cap Legislation Supervisor Seligson explained that in order to continue with the level of services currently provided by the Town and to accept the recommendations from the Town's Departments,the increase to the 2013 Budget would be 6.3%. Although the Town did not go over the Tax Levy Cap last year,it did pass this 9 November 19,2012 legislation authorizing the Town Board to do so if necessary. Supervisor Seligson stated that although the 2013 Budget is not complete,the Town Board would like to have this legislation in place,should the Town decide to utilize this option and override the Tax Cap Levy. On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the"Override the tax levy limit established in General Municipal Law 3-c" law for December 5, 2012 at 8:OOPM in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. Adoption of Revised Safety Policy On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was RESOLVED,that the Mamaroneck Town Board does hereby adopt the Revised Safety Policy for the Town of Mamaroneck as prepared and outlined in the memo to the Town Board dated November 14,2012 from Mary Stanton,Safety Coordinator. Capital Project 2012-12 Water System Improvements On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS,on October 3,2013 the Town Board approved a Public Interest Order and Bond Resolution authorizing borrowing for the Town's share of rehabilitation and improvements to water storage tanks and a water distribution line running from Shaft 22 to the Larchmont Plant. NOW THEREFORE, BE IT 10 November 19,2012 RESOLVED,that the Mamaroneck Town Board does hereby authorize the Town Comptroller to establish the following Capital Project for Water System Improvements in the amount of$325,000.00 as outlined by the Town Comptroller as follows: CAPITAL PROJECTS FUND(FUND H): ESTABLISH BUDGET: EXP H.8340.0400.2012.12 CAPITAL WATER IMPROVEMENT PROJECTS $325,000.00 REV H.0000.5730.2012.12 BOND ANTICIPATION NOTES $325,000.00 (CAPITAL PROJECT#2012-12) Town's share of rehabilitation&improvements to water storage tanks&a water distribution line running from Shaft 22 to the Larchmont Plant. To be funded by 6 month Bond Anticipation Notes,dated 11128112&maturing on 5123113& ultimately converted to Serial Bonds. Per Town Board adopted bond resolution dated October 3,2012. 8. Salary Authorization—Recreation On motion of Councilwoman Elkind Eney,seconded by Councilwoman Wittner,it was RESOLVED,that as provided for in the 2012 Town Budget the Mamaroneck Town Board does hereby authorize the payment of salary to the following: Hommocks Park Ice Rink—Retroactive October 19, 2012—June 9,2013 Scott Hagan Skate Guard $9/hr Joseph Carducci Skate Guard $9.75/hr Hommocks Pool—Effective November 13, 2012—December 31, 2012 Taylor Del Villar Lifeguard $10.75/hour The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye 9. Set January 2013 Town Board Meeting Dates On motion Councilman Odierna,seconded by Councilwoman Elkind Eney,it was unanimously 11 November 19,2012 RESOLVED,that the Mamaroneck Town Board does hereby set the January 2013 Town Board Meeting for January 91"and January 23rd 10. Re-set Public Hearing for the DGEIS—Proposed Zoning Amendment On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,the following was unanimously approved WHEREAS,The Town Board would like the public to have more time to review the documents and understand what the Town is hoping to accomplish with this Zoning Amendment. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby re-set the date for a Public Hearing on the Draft Generic Environmental Impact Statement(DGEIS) regarding the Proposed Zoning Amendment to January 9,2012 at 8:OOPM in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 11. Field 602 Fairway Green Block: 928 Lot: 1.39 Town of Mamaroneck/Village of Mamaroneck Year Assessment Amount of Reduction Reduced Assessment 2010 $17,904 $4,704 $13,200 The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye APPROVAL OF MINUTES -October 3,2012 Deferred WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilwoman Elkind Eney noted the various Veterans' Day events she attended.Councilwoman Elkind Eney(and Councilwoman Katz)attended the Friends of the Library Presentation of the 401" Anniversary of Free to Be You and Me.Councilwoman Elkind Eney attended the Larchmont Chamber of Commerce Meeting,at which they continue to discuss the parking problem in the commercial area. Councilwoman Katz did not attend any'official' meetings,as none have met since her last report. Councilwoman Katz reported that she was involved with the Food Pantry's very successful food drive, adding that they expect to distribute Thanksgiving meal ingredients to over 600 families. Councilman Odierna also attended the many Veterans'Ceremonies. Councilman Odierna reported that he has concluded his course work at Pace University regarding Affordable Housing in Westchester County,attending that they concluded with a tour of Affordable Housing in our communities. Councilman Odierna attended the Housing Authority Meeting at which they discuss some Capital Projects for the future.Councilman Odierna attended the Cable TV Advisory Board Meeting at which they discussed on-line streaming of Town Board Meetings,as well as their search for alternative space for their operation.
