BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Katz,seconded by Councilwoman Wittner,the Work Session was unanimously opened at S:OOPM. Town of Mamaroneck Survey Additionally present: Betty DiMaria of ARAS Consulting Ms. DiMaria read from her report of the Summary Results,dated October 2,2012.The Board and Ms. DiMaria discussed this evening's Public Presentation of the Survey results. On motion of Councilwoman Wittner,seconded by Councilman Odierna,the Town Board closed the Public Meeting to receive advice of Counsel. The Town Board resumed their discussion of the Survey results. The Board asked that the Power Point for this evening be available on the Town web site tomorrow,as well as sending the Survey results to the various Chairs of the Boards and Commissions who were part of early brain storming sessions. The Town Board noted that the Survey should be on the agenda for the next Town Village School(TVS) Meeting. The Board discussed how best to get the information gathered through the Survey out to the public,as well as how to dispel some important public misinformation. Supervisor Seligson asked the Town Board Members to bring to the next meeting three items from the Survey that they feel are the most important to address in the short term. Supervisor Seligson noted a few additional items she felt the Town Board should be apprised of. Update Hazard Mitigation Grant Mr.Altieri explained that this grant was applied for a year ago and that the Town has just received notification that$100,000.00 has been funded to the Town. Mike Liverzani has prepared an RFP to the consulting firms that the Town will need to help prepare a Hazard Mitigation Plan. It was noted that it will take about six months to prepare a Plan,adding there was a previous plan that the Town prepared that will help in developing a new plan. Mr.Altieri stated that any municipalities that do not have a plan in place by 2014 will not be eligible for Federal Grants(?),although it will not preclude the Town from receiving emergency funding. 1 October 3, 2012 ADDED ITEM Update-Pipe Repair at the Reservoir Mr.Altieri gave an update to the Board. Complete Streets Grants The application for several Complete Streets Projects was discussed. Mr.Altieri reported that Westchester County has said no to the 'stamped'crosswalk at Central School.The Town has been trying to get a letter of support for the project from the PTA, but due to the changes in the school's dismissal procedure, parents are having difficulty supporting another change. However,Central School Principal Carol Priore wrote a letter of support. . The Town held a meeting with residents of Garit Lane and will soon meet with the residents of Elkan Road. Supervisor Seligson noted that although not all parties agree on how to make the intersection safer,all agree on its need for improvements and the Town will continue to move forward with the Grant Application. ADDED ITEM Supervisor Seligson noted that the Sustainability Collaborative Committee met last night. The Committee is comprised of individuals with various expertises in environmental arenas. Moving forward the Members will focus on different projects to accomplish as much as possible. Because of its immediacy and importance,the first area of concentration will be the Hommocks Ice Rink. The Town Board continued with a discussion of the Ice Rink Chiller System and the ongoing question of whether to install an industrial chiller or a commercial one. Members of the Sustainability Collaborative Committee, Recreation Committee and Recreation Department personnel met. The group determined that savings in energy costs each year with the industrial chiller will pay for the additional debt service this unit will incur each year. Mr.Altieri stated that by the end of this week the Town Board will receive a full report comparing the two systems,with a final discussion and Board approval at the October 17`"Town Board Meeting. Mr.Altieri emphasized the importance of moving toward a decision,so as to minimize disruption to the facility. Murray Avenue Flooding Mr.Altieri explained that last Friday the Town was operating under a flash flood warning. Flooding occurred throughout the Town,even in areas which have not flooded in recent storms over the past ten years.Over the course of about an hour there were significant water levels rising and subsiding. During this event,a number of homes near the Murray Avenue,Colonial Avenue and Bryson Street flooded. Residents have sent letters to the Town requesting that the Town complete the storm drain line between Colonial and Homer. This storm drain was originally envisioned as part of the County project to improve Murray Avenue, but was not added to the project by the County due to the higher costs of the Murray Avenue improvements and the Town's difficulty in obtaining the easements required, hence the County closed out the project. Mr.Altieri clarified that the Colonial to Homer Storm Pipe was never part of the County's original project. Mr.Altieri stated that if the Board would like he and the Town Engineer can put together a cost estimate,adding previously the estimate was approximately$175,000.00. Councilwoman Wittner stated that this should be part of a greater conversation about new neighborhood associations paying for these types of infrastructure changes,as well as their continuous maintenance,specifically in new construction.Today,even when a few houses are built,developers look to have the Town take over roads and detention basins. Hampshire Golf Club Supervisor Seligson reported that discussions are taking place regarding development of housing at Hampshire Golf Club.The development would require a zoning change. Egress to the property could be a concern for the Town.The Hampshire Property has serious wetland and flooding issues which may concern the Town,especially for the precedent a Zoning Amendment would set for other critical wetlands. 2 October 3, 2012 On motion of Supervisor Seligson seconded by Councilwoman Wittner,the Town Board unanimously agreed to enter into an Executive Session to discuss the qualifications of a particular person being considered for employment in the Administrative Offices. EXECUTIVE SESSION Discuss the qualifications of a particular person being considered for employment in the Town Administrative Offices. On motion of Supervisor Seligson,seconded by Councilwoman Wittner the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson noted that the Town continues to work on the Resident Survey,adding the Town will receive a presentation this evening from the Town's Consultant Betty DiMaria. The Town is also working on the renovations and upgrades to the Hommocks Ice Rink.Supervisor Seligson reminded residents of the importance in signing up for Town emails and robo call updates through the Town's web site. Mr. Rohamn asked the Board to consider providing an expert to walk residents around the Pond to better understand the plantings'. CITIZEN'S COMMENTS Brian Rohman Larchmont Gardens'Civic Association addressed the Town Board. Mr. Rohman noted the well attended brunch that was hosted in honor of the completion of the Duck Pond renovations. The Annual Halloween Parade will take place at 4:00 on October 20`". Finally, Mr. Rohman asked that Sanitation personnel be reminded to place garbage and recycling bins back properly on the homeowners' property. PUBLIC HEARING — Section 8 Housing Administrative Plan The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 3, 2012 at 8:00 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to approve the Section 8 Housing Administrative Plan. Purpose: The Town under the regulations governing the Section 8 Housing Voucher Program is required to hold a public hearing each year on the Section 8 Housing Administrative Plan. The Section 8 Housing Administrative Plan may be examined and copies obtained at the Town Clerk's Office during regular office hours, Monday—Friday,8:30 AM to 4:30 PM and during the months of June, July and August Monday — Friday, 8:30 AM to 4:00 PM. The Town Clerk's Office is located at 740 W. Anna Danoy, Director of Community Services and Housing presented the PHA Annual Plan. Ms. Danoy noted that there were no significant changes in this plan from the previous one. Supervisor Seligson asked if anyone wished to comment on the submitted PHA Plan. On motion of Councilwoman Wittner,seconded by Councilman Odierna,the Public Hearing was unanimously closed. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby accept the Public Housing Agency Administrative Plan for the Fiscal Year beginning January 1,2013. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye PUBLIC HEARING—Water District No. 1 Bond NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Town Board of the Town of Mamaroneck, Westchester County, New York, will meet at the Town Hall, 740 West Boston Post Road, in Mamaroneck, New York, on October 3, 2012, at 8:00 o'clock P.M., Prevailing Time, for the purpose of conducting a public hearing upon a certain map, plan and report, including an estimate of cost, in relation to the proposed increase and improvement of the facilities of Town of Mamaroneck Water District No. 1, in said Town, being the Town's share of the cost of compliance and safety improvements to water storage tanks and the rehabilitation and improvement of a water distribution line, consisting of the installation of a 30" transmission line running from Shaft 22 to the Larchmont Plant, each facilities of the Westchester Joint Water Works, including original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $325,000. Said capital project has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State 4 October 3, 2012 Environmental Quality Review Act ("SEQRA"), the implementation of which as proposed, said regulations provide will not result in any significant environmental effects. On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following was approved: In the Matter of PUBLIC The Increase and Improvement of the Facilities of INTEREST Town of Mamaroneck Water District No. 1, in the ORDER Town of Mamaroneck, Westchester County, New York WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has reviewed materials developed by the Westchester Joint Water Works which caused to be prepared a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the Town of Mamaroneck Water District No. 1, in the Town of Mamaroneck, Westchester County, New York, being the Town's share of the cost of compliance and safety improvements to water storage tanks and the rehabilitation and improvement of a water distribution line, consisting of the installation of a 30" transmission line running from Shaft 22 to the Larchmont Plant, each facilities of the Westchester Joint Water Works, including original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith,at a maximum estimated cost of$325,000; and WHEREAS, at a meeting of said Town Board duly called and held on September 19, 2012, an Order was adopted by it and entered in the minutes specifying the said Town Board would meet to consider said increase and improvement of Water District No. 1, and to hear all persons interested in the subject thereof concerning the same at the Town Hall, in Mamaroneck, New York, in said Town, on October 3,2012 at 8:00 o'clock P.M., Prevailing Time; and WHEREAS, said Order duly certified by the Town Clerk was duly published and posted as required by law; and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard;NOW,THEREFORE,BE IT ORDERED, by the Town Board of the Town of Mamaroneck,Westchester County, New York,as follows: Section 1. A RESOLUTION AUTHORIZING THE ISSUANCE OF $325,0000 BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE INCREASE AND IMPROVEMENT OF WATER DISTRICT NO. 1, IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, said regulations provide will not result in any significant environmental effects; and WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an Order dated the date hereof, said Town Board has determined it to be in the public interest relating to the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York (the "Water District"), being the Town's share of the cost of compliance and safety improvements to water storage tanks and the rehabilitation and improvement of a water distribution line,consisting of the installation of a 30"transmission line running from Shaft 22 to the Larchmont Plant, each facilities of the Westchester Joint Water Works, including original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith,at a maximum estimated cost of$325,000; and NOW,THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck,Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York, being the Town's share of the cost of compliance and safety improvements to water storage tanks and the rehabilitation and improvement of a water distribution line, consisting of the installation of a 30" transmission line running from Shaft 22 to the Larchmont Plant, each facilities of the Westchester Joint Water Works, including original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $325,000, there are hereby authorized to be issued $325,000 bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the plan for the financing of said specific object or purpose is by the issuance of the $325,0000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. 6 October 3, 2012 Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. To the extent not paid from monies raised from said Water District No. 1 as applicable in the manner provided by law, there shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale,and award the bonds in such manner as she shall deem best for the interests of said Town; provided, however, that in the exercise of these delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates,within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money,or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with,and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication,or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. This resolution, which takes effect immediately, shall be published in summary form in the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. PUBLIC PRESENTATION—Town of Mamaroneck Survey Betty DiMaria of ARAS Consulting,the Town's Consulting Firm for the Town Survey, presented a power point of the Survey Results,contents of the Presentation are as follows: Purpose Process and Methods Response Rate and Demographics Executive Summary and Observations Cumulative results Results by Area of Residence Supervisor Seligson stated that the Town Board will continue to discuss these Survey results at future Town Board Meetings. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson then on motion of Commissioner Katz, seconded by Commissioner Elkin-Eney,the Board of Fire Commissioners was unanimously declared open. Present were the following Members of the Commission: Commissioner: Nancy Seligson Commissioner: Phyllis Wittner Commissioner: Ernest C. Odierna Commissioner: Abby Katz Commissioner: Jaine Elkind Eney 2. Other Fire Department Business Commissioner Wittner reported that Fire Council met and of note was the Budget Meeting they had with Mr.Altieri and Mr.Siligato. All hydrants within the Town have been mapped. On a sad note Commissioner Wittner reported the passing of former New Rochelle Chief Walter Bell who was a good friend of our Department. The Department's Open House will be Saturday October 13`" Commissioner Wittner read the Fire Report for the Month of September as submitted by Chief Collins as follows: September 2012 ALARM TYPE NUMBER Generals 36 Minors 21 Stills 10 Out of Town (Mutual Aid) 2 EMS 45 Drills 7 TOTAL 121 Total number of personnel responding: 969 Total time working 55 hours and 56 minutes 8 October 3, 2012 There being no further business to come before the Commission,on motion of Commissioner Wittner, seconded by Commissioner Odierna,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Designation Lead Agency—Zoning Amendment Supervisor Seligson explained that the Town Board has been discussing amendments to the B and SB Zones for residential zoning and has engaged the services of Frank Fish to help the Town write these amendments. Frank Fish gave a presentation to the public on the details of these Amendments'. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the following was approved RESOLUTION Whereas, the Town Board has decided to explore a rezoning which would allow the development of fair and affordable housing in the zoning districts currently designated in the Town of Mamaroneck's zoning ordinance as"B","SB"and a portion of"UR"("Proposed Action"),and Whereas, the Town Board has determined that the Proposed Action is a Type I action as that term is defined in the State Environmental Quality Review Act("SEQR"),and Whereas, the Town Board has had BJF Planning prepare a Draft Generic Environmental Impact Statement dated October 3, 2012 ("DGEIS") for the purpose of studying the potential environmental impacts of the Proposed Action,and Whereas, the Town Board has determined that because the Proposed Action would be an amendment to the Town's zoning ordinance and only the Town Board has the authority to enact a law amending the Town's zoning ordinance, it should be the Lead Agency (as that term is defined in SEQR) for the SEQR review of the Proposed Action. On the motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,it is RESOLVED, that the Town Board designates itself as the Lead Agency for the SEQR review of the Proposed Action,and BE IT FURTHER RESOLVED, that the DGEIS is accepted as adequate with respect to its scope and content for the purpose of commencing public review only,and BE IT FURTHER RESOLVED, that the Town's Environmental Officer is directed to send notice of the Town Board's decision to act as Lead Agency for the SEQR review of the Proposed Action, together with copies of this resolution and the DGEIS to the agencies which the Town Board has identified in section 2.4 of the DGEIS as either an interested or an involved agency and advise those agencies in that notice that unless one or more of them notify the Town Board within 30 days from the date that notice is sent that it or they wish to act as Lead Agency for the SEQR review of the Proposed Action, the Town Board will confirm the designation of itself as the Lead Agency for the SEQR review of the Proposed Action. 9 October 3, 2012 The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye 2. Authorization—Extension of Snow&Ice Agreement—New York State Department of Transportation On motion of Councilwoman Katz,seconded by Councilwoman Wittner,the following was approved WHEREAS,the Town of Mamaroneck conducts snow and ice control on both the Boston Post Road and Weaver Street which are roadways owned by the State of New York,and WHEREAS,in consideration of the Town's snow and ice control activity,the State reimburses the Town,and NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve extending the Agreement for the 2013/2014 Snow &Ice Season, with the New York State Department of Transportation for snow and ice control activity for the 9.2 miles of State road at a rate of $1,507.00 per mile,for a yearly total of$13,864.40. WRITTEN COMMUNICATIONS None 12 October 3, 2012 REPORT OF COUNCIL Councilman Odierna attended the Sustainability Collaborative Meeting last evening. Councilman Odierna was unable to attend the Zoning Board Meeting,as it is being held this evening. Councilman Odierna noted that he and the Board Members attended the Larchmont Gardens'Civic Association Brunch,adding it was very lovely. Councilwoman Wittner noted that she also attended the Sustainability Collaborative Meeting and the Larchmont Gardens'Civic Association Brunch. Councilwoman Wittner attended the Coastal Zone Management Commission Meeting last week,and as for the Fire Council Meeting,Councilwoman Wittner previously reported on that earlier in the Meeting. Councilwoman Katz noted that the Board and Commissions she attends as a liaison have not met. Councilwoman Katz attended the PBA and Fire Department Touch Football Charity Event. The event raised funds for Wounded Warriors,adding there were a lot of donations from the Community.Councilwoman Katz noted other Community events that took place in the Town. Councilwoman Elkind Eney attended the Junior Triathlon; an event that raises funds for our schools. Councilwoman Elkind Eney also attended the Friends of the Library Author Reading and the Ragamuffin Parade. Councilwoman Elkind Eney reminded residents of Fire Prevention Week,adding everyone should take stock of their smoke detectors and practice family fire drills. The Town Clerk reminded residents that the Westchester County Board of Elections will hold Voter Registration on October 10`"from 5:00 to 9:00pm and November 13`"from 9:00-12:00pm in the first floor Lobby of the Town Center. Supervisor Seligson added that she attended the Martin Luther King,Jr. Event Planning Meeting and also a CAP Meeting,of which she is now a Board Member. Supervisor Seligson noted the very fun Larchmont Shares Event. Supervisor Seligson attended the Larchmont Environmental Committee Meeting and the Garden Club Event.Supervisor Seligson is happy to report that 43 plastic bags were removed from the Conservation Area during Coastal Clean Up Day.
