HomeMy WebLinkAbout2012_07_09 Town Board Minutes July 9,2012 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON JULY 9, 2012, BEGINNING AT S:OOPM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the Work Session was unanimously opened at S:OOPM. Strategic Planning Present via conference call: Betty DiMaria of ARAS Consulting The Town Board reviewed a Draft Town Survey prepared by Ms. DiMaria. Supervisor Seligson stated that she would like the Board to address the questions in the Survey regarding shared services, the time frame and schedule for the survey, as well as comments on the Survey as a whole. The Town Board reviewed the survey in its entirety making changes and commenting on each Survey question. The Board discussed ways to notify the public and encourage as many residents to complete the Survey. The Survey is to go 'live' on July 13 and will remain open until September 3rd. Ms. DiMaria will monitor the Survey on SurveyMonkey®and update the Town weekly. Westchester Joint Water Works The Town Board reviewed documentation prepared by the Westchester Joint Water Works in support of a water rate increase.The documents included charts of the history of the rate increases and projected water use scenarios.The Board discussed whether it was appropriate and warranted to add a percentage to the proposed increase, possibly bringing the total increase to 15%. The Board discussed the fact that the Westchester Joint Water Works cannot maintain a surplus and that any surplus would go back to the Town's Water District Fund. Mr.Altieri stated that there would never be enough surplus to fund the UVA Plant,adding that would have to be bonded. There are, however, capital projects and costs that surplus could fund. Councilwoman Katz asked for an update on the customer residing at Springdale Road who was having pressure issues.Supervisor Seligson responded that the WJWW has arranged for improved pressure with united Water in that area, but it appears the issue could be within the home and currently is not a pressure issue within the neighborhood.Supervisor Seligson reported that most of the past due accounts have been cleared up at the Water Works. Tony Canetta, Director of the Westchester Joint Water Works will address the public this evening. 1 July 9,2012 Supervisor Seligson suggested the Board ask Mr. Canetta about projected capital projects. Supervisor Seligson also noted that most of theWJWW water tanks need extensive repair, with the bulk of repairs in the Harrison water tanks. The Water Works will need to address how the costs for these repairs will be shared among the municipalities'. Urban County Consortium Participation The Board discussed the Town's participation in the Urban County Consortium. The Town opted out of joining the Consortium last year due to language in the agreement that the Town felt was unacceptable. The Town is feeling pressure to rejoin the Consortium and would like to revisit the language of the agreement. County Legislator Judy Meyers has reminded the Town that funding throughout the County is dependent upon participation in the Consortium. The Board would like to revisit this before September. Update—EPA—Fenbrook Mr. Altieri informed the Board that the East Branch of the Sheldrake River in the Fenbrook Sub Division is the source of the contamination noted in the Environmental Protection Agency's Administrative Order. The Contractor hired to investigate the source is currently working along this branch of the Sheldrake to finalize the findings. The investigation must be completed by the end of 2012. On motion of Supervisor Seligson,seconded by Councilwoman Elkind Eney,the Board unanimously agreed to enter into an Executive Session to discuss a matter that might imperil public safety if disclosed. EXECUTIVE SESSION A matter which will imperil the public safety if disclosed On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson stated that the Town Board is working with Betty DiMaria of ARAS Consulting on a Strategic Plan for the Town. Currently the Board is preparing a Survey that will be available for the public by July 13`". Supervisor Seligson stated that the Town Board is very excited to receive feedback. 2 July 9,2012 Supervisor Seligson stated that the Memorial Park Concerts are underway,adding a thank you to Bob and the Showman Band for filling in after a last minute cancellation at the last concert. The Muppet Movie will be shown on Friday July 271H Supervisor Seligson continued stating that this evening during Work Session,the Town Board discussed Strategic Planning,the Westchester Joint Water Works,the Urban Consortium and the EPA Order. CITIZEN'S COMMENTS None BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson,and then on motion of Commissioner Wittner,seconded by Commissioner Elkind Eney,the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Authorization—Water Rate Increase Mr.Canetta, Director of the Westchester Joint Water Works addressed the audience. Mr. Canetta explained the organizational structure of the Water Works,and explained the current rate breakdown for participating municipalities.Of note was a change in the implementation of the rate increases to coincide with the setting of the water rates for water purchased from New York City. Historically, by not coinciding with the rate increases for New York City, the Water Works would always be playing 4 July 9,2012 'catch up',thus creating a very unstable cash flow. Mr.Canetta continued stating that through projections of usage for the coming year the Water Works is recommending a rate increase of 12%. Mr.Canetta noted a number of Capital Projects,the UVA Plant,Water Tank repairs,and building structure improvements,adding that these projects will need to be bonded.Asked whether there are any specific Town projects, Mr.Canetta replied no, most are tri municipal projects. The Town Board noted that the rate increase was discussed during this evening's Work Session and that the Town Board proposes an increase of 15%. On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was RESOLVED,that the Mamaroneck Town Board does hereby approve a Water Rate Increase of 15%for the Town of Mamaroneck,effective July 1,2012. Discussion-Boston Post Road Zoning Analysis Frank Fish of BFJ Planning presented to the Town Board a draft of Proposed B-R and SB-R Zoning. Mr. Fish presented models including proposed text and map amendments.This presentation follows previous discussions the Town Board has had with Mr. Fish regarding follow-up on the Boston Post Road Zoning Study prepared by BFJ Planning in 2004. The Board is considering amendments to the Town's existing B Business and SB Service Business Districts to create opportunities for residential uses,and to comply with the Affordable Housing Settlement. Mr. Fish noted that these proposed changes would be consistent with Zoning on Boston Post Road in the two Villages,and would add consistency to the three municipalities. Mr. Fish also noted that within these amendments are incentives to encourage developers to build affordable housing. The Board discussed the next steps; specifically,they would be to incorporate the changes discussed this evening as well as to prepare a generic draft environmental impact study. 3. Authorization—Acceptance of Donation Sidewalk Improvement The Town Board has been in discussions with Ralph Engel regarding the Morris S.and Florence H. Bender Foundation. The Foundation would like to donate,in the form of a grant,$10,000.00 to the Town to rebuild a portion of the sidewalk on the north side of Chatsworth Avenue between the Village of Larchmont border and the corner of Myrtle Boulevard.The grant will provide full funding to install a more slip resistant sidewalk. 5 July 9,2012 On motion of Councilwoman Katz,seconded by Councilman Odierna,it was RESOLVED,that the Mamaroneck Town Board does hereby accept the donation from the Morris S.and Florence H. Bender Foundation in the amount of$10,000.00 to be used for the installation of a new non slip sidewalk surface on the north side of Chatsworth Avenue between the Village of Larchmont border and the corner of Myrtle Boulevard,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to provide a letter of acceptance to the Foundation. Amendment—2013 Budget Calendar On motion of Councilwoman Elkind Eney,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve amending the previously approved Budget Calendar by changing the Tuesday November 6,2012-Capital Budget Review to Monday November 5,2012.The time of 4:30pm to 7:OOpm will remain the same. 6 July 9,2012 6. Approval of Certiorari On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was RESOLVED,that the Town Board hereby authorizes the settlement of the following tax certiorari on the following terms: Palmer Pleasant Realty, LLC 250 Mt. Transfer of Funds—Strategic Planning process On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the Budget Transfer and the Increase in Budget to cover the Consulting Services Fee for ARAS Consulting as prepared by the Town Comptroller as follows: Attachment B APPROVAL OF MINUTES On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve the Board Minutes from the Meeting of June 20,2012. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Odierna attended the Zoning Board Meeting on June 27`",adding at which they approved a record number of applications. Councilman Odierna stated that there are still a number of applications that were adjourned. Councilman Odierna attended the Mamaroneck Chamber of Commerce Meeting, noting there upcoming Sidewalk Sales. Additionally,the Chamber discussed the need for additional parking and the proposal for a parking deck behind Mamaroneck Avenue. Councilman Odierna reported that the annual Fourth of July Fireworks had a record number of attendees. Councilwoman Wittner reported her attendance at the Fire Council Meeting,and then read the Fire Report for the Month of June. 10 July 9,2012 * For consistency the Fire Report appears above under Fire Commission Business. Councilwoman Wittner attended the Long Island Sound Watershed Intermunicipal Council Meeting, noting the County's new Stormwater Law that will require the 13 participating Municipalities to do new studies. These studies will need to include maps,capital projects plans,costs analyses,etc. Additionally,a Hazard Mitigation Plan must be in place for any continued County Funding. These items will be of future and further discussion among the Town Board,with a draft resolution forthcoming. Supervisor Seligson noted the meeting of the newly formed Ad-Hoc Environmental Group. Supervisor Seligson attended the Meeting of the Westchester County Supervisors,adding it is always helpful and informative to meet with one's peers. Of note is the continued discussion among the Supervisors'of dwindling surplus funds. Members of the Complete Streets committee visited sites in the Town to review possible changes and enhancements to the areas around Hommocks School and Central School in the hope of making these areas more pedestrian and bicycle friendly. This group will meet again next week. Supervisor Seligson reminded residents of the upcoming Memorial Park Concerts. Councilwoman Katz noted how much she enjoyed marching in the Village of Mamaroneck Firemen's Parade.Councilwoman Katz attended the Traffic Committee Meeting, noting that they have been addressing some resident concerns regarding parking. Councilwoman Elkind Eney also noted the enjoyable Parade,adding she attended the pre parade celebration in Flint Park. Councilwoman Elkind Eney attended the 'blessing'of the Coast Guard Flotilla,followed by a BBQ. The Town Board welcomed Mr.Altieri back from vacation. Mr. Maker acknowledged the passing of Louis Martirano's Father,condolences goes out to his family. The Town Clerk acknowledged the passing of John Caridi and read the following Proclamation: WHEREAS,for 25 years,John Caridi served as an Election Machine Technician for the Town of Mamaroneck,and WHEREAS,during his tenure over 3,100 machines were serviced, maintained and prepared for Elections,and WHEREAS, because of John, Elections in the Town of Mamaroneck were some of the best run in the County of Westchester,and WHEREAS,while other municipalities scrambled on Election Day to fix machines,the Town of Mamaroneck reveled in John's fine workmanship,and WHEREAS, his hard work and dedication made the Town of Mamaroneck the envy of its neighboring municipalities,and WHEREAS, his loyalty and professionalism was surpassed by none, his ability to begin his day at 5:00 AM and end at 11:00 PM at the age of 90 was nothing short of outstanding,and WHEREAS,when John showed up for work with treats in hand,a fine day was had by all,and 11 July 9,2012 NOW THEREFORE, BE IT RESOLVED,that I Nancy Seligson,Supervisor of the Town of Mamaroneck,and the Town Board Members declare the first Tuesday of every November,John Caridi Day in the Town of Mamaroneck.
