HomeMy WebLinkAbout2012_04_18 Town Board Minutes April 18,2012 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON APRIL 18,2012, BEGINNING AT S:OOPM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN,740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Supervisor Seligson,seconded by Councilwoman Katz,the Work Session was unanimously opened at S:OOPM. Meeting with Town Police Department Additionally Present: Chief Richard Rivera, Exec Lieutenant Robert Koziak, Lieutenant Paul Creazzo, Sergeant Matthew Mehlrose Chief Rivera distributed an Organizational Chart and Standard Operating Procedures for the Police Department's Divisions. The Board asked Chief Rivera to walk them through a typical month in the Police Department. Sergeant Mehlrose displayed the various Policing Zones within the Town. With the Town Map displayed for the discussion,the Board noted how disparate the Town lines are and the difficulty in policing certain areas based on this geography. Chief Rivera noted that there is mutual aid between the Town and Villages,which is very helpful. On motion of Supervisor Seligson,seconded by Councilwoman Elkind Eney,the Town Board unanimously agreed to enter into Executive Session to discuss the investigations regarding the robberies during the last six months. EXECUTIVE SESSION Police Investigation-Robberies On motion of Councilman Odierna,seconded by Councilwoman Wittner,the Board unanimously agreed to reconvene the Work Session. The Town Board emphasized to the Police that they feel strongly about enforcing the Town's Quality of Life Laws.The Board added that if there are laws the Police feel the Board should consider amending,to please bring them to the Town Board's attention. Supervisor Seligson thanked the Police for all their help and cooperation with the upcoming No Idling Day. The Board thanked the entire Department for all they do to keep our community safe. 1 April 18,2012 Boston Post Road Corridor Zoning Review Additionally Present: Frank Fish and Sarah Yackel of BFJ Planning. Supervisor Seligson reminded the Town Board of the previous work Mr. Fish and his firm had done with respect to the Boston Post Road Corridor. Supervisor Seligson noted that the Town is committed to finding venues for fair and affordable housing within the Town. Mr. Fish began with an overview of what he has been asked to do,outlining the Zoning Amendments being proposed. Mr. Fish noted that many of these proposed changes are consistent with the zoning changes the Village of Mamaroneck recently did,adding this would be a nice consistency within the tri-municipal community. Mr. Fish distributed the County's Model Ordinance Provisions, noting the Model Ordinance stipulates that ten percent of new construction be affordable. Mr. Fish feels this is reasonable and doable. Mr. Maker suggested the Town do an inventory of existing lots to determine which ones could accept these new proposed zoning standards. Mr. Fish noted that adding one story of residential is not profitable for new construction and that the Town may need to review the Floor Area Ratio standards.The Town discussed adding the Washington Square Area to the zoning amendments.This area was not included in the previous study by Mr. Fish, but would be important to add to the new study. Mr. Fish noted the importance of letting the business and construction community know of the proposed changes. Supervisor Seligson noted that the Town will let the County know as well.A continued discussion,as well as the additional analysis of the Washington Square Area will be added to a future Work Session. First Quarter 2012 Financial Report Additionally present: Tony Siligato The Town Board reviewed a memo and report prepared by Mr.Altieri and Mr.Siligato regarding the 2012 First Quarter Financials.Those highlights are as follows: Highlights of the First Quarter Financial Performance Generally the first quarter of the year reveals no trends in financial performance. Many of the Town revenues have yet to be earned and expenses other than salaries will not exhibit a specific trend except where there have been payments affixed costs at the beginning of the year for certain service contracts and agreements. On the revenue side, the Town's total receipts were$1,791,911 or 5.73%of total expected revenues. While this number appears low it must be pointed out that property tax collections which make up 65%of our revenues do not begin until April 1. Therefore, they are not reflected in this report. Aside from property taxes there are several other large sources of revenue that are not received in the first quarter. Also our state aid allocations are not received until later in the year. So understandably the revenues are skewed on the low side. On the expense side the Town has expended$7,135,057 or 22%of the budgeted appropriations. Last year at this time the Town had expended$7,475,712. The first quarter expenses for 2012 are lower in large part due to the mild winter. At this time last year, we had expended over$200,000 for overtime expenses related to snow removal. Also there is a$40,000 expense saving for liability insurance. In the part Town Fund, we have expended almost one third of the appropriation for Police Department overtime. That is in large part a result of the additional activities of the department in connection with the rash of burglaries and the robbery on Valley Place. Councilman Odierna asked Mr.Siligato where the Town stood with regards to billing from the School District and the Town's repeated requests for a detailed breakdown. Mr.Siligato reported that the Town has received much of the information requested and has been working very productively with Sue Caruso, the new treasurer for the School District. 2 April 18,2012 2013 Budget Review Process The Town Board continued their discussion of the use of focus groups. Mr.Altieri reported that he has been speaking with the company that gave the proposal,in the hopes of working out a more reasonable price.Supervisor Seligson stated that this process is very professional,adding it is a lot more detailed than one might realize.The proposal set forth would be to hold four focus groups consisting of 12 participants. They would be held at a neutral location and would last two hours. The cost estimate to date is between $25,000 and $35,000. The Board would like to invite the company that provided the proposal to meet with the Board at the May 2nd Town Board Meeting. Dog Shelter Agreement Supervisor Seligson noted that due to the time,the Board should pass on the discussion of the Dog Shelter, noting the memo was self explanatory. Discussion-Health Insurance Due to the time,Supervisor Seligson asked the Board to consider scheduling a special meeting to continue the discussion of health insurance. Mr.Altieri will review possible dates and times with Supervisor Seligson. Update-Property Reassessment Project No discussion Update-Hazard Mitigation Plan Deferred CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson reminded residents that the Work Session which began at S:OOPM is open to the public, adding this is where the Town Board holds very lively discussions and residents are encouraged to attend. Supervisor Seligson noted that during Work Sessions,the Town Board has been meeting with the various Town Departments,as well as the Town's Boards and Commissions. These meetings have been very informative and productive. Supervisor Seligson stated that the Town continues to work on fair and affordable housing. As many residents know,Westchester County is working under a consent order from the Federal Government to add affordable housing in Westchester County,and the Town is working diligently on its part in this process. This coming Saturday and Sunday is Earth Day Weekend.A cleanup event will take place Sunday from 10:00 to 12:00 at the Hommocks Conservation Area.On April 23,the Town will hold a No Idling Day. The Town, Police and School District have been working together on this event.Supervisor Seligson asked Councilwoman Wittner to read the Proclamation for Arbor Day. PROCLAMATION ARBOR DAY TREE CITY U.S.A.AWARD WHEREAS, Friday,April 27,2012 is recognized by the Town of Mamaroneck as Arbor Day,a special day set aside for the 3 April 18,2012 celebration and planting of trees. WHEREAS, This year marks the 215`year the Town of Mamaroneck has been recognized as a "Tree City U.S.A." by the National Arbor Day Foundation. The Tree City U.S.A. Award indicates that the Town of Mamaroneck takes its tree-care responsibilities seriously with an effective community forestry program; and WHEREAS, Trees make a world of difference in our communities. Trees have long been recognized for the beauty and value they lend to homes, neighborhoods, parks and business areas. At the same time,those trees conserve energy, help clean the air, protect rivers and streams, and provide a home for wildlife in our towns and cities. NOW,THEREFORE, BE IT RESOLVED that I, Nancy Seligson,Supervisor,and the members of the Town Council of the Town of Mamaroneck urge all citizens to participate in programs and activities designed to furthering the establishment of trees in our community. Other Fire Department Business Commissioner Odierna noted he had an opportunity recently to speak with a number of firefighters. In that discussion it was noted that buildings constructed with certain trusses have a shorter period during a fire at which the roof will collapse. Commissioner Odierna would like the Fire Department to be aware of which buildings within the Town this problem would apply to. There being no further business to come before the Commission,on motion of Commissioner Katz, seconded by Commissioner Elkind-Eney,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization-Audit of Deferred Compensation Plan Mr.Altieri explained that the Government Accounting Standards Board has recommended an audit of the Town's Deferred Compensation Plan for Employees of Town of Mamaroneck for the years 2011,2012 and 2013. Therefore,it is the recommendation to contract with the Town's Auditor's,O'Connor Davies to perform this audit. On motion of Councilwoman Wittner,seconded by Councilwoman Katz,it is RESOLVED,that the Mamaroneck Town Board does hereby approve a contract with O'Connor Davies,to perform an audit of the Town's Deferred Compensation Plan for Employees of Town of Mamaroneck at a cost of $7,500.00 for the December 31,2011 audit,$7,500.00 for the December 31, 2012 audit,and $7,500.00 for the December 31, 2013 audit. 5 April 18,2012 The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye 2. Report of Bids-Contract TA-12-06 Backhoe Loader On March 14,2012 the Town publicly opened and read two bids for Contract#TA-12-06,entered into the record as follows: Mr.Altieri explained that the lowest bidder, Hoffman Equipment Company,submitted a bid in which there were over thirty exceptions taken to the Town's bid specifications. The second bid from H O Penn Machinery did meet the Town's specifications, but exceeded the available budget for this equipment. Therefore,it is the recommendation that the Town Board reject both bids. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby reject the bids for Contract#TA-12-06 Backhoe Loader. Authorization-Animal Control Contract On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the renewal of the Animal Control Contract between the Town and Ace Trapping of Port Chester, New York for the period of April 1,2012 through March 31,2013 at a cost of$7,500.00 and the period from April 1,2013 through March 31, 2014 at a cost of$7,500.00. Set Public Hearing-Overnight Parking Preston Street On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,it was unanimously RESOLVED,that on the recommendation of the Traffic Committee the Mamaroneck Town Board does hereby set the date for a Public Hearing to allow parking between 3:OOam and 6:OOam on Preston Street for May 16,2012 at 8:OOPM in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 5. Set Public Hearing-Establish No Parking Zone-West Side of Palmer Avenue On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,it was unanimously RESOLVED,that on the recommendation of the Traffic Committee the Mamaroneck Town Board does hereby set the date for a Public Hearing to establish a No Parking Regulation on the West Side of Palmer Avenue for May 16,2012 at 8:OOPM in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 6. Report of Bids—Contract#TA-12-01-A Replacement of Pool Tile On motion of Councilwoman Wittner,seconded by Councilman Odierna,the following was approved, WHEREAS,on March 29,2012,the Town publicly opened and read two bids for Contract#TA-12-01 Replacement of Pool Tiles,and WHEREAS,on April 4,2012 the Town rejected these bids as being unreasonable,and WHEREAS,the Town edited and streamlined the document and offered it out as a Request for Proposal(RFP)to twenty pool contractors. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board hereby award Contract TA-12- 01-A Replacement of Pool Tile and Plaster Surfacing at Hommocks Recreational Facility to AAA Liner and Cover Experts Corp.,at a cost of$20,250.00 for the tile replacement,and $16,000.00 to re-plaster the Training Pool. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye APPROVAL OF MINUTES—April 4,2012 On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve the Board Minutes from the Meeting of April 4,2012. 8 April 18,2012 WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Odierna attended a Meeting of the Mamaroneck Public Library at which they demonstrated the eBooks System. The recent Westchester Municipal Officials Association Dinner was held on April 12,at which they discussed bicycle friendly communities.The Zoning Board will meet next week. Councilwoman Wittner noted two upcoming events. The Town is very proud to announce that Supervisor Seligson is receiving an Environmental Protection Agency Award for her work on the Long Island Sound Study,Citizen's Advisory Committee. This is a Federal Award which is quite something! Supervisor Seligson will travel to Boston on April 25 to receive this ward.That same evening,the Mamaroneck Artists Guild will hold its Second Annual Original Post Card Exhibit and Sale. This year they will be honoring George Latimer. Councilwoman Katz noted that the Planning Board Meeting was cancelled. Councilwoman Katz attended the Summit Meeting at which there was a discussion of the Tappan Zee Bridge Project. Councilwoman Katz reminded residents that the Summit Meetings are open to the public,adding that they meet the third Tuesday of the month at 7:45 am at the Nautilus Diner. Councilman Odierna reminded Councilwoman Katz,that in the absence of a representative from the Larchmont Gardens'Civic Association,she should announce the upcoming event. Councilwoman Katz stated that the Larchmont Gardens'Civic Association will be hosting a neighborhood coffee this coming Saturday from 9:OOam-10:OOam at the Fernwood Road Bridge. Councilwoman Elkind Eney attended the Summit Meeting, noting the great information she received regarding rapid and mass transportation.Councilwoman Elkind Eney attended the Library Meeting and noted the following events and updates.The Friends of the Library will be holding an event at which Pete Fornatale a well known DJ,will be discussing his new album. For National Turn-off Your TV Week,a Story- Walk event will take place throughout the business district. The Library Facade Project is reported to be on target,adding that while repairs are being done the book return bins will be placed on the front lawn.The Library has launched its Facebook page,adding that residents should sign up for email notifications. Councilwoman Elkind Eney attended the Board of Architectural Review Meeting at which they approved the new Porsche Dealership where the old Mercedes Benz was located.The Planning Board also sent the architect for the Walgreens store back to the drawing board. The Mamaroneck Chamber of Commerce will again host the Wine Trails event along Mamaroneck Avenue.Councilwoman Elkind Eney attended the Larchmont Chamber of Commerce Meeting,at which there was a lively discussion about keeping the Village clean and noting the addition of recycling bins to be placed around the Village. Supervisor Seligson noted that Sarah Meister from Mamaroneck High School will be the Town's intern this summer. Supervisor Seligson was invited by the League of Women Voters to attend a meeting,along with many other female elected officials,to be a part of their newly formed program for high schools seniors interested in running for elected office. The League of Women Voters will also be hosting their Annual Luncheon on May 5.
